Short answer: Pharmaceutical exporters and clinical research providers can preserve eligible GST input tax credit (ITC) because exports and qualifying supplies to Special Economic Zone (SEZ) units or developers are zero-rated. That status does not make every business expense creditable or guarantee a cash refund. Eligibility depends on the CGST Act’s conditions, blocked-credit rules, business-use apportionment, the export or SEZ evidence, and the refund route selected for the relevant tax period.

For a clinical research provider, the decisive question is usually whether each cross-border engagement satisfies the statutory export-of-services test and whether the provider supplies the main service on its own account rather than merely arranging somebody else’s supply. Pharmaceutical-sector research also requires a check of the specific place-of-supply notification issued under section 13(13) of the IGST Act.

Start with the ITC rules that apply to every business

ITC is a set-off for eligible GST charged on inward supplies used in making taxable or zero-rated outward supplies. It is not a blanket recovery of all GST shown on company invoices. A registered person must satisfy the statutory conditions, hold the required tax documents, receive the goods or services as required by law, and follow return and payment-related conditions applicable to the period.

Business use is necessary but not sufficient

An expense can be connected with the business and still fail an ITC test. Credit must be restricted where an inward supply is used partly for non-business purposes or partly for exempt supplies. The eligible portion is determined under the apportionment rules; the personal, non-business or exempt-use portion cannot be treated as export-related credit merely because the company also has export turnover.

Check blocked credits before attributing anything to exports

Section 17(5) of the CGST Act blocks specified categories of credit, subject to the exceptions written into the provision. The fact that a cost appears in a clinical-trial budget, manufacturing facility or export invoice does not override a blocked-credit rule. Tax teams should test each invoice against the current statutory list rather than relying on an internal label such as “R&D,” “overhead” or “export expense.”

Keep an auditable attribution method

Maintain a ledger that identifies the supplier invoice, GST amount, cost centre, project or product, and whether the item supports taxable, zero-rated, exempt or non-business activity. Shared costs need a documented allocation method and periodic reversals or adjustments where the rules require them. This evidence becomes important when a refund claim includes Net ITC.

Why an export is zero-rated—and why that is not an automatic refund

Section 16 of the IGST Act treats exports of goods or services, and qualifying supplies to an SEZ unit or developer, as zero-rated supplies. Zero-rating generally preserves eligible ITC, subject to the restrictions in section 17(5) and other applicable provisions. It is different from an exempt supply: the supplier can use eligible credit, and the law provides routes to recover tax or unutilised credit.

The two statutory routes

Route How the supply is made What is claimed Operational issue
Export without payment of IGST Supply under a valid bond or Letter of Undertaking (LUT), following the conditions and forms applicable to the tax period. Refund of eligible unutilised ITC attributable to zero-rated supplies. Requires export evidence, credit attribution and the prescribed refund calculation.
Export with payment of IGST Charge and pay integrated tax on the zero-rated export, subject to the rules and conditions in force. Refund of the IGST paid on the export. Invoice, shipping or service-export data and return reporting must match; eligibility can be affected by overlapping benefits or transaction-specific restrictions.

The choice is not a permanent business classification. Confirm the permitted route, LUT or bond status, reporting requirements and any restrictions for the transaction and tax period. A zero-rated invoice by itself does not prove that a cash refund is payable.

Checklist for pharmaceutical goods exporters

A manufacturer or merchant exporter should separate three questions: is the outward supply an export, is the inward credit legally eligible, and is the chosen refund route supported by evidence?

1. Confirm the export event

  • Match the GST invoice to the shipping bill or other prescribed export document, customs data and the goods actually leaving India.
  • Check the recipient, destination, export date and invoice value against the returns and refund period.
  • For SEZ supplies, retain the endorsed evidence required for supplies to the relevant unit or developer rather than treating an ordinary domestic delivery as zero-rated.

2. Remove ineligible or non-attributable ITC

  • Exclude blocked credits under section 17(5).
  • Apply the exempt and non-business apportionment rules to common inputs and services.
  • Reconcile purchase registers, GSTR-3B credit, supplier data and the credit ledger before calculating a claim.

3. Review export-duty and overlapping-benefit restrictions

CBIC FAQ material cautions that an unutilised-ITC refund is conditional. Export duty and overlapping drawback or IGST-refund treatment can affect eligibility for a particular goods export. Do not claim the same tax benefit through incompatible routes. Review the current Act, rules and notifications for the product, shipping arrangement and period before filing.

4. Preserve a product-level trail

Keep bills of entry or domestic purchase invoices, batch or production records where relevant, freight and testing invoices, shipping documents, bank-realisation or payment evidence, and the working that links each credit category to exported turnover. A defensible trail is more useful than a broad assertion that all factory or headquarters costs supported exports.

When a clinical research service is an export of services

A foreign customer does not automatically turn an Indian clinical research engagement into an export. The provider must test the statutory conditions for the specific supply. The contract, statement of work, deliverables, recipient establishment and payment trail should tell the same story.

Export-of-services condition What to verify in practice
Supplier is in India The contracting and performing entity claiming the export is the registered Indian supplier.
Recipient is outside India Identify the legal recipient, not merely a foreign project contact or payment intermediary. Record its establishment and tax identity where available.
Place of supply is outside India Apply the relevant IGST place-of-supply rule, including any special rule for the service. A foreign address on an invoice is not enough.
Payment is received in permitted foreign exchange Retain bank and remittance evidence. Indian-rupee settlement is relevant only where permitted under the applicable Reserve Bank of India framework.
Supplier and recipient are not merely establishments of the same person Check fixed establishments, branches and distinct-person treatment. A group-company label does not resolve this test.

Map the actual clinical deliverables

Describe precisely whether the Indian team performs protocol design, site management, monitoring, data management, biostatistics, medical writing, pharmacovigilance or another deliverable. Identify who bears performance responsibility, who owns the output and who can direct the work. This mapping helps determine place of supply and whether the provider is supplying a main service or arranging another supplier’s service.

Investigate the pharmaceutical R&D place-of-supply notification

CBIC’s notification index identifies Notification No. 04/2019-Integrated Tax, dated 30 September 2019, as notifying place of supply for pharmaceutical-sector research and development services under section 13(13) of the IGST Act. The index entry alone does not establish the precise services covered, exclusions, conditions or whether later amendments change the result. Obtain the operative notification and amendments for the relevant period before applying a general place-of-supply rule to a pharmaceutical R&D contract.

Own-account research service versus intermediary activity

Classification can change the place-of-supply result and therefore the export analysis. Circular No. 159/15/2021-GST (CBIC, dated 20 September 2021) explains that a person supplying the main service on its own account is not an intermediary merely because that person could be called an agent or broker in another commercial context. The circular also states that subcontracting a main service is not intermediary activity when the subcontractor actually provides the main service rather than arranging or facilitating it.

Indicators of an own-account supply

  • The Indian provider promises a defined clinical or research output under its own contract.
  • It uses its personnel, systems and quality controls to perform the work.
  • It is responsible to the customer for performance, corrections and agreed deliverables.
  • Its fee is for the service supplied, not merely a separately identified arranging commission.

Indicators that require an intermediary analysis

  • The provider brings two other parties together but does not supply either underlying service itself.
  • The contract limits the provider to arranging, facilitating or negotiating another supplier’s service.
  • The provider’s remuneration is a commission or facilitation fee and the underlying service is supplied by someone else.

Apply the facts to the circular and the statute. The special place-of-supply rule for intermediary services is relevant only where either the intermediary supplier or the recipient is outside India, as explained in the circular. Labels such as “CRO,” “agent” or “consultant” cannot replace an examination of the contract and actual conduct.

Outsourcing work to a foreign subcontractor

If an Indian exporter outsources part of its work to a supplier outside India, Circular No. 78/52/2018-GST (CBIC, dated 31 December 2018) describes two supplies. First, the Indian exporter supplies the full contracted service to the overseas recipient. Second, the Indian exporter receives an import of services from the foreign subcontractor for the outsourced portion.

Review both legs separately: the Indian exporter’s invoice and export conditions, the foreign supplier’s invoice, place of supply, reverse-charge or other import-tax treatment, valuation, payment records and the way the subcontracted cost is reflected in the refund calculation. A foreign subcontractor’s involvement does not by itself destroy export status, but it does create a second tax analysis and additional documentation.

How to file an unutilised-ITC refund

Refund applications are filed electronically in FORM GST RFD-01 through the GST Common Portal. The form, supporting statements, declarations and documentary evidence must follow the refund rules and the instructions applicable to the claim period.

  1. Close the period’s books and returns. Reconcile outward zero-rated turnover, tax paid, purchase credits, reversals and the electronic credit ledger.
  2. Choose the correct refund category. Select the category for zero-rated supplies made without payment of tax under LUT or bond, or the category applicable to the tax-paid route.
  3. Compile export or SEZ evidence. Attach the prescribed invoices, shipping or service-export records, SEZ endorsements, payment evidence and statements required for the transaction type.
  4. Calculate the claim under the rule. For LUT or bond exports, the rules use a formula based on zero-rated turnover, Net ITC and adjusted total turnover for the relevant period.
  5. Upload declarations and submit RFD-01. Ensure the authorised signatory, bank account and return data are consistent with the registration.
  6. Respond to a deficiency memo or query. Preserve the original working papers and answer requests with invoice-level reconciliations rather than changing the claim without an audit trail.

The general formula

The prescribed formula for zero-rated supplies made without payment of tax is expressed generally as:

Refund amount = (Turnover of zero-rated supply of goods and services × Net ITC) ÷ Adjusted total turnover

“Net ITC” and “adjusted total turnover” have rule-specific meanings. Use the definitions and exclusions in force for the relevant period; do not substitute the entire purchase-register GST or total company revenue. The formula produces a ceiling subject to the eligible-credit rules, documentary proof, prior refunds, reversals and other statutory restrictions. It is not a promise that the calculated figure will be sanctioned.

“Every cost in the export project is refundable ITC.”

Fix: Remove blocked credits and apportion shared inputs for exempt or non-business use before calculating Net ITC.

“A CRO label proves the place of supply.”

Fix: Read the deliverables and responsibility clauses, then check the pharmaceutical R&D notification and current amendments.

“A subcontractor is always an intermediary.”

Fix: Determine whether the subcontractor performs the main service on its own account or only arranges another supplier’s service.

“The portal calculation guarantees payment.”

Fix: Treat the RFD-01 figure as a claim subject to verification, prescribed evidence, statutory caps and departmental review.

Bottom line

For both pharmaceutical exporters and clinical research providers, GST ITC turns on disciplined classification and records. Establish the zero-rated character of the outward supply, prove that each credit is eligible and properly attributed, select the correct LUT/bond or IGST-paid route, and file the prescribed refund application with transaction-level evidence. Clinical research providers should give special attention to place of supply, the 30 September 2019 pharmaceutical R&D notification, intermediary analysis and any foreign subcontracting. The operative law and portal instructions for the relevant tax period should be checked before filing or relying on a refund position.
