GST data analytics helps Indian tax authorities find possible unregistered businesses by connecting transaction reports, registration records and risk indicators, then directing selected cases to officers for verification. An analytics flag is only a lead: it does not prove that a business must register, that turnover is taxable, or that tax evasion occurred.

Public GST guidance and rules describe parts of this funnel—data reporting, validation, risk-based selection, information requests and assessment—but they do not publish one complete detection algorithm. The available material does not disclose the model’s variables, thresholds, accuracy or false-positive rate.

What GST analytics can establish—and what it cannot

A useful way to understand the process is as five separate stages:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  1. Lead generation: transaction or registration information creates a possible compliance lead.
  2. Data comparison: GST systems validate identity details or compare reported supplies with registration and return data.
  3. Risk prioritisation: documented risk parameters determine which applications or cases receive additional attention.
  4. Verification and information gathering: a jurisdictional officer may check documents, a business location or additional information.
  5. Legal determination: the registration-liability provisions, facts and applicable exemptions decide whether registration is required and what action follows.

Only the last stage can establish legal liability. A data match, a supplier report or a high-risk designation cannot replace the analysis required under the Central Goods and Services Tax Act, applicable notifications and state or Union-territory provisions.

How the detection funnel works

1. Reported activity creates potential leads

Authorities can work with information already submitted through GST processes, including registration applications, returns and supply reports. E-commerce reporting is a particularly concrete example for the unregistered-supplier question. GSTN’s functionality compilation for April 2023 through March 2024 says an e-commerce operator can report supplies made by unregistered suppliers in Form GSTR-8. The same functionality gives suppliers a portal view of reported supplies and amendments. The description is a data input for review, not an automatic finding that every reported supplier is liable to register.

The compilation describes a view of turnover of unregistered suppliers registered in the state or Union territory where the operator is registered. That wording does not establish that every unregistered seller is captured, that all platforms or transactions are covered, or that the reported amount by itself crosses a legal registration threshold. See GSTN’s April 2023–March 2024 functionality compilation.

2. Systems validate and compare information

GST Portal registration guidance says an application goes through PAN validation and risk-parameter checks. These checks help the system decide whether an application can proceed through the normal workflow or should receive additional scrutiny. The guidance describes a specified integrated system of taxation (ISD) workflow in which high-risk applications, or cases where OTP validation has failed or expired, are sent to the jurisdictional officer. This is evidence of risk-based registration processing; it is not a published model for discovering every business that has never applied.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

For an existing registrant, the rules also provide for comparisons involving returns and reported supplies. Those comparisons can reveal inconsistencies, but they concern the compliance status of a person who already has a registration and therefore should not be presented as the method for identifying an entirely unregistered business.

3. Risk parameters prioritise human attention

Risk scoring is best understood as triage. It can move a case from a largely automated path to an officer-led review, but the public sources do not say which variables receive what weight, the numerical cut-offs, the model’s error rate or whether a particular seller has been scored. Claims that authorities use a known list of third-party databases, a universal turnover algorithm or automatic access to every seller’s bank data go beyond the published material.

4. Officers verify facts and seek information

Once a case is selected, the next action depends on the legal route. For a registration applicant, the officer may conduct the verification specified in the rules. For information connected with the Act, section 151 of the CGST Act provides a statutory route for an authorised officer to require information. For a person who was liable to register but did not, section 63 addresses assessment of that taxable person. These powers are legal procedures, not evidence that the initial analytics signal was correct.

Registration-application checks documented by GST rules

Rule 9: risk-based physical verification

Rule 9 of the Central Goods and Services Tax Rules, 2017 allows risk-based selection using data analysis and risk parameters for identifying certain applicants for physical verification of the declared place of business. The rule therefore links analytics to a specific verification step: an officer may check whether the stated premises and business details are genuine. It does not say that every high-risk application is fraudulent or that the same process scans all non-applicants.

Rule 8: biometric Aadhaar and document verification in specified cases

Rule 8 provides for biometric-based Aadhaar authentication and document verification for specified applications identified through the prescribed risk process. This is an applicant-verification control. It can confirm identity or documents in cases routed to it, but it is not a general biometric sweep for all businesses operating without registration.

The official provision is available on CBIC’s Rule 8 page.

Route Data source Who it concerns What the step does What it does not prove
Portal risk checks PAN, application details and risk parameters Registration applicants Routes selected applications, including specified high-risk or failed/expired-OTP cases, for officer attention That an applicant is liable for tax evasion or that an unregistered business has been found
Rule 9 verification Risk-based selection and declared business details Selected applicants Allows physical verification of the declared place of business That every selected applicant is in violation
Rule 8 authentication Aadhaar biometrics and documents in specified cases Specified registration applications Adds identity and document verification That all non-applicants are screened biometrically
E-commerce reporting GSTR-8 supply reports by e-commerce operators Unregistered suppliers whose supplies are reported Creates a transaction lead and a supplier-facing view of reported supplies and amendments That every supplier is included or legally required to register
Return comparison under Rule 21A Returns and outward or derived inward-supply details Existing registered persons Can support suspension and an explanation process when significant differences or anomalies appear A method for identifying every currently unregistered business

Can GST authorities identify unregistered sellers using e-commerce data?

They can receive a defined signal when an e-commerce operator reports supplies by an unregistered supplier in GSTR-8. GSTN’s functionality document says operators can report those supplies and that suppliers can inspect the reported supplies and amendments through the portal. That gives the tax administration a way to compare a reported seller or turnover with the registration information available to it.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

The signal still requires legal and factual checks. A seller might fall within an exception, make supplies whose place or type affects the registration analysis, operate below an applicable threshold, or have a registration obligation determined by provisions not visible from one platform report. Conversely, a platform report may contain an error or cover only the operator’s own reporting scope. The public document does not publish a completeness rate or say that all online sellers are automatically identified.

What a supplier should check in the portal

  1. Review the reported supplies and any amendments shown for the relevant period.
  2. Compare the platform figures with invoices, books and other sales records.
  3. Check the state or Union-territory context: the documented view refers to suppliers’ turnover in the jurisdiction where the operator is registered.
  4. Analyse registration liability under the current CGST Act, applicable state provisions, notifications, supply type and exceptions; do not treat the displayed amount as a legal conclusion.
  5. Keep records that explain differences, cancellations, returns or duplicate reports in case an officer asks for information.

Why Rule 21A is related but not an unregistered-business detector

Rule 21A illustrates how data comparison can trigger a prescribed follow-up for a registered person. It addresses a comparison of returns furnished under section 39 with outward-supply details in GSTR-1 or inward-supply details derived from suppliers’ outward-supply information. Where significant differences or anomalies indicate a possible contravention that could lead to cancellation, the registration may be suspended and the person is given an opportunity to explain.

The rule’s cited response period is 30 days. This mechanism starts with an existing registration, so it should not be described as proof that the system has found an unregistered business. It is an example of analytics supporting a notice and response process after registration.

Consult the current wording of CGST Rule 21A on CBIC’s site, because the provision has been amended and procedural wording can change.

When a data lead becomes a legal registration issue

Registration liability comes from the Act and applicable exceptions

Section 22 of the CGST Act sets the core registration-liability framework, subject to the Act’s exceptions, threshold rules, notifications and applicable state or Union-territory provisions. The exact answer depends on facts such as the nature and location of supplies and the person’s status. A risk score or platform report cannot substitute for that analysis. The current provision is published by CBIC at section 22 of the CGST Act.

Section 151: requesting information

Section 151 allows an authorised officer to require information on matters connected with the Act. In practice, this can provide a legal basis for seeking records or explanations after a lead has been generated, but the section itself does not disclose an analytics formula or determine liability without examining the facts. See section 151 on CBIC’s site.

Section 63: assessment when a liable person did not register

Section 63 addresses assessment of a taxable person who was liable to register but failed to do so. An assessment under this provision is a legal outcome reached through the statutory process; it is not synonymous with an initial automated flag. The provision is available at section 63 of the CGST Act.

What follow-up may look like after a signal

  1. Review the lead: the authority checks the source, period, jurisdiction and whether the information relates to an applicant, an existing registrant or an unregistered supplier.
  2. Validate identity and records: PAN, registration details, reported supplies, invoices, books or premises information may be compared as permitted by the relevant procedure.
  3. Seek an explanation or information: an officer may use the applicable notice or information-gathering power, giving the person the response opportunity required by that route.
  4. Apply the registration rules: the officer considers thresholds, exceptions, notifications, supply characteristics and state-specific provisions.
  5. Take the legally available action: possibilities depend on the facts and provision involved, ranging from correcting records or completing registration to assessment or other proceedings.

Because these stages involve human verification and statutory safeguards, a person should not ignore a notice merely because the underlying data may have come from a platform or automated comparison. The appropriate response is to reconcile the records and address the legal issue raised.

Timing figures that should not be mistaken for detection statistics

Figure What it refers to Source and qualification
30 days Normal taxpayer registration application timing GST Portal guidance says registration is effective from the date liability arises when the application is filed within 30 days; late filing changes the effective date to the date registration is granted. This is a registration rule, not an analytics accuracy measure. GST Portal guidance
30 days Response to specified Rule 21A differences or anomalies The cited rule provides a 30-day opportunity to explain after the relevant intimation. This concerns an existing registrant and is not a count of unregistered businesses found. Rule 21A

Common misconceptions

  • “A high-risk score proves evasion.” No. It prioritises a case or application for a prescribed check.
  • “A GSTR-8 entry proves registration is mandatory.” No. It is reported transaction information that must be tested against the law and facts.
  • “Rule 9 describes the nationwide algorithm for finding all unregistered businesses.” No. The published rule concerns risk-based selection of specified registration applicants for physical verification.
  • “Rule 21A is how authorities detect unregistered sellers.” No. It addresses anomalies involving a person who already has a registration.
  • “The public knows the GST model’s thresholds and accuracy.” No such complete specifications or outcome statistics are published in the cited material.

What businesses should do with this information

  • Track sales by state or Union territory, channel and supply type rather than relying only on a platform dashboard.
  • Reconcile e-commerce reports, amendments, invoices and books regularly.
  • Review current registration thresholds, exceptions and notifications with the facts of the business.
  • Keep PAN, premises, identity and transaction records consistent across registrations and returns.
  • If contacted, ask which period, transaction source and legal provision are involved, then respond within the stated deadline with reconciled evidence.

The practical lesson is limited but important: GST analytics can make an unregistered business more visible by surfacing reportable activity and directing scarce officer time toward selected cases. Whether that visibility ends in a registration obligation, assessment or no further action depends on verification and the registration law—not on the signal alone.
