GST treatment depends on what the bank supplied, to whom, and under which registration—not simply on whether a transaction is called a bank charge. Some specified banking items are exempt, while other services may be taxable. A service between separate GST registrations of the same bank can also be a supply even when the bank makes no charge. To determine the result, identify the service, the supplier and recipient registrations, any consideration, the applicable exemption or valuation rule, and the place of supply.
Is GST charged on bank charges?
Sometimes. “Bank charges” is a broad label, not a single category under GST. A fee must be classified by the service it pays for and checked against the applicable rate or exemption entry. The official material discussed here does not establish one GST rate for every bank fee, and it does not support the assumption that every bank charge is exempt.
CBIC’s rate and exemption listing includes a nil-rate entry for interest or discount on deposits, loans, or advances, except interest involved in credit-card services. It also lists limited exemptions for specified services to Basic Saving Bank Deposit account holders under the Pradhan Mantri Jan-Dhan Yojana (PMJDY), and for a defined acquiring-bank settlement service subject to a stated transaction threshold. Each exemption has its own scope and conditions; the relevant entry and any applicable amendments must be checked for the particular supply.

Do not treat the interest exemption as an exemption for every amount connected with borrowing. Interest or discount on a loan and a separately supplied processing, account, card, late-payment, or other service are not necessarily the same supply. The fact that a charge appears on a loan or card statement does not, by itself, establish that it shares the interest treatment. The relevant exemption or rate entry must match the actual service.

Customer charges and concessional pricing
For a service supplied to a customer who is not a related person, CBIC’s banking FAQ describes the taxable value as the transaction value charged or recovered under section 15 of the CGST Act. It says a bank does not have to enhance that value merely because it offers a free, concessional, or different price for commercial reasons. A lower or waived price is therefore not automatically uplifted to a standard price for this valuation question.
This is a rule about valuing the service in the stated customer situation; it does not decide whether the service is taxable in the first place, nor does it assign a rate to every bank fee. First identify the supply and check whether a specific exemption applies. If it is taxable, then consider the value charged or recovered and the relevant valuation provisions.
How customer charges differ from inter-branch services
A customer-facing service and a service between two GST registrations of the same bank raise different questions. In the first case, the customer is generally the recipient and the fee charged is relevant to valuation. In the second, the supplier and recipient may be distinct persons for GST purposes even though both belong to one bank and share a PAN. A separate charge is not essential for a supply between related or distinct persons.

| Question | Bank service to a customer | Service between bank registrations |
|---|---|---|
| Who receives the service? | The customer or account holder, depending on the actual service. | Another GST registration of the bank, if the facts establish a supply between distinct persons. |
| Must a fee be charged? | The amount charged or recovered is relevant to customer valuation; a concessional price is not automatically uplifted in the situation described by CBIC. | No. Under section 7 read with Schedule I, a supply between related or distinct persons in the course or furtherance of business can be a supply without consideration. |
| What needs checking? | Service description, consideration, exemption or rate entry, and place of supply. | Separate registrations, actual service, valuation method, recipient’s ITC position, and place of supply. |
CBIC’s FAQ distinguishes these cases from a service supplied without consideration to an unrelated recipient, which generally does not qualify as a supply under the guidance cited. It separately addresses imports of services by a bank from a related person or an overseas establishment in the course or furtherance of business. Those situations should not be collapsed into the rule for a free service to an unrelated person.

Does GST apply when a head office supports a branch without charging?
It can. CBIC’s bank-specific FAQ says management oversight or stewardship activities provided by a head office to a branch in India can constitute a supply between distinct entities even if the branch is not charged and does not record an expense. The relevant question is not merely whether the bank made an internal accounting entry; it is whether a service is supplied between separate GST registrations in the course or furtherance of business.
The same PAN does not, by itself, merge separate GST registrations into one recipient for this analysis. A bank should identify which registration provides the service and which registration receives it, then describe the support actually performed. Calling a transaction “internal,” “head-office support,” or a “cost allocation” does not settle whether GST applies. Conversely, not every movement of staff, information, or costs automatically proves a distinct taxable service; the actual facts and applicable provisions matter.
Practical way to classify an internal arrangement
- Map the registrations. Record the GSTIN and State registration of the office providing the support and the registration said to receive it. A shared legal entity or PAN does not answer the distinct-person question on its own.
- Describe the activity. State whether it is oversight, stewardship, operational support, customer facilitation, or another identifiable service. Avoid relying only on a ledger description or a generic “HO allocation.”
- Check the relationship and consideration. Determine whether the registrations are related or distinct persons and whether any amount is charged, allocated, reimbursed, or otherwise recovered. A zero charge does not end the analysis for distinct-person supplies.
- Determine valuation and credit treatment. Apply the relevant Rule 28 approach and account for the bank’s ITC position, rather than assuming that the customer-fee valuation principle controls an inter-registration supply.
- Determine place of supply and document the result. Apply the relevant domestic or cross-border rule and retain the basis for the service description, valuation, and GST treatment.
How are inter-branch services valued?
Valuation and input tax credit (ITC) interact. CBIC’s bank-specific FAQ addresses Rule 28 and the bank’s option under section 17(4) to take 50% of eligible input tax credit, subject to the statutory conditions. The appropriate method depends on the circumstances, including whether the recipient registration is eligible for full ITC and whether an open-market value for a like kind and quality service is available.
Rule 28 and full ITC
CBIC says that, under Rule 28, the value stated on the invoice is deemed to be the open-market value where the recipient is eligible for full ITC. That treatment is tied to the recipient’s full-credit eligibility; it is not a general permission to select any invoice value in every inter-branch situation. Confirm the receiving registration’s actual eligibility before relying on this provision.

When a like-service market value is unavailable
For the branch-service situation addressed in the FAQ, CBIC says a bank may use a reasonable basis consistent with Rules 30 and 31 when an open-market value for like kind and quality is unavailable. This is a fact-specific valuation route, not a single mandatory formula for every bank or every internal service. The records should make the chosen basis understandable and supportable for that service and recipient.
The FAQ also discusses estimating support costs through a branch or office certificate for specified stewardship circumstances. In that described situation, it addresses timing liability when the costs are determined or when the certificate is received. The certificate and timing discussion should not be generalized beyond the circumstances it covers; banks should check the precise facts, current statutory requirements, and records before applying it.
How the 50% ITC option affects the analysis
CBIC states that the 50% ITC restriction does not apply to tax on supplies between registered persons having the same PAN, while its FAQ also discusses the option in relation to specified services involving offshore related or distinct persons. These statements concern credit treatment, not whether a service exists or how it is valued. The bank’s election, the recipient registration, the service, and the statutory conditions must be identified before drawing a credit conclusion.

A practical file for an inter-registration service should therefore connect the service description to the valuation method and the recipient’s ITC position. It should also explain why the selected method applies—for example, the recipient’s full-credit eligibility or the unavailability of a like-kind-and-quality market value in the scenario being assessed.

Which place-of-supply rule applies?
Place of supply determines how a service is treated geographically for GST, including whether it is intra-State or inter-State. For domestic banking and financial services, section 12(12) of the IGST Act generally places the supply at the recipient’s location on the supplier’s records. If the recipient’s location is not recorded, the supplier’s location is the fallback.
CBIC’s FAQ says the address ordinarily used for customer communication may be considered. For a registered customer, it says the bank may rely on the customer’s GSTIN. These details make the bank’s records important: the place-of-supply answer is not necessarily the location of the branch where a transaction happens or the customer happens to receive assistance.
One customer transaction involving two branches
CBIC illustrates an account held in one State and a service facilitated at a branch in another State. The place of supply for the customer-facing banking service follows the account or customer location on the bank’s records under the applicable rule. If the second branch provides a separately identifiable facilitation service to the first branch and that service is separately charged, it raises a distinct inter-branch supply question. Do not merge the customer-facing service and the branch-to-branch facilitation merely because they relate to the same customer transaction.
Cross-border account-holder and offshore-branch cases
The domestic recipient-location rule should not be applied indiscriminately to cross-border cases. The IGST Act has a separate rule for certain cross-border services supplied by a banking company to account holders: the place of supply is the supplier’s location.

CBIC also says that qualifying services supplied from an Indian bank, or a foreign bank’s Indian branch, to its offshore head office or branch may be inter-State supplies between distinct establishments and may not be treated as exports in the circumstances described. The FAQ’s qualification matters: it refers to services that are neither intermediary services nor services to account holders. Check the precise service and establishments before classifying a cross-border arrangement.
What should bank customers and business teams check?
A customer reviewing a bank statement should start with the exact description of the charge and ask what service it represents. A business or finance team reviewing bank documentation or an internal allocation should also identify the registrations involved and preserve the valuation and place-of-supply analysis.
- Charge description: identify the service instead of treating “bank charges” as one GST category.
- Exemption or rate basis: check whether the exact service fits a current, specific exemption entry or is taxable under the applicable rate entry. Do not infer an exemption for ancillary charges from the treatment of interest.
- Recipient and supplier: distinguish the customer from another GST registration of the bank, and record the GSTINs relevant to the supply.
- Consideration: note the amount charged, recovered, or allocated. For a customer who is not a related person, CBIC’s FAQ says a concessional transaction value is not automatically enhanced; for distinct persons, no consideration does not necessarily prevent a supply.
- ITC and valuation: record whether the recipient is eligible for full ITC, whether the bank uses the section 17(4) option, and why the selected valuation method fits the facts.
- Place of supply: check the customer or recipient location recorded by the bank, the GSTIN where relevant, and whether a special cross-border rule applies.
- Supporting records: retain the bank’s document, service details, relevant registrations, exemption or valuation basis, and any certificate or cost support relied on.
What invoice rules apply to banks?
Document flexibility does not mean that the underlying supply is exempt. Under the invoice rules described by CBIC, a banking company supplying taxable services may issue an invoice or substitute document without serial numbering and without the recipient’s address, provided the other prescribed information is present. CBIC’s FAQ also says banks and specified financial suppliers may issue invoices within 45 days from the date of supply of service.
For a customer or business reviewing a bank document, check the charge description, GSTIN or registration details that are provided, place-of-supply information where relevant, and the tax basis. The allowed document format should not be mistaken for a decision about whether GST applies to the service.
How to reach a transaction-specific conclusion
For a customer fee, begin with the service and the customer-facing transaction, then check whether a specific exemption applies. If the service is taxable, determine the transaction value and the applicable place-of-supply rule. For internal bank services, first establish whether separate registrations are involved and what service passes between them; then assess no-consideration treatment, valuation, ITC, and place of supply. A conclusion should be tied to the current law and the bank’s transaction records, not to the informal label attached to a charge or allocation.
