A Bitcoin seizure is not the same as a forfeiture. In a federal case, seizure gives the government temporary control of cryptocurrency while it pursues legal authority to keep it. Forfeiture is the later process that can transfer ownership to the United States. The route—criminal forfeiture, civil judicial forfeiture, or administrative forfeiture—determines who is named, which court or agency handles the matter, and how an owner or other claimant must respond.
This guide covers federal practice and U.S. Department of Justice (DOJ) guidance. State proceedings, the specific forfeiture statute, and orders in an individual case can impose different rules. An official notice and the law governing that case control over any general timeline here.
What a federal Bitcoin seizure actually does
Seizure places property under government control; it does not by itself establish that the property is forfeited or that anyone has lost ownership permanently. Agents may secure cryptocurrency as evidence or as property they contend is connected to a crime, then pursue one of the federal forfeiture paths described below.
The blockchain does not automatically give agents control of coins. They need lawful authority and the technical ability to transfer the assets. For a self-custodied wallet, that can mean obtaining a warrant for a device or location where the wallet and private keys are accessible. A seizure warrant is one possible source of authority; existing search-warrant authority or valid consent may also apply.

Once authorized, agents generally move the cryptocurrency promptly to a government-controlled wallet. The DOJ’s 2025 policy notes that another person may hold a copy of the private key, creating a risk that funds could be moved if they are not secured. The seizing agency then records the property in its forfeiture system and arranges storage. Custody may later move to a U.S. Marshals Service (USMS) or contractor wallet under the procedures available for that asset.
Operational guidance is not a promise that every token, exchange account, hardware wallet, or software wallet can be accessed. DOJ advises agencies to consult USMS before seizure when storage or liquidation support may be unavailable.

Criminal forfeiture is tied to a defendant and the offenses for which that person is convicted. Civil judicial forfeiture can proceed even when a criminal case against an owner is not possible—for example, when the suspected wrongdoer is unidentified or unavailable. Administrative forfeiture is not an exemption from notice and claim rules; failure to respond can allow the agency process to become final. DOJ explains these distinctions in its federal forfeiture overview.
How agents seize Bitcoin: the practical sequence
- Investigators identify a legal and technical path. They determine what property is involved, where the wallet, device, exchange account, or keys can be reached, and which seizure authority is available. DOJ’s 2025 Asset Forfeiture Policy Manual says agencies should consult USMS about whether the cryptocurrency can be stored and liquidated through available procedures.
- A warrant, consent, or other authority is obtained. Where required, law enforcement seeks a seizure warrant. A warrant for a domestic self-custodial wallet may cover a device or premises where the wallet and private keys are accessible. The authority and the case-specific order define what agents may take.
- The assets are transferred to a controlled wallet. Agents use the available keys or account controls to move the cryptocurrency. This is a technical transfer, not a power conferred merely by the public blockchain. Prompt movement helps prevent someone with a duplicate key from transferring the funds first.
- The property is logged and placed in custody. The seizing agency records the cryptocurrency, its transaction information, and the legal basis for the seizure. The agency may retain it temporarily or transfer custody to a USMS or approved contractor wallet.
- The government chooses a forfeiture route. Prosecutors and the agency assess whether the matter belongs in a criminal case, a civil judicial complaint, or an administrative proceeding. The route determines the notice, claim, and court requirements that follow.
DOJ’s Asset Forfeiture Policy Manual 2025 provides the cryptocurrency custody guidance, while the program roles page describes the responsibilities of the agencies involved.
Notices, claims, and the deadlines that can decide the case
Deadlines are calculated from the official notice and the governing statute—not from a seizure announcement, a news article, or the date you first hear a rumor.
Administrative forfeiture notice
DOJ’s Justice Manual says written notice is generally sent as soon as practicable and no later than 60 days after seizure, subject to statutory exceptions and limited waiver procedures. The notice states the deadline for filing an administrative claim. If a potential claimant did not receive direct notice, the general publication rule described in the 2025 policy is 30 days after the final publication day. What an administrative claim must contain
A claim must identify the specific property and the claimant’s interest, be submitted under oath, and be subject to the penalty of perjury. A compliant claim contests the forfeiture process; it is not the same as asking the agency for discretionary remission or mitigation.
What happens after a qualifying claim
Under 18 U.S.C. § 983(a)(3), the government generally has 90 days after a qualifying claim to file a civil forfeiture complaint, include the property in a criminal indictment, return the property, or obtain a court-approved extension. Missing that statutory window can have consequences, but exceptions and case-specific orders matter.
Civil judicial forfeiture deadlines
For a civil judicial case, DOJ’s 2025 policy describes notice with a claim deadline at least 35 days after the notice is sent. After a claim is filed, an answer or a Rule 12 motion is generally due no later than 21 days after the claim filing, subject to the applicable rules and any court order. Read the complaint and docket carefully; these are not deadlines to calculate from a general article.

What happens to the Bitcoin while the case is pending
DOJ’s 2025 policy states: “Cryptocurrency should be kept in the form it was seized and not liquidated (i.e., converted to fiat currency or other cryptocurrency) until a final order of forfeiture is entered or an administrative forfeiture is final.” The policy is designed to limit disputes caused by price changes and the possibility that the government would have to make an owner whole if property is returned.
That is a general policy, not an absolute ban on every early sale. The manual discusses limited circumstances for an interlocutory sale or pretrial conversion, consultation with DOJ’s Money Laundering and Asset Recovery Section, and special approval for certain alternative cryptocurrencies. Therefore, neither “the government always holds the coins” nor “the government immediately sells them” is accurate.
USMS is the program’s primary custodian for seized and forfeited property, with stated exceptions, and disposes of property in its custody under law. Cryptocurrency handling can involve specialized wallets and procedures rather than the ordinary process used for physical property.

Custody can transfer after the initial seizure, so the agency that took the coins may not be the organization holding the wallet later. DOJ’s Program Participants and Roles page explains the program structure.

How to contest a Bitcoin seizure or forfeiture
If your property is involved, treat the notice as a legal deadline, not as an invitation to wait for a criminal case to resolve.
- Get the complete notice and property description. Confirm the wallet address, transaction identifiers, amount, seizure date, agency, and the legal track stated in the document.
- Calendar the exact claim date. Use the date printed in the notice or the governing publication rule. Do not substitute the date of a press release or social-media post.
- File the required claim correctly. Identify the specific cryptocurrency and explain your ownership or other legal interest. Follow the notice’s delivery method, verification, signature, and oath requirements.
- Preserve evidence. Keep purchase records, exchange statements, wallet backups, transaction histories, tax records, contracts, and communications showing how you obtained or controlled the assets. Preserve originals and record when you received the notice.
- Watch for the next filing. After a claim, the government may file a civil complaint, include the property in a criminal indictment, return it, or seek an extension. A court complaint brings separate response deadlines.
- Get qualified legal advice promptly. Forfeiture standing, innocent-owner arguments, privilege, jurisdiction, and deadlines depend on the facts and statute. A lawyer experienced in federal forfeiture can determine which filing is appropriate; legal-aid organizations may help people who cannot afford counsel.
A petition for remission or mitigation asks the government to exercise discretion for reasons such as hardship or equity. It does not replace a claim contesting whether the property is legally forfeitable, and filing one does not necessarily preserve the deadline for a judicial claim.
Does a seizure announcement prove the government won?
No. A seizure announcement can describe property taken under an investigation. A civil forfeiture complaint states allegations that the government must establish in the proceeding; it is not a judgment. Criminal forfeiture requires a conviction, and administrative forfeiture becomes final only after the applicable notice and claim process ends without a compliant challenge.
For example, on June 18, 2025, DOJ announced a civil forfeiture complaint against more than $225.3 million in cryptocurrency allegedly connected to investment-fraud proceeds and money laundering. The figure is the amount described in that complaint, not a general annual statistic and not proof that final forfeiture had already occurred. The announcement is at DOJ’s case release.
Can victims recover money from forfeited cryptocurrency?
Potentially, when federal law authorizes compensation and the required procedures are met. Identification, seizure, and a final forfeiture come first. Recovery depends on the assets actually forfeited, the victims the government can identify, competing claims, and the distribution process authorized for that case. Even when compensation is available, payment can take time; a seizure alone creates no immediate right to the coins or their dollar value.
Federal scope and limits
This explanation concerns federal practice described in DOJ guidance. State forfeiture laws, state agencies, tribal proceedings, the particular federal statute used, and a judge’s case-specific order can change the notice, burden, venue, deadlines, and remedies. A person cannot determine legal standing, innocence, or a filing deadline from the general facts in this article. The controlling notice, complaint, indictment, order, statute, and court docket govern the individual case.
