If your treatment at a game studio changes after you raise a workplace concern, create a factual, dated record immediately. Capture what happened, when and where it happened, who was present, the words used, when you reported the concern, and every later change to your duties, schedule, pay, hours, reviews, access, or employment status. Keep only records you are authorized to retain, and check the law and filing deadline that apply to your location and worker classification.

This article explains a practical documentation method for developers, artists, designers, producers, QA staff, and other studio workers. It is general information, not a determination that any particular event is unlawful retaliation.

Why a contemporaneous record matters

Workplace disputes are often decided months after the events, when memories, chat messages, and project context have changed. A contemporaneous log gives a decision-maker a chronology that can be checked against pay records, calendars, messages, evaluations, and witness accounts. It also helps you describe a concern consistently to a manager, human-resources contact, government agency, union, worker center, or lawyer.

Write observations rather than conclusions. “On 14 March at 3:10 p.m. in the production meeting, the lead said my overtime request would be denied after I asked about unpaid hours” is more useful than “management retaliated.” If you did not personally see or hear something, label it as information from another person and identify that source. Do not turn an assumption about motive into a fact.

There is no special federal documentation format for game developers. The same principles apply whether the issue involves discrimination, harassment, pay, safety, leave, organizing, or another workplace right.

What legally counts as retaliation?

The legal test depends on the right you exercised and the law covering you. In its 2016 retaliation guidance, the U.S. Equal Employment Opportunity Commission (EEOC) describes three parts of an EEO retaliation claim: protected activity, a materially adverse action, and a causal connection between them.

The EEOC’s plain-language definition is: “Retaliation occurs when an employer takes a materially adverse action because an applicant or employee asserts rights protected by the EEO laws.” Protected activity generally includes participating in an EEO investigation or proceeding, or reasonably opposing conduct made unlawful by an EEO law. The EEOC says participation can remain protected even when the underlying allegation is unsuccessful or was filed late.

A frustrating review, rejected creative proposal, ordinary schedule change, or interpersonal disagreement is not automatically unlawful retaliation. The action must be materially adverse under the applicable law, and the reason for it must be connected to protected activity. Other statutes use different definitions and may protect different conduct, workers, or supervisors.

How do I document retaliation at work?

1. Open a dated private log promptly

Start an entry as soon as practical after each relevant event. Use a format that preserves the original date and makes later additions obvious. A notebook, personal document, or other secure method can work; a bound notebook is optional, not a legal requirement. Keep the log on a personal account or device only if doing so complies with your employer’s policies and does not expose confidential information.

For every entry, record:

  • The date and approximate time, plus the time zone if people were working remotely.
  • Where the event occurred: office, video call, chat channel, email thread, or another location.
  • Everyone present or copied.
  • What you personally saw, heard, sent, or received. Use exact words when remembered; otherwise mark a paraphrase as a paraphrase.
  • Any witness and whether the witness was present, shown a record, or merely told about the event.
  • The project, sprint, build, task, or meeting involved, so the entry can be located later.
  • Your immediate work impact, stated factually, such as a removed task, missed shift, blocked account, or changed deadline.

2. Record the original concern and how you raised it

Make a separate entry for the conduct that prompted you to act. Note the policy, pay practice, safety condition, harassment, discrimination, leave issue, or other concern as you understood it, without claiming a legal violation you cannot establish.

Then document the report itself: the date, channel, recipient, subject line, meeting name, and a concise account of what you said. Identify whether you used a manager, HR portal, ethics line, union representative, government agency, or another route. Save an acknowledgment or response that you are lawfully allowed to keep. If the response was verbal, write down the words and participants immediately afterward.

3. Track every later change in conditions

Continue the log after the report, including events that seem favorable or neutral. California’s Labor Commissioner specifically gives demotion and reductions in pay or hours as examples of changes to document. In a studio, other observable changes might include reassigned responsibilities, removal from a project, a new shift, cancelled overtime, a negative evaluation, loss of system access, exclusion from meetings needed to do the job, a written warning, suspension, or termination.

For each change, state the old and new condition, effective date, who communicated it, and the stated reason. Preserve schedules, pay statements, time records, evaluation documents, commendations, and personal notes when you are authorized to retain them. Do not silently edit an earlier entry; add a dated correction that explains what changed.

4. Preserve records lawfully

Keep copies of records you have a legitimate right to possess. California guidance lists pay stubs, time sheets, performance evaluations or commendations, and personal notes as examples. Personal copies of your own emails, messages, calendar invitations, and pay information may be useful, but workplace policies and privacy laws vary.

Do not take confidential source code, unreleased builds, customer data, another employee’s personnel file, trade secrets, or restricted screenshots merely because they might support your account. The official guidance does not create a blanket right to copy employer records. Ask a qualified adviser how to preserve relevant material safely, and keep the minimum necessary information.

5. Record facts that may show a connection

The EEOC identifies several types of evidence that may support an inference of causation:

  • Timing: how soon the adverse action followed the report or other protected activity.
  • Statements: words suggesting that the report, participation, or opposition influenced the decision.
  • Comparative treatment: documented differences in how similarly situated workers were treated.
  • Evidence challenging the stated reason: contemporaneous records showing that the employer’s explanation changed, conflicts with objective records, or was not applied consistently.

These are examples, not a checklist that guarantees a claim. When comparing treatment, write the factual basis for the comparison and avoid guessing about another worker’s medical information, compensation, performance history, or other private circumstances.

6. Keep chronology separate from conclusions

Use one section or file for dated events and another for questions or possible explanations. A chronology should allow someone unfamiliar with the project to follow what happened without accepting your legal conclusion. You can later tell an adviser, “I believe the timing suggests a connection,” while still presenting the underlying dates, words, and records separately.

Evidence examples and their limits

Evidence type What to capture Important limitation
Messages and email Original date, sender, recipients, channel, complete thread, and relevant attachments Do not forward or copy confidential material you are not authorized to retain.
Pay and time records Pay statements, time sheets, schedules, approved overtime, and changes after the report Keep your own records and do not alter employer systems.
Performance records Evaluations, commendations, goals, warnings, and the dates they were issued A single positive or negative review rarely proves motive by itself.
Witness information Name, role, what the person directly observed, and the date you made the note Secondhand accounts should be labeled as such; do not pressure coworkers to adopt your wording.
Comparative treatment Specific, observable differences in assignments, discipline, hours, or access Similarity must be established with facts, not speculation about private circumstances.

Can I talk with coworkers about pay or working conditions?

The National Labor Relations Board (NLRB) explains that employees covered by the National Labor Relations Act (NLRA) may discuss wages and working conditions with coworkers, and that some employer rules restricting those discussions may violate the Act. Conversations about overtime, staffing, schedules, safety, workload, and pay can therefore implicate protected concerted activity when the statutory requirements are met.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Coverage is not universal. The NLRA has exclusions, and classification matters; supervisors and some other categories may not be covered in the same way. Do not assume that a conversation is protected simply because it concerns work, or that every employer rule is unlawful. Record what was said, who participated, and whether the discussion concerned group interests, then verify coverage with the NLRB or a qualified adviser.

Choose the reporting route by right and jurisdiction

Before filing, identify the right involved, the agency with authority, the deadline, and any confidentiality or record-handling limits. The following framework is a starting point, not a substitute for jurisdiction-specific advice.

Concern Potential route Questions to verify
Discrimination, harassment, or participation in an EEO matter EEOC or the applicable state or local fair-employment agency; an internal channel may also exist Does the conduct fall under an EEO law? Are you an employee or applicant covered by it? What charge deadline applies?
Wages, hours, or other labor rights in California California Labor Commissioner’s Office or another agency with jurisdiction Which right was exercised, what employment change followed, and what current filing period applies?
Discussion of pay or working conditions with coworkers NLRB for workers covered by the NLRA Are you covered, was the activity concerted, and did the employer interfere, restrain, or retaliate?
Safety, leave, or another statutory right The government agency named in that law, plus any required internal process What statute applies, who is covered, what records are safe to submit, and when must a complaint be filed?

California’s Labor Commissioner says workers in California are protected against retaliation for exercising labor rights regardless of immigration status and recommends documenting changed conditions. Its guidance states that a retaliation complaint should be filed within one year of the retaliatory act. Treat that period as California-specific and verify the current deadline and process before relying on it; other jurisdictions and laws may use different limits, prerequisites, or extensions.

Game-studio situations that deserve precise notes

Crunch, overtime, and time tracking

Record scheduled hours, actual hours, approvals, and the date you asked about pay or timekeeping. Keep pay statements and time sheets. Avoid describing a whole team’s practice from memory; identify the shifts, builds, or milestones you personally worked and any instructions you received.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Performance reviews after a complaint

Save the review, prior goals, feedback delivered before the complaint, and any stated reason for a sudden rating change. Note who set the rating, which examples were cited, and whether expectations changed in writing. A poor review can be legitimate; the useful record is the chronology and consistency of the reasons.

Access, project assignment, or remote-work changes

Write down when repository, build, ticketing, chat, or hardware access changed; what notice you received; and how the change affected assigned work. Do not bypass security controls or copy restricted files to prove that access was removed.

Common documentation mistakes

  • Waiting until termination: a delayed account may omit dates and witnesses. Make brief entries after each event.
  • Using loaded labels as facts: replace “they sabotaged me” with the observable action and its effect.
  • Editing old entries: preserve the original and add a dated clarification.
  • Taking everything: unauthorized copying can create separate legal and employment risks.
  • Broadcasting accusations: limit disclosures to people who need the information and protect coworkers’ private data.
  • Assuming one law fits all: a game developer may be an employee, contractor, supervisor, or another classification with different protections.
  • Missing a deadline: contact the relevant agency or qualified counsel promptly, even while you continue assembling records.

When to get individual help

Seek jurisdiction-specific advice when employment is ending, a government charge or lawsuit is being considered, a confidentiality or severance agreement is involved, immigration concerns are present, or you are unsure whether a record may be copied. A worker center, employment lawyer, union representative, or the relevant agency can explain coverage, deadlines, protected activity, and lawful record handling. Bring a concise chronology and the records you were authorized to keep rather than an unorganized archive of confidential studio material.
