There is no single U.S.-wide distance. The official state examples here range from 100 to 150 feet, while Florida requires reasonable efforts to keep 100 feet away on rivers, inlets and navigation channels and 300 feet on other waters. The rule depends on where you are boating, so check the current law for your state and waterway before you go.

How far away should a boat stay?

Use the distance set by the jurisdiction where the flag is displayed. The examples below are not interchangeable: some sources state a legal minimum, while others give boating guidance. Florida also distinguishes among types of waterway.

Jurisdiction Distance and scope What the source says
Florida 100 feet on rivers, inlets and navigation channels; 300 feet on other waters Florida Statutes §327.331 requires reasonable efforts to maintain the applicable distance. A vessel that enters the specified distance must travel no faster than needed to maintain headway and steerageway, subject to an exception for law-enforcement and rescue vessels. Florida Statutes §327.331 (2025)
Pennsylvania At least 100 feet 58 Pa. Code §109.5 applies to boats not engaged in diving operations near an area displaying a diver-down flag or code flag Alpha. Pennsylvania Code §109.5
Illinois 150 feet The Illinois boating handbook gives this distance for vessels not engaged in diving operations. Illinois boating handbook
Michigan At least 100 feet around the vessel Michigan DNR describes this as a safe-distance recommendation for a vessel displaying the flag. Michigan DNR: Buoys and markers
California At least 100 feet from the diving site and vessel California boating-course material gives this guidance. California Division of Boating and Waterways course material

These figures summarize the cited state materials, not a nationwide rule. The sources also do not use identical wording: a distance from an “area,” a “vessel,” or a “diving site and vessel” may describe different reference points. Follow the local authority’s wording rather than assuming the measurements have the same legal meaning.

The key comparison is not just the number. Check who the rule addresses, where the distance begins, whether it is a statute, regulation or agency safety guidance, and whether there is a separate speed instruction. For example, Pennsylvania’s regulation refers to boats not engaged in diving operations and an area displaying a diver-down flag or code flag Alpha. Illinois’s handbook gives a 150-foot figure for vessels not engaged in diving operations. Michigan’s page frames 100 feet as a safe distance around the vessel, while California’s course material refers to both the diving site and vessel. Those descriptions should not be collapsed into a single universal measurement.

What the Florida rule requires

Florida’s statute is unusually specific about both distance and vessel speed. Under §327.331, operators must make reasonable efforts to maintain at least 100 feet from a divers-down flag on a river, inlet or navigation channel, and at least 300 feet on other waters. If a vessel enters those distances, it may proceed only as fast as necessary to maintain headway and steerageway. The statute provides an exception for law-enforcement and rescue vessels.

In practical terms, a boater in Florida first needs to identify the kind of waterway. The 100-foot figure applies to rivers, inlets and navigation channels; the 300-foot figure applies to other waters. Do not pick the smaller distance simply because it is familiar from another state or because the flag is near a channel. Check how the applicable waterway is classified and use the current statute and Florida Fish and Wildlife Conservation Commission boating regulations when uncertain. The speed instruction is a distinct requirement: entering the stated distance does not mean the operator may continue at ordinary speed. The vessel must proceed only as fast as needed to maintain headway and steerageway.

Florida also addresses divers and the warning device. Divers should make reasonable efforts to stay within 100 feet of the device on rivers, inlets and navigation channels, and within 300 feet on other waters. The device must be lowered once all divers are aboard or ashore. These are Florida-specific provisions; they should not be treated as rules for other states. Read the current Florida statute and the Florida Fish and Wildlife Conservation Commission boating regulations for the applicable requirements.

How to recognize the warning

The diver-down flag described in the state materials is red with a white diagonal stripe. It signals that divers are in the water nearby; it is a warning to boat operators to keep clear, not an invitation to approach slowly for a closer look. Pennsylvania guidance also identifies the code flag Alpha as a signal associated with diving operations. Do not assume the same flag rules, device specifications or display requirements apply in every jurisdiction.

Florida law sets requirements for how a diver-down flag or buoy is constructed and displayed. If you are buying or displaying a flag, check the local requirements for the waters where it will be used rather than relying on a product description that claims broad compliance. A flag marketed as a diver-down flag does not, by that label alone, establish that its size, construction or manner of display meets every state’s requirements. The cited materials do not establish one product specification that is valid everywhere. Pennsylvania’s official ATON guidance also describes the diver-down signal.

For a boater, recognition is only the first step: treat the signal as a warning that someone may be underwater and hard to see. The cited sources use different reference points for the clearance, so do not assume the diver is directly beneath the flag or that the dive site ends at the edge of the boat carrying the flag. Give the site the locally required clearance from the point named in the rule or guidance.

What to do when you see a diver-down flag

  1. Identify the jurisdiction. State boundaries, local waterway rules and the waterway type can change which distance applies. On unfamiliar waters, check the current state boating authority’s rules before launching. If you are already underway and unsure, do not assume a distance from a different state controls.
  2. Give the site the full required clearance. Apply the local distance to the reference point stated in that jurisdiction’s rule or guidance. Do not treat the 100-foot figures in one state as a default for another. Where a source names both a vessel and diving site, take care not to substitute only one of those reference points.
  3. Follow any speed rule as well as the distance rule. In Florida, a vessel inside the statutory distance must proceed no faster than needed to maintain headway and steerageway. The cited materials do not establish that same speed requirement for every other state. A distance rule and speed rule are separate questions; satisfying one does not automatically answer the other.
  4. Keep a lookout and avoid the area. The flag warns of divers who may be difficult to see from a boat. Leave room for the diver and the dive vessel; do not assume the diver is directly beneath the flag or that no diver is present because none is visible. Keep the warning in view and do not make a close pass just to inspect it.
  5. Check whether the warning is still active. In Florida, the device is lowered after all divers are aboard or ashore. That Florida requirement does not establish when a device must be removed elsewhere, so use the local rule. Do not infer that the dive has ended merely because the water looks clear or the divers are temporarily out of sight.

Before getting underway, a useful sequence is to look up the state rule, identify the waterway category if the state distinguishes among them, and note the exact measurement language. If the source gives a distance from a flag, area, vessel or site, preserve that distinction when applying it. If you cannot confirm the rule for an unfamiliar location, keep clear rather than treating the shortest number in this article as permission to approach.

Why a single number can be misleading

Distance requirements serve as a minimum buffer, but the number alone does not answer every practical question. A 100-foot figure may describe clearance from an area, a vessel, or the dive site, and an agency’s safe-distance guidance may not use the same legal language as a statute or regulation. Florida’s 100- and 300-foot provisions depend on the kind of waterway; a boater cannot choose the shorter figure without identifying the location.

The examples also differ in legal character. Pennsylvania’s figure appears in a state regulation, and Florida’s requirements are in a statute. Illinois’s 150-foot figure is stated in a boating handbook. Michigan describes a safe distance on its DNR page, and California’s figure appears in boating-course material. That distinction matters when deciding what is a binding requirement and what is safety guidance; consult the actual current state authority for the applicable rule instead of treating every number as equivalent law.

Nor does a distance figure necessarily tell you what to do if you are already closer than the specified boundary. Florida supplies a speed requirement for vessels inside its distances. For other waters, use the relevant current rule and proceed conservatively; the examples here do not establish a universal speed limit, maneuver, or enforcement rule. The reviewed examples also do not support applying Florida’s diver-range or device-lowering provisions to other states.

Before boating near a dive site

  • Look up the current boating rule for the state and specific waterway.
  • Confirm whether the location is classified as a river, inlet, navigation channel or other water, where that distinction matters.
  • Check whether the source gives a binding minimum or safety guidance, and note what point the distance is measured from.
  • If you are displaying a flag or buoy, verify local construction, size, placement and display rules; no single specification in these examples is established as valid everywhere.
  • Check for a separate speed instruction that applies within the clearance distance. Florida’s headway-and-steerageway rule is an example, not a nationwide standard.
  • Use official state statutes, regulations or boating-agency material for the water where you will operate, rather than relying only on a seller’s product description or an out-of-state summary.

The answer for an unidentified U.S. location is therefore a range of state-specific rules, not one universal distance. Verify the local requirement before operating near the flag, and follow any additional speed or display rule that applies there.

How far away must boats stay from a diver-down flag in Florida?

Florida Statutes §327.331 calls for reasonable efforts to maintain at least 100 feet on rivers, inlets and navigation channels, and 300 feet on other waters. A vessel that enters the applicable distance must proceed no faster than necessary to maintain headway and steerageway, with a statutory exception for law-enforcement and rescue vessels.

Is the Illinois distance 100 feet or 150 feet?

The Illinois boating handbook states 150 feet for vessels not engaged in diving operations. Do not substitute another state’s 100-foot figure; consult the current Illinois boating materials for the rule applicable where you will operate.

Does a diver-down flag have to be a particular size?

Requirements can vary by jurisdiction. Florida law specifies construction and display requirements for a diver-down flag or buoy, but the state examples do not establish one specification that complies everywhere. Check the applicable local rule before buying or displaying a flag.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

What should I do if I see the flag but cannot tell how far away I am?

Treat it as a warning that divers may be underwater, identify the local clearance rule and keep clear of the site. The cited sources use different reference points, including an area, vessel or diving site, so apply the wording used by the relevant state authority. Florida also has a specific speed requirement for vessels inside its stated distances.

When can the diver-down flag or buoy be taken down?

The Florida statute says the device must be lowered once all divers are aboard or ashore. The examples here do not establish a universal removal rule for other states, so check the applicable local requirements.

The Bottom Line

There is no universal U.S. clearance distance: the official examples range from 100 to 150 feet, and Florida requires 100 feet on rivers, inlets and navigation channels or 300 feet on other waters. Check the current rule for your state and waterway, including any speed and flag-display requirements.
