Under the U.S. Export Administration Regulations (EAR), an item is not controlled simply because someone calls it an “advanced chip” or a “semiconductor tool.” Classification starts with the item’s technical characteristics and the current Commerce Control List (CCL); a separate licensing analysis considers destination, parties, end use, jurisdiction, and—in some cases—U.S.-person activity. The result depends on the exact item and transaction, not its marketing name.
What export classification does—and does not—tell you
The EAR, administered by the Bureau of Industry and Security (BIS), uses Export Control Classification Numbers (ECCNs) to describe items on the CCL. An ECCN may cover a physical item, software, or technology. The classification identifies the relevant control entry and its characteristics; it does not, by itself, answer whether a particular export, reexport, transfer, service, or other activity requires a license.
That distinction matters for both chips and the equipment used to manufacture them. Two items with similar names may have different specifications or design purposes and therefore require different classification analyses. Conversely, knowing an ECCN does not settle the licensing question: destination, end user, end use, party status, ownership or headquarters, jurisdiction, and applicable exceptions can all affect the result.
This article describes U.S. EAR/BIS controls, using agency and regulation material checked October 10, 2026. It is a framework for understanding the process, not an item-level classification or licensing determination. The current operative text can change; for an actual transaction, verify the live EAR and get qualified export-control advice.

How to classify a chip or semiconductor tool
Use the following sequence rather than starting with a product label or a presumed destination restriction.
- Define the item. Record the exact model and configuration, technical specifications, design purpose, manufacturing origin, and whether the item is a chip, computer or assembly, manufacturing equipment, component, software, or technology. Identify associated software and technology where relevant.
- Compare the item with the current CCL. Review the potentially applicable ECCN text, technical parameters, and notes. Do not infer a classification from a name, marketing description, or a broad label such as “AI chip” or “wafer tool.” The precise thresholds for every ECCN are not set out here; use the current entry itself.
- Determine whether the item is subject to the EAR. Establish origin and jurisdiction, then assess whether a foreign-produced item may be covered by a foreign-produced direct product (FDP) rule. Apply the exact rule’s product, technology or software, destination, and end-user criteria.
- Assess the transaction. Check the destination and current country groups, all parties and relevant ownership or headquarters information, restricted-party status, intended end use, and any relevant facility. These factors can trigger licensing requirements independent of the item’s ECCN.
- Consider related activity and exceptions. Determine whether U.S.-person activity is regulated and whether an exception’s specific ECCN, destination, end-user, end-use, notification, reporting, and other conditions are satisfied.
BIS’s current EAR materials direct exporters to the classification resources and regulations for this work. A classification should be supported by the item’s actual technical information and a reasoned comparison to the controlling entry, rather than by an unsupported assumption based on product category.
Which ECCNs are relevant to advanced chips?
ECCN 3A090 and related advanced-computing classifications
ECCN 3A090 is a central classification in the advanced-computing controls. The rules also refer to other enumerated classifications, including in the provisions governing license requirements and exceptions. The proper entry depends on the item’s technical attributes and the applicable ECCN text. The material summarized here does not provide every 3A090 threshold or every related ECCN, so it would be misleading to assign a particular chip to 3A090 from a product description alone.

Classification also depends on what is being exported. A chip shipped by itself is not necessarily analyzed the same way as a computer or assembly incorporating it. Identify the object of the transaction and apply the CCL text that describes that object; consider associated software and technology separately where the rules require it.

Equipment and components require their own analysis
Semiconductor manufacturing equipment controls are distributed across equipment ECCNs, rather than one universal entry for every tool. A component or part may have its own classification and can also raise licensing questions because of its destination or intended incorporation. Do not assume that a tool, part, or software inherits the chip’s ECCN—or that a part is uncontrolled simply because it is not a complete machine.

What happened to ECCN 3B090?
BIS’s 2023 semiconductor manufacturing equipment rule removed ECCN 3B090 and placed certain controls on semiconductor manufacturing equipment alongside similar equipment in existing ECCNs, including 3B001. BIS explained that aligning controls with related classifications supported compliance and enforcement. The rule directed exporters to use updated classifications for export clearance after its effective date, subject to the rule’s license and transition provisions.
As a result, an old internal record, supplier document, or classification reference that says “3B090” is not enough to classify a current shipment. Recheck the current CCL and the applicable transition or licensing provisions. The former number is useful historical context, not a substitute for today’s entry.

After classification, evaluate the transaction against the EAR’s destination, end-user, and end-use controls. BIS identifies covered advanced-computing items destined to an entity headquartered in Macau or in a Country Group D:5 destination as subject to a license requirement. The described rule also reaches an entity whose ultimate parent is headquartered in one of those destinations, even if the entity itself is located elsewhere. This is a specific control, not a rule that every chip export to every destination has the same outcome.

Check the relevant EAR provisions, including §§ 742 and 744, against the exact ECCN and transaction. Verify the current country groups, the parties and their relevant ownership or headquarters, restricted-party status, intended use, and facility. The fact that an item has a known ECCN does not make these checks optional; nor does the destination alone establish the result without the item and transaction facts.
End-use analysis can reach semiconductor development or production involving advanced-node integrated circuits. The equipment, the facility, and what the item will enable can therefore matter alongside the chip itself. BIS’s rules and guidance also address specified activity by U.S. persons in connection with certain PRC/Macau facilities, as described below.
Can U.S. controls cover a foreign-made chip?
Yes, in some circumstances. A foreign-produced item can be subject to the EAR under an applicable FDP rule when the rule’s specified technical or product relationship and destination or end-user criteria are met. The fact that a chip was manufactured outside the United States does not automatically put it outside U.S. export controls.

That does not mean every foreign-made chip is covered. The result depends on the exact FDP rule and its conditions, including the product, technology or software, destination, and end user as applicable. Determine jurisdiction using the current EAR § 734 material; do not substitute a general assumption about manufacturing location for that analysis.

When parts and facility details change the analysis
Parts intended for PRC equipment
BIS’s April 2024 announcement clarified that parts and components exported for ultimate incorporation into indigenous PRC semiconductor manufacturing equipment require a BIS license for the initial export. The practical point is narrow but important: exporting a part rather than a complete machine does not, by itself, eliminate the license question. Determine the part’s classification, destination, and intended incorporation and review the operative provisions for the transaction.
What counts as a facility in BIS FAQ guidance
A BIS FAQ describes a semiconductor fabrication facility as a building where production at the restricted technology level takes place. In that FAQ, later assembly, test, or packaging facilities that do not alter technology levels are not covered by that definition. It treats each building as a separate facility but recommends due diligence where buildings share a campus, address, or legal entity.
This is interpretive FAQ guidance, not a replacement for the operative EAR text. The location and function of the specific building matter; a shared corporate identity or campus does not, on its own, establish that every building has the same status. Verify the current rule and the facts of the intended end use.

The controls are not limited to sending a U.S.-origin item across a border. BIS’s FAQ describes specified U.S.-person activities that may require authorization in connection with certain PRC/Macau facilities, including authorizing or delivering certain items not subject to the EAR for use in development or production there, and servicing items at those facilities.

The FAQ also states that the specified RS controls on the identified ECCNs do not apply to deemed exports or deemed reexports, while AT controls can still make a license necessary for specified persons from Iran, North Korea, or Syria. These are qualified statements about particular controls and circumstances, not a general exemption from U.S.-person restrictions. The FAQ dates from 2023, so check its interpretation against current provisions before relying on it. Identify the activity, item, location, parties, and applicable control reason rather than assuming that a service or support task is outside export-control review.
When can an exception apply?
The EAR provides exceptions, but none should be treated as a blanket authorization for advanced chips or semiconductor equipment. Eligibility is tied to the relevant ECCNs, destination, end users, end uses, and other conditions in the current text.
- NAC and ACA: EAR § 740.8 describes provisions for specified ECCNs and destinations or conditions.
- ACM: EAR § 740.28 describes a provision for eligible items and defined private-sector end users and uses.
Before relying on any exception, confirm every eligibility term, exclusion, and applicable reporting or notification duty in the current regulation. A named exception is not proof that a particular shipment qualifies, and an exception analysis comes after establishing the item, jurisdiction, and transaction facts.
What changed recently, and what should be checked now?
BIS’s homepage, checked October 10, 2026, links guidance on advanced-computing items dated May 2026. It also reports that an April 7, 2026 rule extended through December 31, 2026 the timeline for certain companies to qualify as authorized integrated-circuit designers, allowing additional time for applications and processing. The extension applies to the described timeline; it is not a general change to every chip classification or license requirement. Consult the guidance and rule for their exact scope.
The current EAR § 742.6 source was identified as current from the eCFR as of October 7, 2026. Because ECCN text, country groups, guidance, and authorizations can change, confirm that the version used for a real decision is current on the date of the transaction.
