Data center tax incentives are state- and sometimes locally created benefits, not a single nationwide program. They most often exempt qualifying equipment from sales or use tax, but some also cover energy, offer property tax relief, or provide a tax credit. Whether a project qualifies depends on the jurisdiction’s current rules—including investment, jobs and wages, facility characteristics, eligible purchases, application timing, and continuing compliance.
What a data center tax incentive does
An incentive reduces or removes a specified tax for an eligible project. The most common form is a sales or use tax exemption on defined equipment. If approved, the business—or, in some programs, its contractor—presents an exemption certificate so qualifying purchases are made without the covered tax. The certificate does not automatically exempt every item bought for the project: the program determines which property, purchasers, and taxes are included.
Some programs extend beyond equipment. Indiana’s economic development agency describes an exemption covering qualifying equipment and energy, while some Indiana local governments may also exempt qualifying enterprise IT personal property. Other jurisdictions may provide property tax relief or a credit. Maryland’s exemption is used at the time of purchase; Illinois’s former program included a separate construction-worker wage credit as well as exemptions. These benefits are not interchangeable: an exemption at checkout, a property tax reduction, and a credit claimed under a program have different eligibility and administration rules.
Do these 3 things before closing this tab:
1Clear out junk files and repair common Windows errors2Fix the driver behind crashes, sound loss and screen glitches3Repair Windows errors before they cause bigger problemsState and local taxes must be checked separately. Texas, for example, says its data center exemption covers the 6.25% state sales tax, while applicable local sales or use tax remains due. A state benefit therefore should not be read as a blanket tax-free status for the facility.

There is no national eligibility test
At least 38 states offer preferential tax treatment specifically targeting data centers, according to the Washington Joint Legislative Audit and Review Committee’s 2026 tax preference review. That does not mean 38 states use the same terms, or that every program is open to new applications. States set their own definitions, tax scope, thresholds, application processes, and compliance conditions; local provisions may add another layer.
Common eligibility questions include who is applying (owner, operator, tenant, or another party), where the facility is located, what kind of facility or project it is, how much and what type of investment is committed, how many qualifying jobs will be created, and when construction or purchases begin. Programs may also specify wages, job retention, facility size, utility arrangements, water practices, or the kinds of property that qualify. Thresholds in one state are examples, not a universal checklist.

How selected state programs differ
The examples below illustrate why a project must be checked against the specific program and current law. They are not a list of universally available incentives. Program terms can change, and an advertised benefit or past application is not proof that a new project can still apply.
| Jurisdiction | Key eligibility terms in the cited program | Benefit and important limits |
|---|---|---|
| Texas | For the ordinary qualifying data center route, the owner, operator, or occupant must jointly or independently commit to at least $200 million in capital investment over five years and at least 20 qualifying county jobs. A separate large-project route requires at least 250,000 square feet and its own commitments of $500 million and 40 jobs. | The ordinary exemption lasts 10 years, or 15 years with at least $250 million in investment. The separate large-project route provides a 20-year period. Jobs must be retained for five years; the state exemption does not cover applicable local tax. Specified facilities with former Chapter 313 value-limitation agreements are excluded. |
| Maryland | Facility must be in Maryland. Within three years of applying, a project must invest at least $2 million in qualified personal property in a Tier 1 area, or $5 million elsewhere, and create five qualifying jobs. Jobs must be full-time, newly created, not transferred from another Maryland facility, filled for at least 12 months, and pay at least 150% of the state minimum wage. The agency lists that minimum qualifying wage as $22.50 per hour for 2026. | Benefit is 10 years, extended to 20 years after at least $250 million in qualifying investment within 10 years, subject to annual renewal and job maintenance. Application must come before project start; purchases before certification and issuance of the exemption certificate do not qualify. |
| Kansas | Application and commitment to at least $250 million in eligible data center costs, completed by the fifth year of operations. Construction must begin within 10 years of the state agreement. The project must commit to 10 years of electricity purchases from the certified local retail utility and follow water conservation, reuse, and replacement practices. | An approved firm enters into an agreement with the Secretary of Commerce. The cited statutory subsection does not state a universal jobs threshold. |
| Indiana | Eligibility depends on qualifying investment and program terms; the Indiana economic development agency describes an equipment-and-energy exemption. Local property relief may depend on a separate local government decision and facility investment. | The described exemption period is no more than 25 years for investments below $750 million, and up to 50 years when investment exceeds $750 million. Local personal property relief may be available for qualified enterprise IT equipment when facility investment is at least $25 million. |
| Illinois | The published terms describe a former program for new or existing centers and tenants collectively investing at least $250 million over 60 months and creating 20 new full-time or equivalent operations/maintenance jobs paying at least 120% of county median wages. | Illinois DCEO says it ceased processing applications on July 1, 2026. These are published terms and program history, not an open route for new applicants. |
The descriptions come from the Texas Comptroller and Texas Tax Code; Maryland Department of Commerce; Kansas Legislature; Indiana Economic Development Corporation; and Illinois Department of Commerce and Economic Opportunity. Their thresholds should be confirmed against current agency guidance and statutes before a project relies on them.

What the thresholds mean in practice
Investment is often measured over a defined period
A headline investment minimum is incomplete without its deadline and definition. Texas’s ordinary route, for instance, measures a capital commitment over five years, while Maryland requires a specified amount of qualifying personal property within three years of applying. Kansas sets an eligible-cost commitment to be completed by the fifth year of operations and separately limits when construction must begin after the state agreement. Confirm which expenditures count, when the clock begins, and whether the figure is committed, incurred, or both.
Jobs may have location, wage, and retention tests
Job counts are not necessarily a simple headcount. Texas refers to qualifying county jobs and requires five-year retention. Maryland requires five new positions that are full-time, not transferred from another in-state facility, held for at least 12 months, and paid at least 150% of the state minimum wage. Illinois’s published former-program terms used a different test: 20 full-time or equivalent new operating or maintenance jobs at 120% of county median wages. Do not substitute one state’s definition of a qualifying job for another’s.

Facility and infrastructure conditions can matter
Some programs distinguish a new facility from a refurbishment, set a minimum size, restrict eligible parties, or specify equipment categories. The Texas large-project route has a 250,000-square-foot condition. Kansas includes electricity procurement and water conservation, reuse, and replacement commitments. Washington JLARC’s 2026 review notes that states vary in whether preferences cover items such as security systems, electricity, or construction materials. A project’s servers alone may not define the eligible cost base or the full scope of its tax benefit.

- Identify the exact jurisdiction and administrator. Check the state and any relevant local government where the facility and purchases will be located. Find the current statute, program rules, and administering agency rather than relying on a general summary or an incentive announcement.
- Confirm the applicant and eligible project. Determine whether the owner, operator, tenant, contractor, or another entity can apply and purchase under the program. Do not assume an affiliate or contractor qualifies because the facility itself does.
- Map each tax and purchase category. Ask whether the benefit covers state sales/use tax, local sales/use tax, real or personal property tax, energy, servers, power infrastructure, construction materials, or only specified property. Record exclusions as carefully as inclusions.
- Translate thresholds into a dated project plan. Document the required investment amount and eligible cost definition, the deadline to reach it, job count and qualifications, wage floor, retention period, and any location, size, utility, or water commitments.
- Resolve timing before construction and procurement. Find out when an application must be submitted, when approval or certification takes effect, and what document a seller needs. Maryland explicitly excludes purchases made before certification and issuance of its exemption certificate; applying after orders or project start can therefore leave purchases outside the benefit.
- Plan records and ongoing compliance. Keep invoices, exemption certificates, investment ledgers, job and wage records, and evidence of utility or water commitments. Follow program rules for annual renewal, reporting, audits, and record retention. A benefit may be revoked or lost if commitments are not met.
Why approval is not the end of the process
Some incentives require continuing performance, not just an eligible application. Maryland requires annual renewal and maintenance of five qualifying jobs throughout the benefit period. Texas requires registration and a certificate showing relevant registration numbers; the Comptroller verifies investment and job commitments and may revoke certification when they are not met. The precise reporting, audit, and retention rules belong to each program, so the project should assign responsibility for them throughout the facility’s incentive term.

Noncompliance can affect the benefit even after purchases have been made. The terms may make eligibility conditional on meeting investment or employment commitments, maintaining jobs, submitting renewals, or preserving required documentation. Before approval, clarify what happens if a project misses a threshold, changes ownership, phases construction, relocates jobs, or revises its equipment schedule. Do not assume a benefit is permanent simply because a certificate was issued.
Why current-law checks are essential
Incentive programs are volatile. Illinois DCEO reports that it stopped processing applications on July 1, 2026. Washington JLARC’s 2026 review says the Legislature narrowed exemptions for refurbishment and replacement server equipment, and Minnesota repealed a data center energy sales-tax exemption in 2025. These examples show why a previously valid description may not apply to a new project.
Washington JLARC also estimated that purchases associated with its urban preference rose from $40.6 million in fiscal year 2023 to $141.7 million in fiscal year 2026, using beneficiary savings and a combined state/local rate just over 10%. The report cautions that attribution to the exemption is uncertain, so those figures are not a definitive estimate of purchases caused by the preference. They illustrate the scale of reported activity, not a forecast for another jurisdiction or project.
For a real site decision, verify the applicable statute and agency rules as of the application and purchase dates. A tax adviser or qualified state/local tax counsel can assess the project’s legal entity structure and procurement plan; the administering agency can clarify the program’s process. Neither a local abatement nor a utility arrangement should be treated as equivalent to a state exemption.
