Data center operators evaluate a long-term power deal and a powered site as two connected—but separate—commitments. A contract can set an energy price or supply obligation without proving that the local grid can deliver the required megawatts, when the facility needs them, or at what upgrade cost. Sound diligence therefore joins commercial review with utility interconnection, transmission and distribution studies, permitting, land control, resilience, and execution risk.

The framework below is grounded in U.S. Department of Energy guidance and announcements. State, local, utility, and organized-market rules can differ, so every conclusion about a parcel or contract must be confirmed with the serving utility, grid operator, regulators, counterparties, and local authorities.

What operators must prove before committing

A credible commitment answers six practical questions: Can the site receive the required power? When can it be energized? What will the complete delivered cost be? Will supply remain firm during contingencies? Can the facility meet its operating profile and resilience targets? Are land, permits, approvals, and counterparties ready to execute?

DOE materials separate these issues rather than treating a power-purchase agreement (PPA) as a guaranteed physical connection. The utility or grid operator must still identify an interconnection point, available capacity, required studies, network upgrades, cost allocation, and a schedule that can survive review and construction.

How do I know a site can actually get the power a data center needs?

1. Identify the physical serving arrangement

Name the serving utility, balancing authority or regional transmission organization, proposed substation, and point of interconnection. Confirm whether the load will connect to transmission, distribution, or a combination. Ask for the governing tariff, interconnection procedures, queue position (if any), study stage, and the assumptions used for available capacity.

2. Establish deliverable capacity, not a headline number

Separate the site’s requested peak megawatts from the amount the system can deliver under normal and contingency conditions. Request the utility’s written view of firm capacity, interim capacity, fault-duty or protection constraints, and any limits caused by neighboring projects. A landowner’s statement that “hundreds of megawatts are nearby” is not evidence of an allocated or deliverable service amount.

3. Map every upgrade and dependency

List transformer, substation, transmission, distribution, protection, telecom, and substation-control work. For each item, record the responsible party, engineering status, estimated cost, permitting dependencies, procurement lead time, outage requirements, and whether other queued customers must proceed first. DOE’s federal contracting checklist specifically directs agencies to consult the utility about interconnection costs and timelines.

4. Test the schedule against gates

Build a critical-path schedule from application and studies through executed interconnection agreements, permits, equipment orders, construction, testing, and commercial operation. Mark which dates are estimates, which are contractual milestones, and which depend on a regulator or another customer. “Power available in 2028” is not decision-grade unless the schedule explains what must happen before that date and what happens if a study or permit slips.

5. Confirm tariff consequences

Ask whether the proposed load qualifies for an existing tariff, requires a special contract, or could trigger a new large-load or data-center tariff. Determine demand charges, time-of-use variation, minimum bills, standby charges, power-factor requirements, curtailment provisions, and security or contribution-in-aid-of-construction requirements. DOE guidance warns that rates can vary by time of use and that a project can qualify for or trigger a different tariff.

What should a data center power purchase agreement cover?

A PPA or other long-term power agreement should describe the commercial energy arrangement precisely while acknowledging that physical service depends on separate utility and grid documents.

  • Product and quantity: Define energy, capacity, renewable attributes if applicable, delivery point, shaping, losses, and whether the obligation is baseload, firm, or interruptible.
  • Price mechanics: State fixed, indexed, escalator, or market-set components; time-of-use treatment; congestion or loss adjustments; credit requirements; and settlement intervals.
  • Term and milestones: Tie commencement to objective tests such as interconnection approval, energization, and commercial operation. Include long-stop dates and termination rights if those milestones fail.
  • Physical-delivery conditions: Identify the interconnection agreement, transmission service, metering, scheduling coordinator, outage rules, and curtailment hierarchy. The PPA should not imply that it itself grants queue position or network capacity.
  • Change allocation: Assign responsibility for utility upgrades, taxes, regulatory changes, tariff changes, environmental compliance, fuel or water constraints, and force-majeure events. Require notice, mitigation, and transparent cost records.
  • Performance and remedies: Set availability, delivery, replacement-power, shortfall, imbalance, damages, and credit-support terms. Define how planned and forced outages are measured.
  • Exit and transfer: Cover assignment to a financing vehicle or successor operator, change of control, early termination, stranded-cost payments, and treatment of attributes or equipment at expiry.

Have counsel reconcile the PPA with the utility tariff, interconnection agreement, transmission service, land instruments, and financing documents. A favorable energy price can be overwhelmed by upgrade contributions, demand charges, delay exposure, or a tariff change.

Compare firmness, resilience, and the supply portfolio

DOE notes that data centers often need firm power, but it does not prescribe one technology mix. Evaluate the grid supply together with any on-site generation, storage, efficiency, and demand-response resources.

Firmness and redundancy

Define the operating requirement: continuous load, acceptable interruption duration, ride-through performance, and maintenance strategy. Distinguish utility “firm” service from a facility’s own resilience design. Dual feeds, geographically separate substations, UPS systems, generators, storage, and fuel logistics solve different failure modes and should not be treated as interchangeable.

Portfolio options

DOE’s resource overview identifies clean generation and storage, existing nuclear and hydropower, redevelopment of retired coal sites, grid expansion, efficiency, demand resources, tariff design, financing, and interconnection or regulatory reform. These are options for analysis, not a ranking or guarantee that any resource is available at a particular site. Test fuel, water, emissions, staffing, land, interconnection, and duration constraints for every proposed resource.

Resilience evidence

Request historical outage information, transmission-contingency studies, restoration assumptions, black-start or islanding capability where relevant, and maintenance plans. Require the developer to state which resilience claims are engineered, which are contractual, and which depend on future construction.

Translate “flexible load” into operating requirements

Flexibility can reduce cost or interconnection pressure, but only if the computing workload can respond within an agreed window without violating service-level commitments. DOE’s 2024 flexibility taxonomy provides a practical checklist.

  • Location: Can jobs move between regions, campuses, or availability zones, and what latency limits apply?
  • Magnitude and shape: What is the minimum, normal, ramping, and maximum demand? How do training, inference, cooling, and batch workloads change the curve?
  • Response: How quickly can load change, how much notice is needed, how long can a reduction last, and how often can it be called?
  • Local resources: Record generation and storage type, capacity, fuel constraints, state of charge, and duration.
  • Trigger: Identify the price signal, dispatch instruction, emergency rule, or contractual event that activates a response.
  • Control: Specify what the facility operator controls and what computing customers, cloud tenants, or aggregators control.

Put these parameters into the tariff, service agreement, or operating procedures. A vague promise to “curtail when needed” is not a bankable flexibility product.

Site readiness extends beyond electricity

Power cannot be delivered to land the operator cannot control or permit. Verify title or lease term, easements, access roads, construction laydown, water and wastewater, fiber routes, fuel access, and security requirements. Record renewal rights and conditions that could interrupt a multi-decade operating plan.

Screen federal, state, and local environmental obligations, including historic-preservation review where applicable. Map zoning, building, air, water, noise, wetlands, endangered-species, and emergency-management approvals. DOE contracting materials explicitly point to site-access instruments and federal environmental review considerations.

Use a consistent comparison when choosing sites or offers

When two sites or supply offers appear comparable, score evidence rather than marketing language. The following axes synthesize DOE guidance; there is no universal weighting formula.

Decision axis Questions to document
Deliverable MW and interconnection certainty What capacity is studied, contracted, and physically available? At which point and under which contingencies?
Energization schedule Which studies, upgrades, permits, equipment, outages, and third parties control the critical path?
Full cost What are energy, capacity, demand, transmission, losses, tariff, upgrade, security, and delay costs?
Firmness and resilience What redundancy, storage, generation, fuel, and restoration capabilities are engineered or contracted?
Flexibility What load can move, at what speed and notice, under whose control and with what compensation?
Site readiness Are land, water, fiber, environmental reviews, zoning, construction access, and stakeholder plans complete?
Approval and counterparty risk Is the item announced, solicited, selected, proposed, executed, approved, under construction, or operating?

Separate announcements from enforceable commitments

Status language matters. An announced plan is not a selected site; a selected site is not an executed agreement; an executed agreement may still require regulatory approval; and an approved project is not an operating facility.

DOE’s July 24, 2025 announcement selected four federal locations—Idaho National Laboratory, Oak Ridge Reservation, Paducah Gaseous Diffusion Plant, and Savannah River Site—to advance plans for data-center and energy-generation projects. It described future solicitations and planning, not four operating campuses. Secretary Chris Wright said, “These sites are uniquely positioned to host data centers as well as power generation to bolster grid reliability, strengthen our national security, and reduce energy costs.” That is the Secretary’s view in the announcement, not an independent finding about each site.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

In a July 29, 2026 Paducah announcement, DOE named Brookfield, NextEra Energy, Big Rivers Electric Power Corporation, Jackson Purchase Energy Cooperative, and Paducah Power System in a proposed site and energy-infrastructure partnership. DOE described more than $100 billion in expected private investment, approximately 8,000 expected construction jobs, and 600 expected permanent jobs. Those are project-specific announced estimates, not verified realized outcomes. DOE also stated that the power service agreement remained subject to Kentucky Public Service Commission approval.

Watch the policy environment

DOE announced on June 18, 2026 that FERC issued parallel show-cause orders directing each of six regional grid operators under its jurisdiction to justify or reform tariffs for data centers and other large energy users. This is a live proceeding, not a settled nationwide tariff rule. A project’s economics can change as regulators examine cost allocation, service conditions, and large-load treatment.

DOE also presents grid-modernization aims of decision-making 20–100 times faster and at least a 10% improvement in electricity cost and reliability. The program page does not establish a publication year for those figures, and they are stated as aims rather than measured outcomes. Do not use them as a forecast for a particular site.

A diligence sequence that produces a defensible commitment

  1. Define the load: Create hourly and seasonal demand cases, peak and minimum MW, ramp rates, power quality, latency limits, and resilience targets.
  2. Obtain utility and grid evidence: Secure written interconnection, capacity, study, upgrade, tariff, and schedule information.
  3. Model delivered economics: Combine energy and capacity prices with demand, transmission, losses, upgrade contributions, standby, curtailment, and delay scenarios.
  4. Test supply and flexibility: Model grid contingencies, on-site resources, storage duration, fuel constraints, and workload response under normal and emergency conditions.
  5. Verify site control and permits: Confirm land instruments, environmental and historic reviews, zoning, water, fiber, access, and stakeholder responsibilities.
  6. Align documents: Reconcile the PPA, tariff, interconnection and transmission agreements, construction contracts, leases, financing, and operating procedures.
  7. Record approval gates: Label every claim as proposed, selected, executed, approved, under construction, or operating, with an owner and date for the next decision.
  8. Set walk-away triggers: Define maximum delivered cost, latest energization date, acceptable curtailment, minimum redundancy, and conditions that require renegotiation or termination.

Common failure modes

  • Confusing a PPA with capacity: Fix it by requiring a separate interconnection and deliverability file.
  • Using nameplate generation as firm supply: Apply outage, fuel, weather, storage-duration, and transmission-contingency assumptions.
  • Ignoring tariff change: Obtain the current tariff and model proposed or likely large-load treatment without assuming approval.
  • Believing a single schedule: Maintain a dependency-based critical path with utility, regulator, equipment, and permitting owners.
  • Calling a proposal operational: Publish the exact status and approval condition beside every project claim.
  • Leaving flexibility undefined: Quantify MW, duration, notice, frequency, trigger, compensation, and control.

The decision is ready only when commercial terms, physical deliverability, site readiness, resilience, flexibility, and approvals tell the same story. If any one remains an unverified assumption, treat it as commitment risk rather than available power.
