For U.S. federal elections, the Federal Election Commission (FEC) says a campaign may receive bitcoin as a contribution. The donation is still subject to ordinary federal rules: the campaign must identify and assess its source, apply the limit for the donor and recipient, value the bitcoin when received, report it as directed, and return or refund it if it is prohibited, excessive, or otherwise unlawful. The FEC’s operational instructions cited here concern bitcoin—not every cryptocurrency—and do not establish rules for state or local elections.

Can I donate bitcoin to a political campaign?

For a federal election, yes: the FEC says a political committee may receive bitcoin as a contribution. The Commission explains that the Federal Election Campaign Act (the Act) covers a gift or other thing of value made to influence a federal election. In Advisory Opinion 2014-02, the Commission concluded that bitcoins are “money or anything of value” under the Act. The FEC summarizes that conclusion in its bitcoin contribution guidance.

That answer is specifically about bitcoin and federal campaign-finance rules. It does not establish that every token, payment intermediary, or custody arrangement receives identical treatment. Nor does it decide whether a state or local candidate may accept a particular cryptocurrency. Those questions require the applicable jurisdiction’s rules and, for a novel arrangement, fact-specific guidance.

Calling a transfer a crypto donation does not make it a separate category outside campaign-finance law. The relevant questions remain who supplied the value, who received it, which election it supports, and whether the contribution complies with applicable restrictions and reporting requirements.

How does a federal campaign handle bitcoin when it arrives?

Value it at receipt

The committee values a bitcoin contribution at the bitcoin’s market value when the committee receives it. The valuation point is receipt, not a later sale or transfer. The FEC’s instructions do not make the contribution’s compliance status depend on whether the committee converts it to cash.

For example, if a committee receives bitcoin and holds it rather than selling it immediately, the contribution still has a value for campaign-finance purposes at receipt. A later change in the bitcoin’s price does not alter the fact that the initial contribution must be accounted for under the applicable rules. The committee should retain the information needed to report the amount and document the bitcoin quantity and whether it was later liquidated, as the FEC recommends.

Holding it in a wallet does not suspend compliance duties

The FEC says a committee may hold received bitcoin in a bitcoin wallet until liquidation. That describes a permissible way to hold the asset; it is not an exemption from source restrictions, contribution limits, or refund obligations. If a contribution is from a prohibited source, exceeds the applicable limit, or is otherwise unlawful, the committee must return or refund it even if it remains in a wallet.

The FEC’s guidance addresses bitcoin. Do not assume that a wallet’s custody model, a third-party processor, or the use of a different token changes who made a contribution or how the committee should treat it. The general principle is that the transfer mechanism does not by itself resolve the legal source or compliance status.

Are crypto donations legal in U.S. elections?

For federal elections, the FEC’s bitcoin guidance permits receipt of bitcoin as a contribution, subject to the same federal contribution framework that applies to other forms of value. The practical answer is therefore conditional: a bitcoin donation is not automatically lawful simply because the FEC recognizes bitcoin as value, and it is not automatically unlawful merely because it is made in bitcoin. Its legality depends on the donor, recipient, election, amount, and other applicable requirements.

The FEC identifies several prohibited sources under federal law. These include foreign nationals, corporate treasuries, labor organizations, and federal government contractors, subject to distinctions and specific exceptions in the rules. Contributions made in the name of another person are also prohibited. The FEC’s source eligibility guidance explains who can and cannot contribute.

These restrictions apply to the underlying contribution, not just the payment rail. A crypto address, wallet, or transfer record does not establish that the funds came from a permissible donor. Likewise, a transfer routed through another person does not make that person the true source if someone else supplied the value. The federal ban on contributions in another person’s name is one reason not to treat apparent wallet or account information as a substitute for source review.

Corporate rules have distinctions, including the possibility of contributions through permissible separate segregated funds in situations allowed by law. That distinction is not the same as permission for a corporation to contribute from its treasury. Donors and committees should consult the FEC’s current rules for the specific contributor and recipient rather than generalize from the fact that a corporate-associated committee may be permitted to contribute.

What contribution limits apply to bitcoin donations?

The crypto label does not create a separate federal contribution limit. Limits depend on the donor, recipient, and election cycle. The FEC’s chart for the 2025–2026 cycle lists an individual’s limit to a candidate committee as $3,500 per election. That is a per-election limit for the specified donor-recipient category and cycle, not a universal limit for all cryptocurrency gifts or all political committees.

The FEC also publishes separate limits for PAC and party committee recipients. The applicable amount can differ with the recipient and contributor category, so do not use the candidate-committee figure for a PAC or party committee. Before relying on a number, identify the donor type, the committee receiving the contribution, and the election involved, then check the FEC’s contribution-limit chart for the relevant cycle.

“Per election” matters: the figure is not a blanket amount that can be applied without identifying the election. The limit is also cycle-sensitive, so a figure for 2025–2026 should not be carried forward to a later cycle without checking the chart again. A bitcoin’s value for this purpose is its market value when received, which is the figure the committee must evaluate against the applicable limit.

For a donor, the useful check is not simply “How much bitcoin am I sending?” It is “What is the contribution’s value when received, who is receiving it, which election is it for, and what limit applies to my donor category?” For a committee, those same details matter in deciding how to record the receipt and whether it may be accepted or must be returned or refunded.

How do campaigns report bitcoin donations?

The FEC treats the initial receipt of bitcoin in an in-kind style: the committee reports the contribution and makes an offsetting disbursement entry. The entries allow the receipt and the bitcoin held outside the committee depository to be reflected in the report while reported cash on hand remains unchanged during that holding period. This is a reporting method for the bitcoin receipt, not a statement that the committee has spent the bitcoin on an ordinary campaign expense.

For PAC and party committee reporting on Form 3X, the FEC specifies which Schedule A line to use according to who contributed:

Contributor to a PAC or party committee Form 3X Schedule A line
Individual Line 11(a)
Party committee Line 11(b)
Another type of political committee Line 11(c)

The FEC recommends a memo notation recording the number of bitcoins received and whether they were liquidated. That detail helps distinguish the asset received from any later conversion. The committee should use the applicable reporting guide for its committee type; the Form 3X line instructions above should not be generalized to every kind of committee.

For the current bitcoin-specific reporting example and its instructions, see the FEC’s bitcoin contributions page. The FEC also provides general information about contributions and in-kind treatment. Reporting details matter because the committee has to show the receipt and the corresponding entry even while the bitcoin remains held rather than converted.

What should a donor check before sending bitcoin?

  1. Confirm the election and jurisdiction. This explanation concerns federal elections. State and local rules are jurisdiction-specific; the federal bitcoin guidance does not establish what those jurisdictions allow.
  2. Identify the recipient committee. Candidate committees, PACs, and party committees are not interchangeable for limit or reporting purposes. Confirm which committee will receive the contribution.
  3. Check that the true source is eligible. Federal restrictions include foreign nationals, corporate treasuries, labor organizations, federal government contractors, and contributions in another person’s name, with distinctions and specific exceptions in the law.
  4. Determine the applicable limit. Use the current FEC chart for the donor type, recipient, election, and cycle. For bitcoin, the committee’s valuation is based on market value when received.
  5. Use the committee’s stated contribution process. The FEC’s bitcoin guidance establishes that a committee may receive bitcoin, but it does not prescribe one universal wallet, processor, or donor procedure for every committee.

This checklist cannot determine the legality of a complicated source or transfer arrangement. For a donation involving an intermediary, a disputed beneficial source, or a token other than bitcoin, do not infer an answer from the fact that a committee can accept bitcoin under the cited federal guidance.

Can a campaign keep a crypto donation in a wallet?

For bitcoin, the FEC says a political committee can receive it and hold it in a bitcoin wallet until liquidation. Holding it rather than converting it immediately does not remove the contribution from campaign-finance reporting or compliance obligations. The committee reports the initial receipt under the FEC’s instructions and must return or refund a prohibited, excessive, or otherwise unlawful contribution.

The guidance is about bitcoin and does not settle every custody question. A committee considering another token or a materially different arrangement should not assume that the bitcoin instructions apply unchanged. The FEC’s own materials emphasize that advisory opinions answer specific factual questions, so a novel setup may need its own legal analysis.

Can a foreign national donate cryptocurrency to a U.S. campaign?

Federal law prohibits contributions from foreign nationals to federal campaigns. The ban applies regardless of whether the contribution is made in dollars or in bitcoin; changing the payment form does not make a prohibited source permissible. The FEC lists foreign nationals among prohibited contributors in its source guidance.

A transfer’s appearance in a wallet does not, by itself, prove who provided the funds. The federal rules also prohibit contributions made in another person’s name. A donor or committee should not treat an address, platform account, or intermediary as proof that the underlying source is eligible when the actual source is uncertain.

Do these rules apply to every cryptocurrency and every U.S. election?

Bitcoin and other tokens

The operational FEC guidance discussed here is specifically for bitcoin. The Commission’s conclusion in Advisory Opinion 2014-02 concerns bitcoins as “money or anything of value” under the Act, and the current reporting instructions describe bitcoin receipts. That is a basis for the bitcoin explanation in this article, not a finding that every token or custody structure has identical legal or reporting treatment. The FEC’s advisory opinion process explains that advisory opinions arise from specific facts; an opinion should not be treated as resolving a materially different arrangement automatically.

Federal, state, and local contests

The contribution rules and reporting details described above concern federal elections. State and local jurisdictions set their own campaign-finance requirements, and the federal sources cited here do not establish a nationwide rule for those contests. A donor or committee should check the election authority and law for the particular state or locality instead of assuming the FEC’s bitcoin instructions govern.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Where to verify the rules

Start with the FEC’s bitcoin page for receipt, valuation, and reporting instructions; use its contribution-limit chart for the applicable cycle and recipient; and consult its source eligibility guidance for prohibited contributors. The FEC also explains the advisory opinions it has issued. The Commission notes that advisory opinion materials do not replace the law or change its meaning, and that protections apply to the requestor’s activity or activity materially indistinguishable from it when undertaken in good faith. If the facts differ—especially for a new token, intermediary, custody model, or disputed source—the published bitcoin example may not answer the specific legal question.
