Yes, some employment-based green card applicants can change employers while their Form I-485 is pending. Under the job-portability rule in section 204(j) of the Immigration and Nationality Act (AC21), eligible applicants generally need a properly filed I-485 that has been pending for at least 180 days and a bona fide new job offer in the same or a similar occupational classification as the job tied to the immigrant petition. The rule does not apply to every category or every job change, and meeting its basic conditions does not answer every question about an individual case.
This explanation concerns U.S. employment-based adjustment of status through Form I-485. It distinguishes changing jobs under portability from asking USCIS to change the basis of a pending I-485, because those are separate procedures with different conditions.
What the 180-day rule means
The key clock is the time your properly filed Form I-485 has been pending—not simply the time since your employer filed an immigrant petition, the time you have worked for that employer, or the time since you received a job offer. USCIS describes AC21 portability for certain employment-based adjustment applicants whose I-485 has been pending for 180 days or more. The threshold is a legal timing condition, not a prediction about how quickly USCIS will decide the case. See the USCIS Policy Manual chapter on transfer of underlying basis.
Reaching 180 days does not by itself authorize a job change under this rule. You also need to be in a covered category, have a qualifying new offer, and satisfy the other requirements that apply to your case. Conversely, the 180-day period should not be treated as a universal waiting period for every employment-based applicant: the portability mechanism described here has category limits, and some classifications have different job-offer structures.

Because the rule is tied to an I-485 filing, it is important to identify the actual filing date and confirm that USCIS properly received the application. Do not calculate the threshold from an I-140 filing date or assume that an employer change automatically starts, stops, or resets the clock. A separate timing rule applies in a particular basis-transfer situation, explained below.
Which cases may qualify for AC21 job portability
USCIS identifies certain applicants in the employment-based first, second, and third preference categories (EB-1, EB-2, and EB-3) as potentially eligible for portability. The general description is not a blanket approval for everyone in those broad categories: the underlying petition, I-485 history, job offer, and case posture still matter. The Policy Manual also distinguishes applicants whose petitions are based on extraordinary ability or a national interest waiver. Those cases have different job-offer structures and are not covered by the AC21 portability rule described here in the same way.
Check the basis of the immigrant petition rather than relying only on a label used informally at work. USCIS’s November 17, 2020 policy alert explains that the agency consolidated guidance on portability, including how it evaluates whether a new position is in the same or a similar occupational classification. The current Policy Manual is the primary agency reference for applying that guidance.

- Potentially covered: certain employment-based adjustment cases in EB-1, EB-2, or EB-3, subject to the applicable requirements.
- Different framework: extraordinary-ability and national-interest-waiver cases should not be assumed to use this same portability process.
- Not established by category alone: whether a particular petition remains valid, whether the application meets the timing rules, or whether a specific new job qualifies.
How USCIS evaluates the new job
The new job must be in the same or a similar occupational classification as the job underlying the immigrant petition. That is a comparison of the work, not a requirement that the employer or job title remain identical. A title that looks similar is not enough to establish that the positions match; a different title does not, on its own, establish that they do not. The substantive positions and the evidence describing them matter.

For a useful comparison, set out what the original job involved and what the proposed job will involve. Compare their actual duties and occupational character, rather than treating the employer’s chosen titles as a shortcut. Keep the descriptions accurate and specific. If the positions differ, explain the relationship between them using the facts of the work; do not assume that a shared industry, employer type, or seniority level resolves the classification question. USCIS makes the same-or-similar determination under its guidance, and a reader cannot safely infer the outcome from a short job title.
The offer must also be bona fide and prospective. USCIS Form I-485 Supplement J instructions describe the relevant offer as a new, full-time, permanent job offer that the applicant intends to accept once adjustment is approved. The portability question therefore concerns the job the applicant is genuinely offered and intends to take after approval; the form’s instructions also make clear that this analysis does not itself determine whether the applicant currently has work authorization with that prospective employer.
Questions to answer before relying on portability
- Has the properly filed I-485 been pending for at least 180 days?
- What employment-based category and petition basis support the case?
- What are the real duties and occupational classifications of the original and proposed positions?
- Is there a bona fide full-time, permanent offer that the applicant intends to accept upon adjustment approval?
- Does the current Supplement J edition apply, and is the form needed to confirm the offer or request portability in this case?
- Are there other facts—such as petition history, visa availability, status, work authorization, travel, or derivative applications—that could affect the decision?
What Form I-485 Supplement J does
Supplement J is used to confirm a bona fide job offer or to request job portability under INA section 204(j), according to USCIS’s instructions. The retrieved instructions, dated December 23, 2022, describe a portability request as requiring a properly filed I-485 pending for at least 180 days and an underlying I-140 naming the applicant as the principal beneficiary. They also state that certain extraordinary-ability and national-interest-waiver applicants do not need Supplement J for portability.

Supplement J addresses the job-offer or portability issue; it is not proof that the applicant is authorized to start working for the prospective employer. Do not rely on the form, the 180-day rule, or this general explanation as a substitute for checking the work authorization that applies to the applicant and the proposed start date. Nor does this overview establish that an applicant should resign, accept an offer, travel, or take another action in a particular case.
Job portability is not a transfer of the I-485’s underlying basis
These two procedures are easy to confuse because both can arise when an employment-based case changes. They are not interchangeable. Under AC21 portability, an eligible applicant seeks to use the existing employment-based basis for adjustment while moving to a qualifying same-or-similar job. USCIS says applicants seeking that portability do not need to request that the pending I-485 be transferred to a new petition or basis.
A transfer of underlying basis is a request that USCIS adjudicate the pending I-485 using another petition or immigrant category. USCIS describes separate considerations for such a request, including continuing eligibility and I-485 pendency, evidence supporting the new basis, and visa availability where applicable. The agency states that The decision to grant or deny a transfer request is always discretionary.
That statement concerns a basis-transfer request; it should not be read as describing the ordinary AC21 portability request as the same procedure. See the Policy Manual’s transfer-of-underlying-basis guidance.

This is a rule for that transfer situation, not a universal reset caused by any change of employer. A job change using an existing basis and a request to change the I-485 basis should therefore not be treated as the same event.

| Question | AC21 job portability | Transfer of underlying basis |
|---|---|---|
| What changes? | The applicant seeks to rely on a qualifying new job while retaining the existing adjustment basis. | The applicant asks USCIS to adjudicate the pending I-485 using another petition or immigrant category. |
| Does it require a new basis? | No request to transfer the I-485 to a new petition or basis is needed for portability. | Yes. The request concerns use of another petition or category. |
| Timing noted by USCIS | For the portability rule described here, the properly filed I-485 must have been pending at least 180 days. | A transfer has separate continuity, evidence, and, where applicable, visa-availability considerations. A transfer to a different employment-based category based on a new I-140 has a separate 180-day timing consequence before portability may be used, if it otherwise applies. |
| Agency decision | The applicant must meet the applicable portability conditions; do not equate this with the separate basis-transfer discretion statement. | USCIS says a decision to grant or deny the transfer request is discretionary. |
How to assess a possible employer change
Use the following sequence to identify the questions that need answers. It is a decision aid, not a substitute for the current USCIS instructions or case-specific legal advice.
- Locate the I-485 timeline. Confirm the filing date and whether the application was properly filed. Determine whether it has been pending for 180 days or more; do not substitute the I-140 filing date.
- Identify the petition category and basis. Confirm the employment-based category and whether the case is one of the types USCIS describes as potentially eligible. Do not presume the same AC21 process applies to an extraordinary-ability or national-interest-waiver case.
- Compare the positions. Write down the original and proposed duties and compare their occupational character. Evaluate the jobs themselves rather than relying on titles or employer names.
- Confirm the offer’s terms and intent. Determine whether the offer is bona fide, full-time, and permanent, and whether the applicant intends to accept it once adjustment is approved.
- Check the right filing path. Determine whether Supplement J is appropriate to confirm the offer or request portability, and verify its current edition and instructions on USCIS’s website.
- Separate other immigration questions. Assess work authorization, nonimmigrant status, travel, petition validity, visa availability, and derivative applications on their own facts. Portability eligibility alone does not answer them.
- Identify whether the basis itself is changing. If the request is to use another petition or category, analyze it as a transfer of underlying basis, including its separate conditions and timing, rather than assuming the ordinary employer-change rule governs.
Common assumptions that can lead to a bad decision
“I have an approved I-140, so I can change jobs.”
An I-140 approval alone does not establish the conditions summarized here. The portability rule described by USCIS depends on the I-485 having been properly filed and pending for at least 180 days, a qualifying job offer, and a covered case. The Supplement J instructions also refer to an underlying I-140 naming the applicant as principal beneficiary.
“The new job has the same title, so it qualifies.”
The standard is same or similar occupational classification, not matching titles. Compare the work and its occupational character. A title match does not settle the question, and a title change does not settle it in the opposite direction.

“Any change of employer resets the 180-day clock.”
The supplied USCIS rule ties the 180-day period to the I-485’s pendency. USCIS separately describes a timing consequence after a request to transfer an I-485 to a different employment-based category based on a new I-140. That specific transfer rule should not be generalized to every job change.

“Supplement J gives me permission to work for the new employer.”
The form’s portability analysis concerns the prospective offer; it does not determine current work authorization with that employer. The applicant must consider work authorization separately.
“Changing employers means I have to transfer the I-485.”
Not for an AC21 portability request using the existing basis: USCIS says a portability applicant does not need to ask for a transfer to a new petition or basis. A basis transfer is a different request and brings separate eligibility and discretionary considerations.
What this general rule cannot decide
Even when the 180-day and job-match conditions appear to fit, the result can depend on facts not available from a general description. Relevant issues can include the history and validity of the underlying petition, the exact evidence for both positions, the applicant’s status and work authorization, travel plans, visa availability, and the status of any derivative applicants. A change in the I-485 basis raises additional questions about eligibility, supporting evidence, and visa availability.
