California’s Proposition 13 limits property taxes mainly by separating a property’s taxable assessed value from its current market price. For most property that keeps the same owner, the county uses a Proposition 13 base-year value, raises that value each year by no more than the lower of inflation or 2 percent, and applies a constitutional property-tax rate of 1 percent plus voter-approved bond debt and other authorized charges. A sale, qualifying ownership change, or completed new construction can reset all or part of the assessment to current fair market value.
What Proposition 13 changed
California voters approved Proposition 13 in June 1978, adding Article XIII A to the state Constitution. The measure addressed both the value used for taxation and the rate applied to that value. The California State Board of Equalization describes its original framework as a rollback of most local real-property assessments to 1975 market-value levels, a limit on the basic property-tax rate, and a cap on annual assessed-value growth.
| Proposition 13 feature | What it means for a property owner |
|---|---|
| Base-year value | Most property received a 1975 market-value assessment when the measure took effect. Property acquired later generally receives a new base-year value at the qualifying change-of-ownership date. |
| Annual assessed-value factor | The factored base-year value generally rises by the lower of the California Consumer Price Index change or 2 percent for the year. |
| Constitutional base rate | The basic rate is limited to 1 percent of assessed value. |
| Amounts above the base rate | Voter-approved bonded indebtedness and other lawful, locally authorized charges can make the total bill higher than the 1 percent calculation. |
The protection applies to the value placed on the assessment roll, not automatically to what a home would sell for today. That distinction explains why two similar houses on the same street can have very different tax bills.

How the annual Proposition 13 calculation works
Start with the property’s base-year value
When a property enters the Proposition 13 system, the county assessor establishes a base-year value. While the same ownership continues and no reassessment event occurs, the assessor uses that value as the starting point for future years. The annual figure is called the factored base-year value because it incorporates permitted yearly adjustments.

Apply the inflation limit
Each year, the assessor can increase the factored value by the lower of the applicable California Consumer Price Index change or 2 percent. The 2 percent number is therefore a ceiling on normal assessed-value growth, not a promise that every property’s taxable value will rise by exactly 2 percent. If the applicable inflation change is smaller, the smaller change controls.
For example, a property with a $400,000 factored value would have a $408,000 value after a 2 percent adjustment. If the applicable index change were 1.5 percent instead, the adjusted value would be $406,000. Those examples describe the assessed-value adjustment only; the final bill also depends on the local rate and authorized charges.
Calculate the bill from assessed value, not listing price
A simplified bill calculation is:
Assessed value × 1 percent base rate + voter-approved bonds and other authorized charges = property-tax bill
Actual county bills can include several line items. The constitutional rate does not eliminate those locally approved additions, so multiplying assessed value by 1 percent is useful for understanding the base but is not necessarily the amount shown on the bill.
Why neighbors with similar homes pay different amounts
Market value and taxable value follow different rules. A neighbor who bought recently may have a base-year value close to the purchase-date fair market value. Another owner who bought decades ago may still have a much lower factored base-year value, even if both homes would sell for similar amounts today.

Differences can also result from:
- Different dates of purchase or other qualifying ownership changes.
- New construction completed at different times.
- A Proposition 8 decline-in-value assessment on one property but not the other.
- Different local bond measures or authorized charges appearing on the tax bills.
- An inherited or otherwise transferred property receiving an exclusion under a statute such as Proposition 19, when all requirements are met.
Consequently, a current online estimate or appraisal does not by itself tell you what a neighbor’s taxable value is. The relevant records are the county’s assessment history, the property’s base-year value, and any changes that affected the roll.
When California reassesses a property
Sale or other change in ownership
A purchase or another qualifying change in ownership generally causes the assessor to establish a new base-year value at the property’s current fair market value as of the date ownership changed. The reassessment is not based on the former owner’s protected value. The Board of Equalization states that once a change in ownership has occurred, Proposition 13 requires reassessment to current fair market value as of that date.
Not every deed, trust transaction, or family transfer is treated identically. Exclusions can apply, but they depend on the transaction, the people involved, the property, statutory conditions, and timely claims. Until the assessor determines whether an exclusion applies, do not assume that a transfer will preserve the existing taxable value.
Completion of new construction
Completion of new construction can trigger a new assessment for the completed construction. The assessor’s review is separate from the normal annual Proposition 13 factor. A major addition, newly built structure, or other qualifying work can therefore change the assessment even when the underlying ownership has not changed.
Supplemental assessments
A reassessment caused by a change in ownership or completed new construction can appear on a supplemental roll rather than waiting for the next regular annual roll. A supplemental assessment puts the Proposition 13 reappraisal into effect for the relevant period. The resulting supplemental amount may be positive or negative, depending on how the new assessed value compares with the value previously enrolled and how much of the tax year is affected.

What happens when a home loses value: Proposition 8
The temporary decline-in-value rule
Proposition 8 provides temporary relief when a property’s January 1 market value falls below its adjusted Proposition 13 base-year value. In that situation, the assessor may enroll the lower value for that year. This is commonly called a Proposition 8 assessment or a decline-in-value assessment.
The comparison is not simply between today’s sale price and the original purchase price. The relevant test compares January 1 market value with the property’s adjusted base-year value for the assessment year.
Recovery can be faster than the normal annual factor
Once a property has received Proposition 8 relief, its assessed value can rise by more than the normal annual Proposition 13 factor while the market recovers. That faster increase continues only until the assessed value reaches the factored Proposition 13 value. It cannot exceed that factored value unless a later ownership change or new construction creates a new reassessment event.
This produces a temporary two-value pattern: the property may be enrolled at a reduced value while its market value is weak, then move upward more quickly during recovery. The temporary reduction does not permanently erase the original Proposition 13 base-year history.

Inheritance, family transfers, and Proposition 19
An inheritance or family transfer does not automatically produce one universal tax result. California’s change-of-ownership rules contain exclusions, and Proposition 19 changed the rules for certain transfers.
Transfers covered by the intergenerational rules
For qualifying transfers on or after February 16, 2021, Proposition 19 permits an exclusion for a family home or family farm transferred between parents and children and, in limited circumstances, between grandparents and grandchildren. The exclusion is available only when the statutory conditions are satisfied and the required claim is filed on time. The rules include limits and inflation-adjusted provisions that can affect the amount of value preserved.
Commercial property generally does not qualify
The intergenerational exclusion is aimed at qualifying family homes and family farms. Commercial property generally does not qualify for that exclusion. A transfer involving a rental, business, or other nonqualifying property therefore needs a separate analysis under the applicable change-of-ownership rules.
What a beneficiary should verify
- The exact date the transfer occurred.
- Whether the property is a qualifying family home or family farm.
- Whether the transferor and transferee meet the required family relationship.
- Whether the property was used and occupied in the manner required by the statute.
- Whether the county received the claim and supporting documents within the applicable deadline.
- Whether the property’s value falls within the applicable Proposition 19 limits.
Because the outcome depends on facts and filing requirements, beneficiaries should obtain the county assessor’s forms and instructions for the county where the property is located.
Four common situations compared
| Situation | Likely assessment treatment | What to check |
|---|---|---|
| Owner keeps the property with no qualifying event | The existing factored base-year value continues, subject to the annual inflation limit. | Base-year value, annual factor, and local charges. |
| Buyer acquires the property in a taxable change of ownership | A new base-year value is generally established at current fair market value on the change date. | Change-of-ownership determination and any supplemental assessment. |
| Owner completes qualifying new construction | The completed construction can receive a new assessment. | Construction completion date and assessor’s supplemental notice. |
| January 1 market value falls below the adjusted base-year value | A lower Proposition 8 value may be enrolled temporarily. | January 1 valuation, decline-in-value notice, and later recovery adjustments. |
How to determine why your bill is what it is
- Read the county tax bill. Separate the assessed value from the total amount due, and identify bond or other authorized-charge line items.
- Find the property’s base-year history. Look for the date and value established after the last purchase or other qualifying ownership event.
- Check the annual factor. Confirm how the factored value changed from the prior year and whether a Proposition 8 value is shown.
- Identify recent events. Review purchase documents, recorded transfers, permits, and construction-completion information for anything that could trigger reassessment.
- Look for supplemental notices. A supplemental roll entry can explain an unexpected additional bill or refund after a sale or construction project.
- Review possible exclusions. If the property changed hands within a family, compare the transaction with Proposition 19 and other statutory exclusions, then verify the county’s filing requirements.
- Ask the county assessor for a written explanation. Give the assessor the parcel number, transaction date, and relevant documents so the office can address the specific assessment rather than a general market estimate.
Pitfalls that cause mistaken expectations
Assuming the bill is 1 percent of today’s value
The 1 percent figure applies to assessed value and does not include authorized additions. A home worth $1 million today may have a much lower taxable value if its protected base-year value was established earlier.

Assuming every annual increase is 2 percent
The annual limit is a maximum. The applicable inflation change can be lower, and Proposition 8 can produce a temporary value below the normal factored amount.
Assuming every family transfer preserves the old assessment
Family relationship alone is not enough. The property type, transfer date, use of the property, value limits, claim, and deadline all matter under Proposition 19.
Waiting for the regular annual bill after a purchase
A supplemental assessment can be issued before the next regular roll reflects the transaction. Budget for a possible supplemental notice and keep the closing and ownership documents available.

The practical decision framework
To estimate how Proposition 13 affects a specific property, work through five questions in order:
- What is the existing factored base-year value? This establishes the starting point for a property that has not experienced a reassessment event.
- Did a sale, other ownership change, or new construction occur? If so, determine whether the event requires a new fair-market-value assessment or an assessment for completed construction.
- Does Proposition 8 apply? Compare January 1 market value with the adjusted base-year value for the relevant year.
- Is a statutory exclusion available? For family transfers, examine Proposition 19 and any other applicable exclusion, including claim and deadline requirements.
- What local charges are added? The final bill reflects the constitutional base rate plus voter-approved bond debt and other authorized charges in the jurisdiction.
This sequence keeps the key concepts separate: the protected base value, events that reset or add assessments, temporary decline-in-value relief, transfer exclusions, and the local charges that determine the final bill.
