Autism-informed forensic interviewing keeps the core police objective—an accurate, non-leading account—but changes how the interview is prepared, structured, paced and supported. The interviewer adapts to the individual’s communication, processing and sensory needs rather than assuming that an autism diagnosis predicts one standard response. Child witnesses, adult witnesses and suspects require separate analysis because the evidence and legal safeguards are different.

The short answer: the objective stays constant, the route changes

A conventional forensic interview is already supposed to be structured and non-leading. In a child case, a trained interviewer commonly follows the National Institute of Child Health and Human Development (NICHD) protocol: establish ground rules, build rapport, invite a free narrative, then use progressively more focused questions. The child is told that it is acceptable to say “I don’t remember,” “I don’t know” or “I don’t understand,” and that the interviewer can be corrected.

Autism-informed practice does not replace those safeguards with a looser conversation. It asks what will make this particular person able to understand the task, retrieve memories and communicate them without avoidable sensory or processing barriers. That can mean defining the event more clearly, allowing longer pauses, changing the room, or obtaining information about communication needs before questioning begins.

The distinction matters because a very broad invitation can be open-ended and non-leading yet still be hard to answer. “Tell me everything that happened” leaves the scope, starting point and level of detail undefined. A more accessible prompt can identify the event, time and place and explain which details are useful, while still allowing an unrestricted account.

How the two approaches compare

Interview feature Standard best-practice approach Autism-informed adjustment
Question scope Begin with broad free recall, then narrow questions. Keep recall open and non-leading, but set clear event boundaries and explain the kinds of detail sought.
Preparation Use the case information needed to plan a protocol-compliant interview. Gather individual information from caregivers, professionals or records about communication, competence, strengths and limitations.
Pacing Follow the interview stages without rushing the interviewee. Build in extra processing time, avoid interrupting and check whether a question was understood.
Environment Use a suitable, private interview room. Reduce noise, visual distraction and harsh lighting; consider a familiar setting where practical and permit harmless self-regulatory behaviour such as stimming.
Interviewee role Apply the relevant witness or suspect procedure. Adapt to the person’s functional abilities, age and role; do not treat an autism diagnosis as a complete needs assessment.
Support and safeguards Follow the law and local policy for children, vulnerable people and suspects. Use the jurisdiction’s support provisions, communication assistance and appropriate-adult rules where applicable.
Evidence base Some child-interview protocols have outcome studies. Autism-specific techniques are developing; promising witness findings do not automatically transfer to suspect questioning.

What a standard child forensic interview already does

NICHD structure is more than a list of questions

The NICHD protocol is a staged method, not a script that produces a reliable interview simply by being read aloud. Training covers rapport, practice with narrative detail, ground rules and the transition to the substantive event. The interviewer starts with open prompts and uses focused questions later, rather than beginning with a sequence of suggestive details.

Ground rules give the child permission to correct the adult and to acknowledge uncertainty. That is particularly important when an interviewer’s authority, repeated questioning or apparent expectations could otherwise encourage guessing. The protocol’s sequence also creates a record of how information was elicited, which helps later review.

What the published outcome does—and does not—show

A National Institute of Justice CrimeSolutions profile posted February 9, 2012, described one 2008 study of 1,280 alleged child victims in Salt Lake City. Cases using the NICHD protocol had charges filed in 52.0 percent of cases, compared with 40.7 percent in pre-protocol cases. Those figures describe a case-processing outcome, not interview accuracy, truthfulness or proof that the protocol caused the difference. The profile labels the evidence “Promising,” says it is based on one study and is no longer being updated.

That baseline prevents a misleading comparison. Autism-informed interviewing is not “structured interviewing” versus “unstructured interviewing”; it is an individualized layer added to a structured, non-leading method.

Preparation: find out what this person needs before asking about the event

Use an individual profile, not assumptions about autism

For an autistic child, an OJJDP-sponsored overview published July 1, 2019, recommends gathering information before the interview from caregivers, professionals or records. The aim is to identify the child’s communication strengths, needs, competencies and limitations. Relevant questions include how the person understands time words, whether they use an alternative or augmented communication method, how they signal uncertainty, and what conditions make concentration easier.

The same principle applies to adults. A diagnosis alone does not tell an interviewer whether a person prefers literal language, needs written supports, processes spoken questions slowly, or becomes overwhelmed by eye contact, noise or lighting. The interviewer should establish functional ability and communication preference without turning the pre-interview into an informal credibility test.

Plan the room as part of the interview

  • Choose a quiet room and remove unnecessary visual or movement distractions.
  • Check lighting, background noise, temperature and seating; sensory discomfort can consume attention needed for communication.
  • Explain who will be present and what each person does.
  • Allow harmless self-regulatory behaviour, including stimming, unless it creates a specific safety problem.
  • Consider a familiar setting where practical and legally appropriate.

An anonymous autistic adult quoted in University of Bath guidance expressed the practical effect this way: “I know my environment and am not having to contend with sensory distress, which would prevent good communication.” The quotation is attributed only to that anonymous adult; no name is supplied.

Question design: clear parameters without leading the answer

Why “tell me everything” can fail

Open invitations are valuable because they give the interviewee control over what to report. However, University of Bath guidance prepared by Dr Katie Maras notes that an extremely broad, unfocused invitation such as “tell me everything that happened” may be difficult for some autistic adults. The person may not know which incident the interviewer means, where to begin, or how much background is relevant.

A clearer invitation can specify a particular event, time and location—for example, what happened yesterday in the park between 2 p.m. and 3 p.m.—and state that details about who was there, what happened, when and where it occurred, and how events unfolded are useful. This narrows the task without supplying an answer. The question should remain open, rather than becoming “Did this person hit you?” or another yes/no prompt that constrains recall.

Use a graduated sequence

  1. Orient the interview. Explain the purpose in plain, literal language and establish that the person may say “I don’t know,” “I don’t remember,” “I don’t understand,” or correct the interviewer.
  2. Define the target event. Identify the relevant incident, place and time period without embedding disputed facts.
  3. Invite a narrative. Ask the person to describe what happened in their own words and do not fill pauses too quickly.
  4. Clarify neutrally. Ask who, what, when, where and how questions about information already mentioned. Separate one topic from another.
  5. Check meaning. Confirm ambiguous words, pronouns, time references or literal interpretations without suggesting a correction.
  6. Close carefully. Ask whether there is anything else about the defined event the person wants to add, then explain what happens next.

Extra processing time is a substantive accommodation, not a courtesy. Moving to another question because the first answer did not come immediately can interrupt retrieval or make the person infer that a quick answer is expected.

Witness-Aimed First Account (WAFA): a promising topic-box method

Witness-Aimed First Account divides an event memory into smaller “topic boxes” and explores each in turn. Instead of requiring one unbounded narrative, the interviewer may move through locations, people, actions or time segments while preserving the witness’s own account within each box.

The National Autistic Society’s explainer published October 19, 2022, reports early findings of more detailed and accurate recall for autistic and non-autistic participants than a standard best-practice interview. Those findings make WAFA promising, not universally adopted. It should not be described as a settled replacement for every police interview or as a guarantee of accuracy. Interviewers still need training, non-leading prompts and a plan for testing alternative explanations.

Child witnesses and adult witnesses are not interchangeable

Autistic children

For children, the NICHD sequence remains the reference point for structured practice. Autism-informed preparation adds information about the individual child, reduces distractions, keeps the child on topic when needed and emphasizes open-ended questions, as recommended in the OJJDP overview. The interviewer should distinguish communication differences from evasiveness and should not treat unusual eye contact, movement or affect as evidence that an account is false.

Autistic adults

Adult witnesses may have sophisticated vocabulary yet still need explicit parameters, literal wording or longer pauses. University of Bath guidance stresses tailoring the adaptation to the individual rather than applying a single “autism interview” style. A familiar environment, a clear explanation of the task and permission to regulate sensory load may improve communication without changing the evidential standard.

The interviewer must also avoid infantilizing an adult or assuming that a support person should answer. Any supporter’s role should be defined so that the adult’s own account remains distinguishable from information supplied by someone else.

Suspect interviews require a separate evidence and legal analysis

Why witness findings cannot simply be transferred

Suspect questioning can involve strategic disclosure of evidence, decisions about when to reveal information, pressure associated with possible criminal liability and rules about legal advice. Those demands differ fundamentally from a witness’s attempt to recall an event. The National Autistic Society article dated October 19, 2022, stated that, at that time, it found no published research on how autistic people fare under those suspect-interview demands. That is a dated description of the literature assessment, not a claim that no later work exists.

Accordingly, a technique shown to elicit more detail from witnesses should not be advertised as validated for interrogating suspects. Investigators need jurisdiction-specific legal advice, appropriate safeguards and training on how communication or sensory distress may affect comprehension and decision-making.

England and Wales: PACE Code H example

In England and Wales, Police and Criminal Evidence Act (PACE) Code H sets procedures for vulnerable suspects and the use of an appropriate adult. Its urgent-interview provision permits questioning without the appropriate adult only under specified conditions. It requires authorization at superintendent rank, and the interview must stop once enough information has been obtained to avert the listed consequences. These provisions are an England-and-Wales example, not a rule for police in other jurisdictions.

Code H’s healthcare-assessment guidance also directs decision-makers to consider functional ability rather than relying only on a diagnosis. That principle aligns with autism-informed practice: the relevant question is what support this person needs to understand and participate, not whether a label appears in a record.

Common mistakes and practical corrections

  • Using a diagnosis as a script: Ask about the individual’s communication and sensory profile instead.
  • Interpreting delayed answers as deception: Pause, repeat the question in plain language and allow processing time.
  • Replacing open questions with yes/no questions: Define the event and requested detail while preserving an open response.
  • Overlooking the environment: Treat noise, lighting, crowding and interruptions as interview conditions that can affect communication.
  • Forcing eye contact or stillness: Focus on the content and consistency of the account; permit harmless regulation.
  • Applying witness techniques to suspects: Reassess the method in light of disclosure strategy, legal rights and the jurisdiction’s vulnerable-suspect rules.
  • Reading a protocol without training: NICHD and other structured approaches depend on competent implementation, not merely following printed prompts.

What a defensible autism-informed interview record should show

A good record makes the adaptation visible without implying that autism itself determines credibility. It should identify the person’s role and age, the information used to plan communication, the environmental steps taken, the explanation of ground rules, the main invitation to recall, pauses or breaks, and any clarification of communication aids or support-person involvement. It should also distinguish what the interviewee said from what another person supplied.

That documentation helps later reviewers understand why the interviewer used defined event parameters, a topic-box sequence or additional processing time. It does not turn an adaptation into proof that the account is accurate; assessment still depends on the complete evidence and the applicable legal standard.

Bottom line for police, lawyers and interview designers

Autism-informed forensic interviewing changes access to the interview, not the requirement for an accurate, non-leading account. Start with a structured method, then tailor preparation, wording, pacing, room conditions and support to the individual. Use clear event parameters and requests for relevant detail without forcing yes/no answers. Treat WAFA as a promising witness approach rather than a universal standard. Keep child, adult and suspect interviews conceptually separate, and apply the law of the relevant jurisdiction—such as PACE Code H in England and Wales—rather than assuming that one safeguard system travels everywhere.
