Yes, an AI-generated 3D asset may be usable in a commercial game, but that depends on the generation service’s terms, the asset’s particular license, the rights of anyone whose material appears in it, and the rules of the platform where you publish or sell it. Permission to use an asset commercially is not the same as owning copyright in it or having exclusive rights to it. This guide focuses on the United States and official guidance and platform examples dated 2024–2025; it is not a determination of the rights in any particular asset or legal advice.
What “commercial use” does—and does not—mean
For a game developer, “Can I use this asset commercially?” sounds like one question, but it combines several. A tool provider may authorize use of generated outputs; a marketplace may grant a license to incorporate an asset in a game; and a store may impose submission or disclosure requirements. Separately, copyright law determines what expression is protected and who may claim rights in it. A commercial-use permission answers only part of that picture.
Keep these three issues distinct:
- Contractual permission: What do the AI service terms and the license for this specific asset allow? Check the permitted uses, restrictions, and any conditions.
- Copyright in your contributions: Which parts of the asset, if any, reflect human-authored expression? Permission to use output does not by itself establish copyright ownership or exclusivity.
- Other people’s rights: Does the asset include or closely reproduce recognizable third-party material, such as a character, logo, brand, or protected design? A license from a tool or seller does not necessarily clear those rights.
These questions matter whether you generated a model yourself or obtained one from a marketplace. They also matter at different stages: development, collaboration, public release, and any later decision to distribute the model files separately.

Possibly. First verify that the applicable generation-service terms and asset license permit your intended use. Then check whether the license covers the way you plan to distribute the game, and whether the asset contains material that raises separate rights concerns. A license that allows an asset to be incorporated into a project may still prohibit selling or giving away the asset on its own.

In the United States, the Copyright Office’s 2025 announcement says that AI assistance, or inclusion of AI-generated material in a larger human-generated work, does not automatically bar copyrightability. That does not mean every output produced entirely by a model is protected, nor does the announcement decide the status of a particular 3D model or workflow. Whether a human contributed copyrightable expression is a fact-specific question.
So a game may be commercially usable under a contract even if you cannot claim copyright in every generated element. Conversely, a human contribution that may qualify for copyright does not override a service or marketplace license restriction. Do not treat a commercial-use clause as proof that you own the output, can stop others from using similar output, or have cleared every third-party right.
Which terms and licenses should you check?
Read the terms that apply to both the generation process and the asset you intend to use. If the asset comes from a marketplace, identify its selected license and tier rather than relying on a general statement about the marketplace. Keep a copy of the terms and listing that applied when you acquired the asset; platform conditions can change.
Generation-service terms
Check what the service says about generated outputs, commercial use, and any restrictions relevant to your workflow. Do not assume that the service’s permission answers whether a separate marketplace license allows your planned distribution, or whether any third-party material in the output is cleared. The official materials summarized here do not establish terms for every generation service, so the actual service terms matter.

Asset-level license
Look for the license attached to the particular product, including its tier and any applicable end-user license agreement (EULA). Note the permitted project uses, limits on redistribution, and whether you receive source files or only a reference-format asset. A marketplace’s short summary may help explain a license, but it may not be the binding document.
Example: Fab license distinctions
Fab’s Standard License summary describes commercial and private use, modification, and commercial distribution of projects that incorporate assets. It prohibits standalone resale or free redistribution of the asset. Fab also says its summary is not binding and points users to the full EULA. The product’s selected license and the applicable full EULA are therefore the documents to check.

Fab supports an open marketplace with Unreal Engine, Unity, and other 3D formats, but the existence of a listing or supported format is not evidence that a particular asset’s underlying rights have been cleared.
Platform terms are separate from software terms
Unity says Asset Store assets are governed by its Asset Store Terms and the applicable Asset Store EULA. Its terms page notes a December 4, 2024 revision clarifying restrictions on using the store for training AI or machine-learning models. That restriction is relevant when considering what you may do with store assets; it is not a general permission to use them in any way.

Epic’s content EULA has content addenda and defines a “Generative AI Program.” Check the content license that applies to the actual asset. The Unreal Engine software EULA should not be assumed to license marketplace content: software access and rights in a marketplace asset are distinct matters.
How to evaluate an asset before putting it in a game
Use this sequence for an asset you generated or downloaded. It is designed to catch problems before the model becomes embedded in a project, where replacing it may be costly.
- Identify the asset and its source. Record whether it was generated with a service, made by a seller, or supplied through a marketplace. For marketplace content, save the listing and identify the selected product license.
- Read the applicable terms. Check the generation service’s terms and the asset’s license or EULA. Look specifically for commercial use, modification, project distribution, standalone redistribution, and any source-file or format restrictions.
- Match the license to your release plan. Consider the game’s platforms, collaborators, revenue model, and distribution method. If players, modders, contractors, or other partners will receive asset files, determine whether the license allows that particular form of access or redistribution.
- Check provenance and seller authority. Ask who created or generated the asset and whether the seller has authority to license it. A marketplace listing can identify a product and its license, but the listing alone does not establish that every underlying right is clear.
- Inspect the output for recognizable third-party material. Look for characters, logos, brand identifiers, or copied designs. If you identify material that needs permission, request documented authorization or replace the asset. Resemblance alone does not establish a legal conclusion, but it is a reason to investigate rather than assume clearance.
- Record your own contributions. Keep the prompts and workflow records, and document which parts you modeled, sculpted, retopologized, textured, or otherwise changed. Records help explain the creation history; no particular amount of editing guarantees copyright protection.
- Check the destination platform’s rules. If you submit the asset to a store, verify its current AI disclosure and acceptance requirements. A license that permits use in a commercial game does not necessarily satisfy a store’s separate submission policy.
- Save the evidence. Retain the listing, license version, service terms, prompts and workflow records, and any seller representations from the time of acquisition. This gives your team a record of what it relied on when choosing the asset.
How Unity Asset Store rules affect AI-generated assets
Unity’s publisher guidance is a marketplace submission policy, not a universal legal requirement. For submissions covered by that guidance, publishers must identify the AI tools and generated content in the “AI description” field in plain language, including modifications that add value beyond the generation result. The description should not use marketing language or claim human effort for AI-generated or AI-assisted material; Unity specifically gives terms such as “drawn,” “hand drawn,” and “painted” as examples to avoid when they would imply work that was generated or AI-assisted.

Unity also says it may reject mass-produced AI submissions that lack sufficient differentiation or customer value. Thus, a technically licensed asset can still fail marketplace review if its submission does not meet the store’s requirements. Be accurate about what the tool generated and what a person changed; do not describe an AI-generated result as wholly human-made to make a listing sound more valuable.

Before submitting, check the live publisher guidance and the asset terms that apply. The Unity materials identified here include the December 4, 2024 terms revision, but platform rules can change, and a policy statement is not a substitute for the version in force when you submit.

A license can authorize uses of the rights the licensor controls; it is not automatically a warranty that no other rights are involved. This is especially important for outputs that resemble a recognizable entertainment character, contain a visible logo, use a brand name, or reproduce a distinctive design.
Epic’s marketplace guidelines say products must not use copyrighted or trademark-protected names, branding, or content unless the seller owns or is adequately licensed to use them. Treat that as a practical screening prompt when reviewing an asset, not as a final legal determination that every resemblance is infringement. A seller’s ability to license the asset and the existence of permissions for recognizable third-party material are questions worth documenting.

Also consider what the asset actually contains, not just its file name or listing description. A generic label does not make a recognizable logo or character generic. If a material similarity or unclear provenance could affect a high-value release, seek qualified legal advice or choose a replacement with clearer documented rights.

What rights do you have in the asset you generated?
Do not equate “I generated it” with “I own copyright in all of it.” The Copyright Office’s 2025 statement is narrower: using AI as an aid, or including AI-generated material in a larger human-generated work, does not by itself prevent copyrightability. Whether a specific asset contains protectable human-authored expression depends on the facts of creation. The announcement is not a ruling on every prompt, model, or editing workflow.
Describe the human role precisely. A record that a person made substantial artistic choices or authored particular elements may help document what happened, but the supplied official guidance does not set a minimum editing threshold that guarantees protection. A prompt, selection among outputs, or later modification should not be presented as automatically making every generated element copyrightable.
Think of permission and ownership as separate columns in your project records: what the service and asset license permit, and what human-authored expression you may be able to claim. That distinction is useful when negotiating distribution, explaining the asset’s history to a publisher, or deciding how much reliance to place on exclusivity.
Common mistakes that create avoidable licensing risk
- Relying on a short commercial-use label. Read the applicable license and EULA, including restrictions on standalone redistribution and source-file access.
- Assuming marketplace availability proves clearance. A listing is not, by itself, evidence that the seller controls all rights in the asset.
- Confusing game distribution with asset redistribution. A license may permit an incorporated asset in a distributed project while barring resale or free distribution of the asset separately.
- Treating AI disclosure as optional marketing copy. Where Unity’s submission rules apply, disclose the tools, generated content, and value-adding modifications in the required field, and avoid implying human work that did not occur.
- Assuming platform rules apply everywhere—or nowhere. Unity’s requirements apply to its submissions; they are not a universal law. Other stores may have different rules, so check the destination platform.
- Assuming a copyright claim follows from editing. Keep records of contributions, but do not promise that a particular edit or amount of labor automatically establishes copyright.
When to get legal advice
For a small prototype, a careful terms check and a documented replacement plan may be proportionate. For a high-value commercial release, unclear asset provenance, a disputed license, or material similarity to third-party content, ask a qualified lawyer to review the actual asset and documents. That advice should address the relevant jurisdiction and distribution model rather than treating a marketplace’s general summary as a complete clearance opinion.
The examples here concern U.S. Copyright Office guidance and particular Unity and Epic policies and licenses. They do not resolve copyrightability or infringement under other countries’ laws, every generation service’s terms, the training or generation history of an individual asset, or the outcome of a court dispute. Verify the live terms and policies for the specific asset and release at the time you use or submit it.
