Stop ground-disturbing work in the discovery area immediately when excavation uncovers possible human remains, an unmarked burial, funerary objects, or likely burial artifacts. Secure the area, do not move or clean anything, and notify the officials identified by the land’s jurisdiction. Continuing to dig can destroy evidence, violate burial-protection laws, and expose the project owner and contractor to enforcement.

The exact procedure is not nationwide. Federal and tribal discoveries can fall under the Native American Graves Protection and Repatriation Act (NAGPRA), while state statutes determine most incidents on state, municipal, and private property. The examples below show why the first call, reporting deadline, required buffer, and authorization to resume work must be confirmed for the specific site.

The immediate rule after a burial-ground discovery

When workers encounter bones, a grave shaft, a coffin, burial hardware, funerary objects, or an unusual concentration of artifacts that may indicate a burial, treat the find as potentially protected until an authorized official determines otherwise. Stop excavation, grading, trenching, utility work, drilling, clearing, and any other activity that could disturb the discovery. The halt normally applies to the discovery area and the area that could be affected by continued work, not automatically to every operation on the entire project.

Do not decide on site that the remains are “too old” to matter

Field crews generally cannot determine whether material is modern, historic, archaeological, or Native American. Age, visible condition, and the presence or absence of a marker do not by themselves remove legal protection. Leave remains and associated objects where they are. Do not collect, wash, reassemble, relocate, expose more material, or allow unauthorized visitors to handle the find.

Protect the location without disturbing it

Use a controlled buffer, fencing, signs, or a temporary access restriction that can be installed without contacting the remains. Keep equipment, spoil piles, water flow, and vibration away from the area. Preserve the condition in which the discovery was made while waiting for instructions from the responsible authority.

What to do in the first response

  1. Stop the threatening activity. Shut down the excavator, grader, trencher, or other equipment operating in the affected area. Do not resume simply because no additional bones are visible.
  2. Secure the area. Establish a practical buffer, prevent entry and handling, and protect the location from weather, erosion, vehicles, and unauthorized removal.
  3. Record basic facts. Note the date and time, precise location, work underway, visible materials, equipment position, and the steps taken to secure the site. Keep notes factual and avoid conclusions about identity or age.
  4. Preserve the scene. Do not collect, clean, publish photographs, or move remains or objects. If documentation beyond a basic location record is needed, ask the authorized official what is permitted.
  5. Make the required calls. The first contact may be a federal land manager, an Indian Tribe or Native Hawaiian organization, law enforcement, a coroner or medical examiner, a state archaeologist, a State Historic Preservation Office, or a local building official.
  6. Ask for written direction. Confirm the required report, consultation, archaeologist, medical examiner review, permit, cemetery plan, or other process, and identify who can authorize work to restart.

Determine which legal regime applies

Federal and tribal lands: NAGPRA

Under 25 U.S.C. § 3002(d), a person who knows or has reason to know that Native American cultural items were discovered on federal or tribal lands must notify the responsible federal agency or, on tribal lands, the appropriate Indian Tribe or Native Hawaiian organization when that entity is known or readily ascertainable. When the discovery is connected with construction or another activity, the person must cease the activity in the discovery area, make reasonable efforts to protect the items, and provide written notice.

The notice should identify the location and contents of the discovery, the activity that led to it, threats to the materials, and the protective measures already taken. The National Park Service describes the field response as stopping activity that could threaten the find, reporting those details, and waiting for written certification before resuming.

Work may resume only after the responsible official or tribe certifies receipt of the notice and 30 days have passed. A contractor’s internal decision, a verbal assurance from a subcontractor, or the absence of additional visible material is not a substitute for that certification process.

Federal projects and Section 106 policy

The Advisory Council on Historic Preservation adopted its updated Policy Statement on Burial Sites, Human Remains, and Funerary Objects on March 1, 2023. It states that “federal and state agencies, contractors, and other relevant entities should, at a minimum, seek to implement” its standards and guidelines so burial sites, human remains, and funerary objects receive appropriate consideration and protection.

The policy is particularly relevant when a federal agency undertaking triggers Section 106 review. It is guidance for responsible federal decision-making, not a single stop-work statute covering every private project. On state and private land, the applicable state and local burial-remains laws control the immediate response and the route to resumption.

State and local law on other property

State statutes differ in the official who must receive the first notice, the deadline, the geographic scope of the halt, and the person who can authorize work. A county medical examiner may control an unmarked burial in one state, while a building official, state archaeologist, or law-enforcement agency may start the process in another. Land status and the type of activity therefore need to be established before selecting a notification path.

State examples: materially different procedures

Jurisdiction Trigger and stop-work scope Initial notice Timing or resumption point
Indiana Possible human remains should remain undisturbed. Indiana’s summary of IC 14-21-1-29 requires ground disturbance to stop when an artifact or burial object is found during work being done for another purpose. County coroner, Indiana Department of Natural Resources Division of Law Enforcement, and DNR Division of Historic Preservation and Archaeology. DNR’s summary states the department must be notified within two days for the covered artifact or burial-object discovery. Certain projects disturbing ground within 100 feet of a burial ground or cemetery may require a survey and development plan.
Florida Florida Statutes § 872.05 requires all activity that may disturb an unmarked human burial discovered outside an authorized archaeological excavation to cease immediately. District medical examiner. The State Archaeologist has additional responsibilities, including for discoveries made during archaeological excavation. In specified archaeological-excavation cases, an archaeologist’s report to the State Archaeologist is due within 15 days. The responsible officials determine the next steps.
Alabama Human remains or funerary objects discovered on state or private lands trigger immediate law-enforcement involvement. If connected with construction, mining, logging, agriculture, or another land-disturbing activity, work in the area must cease and reasonable protective measures must be taken. Law enforcement, which investigates and contacts the Alabama Historical Commission as warranted. Work remains stopped while the investigation and any required historical review proceed; the applicable authority controls release of the area.
New Hampshire For covered construction or agricultural encounters with unmarked remains, disturbance ceases immediately. County medical examiner and State Archaeologist, who have jurisdiction over unmarked remains under RSA 227-C:8-b. Work cannot resume without the authorization specified by the statute. The cited code page lists an amendment effective July 10, 2026; verify the current codification before relying on timing details.
Rhode Island Discovery of an unknown cemetery, unmarked cemetery, archaeological burial site, or skeletal material during construction, excavation, or another ground-disturbing activity requires immediate notice. Local building official, who then notifies the state medical examiner and, when the discovery appears historic, the Historical Preservation & Heritage Commission. The building official and state authorities determine the required protection and authorization before affected work proceeds.

Indiana: notice and a possible 100-foot planning obligation

Indiana DNR advises leaving possible human remains undisturbed and reporting them as soon as possible to the county coroner, DNR Division of Law Enforcement, and DNR Division of Historic Preservation and Archaeology. Its explanation of IC 14-21-1-29 addresses artifacts and burial objects encountered during ground disturbance for another purpose and gives a two-day notification period to the department. Indiana also describes cemetery surveys and a possible development-plan requirement when certain structures involve ground disturbance within 100 feet of a burial ground or cemetery. That planning requirement is different from the response to an active discovery: it is a pre-construction control that can identify risk before machinery arrives.

Florida: medical-examiner notification and archaeological-excavation reporting

Florida’s § 872.05 separates an unmarked burial found outside an authorized archaeological excavation from discoveries made during an approved excavation. In the first situation, activity that may disturb the burial stops immediately and the district medical examiner is notified. Where an archaeological excavation is involved, the State Archaeologist has defined roles, and in specified cases the archaeologist must submit an opinion report within 15 days. A project team should identify which category applies before assuming that an archaeological permit changes the ordinary response.

Alabama: law enforcement starts the investigation

Alabama Administrative Code 460-X-10-.01 requires immediate law-enforcement notification when human remains or funerary objects are found on state or private land. If the find is tied to construction or another listed land-disturbing activity, work in the area stops and the site is protected while law enforcement investigates and contacts the Alabama Historical Commission when appropriate. Contractors should not bypass law enforcement by treating the find as an ordinary archaeological feature.

New Hampshire: check the 2026 codification

RSA 227-C:8-b gives the county medical examiner and State Archaeologist jurisdiction over unmarked remains and requires immediate cessation for covered construction and agricultural encounters. The code page identifies a July 10, 2026 amendment. Because the effective date is in the future relative to earlier versions of the statute, project counsel should check the current official codification and any implementing instructions before relying on a deadline or authorization condition.

Rhode Island: the building official is the first gateway

Under Rhode Island regulation 530-RICR-10-00-2.6, the first notice for skeletal material or a possible unknown or unmarked cemetery found during construction or excavation goes to the local building official. That official then notifies the state medical examiner and, if the discovery appears historic, the Historical Preservation & Heritage Commission. A contractor should therefore keep the local building department’s contact information in the site emergency plan rather than assuming the state office is the first call.

Who should be called when the land status is unclear?

Pause the work and contact the project owner’s legal or compliance lead while preserving the area. If the property may be federal, identify the managing agency. If it is tribal land, identify the appropriate tribe or Native Hawaiian organization. For state, municipal, or private property, use the state’s specified medical examiner, coroner, archaeologist, historical-preservation office, building official, or law-enforcement channel. When the remains could be recent, law enforcement or the medical examiner should be included rather than relying only on an archaeological contact.

Do not make multiple uncoordinated calls that produce conflicting instructions. Designate one project representative to keep a call log, capture names and titles, record the time of each notification, and request written confirmation of the next required step.

How construction is cleared to resume

Federal or tribal discovery

For a NAGPRA-covered discovery, the responsible federal official or tribe must certify receipt of the written notice, and the 30-day period must pass before the activity resumes. The project team should retain the notice, delivery evidence, certification, consultation records, and the written release with the project’s environmental and safety files.

State discovery

State processes may require a medical examiner’s determination, law-enforcement release, archaeological documentation, tribal consultation, a cemetery survey, a revised development plan, or a permit condition. The person who receives the initial call may not be the person authorized to release the site. Obtain a clear written statement identifying the area released, any continuing buffer, monitoring requirements, treatment of remains or objects, and conditions for restarting each type of ground disturbance.

Partial restart is possible, but only if defined

An authority may allow work outside a mapped buffer while the discovery area remains protected. Treat that as a location-specific authorization, not as permission to move the buffer, stockpile soil beside it, or perform a different activity inside it. Update site drawings and equipment routes so the approved limits are visible to every crew.

Preventive steps before excavation begins

  • Review known cemetery and burial-ground records for the parcel and adjoining rights-of-way.
  • Ask the permitting authority whether a cemetery survey, archaeological assessment, or development plan is required before ground disturbance.
  • Where the risk justifies it, obtain a qualified archaeological or cemetery assessment, which may include professional mapping or non-invasive geophysical survey.
  • Include an inadvertent-discovery plan in bid documents, subcontractor agreements, site orientations, and daily briefing materials.
  • List the project’s land manager, county coroner or medical examiner, law-enforcement contact, state archaeologist, historic-preservation office, tribe or Native Hawaiian organization, and local building official as applicable.
  • Define who can stop equipment, who maintains the buffer, who communicates with authorities, and who keeps the written record.

Digital records that help without disturbing the site

A project can use a restricted-access GIS layer or drawing to mark the discovery point and authorized buffer, provided the mapping process does not require entering or exposing the area. Timestamped incident logs, equipment shutdown records, call logs, delivery receipts for written notices, and scanned authorizations create an auditable chain of events. Limit distribution of precise burial locations to people who need the information for protection and compliance; public posting can invite unauthorized access or damage.

Common mistakes that create additional liability

  • Allowing a different crew or subcontractor to continue work because the original operator stopped.
  • Moving bones or objects “for safekeeping” before an authorized official arrives.
  • Assuming a private parcel is outside historic-preservation rules.
  • Calling only a project archaeologist when the statute requires a coroner, medical examiner, law enforcement, or building official.
  • Relying on a telephone conversation without documenting the notice and obtaining the required written certification or release.
  • Restarting after a verbal indication that the discovery is probably not human, without the determination required by the governing authority.
  • Expanding the work zone into a cemetery or suspected burial area while waiting for instructions.

A practical decision path for project managers

  1. Is there a reasonable possibility of human remains, a burial, funerary objects, or burial artifacts? If yes, stop the potentially disturbing activity.
  2. What is the land status? Federal or tribal land points to the NAGPRA notification and certification process; other land requires the applicable state and local procedure.
  3. Which agency or official is named by that procedure? Follow the first-notice requirement rather than choosing the most convenient office.
  4. What must the written notice contain? Prepare the location, discovery contents, activity, threats, protective measures, date, and project contact information.
  5. What authorizes restart? Obtain the required certification, release, permit, plan approval, or other written direction, and apply any continuing buffer or monitoring condition.

There is no nationwide deadline or single agency for every historic burial-ground discovery. The reliable rule is to stop, protect, notify the authority tied to the land and state, and wait for documented authorization before disturbing the area again.
