Short answer: HIPAA is a United States federal law and does not apply simply because a Canadian therapist stores health information electronically. Canadian obligations depend on the province or territory, whether the practice is commercial, how information moves across borders, the therapist’s organizational role, and any U.S. connection. A private practice may have to assess PIPEDA, a substantially similar provincial privacy or health-information statute, or more than one law. Cross-border clients and U.S.-based vendors require fact-specific analysis rather than a blanket answer.

Start with the governing question: which law reaches this activity?

“HIPAA versus PIPEDA” is not a choice between two equivalent privacy codes. HIPAA is a U.S. federal regime with defined categories of covered entities and business associates. PIPEDA is Canada’s federal private-sector privacy law, but it does not operate as a universal health-privacy code across the country. Provincial private-sector and health-information laws can replace PIPEDA for activity within a province, and a different rule can apply when information crosses a provincial or national border.

For a Canadian therapist, the analysis normally starts with six facts:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • Where the practice is established and where services are delivered.
  • Where clients are located, including whether any are in the United States.
  • Whether the therapist works as an independent private practitioner, for a clinic, or for another organization.
  • What information is collected, used, disclosed, and retained.
  • Whether information moves between provinces or outside Canada.
  • What electronic transactions and vendors are involved.

Those facts determine which regulator, statute, contractual duty, or professional rule must be checked. A privacy lawyer or the applicable privacy regulator can resolve questions that cannot be answered from the therapist’s location alone.

When HIPAA can apply to a Canadian therapist

The covered-entity threshold

The U.S. Department of Health and Human Services (HHS) says the HIPAA Rules apply to covered entities and business associates. Covered entities include health plans, health care clearinghouses, and health care providers that transmit health information electronically in connection with a transaction for which HHS has adopted a standard. Psychologists are among the provider types listed in the federal definition, but professional title alone does not make a provider a covered entity.

For a Canadian therapist, the key question is therefore not “Is the record electronic?” It is whether the provider conducts a covered electronic transaction, such as a standardized transaction within HIPAA’s framework. A practice that uses email, a client portal, electronic notes, or online booking may still need a transaction-by-transaction analysis; electronic storage by itself is not the stated threshold.

HHS’s definitions do not settle every cross-border arrangement. A Canadian provider serving a U.S. client, billing a U.S. plan, or operating through a U.S. organization may have facts that bring HIPAA obligations into play, but the result depends on the particular transactions, contracts, and entities involved.

Business associates and service providers

A business associate is a person or organization that handles protected health information (PHI) for or on behalf of a HIPAA covered entity in a service role. When a covered entity engages one, HIPAA generally requires a written contract or other arrangement requiring the associate to safeguard PHI and perform applicable obligations. The contract framework matters when a Canadian therapist is part of a U.S. covered-entity arrangement, and it can also matter to a vendor serving a covered Canadian practice if that practice is independently within HIPAA.

Do not assume that calling a vendor a “HIPAA-compliant” platform answers the legal question. First determine whether the practice is a covered entity, whether the vendor is handling PHI on its behalf, what the contract says, where data and support personnel are located, and what security and breach duties apply.

What HIPAA does not establish for every Canadian practice

HIPAA does not automatically govern every Canadian therapist, every Canadian clinic, or every electronic health record. Nor does a U.S. server location, standing alone, prove that the therapist is a HIPAA covered entity. The HHS definitions provide the federal framework; they do not provide a universal answer for every combination of Canadian professional status, client location, software, billing, and contractual relationships.

How PIPEDA and provincial laws divide responsibility

PIPEDA’s commercial and cross-border role

The federal Personal Information Protection and Electronic Documents Act (PIPEDA) applies to personal information handled in commercial activity in the circumstances defined by federal law. The Office of the Privacy Commissioner of Canada describes private-practice health providers as engaged in commercial activity, unless substantially similar provincial legislation applies. That is useful federal guidance, not a province-by-province determination for every therapist, counsellor, employer, or organizational structure.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

PIPEDA also has an important cross-border role. A disclosure or flow of personal information between provinces or to another country can bring the federal law into the analysis even when an in-province activity is governed by a provincial statute. A practice must map the movement of information rather than assume that the law of its office location controls every use.

Substantially similar provincial private-sector laws

The federal privacy commissioner identifies Alberta, British Columbia, and Quebec as having substantially similar private-sector privacy statutes. Organizations covered by those statutes are generally exempt from PIPEDA for collection, use, or disclosure that occurs within the province. The exemption is not a blanket exemption from all federal obligations: an activity outside the provincial scope, including certain interprovincial or international disclosures, may still engage PIPEDA.

Substantially similar provincial health-information laws

The commissioner identifies substantially similar provincial health-information statutes in New Brunswick, Newfoundland and Labrador, Nova Scotia, and Ontario. A therapist’s duties in one of those provinces may depend on whether the therapist or organization is an actor covered by the applicable health-information statute, such as a health-information custodian, and on the particular handling of the record.

More than one law can apply to different parts of one organization’s activity. Where overlapping laws apply, the organization must meet the requirements that govern each activity. A clinic might therefore analyze a provincial rule for local collection and a federal rule for a disclosure to another province or country.

Provinces and territories not listed in those categories

The list above does not mean that practices elsewhere have no privacy duties. A practice outside the identified substantially similar regimes must determine whether PIPEDA applies and must also check professional, contractual, employment, health-record, breach, and other applicable requirements. “PIPEDA applies” and “PIPEDA does not apply” are both conclusions that require the facts and the relevant statute.

HIPAA and PIPEDA compared by the questions a practice must answer

Question HIPAA framework Canadian framework
Who is regulated? Covered entities and business associates. A provider generally enters the covered-entity definition when it transmits health information electronically in connection with a standardized covered transaction. Commercial organizations under PIPEDA, provincial private-sector organizations, health-information custodians, and other actors defined by the applicable provincial or territorial law.
Does electronic storage decide coverage? No. Electronic storage alone is not the covered-entity test; the provider’s covered electronic transactions matter. No single national test. The statute, province, organization type, activity, and data flow determine the applicable obligations.
What happens to in-province activity? U.S. federal coverage is based on HIPAA definitions and relationships, not a Canadian province-of-practice rule. Alberta, British Columbia, and Quebec have substantially similar private-sector laws; specified health-information statutes exist in New Brunswick, Newfoundland and Labrador, Nova Scotia, and Ontario. Local exemptions from PIPEDA are generally activity-specific.
What happens when data crosses a border? HIPAA may apply if a covered entity or business associate is involved; contracts and safeguards remain relevant. Interprovincial and international flows can bring PIPEDA into the analysis, even where a provincial law governs another part of the practice.
How are vendors treated? A vendor handling PHI for a covered entity may be a business associate and generally requires a written business-associate arrangement plus safeguards. Vendor duties depend on the applicable federal or provincial statute, the organization’s role, contracts, disclosures, security expectations, and where the vendor processes information.
Are psychotherapy notes a special category? Yes, for qualifying notes maintained separately from the medical record, with special authorization and access rules. No single Canadian rule can be inferred from HIPAA’s category. The governing province’s access and record rules must be checked.

Psychotherapy notes are not the same as ordinary progress notes

HIPAA’s narrow definition

HHS defines psychotherapy notes as notes recorded by a mental-health professional that document or analyze conversations during a counselling session and are maintained separately from the rest of the medical record. The definition excludes information such as medication details, session times, modalities, test results, and summaries of diagnosis, functional status, treatment plans, symptoms, prognosis, or progress when those items are maintained in the medical record.

That means a clinical chart, treatment plan, intake form, risk assessment, or SOAP-style progress note is not automatically a HIPAA psychotherapy note. Labeling a whole chart “psychotherapy notes” does not create the special category; separate maintenance and the content of the notes matter.

Disclosure and authorization

With limited exceptions, HIPAA requires an individual authorization to disclose qualifying psychotherapy notes. The rule is narrower than a general rule that all mental-health information needs separate authorization. Other PHI may be subject to HIPAA’s ordinary uses, disclosures, and minimum-necessary framework, depending on the circumstance.

Access rights

HIPAA’s access right generally covers PHI in a designated record set, including ordinary clinical case notes. Separately maintained psychotherapy notes are generally excluded from that access right, while underlying PHI kept in the designated record set remains subject to access rules.

This is a U.S. rule. A Canadian therapist must not use it as a shortcut for deciding what a client can access. The applicable provincial or federal Canadian regime may define records, exceptions, timelines, and review processes differently.

Safety-related disclosures require two legal checks

HHS guidance states that a HIPAA-covered entity may disclose PHI, including psychotherapy notes, when it has a good-faith belief that disclosure is necessary to prevent or lessen a serious and imminent threat to health or safety and the recipient can help mitigate the threat. The disclosure must also be consistent with applicable law and ethical standards.

For a Canadian therapist, that guidance cannot be converted into a universal Canadian permission. A crisis decision may involve provincial privacy law, professional standards, emergency or mental-health legislation, consent rules, and the facts supporting the risk assessment. Document the clinical basis, the information disclosed, the recipient, and the legal or ethical authority relied on, then obtain jurisdiction-specific advice when the situation is not clear.

Cross-border situations that need fact-specific analysis

A Canadian therapist sees a client who is physically in the United States

The client’s location may affect professional licensing, telehealth, contractual, and privacy questions, but it does not by itself prove HIPAA coverage. Determine whether the therapist or an associated organization conducts a HIPAA covered transaction, whether a U.S. covered entity is involved, and how information is transmitted and stored. Canadian obligations still need to be assessed under the therapist’s province and the applicable data flows.

A Canadian practice uses a U.S.-based software or cloud vendor

A vendor’s country of incorporation or data centre is only one fact. Identify whether the vendor receives identifiable information, acts on the practice’s instructions, uses the information for its own purposes, subcontracts processing, or transfers support access across borders. Then apply the governing Canadian statute and, if relevant, HIPAA’s covered-entity and business-associate rules. Contract terms should address confidentiality, permitted uses, security, incident notice, return or deletion, subcontractors, and assistance with access requests where the law requires it.

A therapist works for a clinic, insurer, university, or other organization

The organization may be the regulated entity, while the therapist is an employee, agent, custodian, or service provider under the applicable law. Responsibilities can differ from those of an independent private practitioner. Review the organization’s privacy policy, role definitions, retention schedule, incident process, and contracts rather than assuming that the therapist’s personal practice rules control.

A practice sends records to another province

Map the specific disclosure and its purpose. A provincial law may govern local collection and use while PIPEDA applies to the interprovincial transfer. The practice should identify notice and consent requirements, safeguards, access handling, retention, and any restrictions imposed by the receiving jurisdiction.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

A practical privacy-law fact check for your practice

  1. Map the practice. Record the province or territory where the business operates, where clinicians provide services, the organization’s legal structure, and whether it is a private practice, clinic, employer, or contractor arrangement.
  2. Map the people. List the locations of clients, payers, referral sources, family contacts, and other recipients. Mark every U.S. connection and every interprovincial or international disclosure.
  3. Map the information. Separate intake data, clinical records, billing data, appointment details, communications, risk documentation, and any separately maintained personal notes. Identify who can access each category.
  4. Map transactions. Document electronic billing, claims, eligibility checks, referrals, portals, messaging, and other transmissions. Ask whether any transaction is one for which HHS has adopted a HIPAA standard.
  5. Classify the organization’s role. Under Canadian law, determine whether the practice is a commercial organization, health-information custodian, trustee, agent, or another defined actor. Under HIPAA, determine whether it is a covered entity or whether it performs business-associate services.
  6. Inventory vendors. For each electronic-record, scheduling, telehealth, email, storage, payment, analytics, or transcription provider, note the data handled, processing location, subcontractors, security commitments, breach notice terms, and deletion or return process.
  7. Check provincial requirements. Confirm the statute, regulator, consent standard, access process, correction procedure, retention rule, breach obligations, and cross-border guidance that apply to the province and activity.
  8. Set an escalation rule. Decide who approves disclosures involving serious risk, law-enforcement requests, subpoenas, minors, incapacity, or cross-border transfers. Keep a record of the decision and the authority relied on.
  9. Get targeted advice. Take the completed map to the relevant privacy commissioner, professional regulator, or qualified lawyer. Ask a narrow question tied to the actual workflow instead of seeking a generic “HIPAA-compliant” label.

Common mistakes and how to correct them

  • “The records are electronic, so HIPAA applies.” Correct the assumption by checking the covered electronic transaction and covered-entity definitions.
  • “I am in Canada, so HIPAA can never apply.” Check U.S. clients, covered entities, standardized transactions, business-associate contracts, and other U.S. connections before reaching a conclusion.
  • “PIPEDA is Canada’s HIPAA.” Treat PIPEDA as a federal commercial-activity law and identify the provincial private-sector or health-information statute that may govern local activity.
  • “A substantially similar province is exempt from all federal rules.” Check whether the activity is actually in-province; interprovincial and international flows can have a different analysis.
  • “Every mental-health note is a psychotherapy note.” Apply HIPAA’s separate-maintenance and content requirements. Ordinary progress and case notes are generally handled as part of the designated record set.
  • “A vendor’s marketing claim settles compliance.” Review the actual data role, contract, safeguards, access arrangements, and transfer locations under the laws that reach the practice.
  • “The same access rule applies in Canada.” Use HIPAA’s access distinction only for a HIPAA-covered situation; verify Canadian access rights under the governing provincial or federal regime.

What Canadian therapists should do next

Write down the practice’s province, organizational role, client locations, electronic transactions, vendors, and cross-border flows. Use that map to identify whether PIPEDA, a provincial private-sector statute, a provincial health-information law, HIPAA, or more than one regime applies to each activity. Keep clinical records and separately maintained personal notes clearly classified, use contracts that match the parties’ legal roles, and document high-risk disclosures.

The safest conclusion is deliberately narrower than a slogan: HIPAA is not automatically triggered by practising in Canada, and PIPEDA is not a universal substitute for provincial health-privacy law. The governing answer is the one reached from the actual jurisdiction, transaction, record, vendor, and disclosure facts.
