HealthWorX describes an employer-facing nonprofit–third-party administrator model, but the available public evidence does not establish that its plan is safer, compliant, or less expensive than other options. Federal guidance does establish that some employer arrangements reimbursing individual health-insurance premiums are group health plans subject to ACA rules. Employers should assess the specific plan documents, legal structure, coverage, operating arrangements, and total costs—not rely on a “section 105(b)” label or a vendor’s savings claims.

What “section 105(b)” does—and does not—tell an employer

Section 105(b) concerns the tax treatment of qualifying employer-provided benefits. Its mention does not, by itself, identify a complete plan design or establish that an arrangement satisfies the Affordable Care Act (ACA), ERISA, tax, or other applicable requirements. The decisive questions are what the employer actually does, how the plan is structured, and which rules apply to those facts.

The IRS says an employer payment plan generally includes an arrangement in which an employer reimburses employees for some or all premiums on individual health-insurance policies. Under Notice 2013-54, such arrangements are treated as group health plans subject to ACA market reforms; they generally cannot be integrated with individual policies to satisfy those reforms. The IRS describes a potential section 4980D excise tax of $100 per day per applicable employee, or $36,500 per employee per year, for the noncompliant employer-payment-plan situation it discusses. That is not a universal penalty for every arrangement that uses section 105(b). IRS guidance on employer health care arrangements

In a 2015 FAQ, the Department of Labor answered “No” to a specific vendor model: an employer cancels group coverage, sets up a section 105 reimbursement plan, helps employees select individual policies, and allows eligible employees to seek Marketplace credits. The DOL explains that the arrangement described is a group health plan, that employees enrolled in it are ineligible for premium tax credits or cost-sharing reductions, and that ACA market-reform failures can trigger section 4980D taxes. The answer addresses that fact pattern; it is not a ruling on HealthWorX or every benefit arrangement mentioning section 105. DOL ACA FAQ, Part XXII, Q3

What HealthWorX says it provides

In a September 3, 2026 press release, HealthWorX describes a “nonprofit–third-party administrator” model. The company says a mission-driven nonprofit supports healthcare access while a third-party administrator (TPA) manages enrollment, eligibility, plan operations, participant support, provider access, claims processing, and compliance. It characterizes the approach as providing healthcare services rather than returning payroll deductions as purportedly tax-free cash. These are the company’s descriptions, not independent verification of legal compliance, provider access, claims performance, or savings. HealthWorX press release distributed via PR Newswire, September 3, 2026

A July 28, 2026 company release emphasizes that the model requires operating infrastructure, not only plan documents or a benefits announcement. It does not provide independently audited performance measures. HealthWorX press release distributed via PR Newswire, July 28, 2026

The HealthWorX/WorXsiteHR compliance page identifies Wellness WorX, Inc. dba Xtension Health as its nonprofit partner and makes claims about nonprofit status and DOL audits. A company comparison document describes the plan as a section 125 ERISA healthcare plan and lists telemedicine, hospital indemnity, accident insurance, and life insurance. These interested-party materials do not establish that the IRS or DOL approved the particular plan. Employers should request the underlying records and determine what, if anything, was reviewed, by whom, and for which arrangement. Company compliance page; Company comparison document

How this compares with established reimbursement options

Individual coverage HRAs (ICHRAs) and qualified small employer HRAs (QSEHRAs) are distinct arrangements with specific statutory and regulatory conditions. They are not generic names for reimbursing individual premiums without limits. An employer should confirm eligibility and requirements for its own workforce and plan year.

Arrangement Key rules relevant to an employer 2026 figure and qualification
Individual coverage HRA (ICHRA) Final rules issued in 2019 allow an ICHRA to integrate with individual health-insurance coverage or Medicare if specified conditions are met. Employees offered affordable ICHRA coverage generally cannot receive Marketplace premium tax credits for those coverage months. If the offer is unaffordable, an employee may opt out and choose a credit if otherwise eligible; individual facts and the plan-year calculation matter. 9.96% affordability threshold, as stated by HealthCare.gov for 2026. HealthCare.gov ICHRA guidance
QSEHRA Must be funded solely by the employer, reimburse qualifying medical expenses after proof of coverage, generally provide the same terms to eligible employees, and satisfy eligibility requirements. An eligible employer generally cannot be an applicable large employer (ALE) and cannot offer employees a group health plan. Maximum permitted benefits for 2026: $6,450 self-only or $13,100 family, according to IRS Publication 15-B. These are plan-year limits and should be checked again for later years. IRS Publication 15-B (2026)
Employer premium-reimbursement arrangement An arrangement reimbursing individual-policy premiums may be an employer payment plan and a group health plan subject to ACA market reforms. Its treatment depends on its actual facts and structure; a section 105(b) label alone does not establish compliance. No generally applicable contribution figure established here. The IRS describes a potential excise tax for the noncompliant fact pattern discussed in its guidance, not for every section 105(b) arrangement. IRS employer-arrangements guidance

For ALEs, the employer shared-responsibility rules are a separate consideration: ALEs generally must offer full-time employees affordable coverage providing minimum value or could owe a payment if an employee receives a premium tax credit. A benefit vendor’s cost assertion does not show that an employer has met this obligation. IRS employer shared-responsibility Q&A

What the recent section 105(b) activity establishes

In a 2024 bulletin, Treasury and the IRS said they were not finalizing proposed amendments to section 1.105-2 at that time and cautioned that “No inference should be drawn” from that decision. The agencies also stated: “IRS compliance efforts regarding the exclusion from gross income under section 105(b) of the Code will continue to assist taxpayers to satisfy their existing tax responsibilities.” This supports the conclusion that tax treatment remains subject to compliance attention; it does not establish a new 2026 enforcement sweep against every plan described as section 105(b). What to verify before choosing a plan

  1. Identify the legal structure. Ask whether the proposal is an insured group plan, employer payment plan, ICHRA, QSEHRA, or another arrangement. Obtain the current plan document, summary plan description, required notices, and any insurance policy or certificates. Have benefits counsel assess the employer’s actual facts and applicable requirements.
  2. Calculate total cost on the same basis. Include employer contributions, employee payroll deductions, administration fees, premiums, uncovered expenses, and any costs shifted to employees. No independently verified HealthWorX employer-savings figure is established in the sources cited here.
  3. Check usable coverage and access. Review covered services, exclusions, cost sharing, prescription coverage, provider access, geographic availability, and the practical steps for obtaining care. Ask for the applicable policy and provider information rather than relying on general descriptions.
  4. Map operations and accountability. Confirm who determines eligibility, processes claims, handles appeals and complaints, maintains records, and bears insurance risk. Match each party’s claimed role to its contract and the plan documents.
  5. Assess credits and employer obligations. For individual-market coverage and an ICHRA, establish how the offer affects each employee’s premium-tax-credit eligibility. Separately assess ALE obligations where applicable; an employee generally cannot claim a Marketplace premium tax credit for a month in which an affordable ICHRA offer applies.
  6. Separate evidence from promotion. Distinguish official guidance, operative plan and insurance documents, independent audits or measured results, and vendor statements. Request the source and scope of any claimed approval, savings, provider access, or audit result.

What is not independently established about HealthWorX

The cited public materials do not establish current employer or employee prices; the complete current plan document and summary plan description; insurer and policy details; covered services and exclusions; network reach; actual claims-administration arrangements; eligibility and participation rules; the payroll funding arrangement; independent legal analysis of the current plan; or independently measured employer savings, worker access, retention, or medical outcomes. Until those points are documented and assessed, “safer” and “lower cost” remain claims to test rather than conclusions supported by the available evidence.
