There is no universally better visa. H-1B is usually the relevant route when a U.S. employer offers you a qualifying specialty-occupation job. L-1 is usually the relevant route when your existing non-U.S. employer is transferring you to a related U.S. entity and you meet the multinational-transfer rules. Start with that fact pattern—not with nationality, job title, or assumptions about which visa is easier.
The family difference can be decisive: a qualifying spouse admitted in L-2S status is employment-authorized incident to status, while an H-4 spouse generally needs separate U.S. work authorization under qualifying conditions. The sections below explain the eligibility tests, cap and transfer mechanics, maximum stays, evidence, family rights, and practical decision process for an Indian IT employee.
H-1B and L-1 in one view
| Question | H-1B | L-1 |
|---|---|---|
| What starts the case? | A U.S. employer offers a specialty-occupation position and files a petition. | A qualifying multinational organization transfers an employee from a foreign related entity to the United States. |
| Main worker test | The position requires theoretical and practical application of specialized knowledge and at least a bachelor’s degree or equivalent in the specific specialty. | The employee generally worked abroad for at least one qualifying year in the preceding three years and will work in L-1A managerial/executive capacity or L-1B specialized-knowledge capacity. |
| Annual selection | Cap-subject cases normally require electronic registration and selection before a cap petition. Some employers and petitions are cap-exempt. | No H-1B annual cap registration applies. |
| Employer relationship | The petitioning U.S. employer and the offered job must qualify. | The foreign and U.S. entities must have a qualifying parent, branch, subsidiary, or affiliate relationship and conduct business as required. |
| General maximum stay | Generally six years, with statutory exceptions. | Up to seven years for L-1A and up to five years for L-1B. |
| Spouse work status | H-4 spouses generally need USCIS work authorization under defined conditions. | A qualifying spouse admitted in L-2S status is employment-authorized incident to status. |
| What decides the result? | Actual duties, degree or equivalent, employer, worksite and cap status. | Entity relationship, foreign employment records, actual U.S. duties and specialized-knowledge or managerial evidence. |
The U.S. Department of Labor describes the specialty-occupation standard as “the theoretical and practical application of a body of specialized knowledge and a bachelor’s degree or the equivalent in the specific specialty.” Read the DOL H-1B program requirements before treating a software or IT title as sufficient.
USCIS describes the L route as enabling a U.S. employer to transfer an executive, manager or professional employee with specialized knowledge from an affiliated foreign office to a U.S. office. The USCIS L-status guidance explains the classification and employment-authorization evidence.

When H-1B fits an Indian IT employee
The position, not the title, must be a specialty occupation
An H-1B petition must connect the offered job’s normal duties to a specialized body of knowledge and to a bachelor’s degree or equivalent in the specific specialty. “Software engineer,” “systems analyst,” or “data engineer” on an offer letter does not prove eligibility by itself. The employer must be able to describe duties, required knowledge, degree requirements and the employment arrangement consistently across the petition and supporting records.
Your education must also match the position’s specialty requirement. A degree in an unrelated field, an incomplete credential, or an equivalency that cannot be documented can create a problem even when you have substantial IT experience. Gather degree certificates, transcripts and any credential-equivalency evidence before the employer prepares the filing.
Cap-subject cases and registration
The general statutory H-1B numerical limits are 65,000 visas or status grants per fiscal year, plus 20,000 places for beneficiaries with a qualifying U.S. advanced degree. A cap-subject employer normally registers the prospective beneficiary electronically and may file a cap petition only after selection. The registration process, dates, fee and selection mechanics change; the USCIS FY2025 registration materials are historical process guidance, not a current-year calendar.

Examples can include qualifying institutions of higher education, related nonprofit entities and certain research organizations, but the exact employer and job facts control. What the employer must coordinate
The employer is responsible for the labor-condition and petition process, including the offered wage, work location and terms represented to the government. Your case should use one consistent job description: the duties in the offer, labor filing and petition should describe the same role. A material change in employer, worksite or duties can require additional immigration action; obtain case-specific advice before changing assignments.

What Indian nationality does—and does not—change
Indian citizenship does not create a separate H-1B specialty-occupation standard or a preference in the cap. The legal questions are the position, your qualifications, the petitioner and whether the case is cap-subject. India-specific visa information matters later for visa issuance and travel, not as a substitute for the eligibility analysis.
When L-1 fits an Indian IT employee
A real qualifying corporate relationship is essential
The U.S. petitioner and the foreign employer must have a qualifying relationship, such as parent, branch, subsidiary or affiliate status, and the organizations must conduct business as required. Ownership, control and operating records matter. A company that merely has a commercial contract, reseller arrangement or common brand may not satisfy the statutory relationship test.

The employer should be prepared to show that both entities are genuine operating organizations, not only paper entities created for immigration purposes.
The one-year foreign employment rule
You generally must have worked full-time abroad for at least one qualifying year during the three years immediately preceding the L-1 filing or admission, depending on the case posture. The employment must have been with the petitioner or a qualifying related organization. Preserve contracts, payroll statements, tax or social-insurance records, dates of employment and descriptions of your actual duties.
Time spent in the United States can affect how the three-year lookback is calculated. Because the calculation depends on your travel and immigration history, an employer should verify the dates rather than relying on a résumé’s total years of experience.

Choose the capacity that matches the proposed U.S. duties
L-1A is for executive or managerial capacity. The petition must explain what you will manage, which personnel or essential function you will direct, your authority, and how your role fits the organization’s structure. A senior-sounding title is not enough if the day-to-day work is primarily individual production.

The evidence should identify what the knowledge is, how you acquired it, why it is uncommon or advanced within the organization, and why the U.S. operation needs it. General programming ability or familiarity with widely available tools does not automatically establish specialized knowledge.
An employee can move from one L capacity to another in appropriate circumstances, but the proposed U.S. job must be analyzed on its own duties. Do not infer L-1A or L-1B eligibility solely from your current Indian title.
Blanket petitions
A qualifying large organization may use a blanket L petition to streamline repeated transfers. A blanket approval does not waive the beneficiary’s one-year foreign employment, entity-relationship or role requirements. The individual transfer still needs supporting evidence and consular or USCIS processing appropriate to the case.
Detailed comparison for a practical decision
| Decision point | If your facts look like this | Route that may fit | Evidence to assemble |
|---|---|---|---|
| You have a direct U.S. offer from an unrelated employer | No qualifying foreign-to-U.S. corporate transfer exists. | H-1B may be relevant if the job is a specialty occupation; L-1 is generally unavailable on these facts. | Offer, detailed duties, degree records, employer information and cap status. |
| Your Indian employer owns or controls a U.S. entity | You have worked for the group abroad for the required period and will transfer internally. | L-1 may fit if the relationship and proposed L-1A or L-1B duties qualify. | Ownership documents, payroll history, organizational charts and role descriptions. |
| Your employer is hiring you into a U.S. role after you worked for a different company in India | There is no qualifying prior employment with the petitioner’s foreign organization. | H-1B may be the relevant employment route; L-1’s foreign-employment test may fail. | Specialty-degree match and employer petition records. |
| You need your spouse to work quickly | Family income or career continuity is a priority. | L-2S generally provides incident-to-status employment authorization; H-4 work requires separate eligibility and authorization. | Correct dependent classification, admission notation and current USCIS evidence rules. |
| You are near the end of prior H or L time | You have previous U.S. stays in H or L classifications. | Either route may have less time available than its headline maximum. | Passports, I-94 records, approval notices and complete travel history. |
A step-by-step decision process
- Identify the employment model. Write down whether a U.S. employer is hiring you directly or your current multinational employer is transferring you. If there is no qualifying transfer relationship, begin with H-1B analysis rather than L-1.
- Map the entities. For a possible L-1, document the ownership or control chain between the Indian and U.S. organizations. Confirm that each entity is operating and that the relationship is one recognized by the L rules.
- Build a duty-based job description. List your actual daily responsibilities, reporting line, authority, tools or systems, team structure and expected U.S. deliverables. Then test whether the job is a specialty occupation, managerial/executive role or specialized-knowledge role.
- Check the foreign-employment dates. For L-1, verify at least one qualifying year abroad in the relevant three-year period using payroll and employment records. Do not count general industry experience as a substitute.
- Check H-1B cap status. Ask whether the employer is cap-subject, cap-exempt or relying on another exemption. If cap-subject, confirm the current fiscal-year registration instructions on USCIS rather than using prior-year dates or fees.
- Calculate prior U.S. time. Collect every prior H-1B, L-1 or related admission record. The statutory maximum is not automatically the time remaining in your individual case.
- Plan the family classification. Decide whether a spouse will enter in H-4 or L-2S and review the work-authorization consequences before choosing a start date or relocating.
- Separate petition, visa and admission. USCIS adjudicates the petition or change-of-status request. The Department of State handles visa issuance abroad, and U.S. Customs and Border Protection decides admission and the authorized stay recorded at entry. Petition approval alone does not issue a visa or guarantee entry.
Maximum stay, visa validity and travel
The general statutory maximum is seven years for L-1A and five years for L-1B. Most H-1B workers are limited to six years, although statutory exceptions can extend H-1B time in some green-card situations. These are category-level limits, not promises that every person can remain for the full period. Read the U.S. Code provisions on H and L classifications and the Department of State H-visa guidance for the governing framework.

A visa stamp permits you to seek entry; it does not itself set the authorized stay. At admission, CBP issues an I-94 record showing the authorized-until date or status duration. Check that record after every entry and preserve approval notices and passports when calculating remaining time.
For Indian nationals, the Department of State’s India reciprocity schedule states that derivative H-4 and L-2 visas issued to accompanying or following-to-join dependents may not exceed the principal applicant’s visa validity. That is a travel-document rule, not a replacement for the individual I-94 or an independent calculation of authorized stay.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Spouse and dependent work rights
L-2S
A qualifying spouse admitted in L-2S status is employment-authorized incident to status. The admission notation and current USCIS employment-authorization evidence allow the spouse to complete Form I-9 without treating an additional employment-authorization application as the source of the underlying permission. Verify that the dependent was admitted in the correct spouse classification; dependent children do not receive the same spouse work authorization.
H-4
H-4 status alone does not give every spouse automatic permission to work. The Department of State explains that an H-4 dependent may not accept employment unless USCIS grants work authorization under qualifying conditions or the person independently holds another work-authorized category. Do not promise that an H-4 spouse can work, and do not state categorically that an H-4 spouse can never work; eligibility depends on the principal worker’s circumstances and the current USCIS rules.

Family travel planning
Keep each dependent’s passport, visa, approval notice and I-94 aligned with the principal worker’s records. A dependent visa’s validity can be shorter than expected under the India reciprocity schedule, and visa validity does not extend the admission period shown by CBP.

Evidence checklist
For an H-1B case
- Detailed U.S. job description showing specialized duties and the required specific specialty.
- Degree certificates, transcripts and documented equivalency where applicable.
- Offer letter, worksite and reporting information.
- Employer records supporting the business, wage and petitioning relationship.
- Current-year cap registration or evidence of a cap exemption, when relevant.
- Prior U.S. approval notices, passports and I-94 records for any time calculation.
For an L-1 case
- Foreign and U.S. entity formation, ownership and control records.
- Proof of at least one qualifying full-time year abroad in the relevant three-year period.
- Foreign payroll, tax, employment and duty records.
- Organizational charts identifying reporting lines, personnel and the proposed U.S. position.
- For L-1A, evidence of managerial or executive authority and the function or people managed.
- For L-1B, a specific explanation of specialized knowledge and why the U.S. operation needs it.
- Evidence of the organizations’ active business operations and, if used, blanket-petition documentation.
Costs, timing and statistics you should not assume
Filing fees, registration dates, premium-processing availability, USCIS processing times and consular appointment waits in India can change. The sources cited here do not establish a current fee schedule, interview wait or processing-time promise. Check the current USCIS, DOL and Department of State pages immediately before filing and budget for possible legal, translation, credential and travel costs separately from government fees.
The 65,000 H-1B cap and 20,000 advanced-degree exemption are annual statutory limits, not selection odds for an Indian applicant. USCIS’s FY2024 H-1B characteristics report contains administrative data and notes limitations in self-reported fields; it should not be converted into an H-1B-versus-L-1 approval probability. No verified figure in the cited material establishes a current Indian applicant’s selection odds, L-1 approval odds, processing time or interview wait.
Common mistakes and how to avoid them
- Choosing from the job title: replace the title with a duty-by-duty analysis and the degree or specialized-knowledge requirement.
- Calling every internal move an L-1: verify the legal entity relationship and the one-year foreign employment rule.
- Assuming L-1 avoids scrutiny: USCIS still examines corporate records, actual duties and evidence of specialized knowledge or managerial capacity.
- Using old H-1B dates or fees: FY2025 registration instructions are not a current fiscal-year calendar.
- Confusing visa validity with stay: use the CBP I-94 record for the authorized-until date.
- Promising spouse employment: confirm L-2S notation or H-4 eligibility and USCIS authorization before the spouse accepts work.
- Ignoring prior U.S. time: calculate previous H and L stays before relying on the six-, seven- or five-year headline.
- Treating petition approval as entry permission: USCIS, the Department of State and CBP perform different functions, and each stage can raise separate issues.
When professional review is worthwhile
A U.S. business-immigration attorney can be useful when ownership is layered, duties are split between entities, your degree is not an obvious match, your foreign employment includes leave or transfers, you have substantial prior U.S. time, or your spouse’s work plans affect the decision. Employer immigration counsel should review the petitioning entity, job description, payroll evidence and filing strategy; a separate attorney can review family or status issues. Professional help is optional, but no responsible adviser can guarantee selection, approval, visa issuance or admission.
Recommended Free Tools
Before committing to a route, have the employer produce a written fact summary covering the U.S. role, foreign and U.S. entities, employment dates, prior U.S. status, cap category and dependent classifications. That document gives counsel and the employer the same factual foundation and exposes missing evidence early.
