Short answer: H-1B eligibility is built around a U.S. specialty-occupation job and a worker qualified for that specialty. L-1 eligibility is built around a qualifying multinational-company relationship, the employee’s prior work abroad, and a transfer to a U.S. managerial, executive, or specialized-knowledge role. An employer and worker must match the facts to the correct framework; neither classification is a general substitute for the other.

H-1B vs. L-1: what creates eligibility?

H-1B and L-1 are both temporary U.S. employment classifications, but they answer different legal questions. H-1B asks whether the offered position is a qualifying specialty occupation and whether the worker meets that occupation’s requirements. L-1 asks whether related foreign and U.S. organizations qualify, whether the employee has the required qualifying service abroad, and whether the proposed U.S. position is managerial, executive, or based on specialized knowledge.

That distinction matters for technology companies, global employers, and employees deciding whether a new hire, an internal transfer, or an overseas assignment can support U.S. employment. A job can look highly technical without satisfying the L-1 rules, and a multinational employer cannot use an L-1 transfer simply because the position would otherwise qualify for H-1B. The evidence, timing, and employer obligations are different.

How H-1B eligibility works

The position must be a specialty occupation

USCIS describes a specialty occupation as work requiring highly specialized knowledge and at least a bachelor’s degree or equivalent in the specialty. A position can meet the standard in several ways. One route is that a degree in a specific specialty is normally a minimum entry requirement. Another is that the position’s specialized and complex duties are associated with the practical application of knowledge normally gained through such a degree.

The analysis concerns the actual job being offered, not merely the employer’s industry or a generic job title. An employer should be able to explain the duties, the technical or professional knowledge those duties require, and why the role is connected to a specific field of study. Titles such as “engineer,” “analyst,” or “developer” do not establish eligibility by themselves.

The worker must meet the specialty’s qualification route

The beneficiary must also qualify for the specialty occupation. USCIS background material identifies routes that can include:

  • A qualifying U.S. bachelor’s degree or higher in the relevant specialty.
  • An equivalent foreign degree.
  • A required professional license, where the occupation requires one.
  • An accepted combination of education, training, and experience that is equivalent to the required degree.

The employer’s job description and the worker’s evidence must align. A worker’s credentials do not cure a job description that fails the specialty-occupation test, and a qualifying position does not cure a beneficiary who lacks the required specialty qualifications.

The employer uses an LCA and a USCIS petition

The H-1B process described in USCIS employer material begins with a Labor Condition Application (LCA) filed with the U.S. Department of Labor, followed by an H-1B petition to USCIS. The LCA identifies the job, salary, length of employment, and geographic location. The employer agrees to pay the greater of the actual wage paid to comparable employees or the applicable prevailing wage described for the job and location.

The cited USCIS background report is historical. Current forms, electronic registration requirements, filing windows, fees, exemptions, worksite rules, and adjudication procedures must therefore be checked against current Department of Labor and USCIS instructions before filing. The broad sequence—LCA followed by the USCIS petition—does not by itself establish that a particular case is cap-subject, exempt, timely, or approvable.

How L-1 eligibility works

A qualifying corporate relationship is essential

L-1 is an intracompany-transfer classification. The U.S. petitioner and the foreign organization must have a qualifying relationship, such as parent, branch, affiliate, or subsidiary status. The relationship must be supported by organizational and ownership evidence rather than by a commercial contract or a loose business association.

For a non-new-office case, USCIS looks for evidence that the petitioner is a qualifying U.S. or foreign legal entity; that the organization does business as an employer in the United States and at least one other country; and that it will continue doing business during the employee’s stay. “Doing business” is a substantive requirement concerning regular, systematic, and continuous provision of goods or services, not merely the existence of a paper entity.

The employee needs qualifying service abroad

The employee must have worked full-time for the petitioner or a qualifying related organization for at least one of the three years immediately preceding the relevant period, in a qualifying capacity. The foreign assignment and the proposed U.S. assignment do not have to be identical. An employee may move into a different qualifying capacity in the United States, provided the proposed role satisfies the applicable L-1A or L-1B standard.

The record should connect the person’s employment history to the related entity, establish full-time service, identify the dates and location of the foreign work, and describe the duties performed there. Payroll, organizational charts, assignment records, and detailed duty statements are commonly important forms of corroboration, although the exact evidence required depends on the facts and current USCIS instructions.

The U.S. job must fit L-1A or L-1B

L-1A covers qualifying executives and managers. L-1B covers employees with specialized knowledge. The proposed U.S. duties, authority, reporting structure, and organizational context determine which subcategory is appropriate.

  • L-1A: The U.S. role must be primarily managerial or executive. The petition should explain the employee’s authority, the functions or organization managed, and how the position operates at a managerial or executive level rather than as an individual contributor.
  • L-1B: The U.S. role must involve specialized knowledge. The employer should identify the knowledge, explain why it is specialized in the organization’s products, services, research, equipment, techniques, or procedures, and show how the employee will apply it in the United States.

Calling an employee a “manager” or a subject-matter expert is not enough. USCIS evaluates the duties and the surrounding business facts, including the organization’s size, structure, staffing, and the employee’s actual authority or knowledge.

H-1B and L-1 compared

Question H-1B L-1
What creates eligibility? A qualifying specialty-occupation position and a worker who meets that specialty’s requirements. A qualifying multinational relationship, qualifying prior employment abroad, and an eligible U.S. transfer role.
What is the central employee test? Whether the worker has the required degree, equivalent credentials, license, or accepted education-and-experience combination for the specialty. Whether the worker completed the required full-time service abroad for a qualifying related organization and is transferring into an L-1A or L-1B role.
What is the central employer test? Whether the job qualifies, the LCA and wage obligations are met, and the petition accurately describes the employment. Whether the entities have a qualifying relationship, conduct business in the required countries, and can support the proposed transfer and role.
Typical evidence focus Detailed duties, specialty-degree connection, worker credentials, LCA information, wage, worksite, and employment terms. Corporate ownership or control, business activity, foreign employment history, organizational charts, and L-1A or L-1B duties.
Does the worker need prior employment with the employer? Not as an H-1B eligibility element; the key issue is the qualifying job and the worker’s specialty qualifications. Yes. The employee generally must have worked full-time for the petitioner or a qualifying related organization for at least one of the preceding three years in a qualifying capacity.
Does the U.S. and foreign job need to be identical? There is no L-1 transfer comparison to make; eligibility turns on the U.S. specialty occupation and the worker’s qualifications. No. The employee may move into a different qualifying capacity in the United States, but the new role must independently satisfy L-1A or L-1B requirements.
Special routes Cap treatment, exemptions, registration, filing windows, and related procedures require current, case-specific checking. New-office and blanket-petition routes have additional rules and evidence; they are not universal requirements.

This comparison is a framework for issue-spotting, not an eligibility determination. Immigration classification depends on the particular employer structure, job, employee history, and current rules.

What an employer must document

H-1B employer checklist

  • Describe the position’s day-to-day duties and explain the connection to a specific specialty degree.
  • Identify the work location, salary, length of employment, and other details required for the LCA and petition.
  • Establish that the offered wage meets the greater-of-actual-or-prevailing-wage obligation described in the USCIS material.
  • Provide evidence that the beneficiary has the required U.S. or foreign degree, license, or accepted equivalent combination of education, training, and experience.
  • Check current cap applicability, exemptions, registration, filing windows, forms, fees, and worksite requirements rather than relying on a prior filing cycle.

L-1 employer checklist

  • Prove the legal relationship between the U.S. petitioner and the foreign organization through ownership, control, or other qualifying evidence.
  • Show that the organization does business as an employer in the United States and at least one other country and will continue doing so during the stay.
  • Document the employee’s full-time service abroad for at least one of the last three years in a qualifying managerial, executive, or specialized-knowledge capacity.
  • Describe the proposed U.S. duties and explain why they are primarily managerial, executive, or specialized-knowledge work.
  • Match the petition to L-1A or L-1B; do not rely on a generic “transfer” description.

Step-by-step: evaluating a potential H-1B case

  1. Define the actual job. List the essential duties, tools, technical decisions, supervision, deliverables, location, salary, and expected length of employment.
  2. Test the specialty connection. Determine whether a degree in a specific specialty is normally a minimum entry requirement or whether the duties are sufficiently specialized and complex to be associated with such a degree.
  3. Map the worker’s credentials. Confirm the relevant U.S. degree, equivalent foreign degree, license, or accepted education-and-experience route.
  4. Check the LCA facts. Confirm the geographic location, salary, employment period, and wage obligation. The employer must meet the greater of the actual or prevailing wage identified for the job.
  5. Check current procedural rules. Verify whether the case is cap-subject or exempt, whether registration or a particular filing window applies, and which forms and fees are current.
  6. File the USCIS petition after the LCA step. The petition should present a consistent job description, wage, location, and credential record.

A change in worksite, duties, salary, employer, or employment structure can affect the analysis. Those changes should be reviewed under the rules and forms in effect when they occur.

Step-by-step: evaluating a potential L-1 case

  1. Map the corporate structure. Identify the U.S. petitioner, foreign employer, ownership chain, and whether the relationship is a parent, branch, affiliate, or subsidiary relationship.
  2. Confirm active business operations. Establish that the organization conducts business as an employer in the United States and at least one other country and will continue doing so during the proposed stay.
  3. Audit the employee’s foreign service. Verify full-time employment for at least one of the last three years with the petitioner or a qualifying related organization, including dates, entity, location, and qualifying duties.
  4. Select L-1A or L-1B. Decide whether the U.S. role is primarily managerial or executive, or instead requires specialized knowledge.
  5. Draft the U.S. role around duties. Explain reporting lines, authority, personnel or functions managed, business impact, or the specific organizational knowledge the employee will use.
  6. Determine whether a special route applies. A new-office petition and a blanket petition have distinct evidence and eligibility rules. Do not use their requirements as a checklist for every individual L-1 case.
  7. Assemble entity and personnel evidence. The corporate relationship, ongoing business, foreign employment, and proposed U.S. duties should tell one consistent story.

New-office L-1 petitions

A new-office petition is a narrow L-1 situation in which the U.S. office is being established. USCIS identifies additional evidence concerning the proposed office’s nature, organizational structure, financial plans, investment, and ability to pay the employee. The business must also secure sufficient physical premises.

For an individual new-office petition, USCIS says initial approval is limited to no more than one year. An extension requires further evidence that the office and qualifying operations have developed as represented. This one-year limit applies to the new-office circumstance; it should not be generalized to every L-1 petition.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Blanket L petitions

A blanket L petition is advance approval for a qualifying organization, not approval of a particular beneficiary. The individual employee still needs to satisfy the applicable L-1 classification and transfer requirements.

USCIS lists organization-level conditions that can support the blanket route. The organization must have three or more domestic and foreign branches, subsidiaries, or affiliates, and must meet one of these thresholds:

Blanket-petition threshold What the threshold describes
Petition volume At least 10 approved L manager, executive, or specialized-knowledge petitions during the previous 12 months.
Sales At least $25 million in combined annual sales of U.S. subsidiaries or affiliates.
U.S. workforce At least 1,000 U.S. employees.

These are criteria for the blanket-petition route, not universal requirements for every L-1 employer or beneficiary. A company that does not qualify for a blanket petition may still need to evaluate an individual L-1 filing under the ordinary rules.

Dependents and family considerations

USCIS states that an L-1 worker may be accompanied or followed by a spouse and unmarried children under 21 in L-2 status. It also explains that a spouse admitted in L-2S status is employment-authorized incident to status for Form I-9 purposes. Employers and families should confirm current admission documentation and verification procedures before relying on that authorization in a particular case.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

The available material does not establish a parallel, current comparison of H-4 dependent work authorization. Therefore, an H-1B-versus-L-1 decision should not assume that the L-2S rule answers the H-4 question. H-1B families need a separate, current review of the dependent classification and any employment authorization requirements.

Common mistakes and how to avoid them

Treating the classifications as interchangeable

An employer may see a technical role and immediately choose H-1B, or see a global company and immediately choose L-1. That shortcut ignores the controlling eligibility element. H-1B is job-and-qualification driven; L-1 is relationship-and-transfer driven.

Using a title instead of duties

“Manager,” “executive,” and “specialist” are labels, not proof. The petition should show what the person actually does, what authority the person exercises, and how the work fits the selected category.

Ignoring the corporate relationship

A vendor, customer, investor, or strategic partner is not automatically a qualifying L-1 relationship. The U.S. and foreign entities must fit the required parent, branch, affiliate, or subsidiary structure, supported by reliable legal and ownership records.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Assuming a blanket petition approves everyone

Blanket approval concerns the organization-level route. Each beneficiary still requires an individual classification analysis, including qualifying foreign employment and an eligible U.S. role.

Applying new-office rules to established offices

The additional business-plan, premises, investment, and one-year initial-approval rules belong to the new-office context. They are not a universal L-1 evidence list.

Relying on outdated procedural information

Cap dates, registration, forms, fees, exemptions, filing procedures, and stay rules can change. The historical H-1B source supports the broad LCA and specialty-occupation framework, but it should not be used as a current filing calendar. Current USCIS and Department of Labor instructions control the filing made today.

Which classification may fit?

If the facts look like this… Start with this question
The employer is hiring a person for a professional or technical position, but there is no qualifying foreign-company transfer history. Does the position qualify as a specialty occupation, and does the worker meet its degree or equivalent requirements?
The employee already works for a related foreign organization and will move to a U.S. office. Do the entities have a qualifying relationship, does the employee meet the prior-service rule, and is the U.S. role L-1A or L-1B?
The employee will help launch a U.S. office. Does the case satisfy the new-office evidence requirements, including premises, plans, investment, and ability to pay?
The multinational employer transfers employees frequently. Does the organization meet the blanket-petition thresholds, and does this individual still qualify on the merits?
The employer wants a fast answer based only on the job title or company name. What documentary evidence proves the actual duties, credentials, entity relationship, and employment history?

This framework helps identify the right questions; it does not replace a case-specific legal review. A company should obtain current immigration counsel or qualified mobility advice when ownership, job duties, work locations, prior employment, or dependent plans are complicated.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Facts that require current verification

Several important details are not established by the cited materials and should not be guessed:

  • Current H-1B cap dates, registration mechanics, cap exemptions, and filing windows.
  • Current form editions, government fees, evidence standards, and procedural instructions.
  • Complete stay-period and extension comparisons for H-1B, L-1A, and L-1B.
  • A full, current comparison of H-4 and L-2 dependent employment authorization.
  • Any current statistical comparison of H-1B and L-1 approvals, denials, or beneficiaries.

Those items can materially change a filing strategy. Confirm them from the current USCIS and Department of Labor guidance applicable to the employer, worker, nationality, worksite, and filing date.

The practical distinction

Choose the H-1B analysis when the case is fundamentally about a U.S. job that requires specialized knowledge normally associated with a specific bachelor’s degree or equivalent, and the worker has the corresponding credentials. Choose the L-1 analysis when the case is fundamentally an internal transfer within a qualifying multinational structure and the employee has the required prior service abroad for a managerial, executive, or specialized-knowledge role.

Once that distinction is clear, the evidence follows: H-1B centers on the specialty occupation, worker qualifications, LCA, wage, and petition; L-1 centers on corporate relationship, ongoing international business, foreign service, and the proposed transfer role. New-office and blanket procedures add specialized paths within L-1, while cap and filing details make current H-1B verification indispensable.
