Short answer: An H-1B is a temporary, employer-sponsored U.S. work classification for a job that qualifies as a specialty occupation. A U.S. employer (or qualifying U.S. agent) normally files Form I-129 after obtaining a certified Labor Condition Application (LCA) from the Department of Labor (DOL). You cannot use the ordinary employer-petition route to self-sponsor. For cap-subject jobs, the employer generally must register you and be selected before filing the petition.
Approval is not automatic. USCIS separately examines the position, your qualifications, the employer’s evidence, and any cap requirements. A petition approval, a change to H-1B status in the United States, and an H-1B visa stamp for travel are different outcomes.
What an H-1B does for a technology worker
H-1B classification lets a U.S. employer employ a foreign worker in a qualifying specialty occupation. The classification is tied to the petitioning employer, the described role and work locations, and the approved validity period. It is not an open work permit that lets you change employers or work any job.

In technology, titles such as software engineer, data analyst, cloud architect, cybersecurity specialist or IT specialist do not qualify by title alone. USCIS looks at the actual duties, the minimum entry requirements and the evidence that a bona fide position will be available when the requested H-1B period begins.
Can I get an H-1B as a software engineer or other tech worker?
Usually, a technology role is strongest when its duties require specialized knowledge and a bachelor’s or higher degree in a directly related, specific specialty (or an accepted equivalent). USCIS’s Form I-129 instructions, edition January 17, 2025, describe “directly related” as a logical connection between the degree field, or its equivalent, and the job duties.

What makes the position a specialty occupation
- The employer must show that the offered position requires specialized knowledge.
- The minimum entry requirement must be a U.S. bachelor’s or higher degree in a directly related specific specialty, or an equivalent qualification.
- A general degree with no further specialization is not enough under the USCIS instructions.
- The petition should document the real duties, the required knowledge and why those requirements are normal for this particular position.
- Evidence must show that a bona fide job will exist by the requested start of the H-1B validity period.
A range of degree fields can be acceptable when every listed field is logically connected to the duties. The issue is not whether the job title sounds technical; it is whether the employer can prove the specialty requirements from the position’s duties and entry criteria.
Does my degree have to match my tech job exactly?
No exact title match is required, and “any bachelor’s degree” is not a safe rule. USCIS evaluates the relationship among the job’s minimum specialty, the degree field and the duties. For example, a petition may explain why computer science, software engineering or another specifically related field supplies the knowledge needed for a software-development role. The employer must make that connection in the evidence rather than relying on the occupation’s title.

Position eligibility and worker eligibility are separate questions. Even when the job qualifies, you must document that you meet its specialty requirement.
Accepted ways to show the required qualification
- A U.S. bachelor’s or higher degree in the required specialty.
- A foreign degree accompanied by evidence that it is equivalent to the required U.S. degree.
- A combination of education, specialized training and progressively responsible experience evaluated as equivalent to the required U.S. degree.
- Any state license or other official permission required to practice the occupation.
Gather the diploma and transcripts for a U.S. degree, or a credible equivalency evaluation and underlying academic records for a foreign degree. If relying on experience or training, the petition needs documentation showing how that background equals the required degree-level specialty. USCIS makes the decision from the complete record; a résumé by itself may not establish equivalency.
Who sponsors an H-1B and what the employer must do
The U.S. employer or a qualifying U.S. agent files Form I-129. Before the petition, the employer submits Form ETA-9035/9035E, the LCA, through DOL’s FLAG system. The LCA identifies the occupation, wage, worksite or worksites and working-condition attestations. DOL says it must not be filed more than six months before the employment start date and reviews it for completeness and obvious errors.

- Define the role. The employer documents duties, minimum degree specialty, work locations, start date and the availability of a real position.
- Set the required wage. The employer compares its actual wage for similarly experienced and qualified employees with the applicable prevailing wage for the occupation and area.
- File the LCA. Form ETA-9035/9035E is submitted in FLAG with the wage and working-condition attestations. The employer waits for certification.
- Complete cap registration when required. For a cap-subject case, the employer registers the beneficiary in the USCIS system during the announced fiscal-year window.
- Wait for selection if the case is cap-subject. A selected registration supplies permission to file during the stated filing period; it is not an approval of the petition.
- Prepare Form I-129 and exhibits. The employer submits the certified LCA, position evidence, proof of the worker’s qualification, employer information and any required selection evidence.
- File with USCIS. The filing must use the current form edition, fees and filing location listed in USCIS instructions. USCIS’s H-1B checklist requires a valid beneficiary confirmation number and selection notice for relevant cap petitions.
- Respond to any request for evidence. USCIS may ask for clarification of the duties, degree relationship, worksite, employer or other eligibility evidence.
- Complete the post-approval step that fits your situation. A worker already in the United States may seek a change of status if eligible. A worker outside the United States generally follows Department of State visa-application and admission procedures.
Do I have to be selected in the H-1B lottery?
Only some cases are cap-subject. DOL describes an annual statutory limit of 65,000 regular H-1B places plus 20,000 places under the U.S. advanced-degree exemption. For a cap-subject filing, USCIS requires the beneficiary confirmation number and registration selection notice. Registration and selection therefore come before the petition.
Not every H-1B filing follows that sequence. Some employers and filing categories may be cap-exempt or otherwise counted differently. The employer must confirm the category under the current USCIS instructions; do not assume that a nonprofit, research connection or prior H-1B history automatically removes the cap.
What the 20,000 advanced-degree exemption means
The exemption is for a master’s or higher degree from a U.S. institution of higher education, subject to the current rules. It is an additional statutory allocation, not a guarantee of selection. A foreign master’s degree does not satisfy this particular exemption merely because it is advanced; the petition must meet the applicable U.S.-degree requirement.
Annual dates and forms change
Registration windows, selection notices, filing periods, fee amounts and acceptable form editions are announced by USCIS for each fiscal year. Use the current USCIS notice and Form I-129 instructions rather than dates from a prior season. A selected registration permits filing only within the assigned period and does not guarantee approval.

How H-1B wages and workplace protections work
The LCA wage promise is central to the program. The employer must pay at least the higher of:
| Wage measure | Meaning |
|---|---|
| Actual wage | The wage the employer pays workers with similar experience and qualifications doing the specific job. |
| Prevailing wage | The prevailing wage for the occupational classification in the area of intended employment. |
DOL’s Wage and Hour Division summarizes the rule this way: “You must be paid the actual wage, which is the same wage rate your employer pays other workers with similar experience and qualifications, or the local prevailing wage for the occupation in the area of intended employment, whichever is higher.”
Protections to understand before accepting an offer
- You must receive the required wage and qualifying pay for employer-caused nonproductive time.
- Fringe benefits must be offered on the same basis as to comparable U.S. employees.
- The employer must meet the LCA’s working-condition and recordkeeping obligations.
- Keep your own records of hours, pay statements and employer contact information.
- DOL identifies anti-retaliation protections for workers who raise concerns.
Employers may not require workers, directly or indirectly, to pay certain petition filing fees, a financial penalty for leaving before a contract date, or employer business expenses such as LCA preparation and filing attorneys’ fees. Fee responsibility depends on the particular fee and facts, so treat a demand that you pay everything as a warning sign and obtain advice before paying.
You should receive a copy of the LCA. Suspected wage or workplace violations can be discussed with DOL’s Wage and Hour Division.

Who pays H-1B filing fees?
The employer is responsible for the employer-side costs that law and DOL rules place on it, including prohibited shifting of specified petition-related fees and business expenses. Other charges can depend on the filing, the worker’s circumstances and the service requested. Because fee schedules and allocations change, review the current USCIS fee instructions and the LCA obligations instead of relying on a fixed internet checklist.

Ask for an itemized explanation identifying each charge, who pays it and whether it is refundable. Keep receipts and copies of the filed forms. Never sign an agreement that imposes an unlawful penalty for resigning or quietly deducts prohibited costs from wages.
After approval: change of status versus visa abroad
USCIS petition approval does not itself place a visa stamp in your passport. The next step depends on where you are and what the petition requested.
| Situation | What approval means | What still must happen |
|---|---|---|
| Eligible worker in the United States requesting change of status | USCIS may grant H-1B status from the approved effective date if the request and evidence qualify. | Follow the approval notice, maintain status until the change takes effect and obtain advice before international travel. |
| Worker outside the United States | The approved petition supports a visa application and admission request. | Follow current Department of State consular instructions and present the required documents; a petition approval does not guarantee visa issuance or admission. |
Consular appointment procedures, document lists and processing times can change. Check the current USCIS and Department of State instructions for your country and case. Do not book irreversible travel based only on an approval notice.
Important 2025–2026 policy issue: reported $100,000 condition
DOL’s H-1B program page reports that a presidential proclamation dated September 19, 2025 restricts issuance of H-1B visas, subject to a $100,000 payment condition for covered petitions filed after September 21, 2025, at 12:01 a.m. Eastern Daylight Time. The DOL summary does not establish every exception, implementation detail or whether a particular worker is covered.
Do not treat the $100,000 condition as a universal charge for every H-1B worker. Before filing, changing status or traveling, check the latest USCIS and Department of State guidance and obtain case-specific immigration advice. This policy is especially volatile, and agency instructions control the application of any proclamation.

Common mistakes and how to avoid them
Relying on the job title
Fix: describe the actual work, tools, level of responsibility and minimum degree specialty. A technical-sounding title is not proof of a specialty occupation.
Claiming that any bachelor’s degree is enough
Fix: connect the degree field or documented equivalent to the duties and explain why a general degree without specialization would not meet the role’s requirement.
Treating the LCA as an approval
Fix: remember that DOL certification covers wage and working-condition attestations; USCIS still decides the H-1B petition.
Confusing selection with approval
Fix: a selected registration only opens the filing opportunity. USCIS can still deny or request evidence on the petition.
Assuming approval equals travel permission
Fix: determine whether you need a change of status or a visa application abroad, then follow current agency instructions before traveling.
Accepting unlawful cost shifting
Fix: request an itemized fee explanation, retain the LCA and pay records, and contact DOL or qualified counsel if prohibited deductions or penalties are proposed.
A practical decision path
- Ask the employer for the exact job duties, minimum degree specialty, work locations and proposed wage.
- Compare your education or documented equivalent experience with that specialty requirement.
- Have the employer determine whether the case is cap-subject, cap-exempt or otherwise counted under current USCIS rules.
- If cap-subject, confirm registration and selection before expecting a petition filing.
- Verify that the LCA is certified and that its wage and worksites match the offer.
- Review the Form I-129 evidence, current fees and form edition before filing.
- After a decision, follow the correct change-of-status or consular path and recheck current policy, especially any proclamation affecting visa issuance.
This framework explains the federal process but cannot determine an individual’s eligibility, selection likelihood, approval, employment duration or travel permission. Those outcomes depend on the facts and the agency rules in force when the case is filed.
