A special bench of the Goods and Services Tax Appellate Tribunal (GSTAT), Delhi Principal Bench, has directed the Indian Railway Catering and Tourism Corporation (IRCTC) to deposit ₹50,41,44,461 in consumer-welfare funds for failing to pass a GST reduction on Rail Neer bottled water to consumers. The order, dated 14 October 2026, covers supplies made from 1 July 2017 to 31 May 2020.
What GSTAT ordered
The bench, comprising judicial member Justice Mayank Kumar Jain and technical member Anil Kumar Gupta, accepted the Directorate General of Anti-Profiteering (DGAP) calculation dated 11 June 2021. IRCTC must deposit the assessed amount within one month, dividing it equally between the Central Consumer Welfare Fund and the relevant state consumer-welfare funds.
Interest at 18% applies from 28 June 2019 until the amount is deposited. A 10% penalty is contemplated, but it will not apply if IRCTC pays the full profiteered amount and interest within 30 days of the order.

Why Rail Neer was examined
Rail Neer is IRCTC’s packaged drinking water sold on trains and at railway stations. IRCTC’s 2024–25 annual report records that, from 1 July 2017, its tax burden changed from an effective 24% combination of 12.5% excise duty with 45% abatement and 12.5% VAT to 18% GST.
The anti-profiteering allegation was that the tax reduction was not reflected in the consumer price. The National Anti-Profiteering Authority’s 2022 notice, as described in IRCTC’s annual report, quantified the claim at ₹5,041.44 lakh (approximately ₹50,41,44,000). GSTAT’s final assessed figure is ₹50,41,44,461.
The dispute over the ₹15 maximum retail price
The complaint said IRCTC continued charging a ₹15 maximum retail price after GST came into force. IRCTC’s defence relied on several points:

- IRCTC supplied water to railway departments and licensees rather than selling directly to passengers.
- Rail Neer was priced below competing packaged-water brands.
- Higher costs and the subsidised nature of supply justified retaining the existing price.
The tribunal separated control of the retail MRP from control of the transfer price. Its reasoning was that IRCTC could determine the price at which it supplied Rail Neer to railway departments and licensee-operated units. Therefore, even if the ministry-controlled MRP could not be changed, IRCTC could reduce its transfer price so that the GST benefit reached the end consumer.
What GSTAT said about government ownership and premium trains
GSTAT rejected the argument that government ownership or subsidised supply placed IRCTC outside the anti-profiteering requirement in section 171 of the Central Goods and Services Tax Act, 2017. The obligation to pass on a tax reduction applies to the pricing chain rather than depending on whether the supplier is privately or publicly owned.
The tribunal also held that Rail Neer supplied on premium trains was not complimentary. Although passengers might not see a separate water charge, the cost was included in the ticket fare. That meant the tax benefit still had to be considered in the price paid by passengers.

The money is not being awarded as damages to a named group of passengers. It is to be placed in consumer-welfare funds: half in the Central Consumer Welfare Fund and the balance in the appropriate state funds for the jurisdictions covered by the calculation.
Did GST make Rail Neer cheaper?
The tax rate applied to the product fell from the earlier effective 24% structure to 18% GST. GSTAT’s finding, however, was not that every bottle had to carry a particular new MRP. It was that the tax saving had to be passed through the pricing mechanism. Because the railway ministry controlled the displayed MRP, the tribunal identified IRCTC’s transfer price as the point at which the benefit could be passed on.

What happens next
- IRCTC is required to deposit ₹50,41,44,461 within one month of the 14 October 2026 order.
