Assumption: This guide applies to Canada’s GST/HST system. If the property is in another country, its rules may be entirely different. In Canada, GST/HST treatment does not follow a simple “business property versus personal property” label. The result depends on the owner, GST/HST registration, whether the activity is taxable or exempt, the property’s actual commercial use, whether it is capital real property or housing, and what happens after construction.
Generally, a GST/HST registrant may claim an input tax credit (ITC) for tax on capital real property only to the extent the property is used in commercial activities. Personal use and exempt activities can reduce or eliminate the claim. A later conversion can trigger a deemed sale or acquisition even when no property changes hands. A builder who constructs or substantially renovates housing can also face self-supply rules based on fair market value. Separate new-housing and rental rebates may apply, but they are not interchangeable with ordinary ITCs.
What determines GST/HST treatment
Canadian GST/HST analysis starts with the activity carried on in the property, not the owner’s description of the project. “Business use” in everyday speech can include activities that are exempt from GST/HST, while some property uses are personal even when they occur inside a registered business. The key questions are:
- Who owns or builds the property: an individual, corporation, or partnership?
- Is the owner registered, or required to register, for GST/HST?
- Is the property used to make taxable commercial supplies, exempt supplies, or both?
- What proportion of the property is actually used for each activity?
- Is it capital real property, a new residential complex, or substantially renovated housing?
- Was it occupied, leased, converted, or sold after construction?
- Which province applies, and what GST/HST rate and rebate rules are current when the transaction is reported?
Those facts can produce different outcomes for buildings that look similar physically. A commercial workshop, an exempt medical office, a long-term rental apartment, and a private residence do not receive the same treatment merely because each was constructed by a person who operates a business.

Business-use property: when construction GST/HST can be an ITC
For capital real property, the general rule is that a GST/HST registrant can claim an ITC for tax paid or payable to acquire, construct, or improve the property to the extent it is used in commercial activities. “Commercial activity” is a technical GST/HST concept. It generally includes making taxable supplies for consideration, but not every activity that earns income qualifies.
Taxable commercial use
Space used for taxable commercial operations—such as a workshop making taxable sales, an office providing taxable services, or premises leased under a taxable commercial lease—can support an ITC allocation. The credit is tied to the portion used for those activities and to the tax actually paid or payable on eligible costs. A GST/HST registration number by itself does not convert personal construction costs into business costs.
Exempt activity is different from taxable business activity
Some professional and financial services are exempt. A property used to earn exempt supplies may not generate the same ITCs as property used for taxable supplies. A professional who calls a room a business office therefore cannot assume that all construction GST/HST is recoverable. The tax status of the service supplied from that room must be determined first.

Individual personal-use restriction
The Excise Tax Act generally denies an individual registrant an ITC for capital real property acquired primarily for the individual’s, or a related individual’s, personal use and enjoyment. This restriction is separate from the ordinary percentage allocation for commercial use. It is why an individual’s home cannot automatically produce a full ITC simply because a business is operated there.
Mixed-use buildings and allocation of the ITC
When a property has both commercial and non-commercial areas, the claim must be allocated using a reasonable measure that reflects actual use. Floor area may be appropriate for separately identifiable rooms; time, output, or another supportable measure may be more appropriate where spaces are shared. The records should show how the measure was chosen and why it fairly represents use.
CRA’s mixed-use illustration
CRA’s memorandum describes an individual’s property used 25% for an exempt medical practice, 30% leased to a dentist, and 45% as a personal residence. The illustration describes a 30% ITC for the commercial-use portion—the area leased to the dentist. The 25% exempt practice and 45% residence do not create an equivalent credit. This example demonstrates the analysis; it is not a universal allocation formula for every building.

|---|---|---|
| Exempt medical practice | 25% | Not included in the described ITC |
| Leased to a dentist | 30% | Commercial portion used for the described ITC |
| Personal residence | 45% | Personal-use portion; no equivalent commercial ITC |
If a residential complex is used primarily as the individual’s residence, CRA says ITCs on its acquisition and improvements are not available under the personal-use restriction, although separate rules can affect operating expenses. “Primarily” and the actual pattern of use must be established from the facts rather than assumed from the presence of a home office.
Evidence that supports an allocation
- Architectural plans showing dedicated commercial and residential areas.
- Measured floor areas and a written explanation for shared-space calculations.
- Leases identifying the premises, use, and whether rent is taxable or exempt.
- Invoices that separate construction materials, equipment, professional fees, and improvements.
- Occupancy dates, photographs, utility records, and calendars for shared rooms.
- Corporate, partnership, or personal ownership documents and GST/HST registration records.
Individual, corporation, and partnership ownership
Ownership changes the available exceptions and the way personal use is analyzed. An individual who builds a home as a private residence is generally not treated as a “builder” for the residential self-supply rules unless the individual is acting in a business or in an adventure or concern in the nature of trade. A corporation or partnership does not obtain the same individual exception merely because a shareholder or partner occupies the housing.
For an incorporated project, the corporation’s use, leases, and supplies are examined. A shareholder’s private occupancy is not automatically the corporation’s commercial use. Partnerships require the same attention to the partnership’s activities and the partners’ rights to occupy or use the property. The legal owner, not simply the person who pays a contractor, should be identified before claiming tax.
What happens when use changes after construction
Capital real property has change-in-use rules. CRA generally treats an increase or decrease of 10% or more in the extent of commercial use as significant. A significant reduction can require the registrant to account for GST/HST on the portion moved out of commercial activities, unless the deemed sale is exempt. A significant increase can create a deemed acquisition for the additional commercial portion and may permit an ITC if the other conditions are met.
Stopping commercial use
If commercial use stops, CRA says the whole property can be treated as sold and reacquired under the relevant deemed-supply rules. This can apply even though the owner never lists the property or receives sale proceeds. The tax calculation may use basic tax content or fair market value, depending on the type of change and whether personal use is involved.

Moving a property to primarily personal use
For an individual who used capital real property commercially and then begins using it primarily for personal enjoyment, CRA explains that the individual may be considered to have stopped commercial use, sold the property, and collected GST/HST unless the deemed sale is exempt. Where personal use reaches at least 90%, two provisions can be engaged; CRA describes the combined result as the greater of tax calculated on fair market value or basic tax content. The actual deemed-tax computation must be made from the property’s facts.

Small changes can accumulate
A change below 10% is not a licence to ignore later changes. Successive changes can alter the property’s status over time, and complete cessation of commercial use is significant even if the final measured change is below that threshold. Keep dated records whenever a tenant leaves, a room is converted, a business closes, or personal occupancy expands.
Housing built or substantially renovated by a builder
Residential construction has an additional issue: self-supply. A “builder” is a defined GST/HST term, not simply anyone who hires a contractor. CRA’s home-construction guidance includes a person who acquires an interest while housing is under construction and completes it, and a person who converts certain properties into housing. An individual building a private residence is generally outside that definition unless the facts show a business or an adventure or concern in the nature of trade.
How self-supply works
When the rules apply, the builder can be deemed to have made and received a supply of the housing. CRA says the amount is generally based on the housing’s fair market value, including the building and land. The self-supply time is generally the later of substantial completion and first possession or use. Thus, no open-market sale is required before GST/HST accounting can arise.

The detailed result depends on the type of housing, occupancy, ownership, and any applicable exception.
Individual residence exception
CRA describes an exception for an individual builder who claims no ITCs and who, after completion, uses the housing primarily as a residence for the individual or a related person. The exception does not automatically transfer to a corporation or partnership when a shareholder or partner moves in. Confirm the legal owner and whether any ITCs were claimed before relying on it.
Mixed residential and commercial leasing
For a mixed-use property containing long-term residential leasing and commercial leasing, CRA says a deemed self-supply may apply only to the residential part. A later sale may be treated as two supplies: GST/HST generally applies to the commercial part, while the residential part may be exempt. New, never-occupied mixed buildings can be treated differently, so the construction history and first occupancy must be documented.

Long-term residential rent and commercial rent
Long-term residential rent is generally an exempt activity. That is materially different from taxable commercial rent. A landlord who builds apartments for qualifying long-term residential occupancy therefore should not assume that ordinary business ITCs are available on the construction costs. The landlord may instead need to examine a new residential rental property rebate or an enhanced purpose-built rental rebate.

Rebates that are separate from ITCs
New-housing rebates have their own claimant, occupancy, price, construction, and timing requirements. They should not be presented as a substitute for a commercial ITC.
New housing rebate for an individual residence
CRA’s current guide describes a federal rebate of 36% of GST, or the federal part of HST, up to $6,300 for eligible individuals who buy, build, or substantially renovate housing for use as a primary residence and are the first individual to live there. The guide states a price or fair-market-value threshold that generally excludes housing valued at $450,000 or more from that federal rebate. Provincial rebates can be separate. Rates, thresholds, and filing conditions are date-sensitive and should be checked against the current CRA material for the project.
New residential rental property rebate
A landlord who buys or builds qualifying new housing for long-term residential use may qualify for a new residential rental property rebate when conditions are met. CRA’s guide refers to expected primary-residence use by tenants for at least one year and required tax accounting. The owner must verify the eligibility tests, timing, and documentation rather than treating every rental building as eligible.

Enhanced rebate for certain purpose-built rentals
CRA also describes an enhanced rebate of 100% of the federal component for certain purpose-built rental housing. The guide includes construction commencement and completion windows and minimum-unit criteria. Because these windows and requirements can change, confirm the current rules before budgeting the project or filing a claim.

Practical comparison: business build versus personal build
| Question | Primarily taxable business use | Primarily personal residential use |
|---|---|---|
| Typical GST/HST recovery route | ITC to the extent of taxable commercial use, subject to registration and other requirements | Personal-use restriction generally blocks an individual’s capital-property ITC; a qualifying housing rebate may be relevant |
| Mixed use | Allocate using a reasonable, documented measure | Personal portion is not commercial; a home office does not make the whole build creditable |
| Later conversion | A 10% or greater change can trigger deemed-supply or deemed-acquisition rules | Moving to primarily personal use can trigger deemed sale and GST/HST accounting |
| Builder issue | Housing constructed or substantially renovated by a builder may be self-supplied | An individual private-residence exception may apply when no ITCs were claimed, but ownership and facts matter |
| Rental distinction | Taxable commercial rent can support commercial treatment | Qualifying long-term residential rent is generally exempt and may require a rental rebate analysis |
Step-by-step method for a real project
- Identify the jurisdiction and rate. Confirm the province, whether GST or HST applies, and the rate in effect when each invoice and deemed transaction is reported.
- Map ownership. Record the legal owner, beneficial owner, partners, shareholders, and any related-person occupancy.
- Confirm registration. Determine whether the owner is registered or required to register and whether the registration covers the activity generating the claimed ITC.
- Classify every activity. Separate taxable supplies, exempt supplies, and personal use. Do not combine an exempt professional practice with taxable commercial leasing simply because both produce income.
- Classify the property. Decide whether it is capital real property, a residential complex, substantially renovated housing, or a mixed building.
- Set the allocation method before claiming. Measure dedicated areas and shared use, document assumptions, and preserve plans, leases, invoices, and occupancy evidence.
- Separate tax by cost. Track land, construction, professional services, equipment, repairs, and improvements so that ineligible or differently used costs are not blended into one claim.
- Check builder self-supply. If housing was built, substantially renovated, converted, occupied, or leased, test the builder definition and the later-of-substantial-completion/first-use timing.
- Monitor changes. Recalculate when use changes by 10% or more, when commercial use ends, or when personal occupancy becomes primary. Review the 90% personal-use rule where it may apply.
- Test rebate routes separately. Compare the facts with the new housing, rental-property, or purpose-built rental rebate requirements; do not net a rebate against an ITC without confirming the filing rules.
- File and retain support. Keep tax invoices, calculations, leases, valuation evidence, occupancy dates, and the reasoning for each allocation with the GST/HST records.
Worked fact patterns
Standalone taxable workshop
A registered corporation constructs a workshop used exclusively for taxable manufacturing. The direct construction tax is connected with taxable commercial activity, so the corporation can generally examine an ITC for the eligible tax, subject to the normal documentation and timing requirements. If part of the building later becomes a private residence or exempt activity, the change-in-use rules must be reviewed from that date.
Home with a taxable leased office and private living area
An individual owns a house, leases a defined office to a tenant under a taxable commercial arrangement, and lives in the remainder. The claim is not automatically all-or-nothing. The commercial area may support an allocation, but the individual personal-use restriction and the exact lease terms must be applied. A defensible floor-area calculation and contemporaneous lease are important.
Medical practice in a residence
An individual operates an exempt medical practice from part of a home. The activity may be a business operationally, yet exempt supplies do not create the same ITC entitlement as taxable supplies. The home’s construction tax therefore cannot be claimed merely because patients are seen there.
Apartment building held for long-term tenants
A landlord constructs apartments intended for tenants’ long-term primary residences. Residential rent is generally exempt, so ordinary commercial ITC treatment may not apply. The owner should analyze the new residential rental property rebate and, if the project qualifies, the enhanced purpose-built rental rebate, using the current construction windows and unit requirements.
Common errors and how to correct them
- Claiming 100% because the owner is registered. Correct the claim by matching each cost to actual taxable commercial use.
- Treating every income-producing activity as taxable. Check whether the supplies are exempt, particularly long-term residential rent and certain professional services.
- Using a personal-property threshold for land or buildings. Capital real property generally uses an extent-of-use analysis; do not import a threshold that belongs to another property category.
- Ignoring corporate occupancy. A shareholder or partner living in corporation- or partnership-owned housing does not automatically receive an individual private-residence exception.
- Assuming no sale means no GST/HST. Deemed supplies can arise on self-supply or a change in use without an open-market transaction.
- Failing to record first possession. Builder self-supply timing generally depends on substantial completion and first possession or use.
- Leaving allocation until an audit. Prepare the method, measurements, and supporting documents while the build is underway.
- Using old rebate figures. The 36%, $6,300, $450,000, and 100% figures described in CRA’s current guide are subject to eligibility, timing, and legislative change. Verify the live rules before filing.
When professional advice is warranted
Obtain Canadian GST/HST advice before filing when the project involves a corporation or partnership, mixed residential and commercial leasing, a conversion from business to personal use, substantial renovation, a related-party occupancy, an uncertain exempt-versus-taxable activity, or a high-value fair-market-value calculation. Provide the adviser with ownership documents, registration details, plans, leases, invoices, use percentages, construction and occupancy dates, and the intended use after completion.
The safest conclusion is fact-specific: a property built for a business can support an ITC only to the extent the tax relates to taxable commercial activity, while personal or exempt use can restrict recovery. Housing self-supply and separate rebates can override a simple business/personal comparison, and later changes can create GST/HST even without a conventional sale.
