A GST summons, an inspection, a search and seizure, and an arrest are different legal powers under the Central Goods and Services Tax (CGST) framework. A summons seeks evidence or records; an inspection permits an authorised officer to examine specified premises; a search and seizure requires a separate statutory threshold; and an arrest is tied to specified section 132 offences and a Commissioner’s order. Receiving one does not automatically trigger the others, but each should be treated as a formal legal matter.
At a glance: four powers, four different consequences
The document you receive matters. A summons normally requires attendance or production of information. An inspection concerns access to specified business or other covered premises. Search and seizure goes further, allowing officers to look for and take possession of goods, books, documents or other things when the statutory conditions are met. Arrest concerns personal custody and arises under section 69 read with the specified offences in section 132.
| Power | Main purpose | Legal source | Who authorises it | Threshold or grounds | What the taxpayer should expect |
|---|---|---|---|---|---|
| Summons | Obtain evidence, a statement, documents or another thing in an inquiry | CGST Act, section 70 | Proper officer conducting the inquiry | Attendance is considered necessary for the inquiry | Appear on the stated date or promptly seek an adjustment; bring or produce the specified material |
| Inspection | Examine specified places and business records | Section 67(1) | Proper officer not below Joint Commissioner rank, by written authorisation to another central tax officer | Section 67(1) reasons-to-believe conditions, including suspected suppression, contravention to evade tax, or relevant goods or records in covered locations | Provide access to the identified premises and cooperate with the inspection while recording what occurs |
| Search and seizure | Locate and take possession of goods or material relevant to proceedings | Section 67(2), with related provisions in section 67 | Qualifying officer directly or by written authorisation to another central tax officer | Reasons to believe that confiscable goods or useful or relevant documents, books or things are secreted in a place | Allow the authorised search; obtain inventories and receipts for anything seized; preserve a contemporaneous record |
| Arrest | Place a person in custody in a specified GST-offence case | Section 69, read with section 132 | Commissioner, by order authorising a central tax officer | Reasons to believe the person committed an offence covered by section 132 | Receive the grounds of arrest, comply with the production requirement, and obtain urgent legal assistance on custody and bail |
These powers can appear during the same investigation, but one is not automatically a legal precondition for another. In particular, a summons does not itself authorise a search or arrest.
What a GST summons under section 70 means
What the officer may require
Section 70(1) permits the proper officer to summon a person whose attendance is considered necessary to give evidence or to produce a document or other thing in an inquiry. The recipient may be an individual, an employee, an officer of a company or another person who can provide relevant information. Read the document for the issuing office, the statutory section, the appearance date and time, the place, the subject of the inquiry and the records requested.

The Act treats the inquiry as a “judicial proceeding” for the purposes of the penal-code provisions identified in section 70(2). That designation does not turn every answer into an admission or make every statement automatically admissible in every prosecution. Section 136 sets out when a signed statement made in response to a section 70 summons may be relevant in a prosecution; admissibility still depends on the statutory conditions and the facts.
How to respond
- Verify the issuing authority, section 70 reference, appearance details and the precise list of records.
- Preserve the relevant books, invoices, returns, electronic records and correspondence. Do not destroy, alter or backdate anything.
- Prepare a factual chronology and identify who can answer each subject. Take professional advice before signing a statement if the inquiry could expose the taxpayer or another person to liability.
- Attend as required, or contact the issuing office promptly if a genuine difficulty makes the date, place or requested production impossible. Ask for a recorded adjustment rather than simply failing to appear.
- Keep copies of what you submit and make a note of questions asked, answers given and documents handed over.
CBIC guidance on use of summons
CBIC Instruction No. 03/2022-23, dated 17 August 2022, tells field officers to use summons judiciously. It raises concerns about routine summonses to very senior officials and requests for statutory records that are already available on the GST portal. Officers are asked to consider whether a letter requesting information would achieve the inquiry’s purpose. This is administrative guidance, not a blanket permission to ignore a summons. A recipient should still respond and raise any objection or practical difficulty with the issuing office.
Inspection under section 67(1)
Inspection is an access power
Section 67(1) deals with inspection, not custody. A proper officer who is not below the rank of Joint Commissioner may, when the statutory reasons-to-believe conditions exist, authorise another central tax officer in writing to inspect specified places of business or other places covered by the provision. The grounds concern suspected suppression or a contravention intended to evade tax, or goods and records connected with possible evasion in transport, a warehouse or another covered location.

Read the authorisation for the exact premises and scope. An inspection should not be treated as an unlimited licence to enter unrelated locations or examine material with no connection to the stated inquiry. Designate a responsible person to accompany officers, provide reasonable access and record which rooms, systems and files are examined.

Practical preparation for an inspection
- Ask to see the written authorisation and note the officer names, identification details, date and premises covered.
- Secure sensitive personal data and unrelated confidential material without obstructing access to records within scope.
- Have an IT representative preserve relevant systems and make a log of files copied or viewed.
- Record questions, explanations, documents supplied and any items taken for further examination.
- Do not argue about the merits of tax liability on the spot; provide accurate facts and reserve detailed legal submissions for the proper proceeding.
Search and seizure under section 67(2)
Why it is different from inspection
Section 67(2) is a separate power. The qualifying officer must have reasons to believe that goods liable to confiscation, or documents, books or things useful or relevant to proceedings under the Act, are secreted in a place. The officer may conduct the search and seizure or authorise another central tax officer in writing. The existence of an inspection does not by itself establish the section 67(2) threshold.
Section 67 contains provisions dealing with search procedure, inventory and related safeguards. The CGST Rules provide for an authorisation in FORM GST INS-01 and an order of seizure in FORM GST INS-02. Forms and procedural details can change with amendments, so check the version applicable on the date of the operation rather than relying on an old template.
During and after a seizure
Do not conceal, move or destroy anything covered by the authorisation. Ask officers to identify each seized item and preserve the inventory. Section 67(11), in the circumstances specified by that subsection, provides for a written receipt when accounts or documents produced before an officer are seized. Keep a copy of every inventory, receipt, panchnama or other record supplied, and note any disagreement accurately rather than refusing to sign a receipt that merely acknowledges delivery.

Arrest under section 69 and section 132
When arrest power arises
Arrest is not the routine next step after a summons, inspection or search. Under section 69(1), the Commissioner must have reasons to believe that a person committed an offence specified in section 132 and must authorise a central tax officer to make the arrest by order. The particular section 132 offence, its ingredients and its punishment category matter. A disputed tax demand or an ordinary investigation does not automatically satisfy those conditions.
Immediate safeguards and the 24-hour rule
In the specified arrest case, the person must be informed of the grounds of arrest and produced before a Magistrate within 24 hours. Section 69 also contains different bail treatment for different offence categories and gives the Deputy Commissioner or Assistant Commissioner specified bail-related powers for a non-cognizable and bailable offence. Because the result depends on the exact offence classification and current criminal-procedure law, do not assume that every GST arrest is bailable or that every case follows the same route.
Ask for the authorising order and written grounds, note the time of arrest, and request that the arrest memo accurately records the required particulars. Contact a criminal-tax lawyer immediately. The production deadline, bail category, and any challenge to the order should be assessed against the documents, not a generic checklist.

“If the Investigating Officer has no reason to believe that the accused will abscond or disobey summons and has, in fact, throughout cooperated with the investigation we fail to appreciate why there should be a compulsion on the officer to arrest the accused.”
This passage is a caution about the circumstances for exercising arrest discretion, not a promise that cooperation prevents arrest in every case. The Supreme Court’s decision in Radhika Agarwal v. Union of India (2025) addresses GST investigative powers and safeguards. CBIC Instruction No. 01/2025 is reported to require that grounds of arrest be explained and furnished in writing as an annexure to the arrest memo. For a live matter or litigation, verify the instruction and judgment against their authoritative full texts.

- Classify the document. Decide whether it is a summons, an inspection authorisation or notice, a search authorisation, a seizure order or an arrest-related document. The legal consequences are not interchangeable.
- Check authority and scope. Record the officer, statutory section, date, time, premises, appearance requirement, requested records and every attached order or authorisation.
- Check authenticity and DIN where applicable. CBIC Circular No. 128/47/2019-GST says specified communications without an electronically generated Document Identification Number are invalid unless an exception applies. Confirm that the communication falls within the circular’s scope and an exception has not been used before drawing a conclusion from a missing DIN.
- Preserve evidence. Freeze routine deletion of email, accounting and CCTV data. Keep an index of records produced, copied or seized.
- Respond without improvising. Give accurate information, avoid speculation and do not sign a factual statement you have not read and understood.
- Escalate promptly when custody or seizure is involved. Obtain qualified, case-specific advice, especially if officers mention arrest, confiscation, prosecution or a demand to unlock or surrender material outside the apparent scope.
Common misunderstandings
“A summons means I will be arrested.”
No. A summons is an evidence-gathering tool under section 70. Arrest requires the separate section 69 process, a section 132 offence and the Commissioner’s reasons-to-believe and authorising order. Ignoring a summons can create procedural and evidentiary problems, but the summons itself is not an arrest order.
“Inspection and search are the same.”
No. Inspection under section 67(1) and search and seizure under section 67(2) have different statutory grounds and consequences. Search and seizure requires the officer’s reasons to believe that confiscable goods or relevant material are secreted in a place.

“Payment settles every issue.”
Payment, cooperation or a statement may affect the facts, but none automatically substitutes for advice on the validity of a summons, authorisation, seizure or arrest. Keep the procedural record and obtain advice on the live matter.
What changed in 2026—and what has not been established
A PIB FAQ posted on 9 October 2026 says the GST Council recommended removing GST arrest provisions and raising the prosecution threshold, among other proposals. It describes recommendations, not enacted law. Do not report arrest powers as removed unless the relevant amendment has been enacted, commenced and published in the applicable Gazette. This area is moving quickly, so verify the law on the date of the notice or arrest.
The CGST Act text and CBIC materials provide the general central framework, but state GST practice, later amendments, the exact contents of a live notice and the validity of a particular search or arrest remain fact-specific. A taxpayer facing an actual communication should have the original documents reviewed by a qualified GST or criminal lawyer.
