Section 74 of the Central Goods and Services Tax (CGST) Act is the fraud-based demand route for tax periods up to financial year (FY) 2023-24. It applies when tax was not paid or was short paid, a refund was issued incorrectly, or input tax credit (ITC) was wrongly availed or utilised because of alleged fraud, wilful misstatement or suppression of facts to evade tax. A notice can demand the tax, interest under Section 50 and a penalty equal to the tax, although the Act provides lower penalty outcomes when payment is made at specified stages.

For FY 2024-25 onward, Section 74A is the new common demand framework. The Ministry of Finance’s 2024 explanation says the reduced-penalty payment period under that framework was extended from 30 days to 60 days. The exact provision and payment option that apply therefore depend first on the financial year under examination.

What Section 74 covers

Section 74 is not the ordinary provision for every GST discrepancy. The allegation must connect the tax shortfall, erroneous refund or wrongly availed or utilised ITC to one of three specified causes:

  • fraud;
  • wilful misstatement; or
  • suppression of facts to evade tax.

The notice must explain why the taxpayer should pay the amount, interest under Section 50 and the applicable penalty. Section 74(1) describes the demand as a notice “requiring him to show cause as to why he should not pay the amount specified in the notice along with interest payable thereon under section 50 and a penalty equivalent to the tax specified in the notice.”

Tax situations that can trigger a notice

  • Output tax was omitted or under-reported.
  • Tax was paid at a lower amount than required.
  • A refund was granted even though it was not admissible.
  • ITC was claimed or used without entitlement, where the department alleges the required fraudulent or evasive conduct.

A calculation error, documentation lapse or interpretive disagreement does not automatically establish Section 74. The notice should identify the conduct and evidence said to satisfy the fraud, wilful-misstatement or suppression test.

Penalty amounts and the payment windows

The headline Section 74 penalty is equal to the tax specified in the notice. The law also creates settlement windows with lower penalties. Interest remains separate in every window and must be paid for the applicable period.

When payment is made Tax to pay Interest Penalty Procedural result
Before service of the notice Amount of tax identified Section 50 interest 15% of that tax The statute says no notice is issued for the amount paid.
Within 30 days after service of the notice Tax specified in the notice Section 50 interest 25% of that tax Proceedings for that notice conclude.
Within 30 days after communication of the adjudication order Tax confirmed in the order Section 50 interest 50% of that tax Proceedings for the notice conclude for that tax.
No qualifying early payment Tax confirmed or otherwise payable Section 50 interest Up to 100% of the tax under the Section 74 demand The demand follows adjudication and recovery rules.

The 30-day periods are consequential. They run from the legally relevant event—service of the notice or communication of the order—not from an informal conversation, an internal email or the date a discrepancy was first discussed. Preserve proof of the service and communication dates.

What “conclusion” means

Payment under an applicable statutory window is intended to close the proceedings covered by that payment. It does not erase unrelated tax periods, other notices or liabilities outside the amount paid. Verify that the payment reference, tax period and demand number match the notice or order.

How interest under Section 50 works

Section 74 points to Section 50 for interest. Interest is additional to both tax and penalty; paying the penalty does not substitute for interest.

Section 50 situation Statutory ceiling stated in the Act What must be checked
Delayed payment of tax (Section 50(1)) 18% The government-notified rate and the period of delay applicable to the demand.
Undue or excess ITC claim or reduction of output-tax liability (Section 50(3)) 24% The notified rate, the date the credit or reduction is treated as improper and the statutory computation method.

The figures in the table are ceilings, not automatic rates for every notice. The applicable rate is notified by the government and can depend on the type of liability and period involved. Interest generally runs for the statutory period of delay, so the calculation should be reconciled to the relevant returns, payment dates, credit utilisation and the notification in force for that period.

Illustrative calculation

Assume, solely as an arithmetic illustration, that tax specified in a notice is ₹100,000 and the applicable interest calculation produces ₹12,000. Payment before notice would add a 15% penalty of ₹15,000, for an illustrative total of ₹127,000. Payment within 30 days of notice would add ₹25,000, for ₹137,000. Payment within 30 days of the order would add ₹50,000, for ₹162,000. These totals are not a determination of the correct interest rate or delay period for any particular business; those inputs must come from the notice, the applicable notification and the records.

Comparison point Section 73 Section 74 Section 74A
Financial year covered Used for demands not involving fraud, wilful misstatement or suppression; the relevant statutory version and period must be checked. Current Act text applies to periods up to FY 2023-24. Common framework for demands for FY 2024-25 onward.
Required allegation No fraud-based allegation. Fraud, wilful misstatement or suppression of facts to evade tax must be alleged and supported. Designed as a common framework whether or not fraud or suppression is alleged.
Penalty and payment window Different penalty rules apply under Section 73. 15% before notice, 25% within 30 days of notice, or 50% within 30 days of order; otherwise the headline penalty can equal the tax. The Ministry of Finance says the reduced-penalty period is 60 days; the applicable percentage and conditions must be read from Section 74A and the notice.
Interest basis Section 50, subject to the facts and notified rate. Section 50, subject to the facts and notified rate. Section 50, subject to the facts and notified rate.
Maximum order period Check the limitation rule for the period and provision cited. Generally five years from the due date for the annual return for the relevant FY, or five years from the date of an erroneous refund, subject to statutory adjustments such as court or tribunal stays. Uses the new common limitation framework; do not apply the pre-74A rule without checking the period and current text.

If an appeal or adjudication establishes that the fraud-based allegation is not proved, the demand is treated as a Section 73 matter rather than a Section 74 matter. That can affect the penalty analysis and is one reason a taxpayer should test the legal basis of the notice instead of treating every mismatch as fraud.

Limitation, notice timing and service

For pre-74A periods, the Section 74 order is generally subject to a five-year limit measured from the due date for the annual return for the relevant financial year. In an erroneous-refund case, the five-year reference point is the date of the refund. A court or tribunal stay can affect the computation.

The officer must issue the notice at least six months before the deadline for passing the order. A notice received close to the apparent deadline therefore requires an immediate date calculation: identify the financial year, annual-return due date or refund date, any stay period, the statutory order deadline and the date on which the notice was issued and served.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Why the service date matters

  • The 30-day 25% penalty window is tied to service of the notice.
  • The 30-day 50% window is tied to communication of the order.
  • A portal upload, email, physical delivery and other legally recognised modes can create different evidence trails.
  • Keep screenshots, portal acknowledgements, emails, delivery records and downloaded copies of the notice and annexures.

What to do when a Section 74 notice arrives

  1. Freeze the timeline. Record the date, time, portal location and mode of service. Note the notice number, tax period, response date and the statutory payment deadline.
  2. Reconcile the tax figure. Match the notice to GST returns, invoices, credit notes, e-way bills, bank and payment records, refund applications and the electronic credit and cash ledgers. Identify each invoice or transaction behind the department’s figure.
  3. Separate the three components. Build separate schedules for tax, Section 50 interest and penalty. Do not accept a combined figure that cannot be traced to transactions and dates.
  4. Test the Section 74 allegation. Ask whether the notice identifies evidence of fraud, a deliberate false statement or suppression intended to evade tax. Distinguish an intentional act from a clerical, classification, timing or interpretive error.
  5. Model the lawful options. Calculate the 15%, 25% and 50% outcomes only where the statutory stage is still open. Include the interest period and any tax already paid.
  6. Prepare the response or payment decision. A written professional review is prudent before conceding a fraud allegation, making payment or relying on a limitation objection.
  7. Preserve the record. Keep the notice, annexures, reply, hearing submissions, payment challans, ledger entries, acknowledgements and order together by tax period.

How payment and closure are recorded

GST payment is made through the electronic cash ledger and reflected in the electronic tax liability register. The rules and forms use distinct records for different stages:

Common mistakes and how to avoid them

Paying the tax but overlooking interest

Section 74 payment windows require tax, Section 50 interest and the specified penalty. Paying only the tax can leave the proceedings open and create a residual liability.

Assuming the 15% option remains open after notice

The 15% route is expressly a pre-service option. Once the notice has been served, the relevant reduced-penalty window is the 25% route and its 30-day deadline.

Accepting “suppression” without examining the evidence

A notice should connect the alleged omission or misstatement to an intent to evade tax. Request and analyse the relied-upon invoices, statements, system extracts and reconciliation logic.

Ignoring the financial-year boundary

Section 74 governs periods up to FY 2023-24, while Section 74A applies from FY 2024-25. A notice covering multiple periods may require separate provision, limitation and payment analyses for each year.

Failing to preserve portal records

Portal notices, acknowledgements and ledger postings can be difficult to reconstruct later. Download them when received and maintain an immutable internal copy with access logs.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

A practical decision framework

Use this sequence to decide whether to pay, reply, or do both:

  • Is the period up to FY 2023-24? If yes, test Section 74; if it is FY 2024-25 or later, examine Section 74A instead.
  • Is the tax computation correct? If not, prepare a transaction-level reconciliation and challenge unsupported items.
  • Does the evidence establish the required Section 74 conduct? If the notice shows only an error without an evasion-based allegation, obtain advice on the correct statutory route.
  • Is a payment window still open? Calculate the deadline from service or order communication and document the calculation.
  • Can the business fund the undisputed amount without waiving a defensible objection? Separate undisputed tax from disputed allegations and obtain professional advice on the consequences of each payment.

Keep a single schedule showing the tax period, notice and order dates, tax, interest, penalty percentage, amount paid, DRC-03 reference, ledger posting and closure document. That schedule helps prevent a payment intended for one period from being applied to another.

Key points to retain

  • Section 74 is the fraud-based demand provision for periods through FY 2023-24.
  • The defining allegation is fraud, wilful misstatement or suppression of facts to evade tax.
  • The standard penalty can equal the tax, with statutory reductions for payment before notice, within 30 days of notice or within 30 days of the order.
  • Section 50 interest is separate, subject to notified rates and the statutory delay period; the Act states ceilings of 18% for delayed tax and 24% for undue or excess ITC claims or output-tax reductions.
  • If the fraud allegation is not proved, the matter is treated as a Section 73 case.
  • Section 74A governs FY 2024-25 onward, and the Ministry of Finance says its reduced-penalty period is 60 days.
  • Service dates, limitation calculations and payment records can determine whether a reduced penalty and formal closure are available.
