The 57th GST Council recommended a package of changes to return reconciliation, input tax credit (ITC) refunds, refund processing and tax disputes. The proposed return mechanism may apply from the April 2027 return, while some refund eligibility changes have earlier or different proposed dates. These are recommendations, not proof that the changes are already law or live on the GST portal: check the relevant legislation, notifications, circulars and portal notices before relying on them.

What is proposed, and when could it take effect?

At its meeting on 8 October 2026, the GST Council recommended amendments to the CGST Act, CGST Rules and IGST Act, as well as circulars and GST portal changes. The Government of India’s explainer, published on 9 October, describes the proposals. The Council also recommended public consultation on the revised return mechanism. A recommendation, a statutory commencement date and a working portal feature are separate stages; the Council’s release does not establish that every measure has completed them.

Measure Proposed date or timing What the date means
Refund of accumulated ITC on input services for inverted-duty-structure claims Credit availed on or after 1 November 2026 Proposed eligibility date for the credit; final statutory text and claim conditions still matter.
Revised return-reconciliation mechanism May apply from the return for April 2027 The Council recommended consultation on the mechanism; this is not confirmation of a finalized filing process.
Refund of capital-goods ITC for zero-rated and inverted-duty-structure claims Credit availed on or after 1 April 2027 Proposed eligibility date, with refunds spread over 60 months; the final method and statutory terms need confirmation.
Other refund, registration, penalty and enforcement changes No common start date established in the recommendations summarized by the Council Check the applicable amendment, notification, circular or portal implementation for each measure.

The dates in the first three rows are not interchangeable: one concerns input-services credit, one a possible return period, and one capital-goods credit. Neither a proposed credit date nor the April 2027 return reference should be treated as an effective date for the entire package.

How could GST return filing and mismatch correction change?

The central compliance proposal is to bring reported outward-supply liability and available ITC into closer alignment across GSTR-1, GSTR-1A or IFF, GSTR-3B and GSTR-2B. The recommended system would pair changes to return reporting with recipient-side document management and clearer portal statements.

Elebase USB to USB C Adapter for iPhone 18 Pro Max,USBC Car Charger Adapter
  • Read Before You Buy — No Video Output: These adapters support charging and USB 2.0 data transfer, but cannot transmit video signals. Except for standard USB webcams (which use USB data only), they are not compatible with HDMI/DisplayPort cables, video-capable USB-C hubs, or docking stations with video output.
  • Convert USB-A Ports to USB-C: Designed to connect USB-C earphones, cables, flash drives, card readers, and other USB-C accessories to standard USB-A ports. Plug-and-play with no drivers or software required.
  • Aluminum Alloy Housing: Built with a sturdy aluminum alloy shell that aids in heat dissipation and protects against daily wear and scratches. Designed to maintain a stable and secure connection.
  • Compact & Travel-Friendly: The ultra-compact design allows the adapter to stay plugged into your device without blocking adjacent ports or adding bulk, reducing wear and tear on your original USB ports.
  • 12-Month Warranty: Backed by a 12-month manufacturer warranty for peace of mind. Designed to meet strict quality control standards for reliable everyday performance.

Liability and ITC reconciliation

  • Improve reconciliation between outward-supply details in GSTR-1, GSTR-1A or IFF and liability reported in GSTR-3B, including a way to correct GSTR-3B liability to align with outward-supply information.
  • Align ITC reported in GSTR-3B with the ITC available in GSTR-2B.
  • Provide portal statements showing reverse-charge tax paid and ITC claimed.
  • Include invoice details for payments made through DRC-03.

Recipient-side invoice management and credit adjustments

An Invoice Management System is proposed in which recipients could accept, reject or leave certain inward-supply documents pending for GSTR-2B generation. The Council also recommended an Electronic Credit Reversal and Reclaim Statement to track reversals and subsequent reclaims. The detailed document rules, permitted corrections and portal workflow depend on final instructions and implementation.

Portal guidance

Recommended filing improvements include clearer navigation, drop-down menus, tooltips and contextual guidance. The Council also proposed more specific registration-document requirements and FAQs. These usability changes may help taxpayers complete filings, but they do not replace the substantive rules for reporting liability or claiming credit.

What registration and cancellation processes are proposed?

Amending registration particulars

Most amendments to registration particulars would be automatically accepted under the proposal. A change to the principal place of business would generally be excluded from that automatic route. Taxpayers registered through the automatic route would, however, receive automatic acceptance for all registration particulars, including a principal-place-of-business change.

Cancellation applications

The proposal has phases. In phase one, system acceptance would be available to specified taxpayers after pending returns are filed and dues paid. The specified categories include taxpayers who did not pass on ITC above ₹2.5 lakh in any month, and taxpayers who exceeded that amount in a month if they file the final return within the specified time. A later phase would broaden automatic acceptance once returns are filed and dues are cleared. The detailed eligibility checks and phase rollout need to be confirmed in the final rules and portal process.

Eligible small goods sellers using e-commerce operators

A simpler registration route is proposed for eligible small goods sellers using e-commerce operators in States or Union Territories where the seller has no physical presence. Under the recommendation, the operator’s warehouse would be declared as the seller’s principal place of business, and a monthly ITC-passing threshold of ₹2.5 lakh would apply, subject to conditions. Sellers should not assume that use of an e-commerce operator alone qualifies them; the final conditions determine eligibility.

Who could claim new types of ITC refunds?

The Council recommended expanding refund access for accumulated credit in two specific cases. The relevant date is when the credit was availed, not simply when the refund application is filed.

Capital-goods ITC in zero-rated supply claims Permit refund, spread over 60 months Credit availed on or after 1 April 2027; the release does not establish the final calculation or claim procedure.
Capital-goods ITC in inverted-duty-structure claims Permit refund, spread over 60 months Credit availed on or after 1 April 2027; the final statutory and procedural terms control.

The Council also recommended removing section 17(5) restrictions for several listed categories: outdoor catering; health and life insurance; telecommunication towers; pipelines outside factory premises; free samples; and goods destroyed or written off on expiry of shelf life as required by law. This is not a blanket entitlement to claim ITC in every such case. The final wording and the general conditions for ITC claims still apply.

How might refund processing become more automated?

The Council recommended a phased approach to processing, alongside changes to refund applications and claim limits. Automation would not mean that every claim is paid without checks: the recommendations include system verification, risk evaluation and adjustment of pending dues.

Proposed first-phase processing

  • Automatically sanction the full excess balance refund from the electronic cash ledger.
  • Reduce the period for issuing an acknowledgement or deficiency memo from 15 days to 10 days. If neither is issued within 10 days, acknowledgement would be deemed to have occurred.
  • Automatically sanction 90% provisionally for zero-rated and inverted-duty-structure refunds, subject to system risk evaluation.

Proposed second-phase processing

After system verification, qualifying applications would receive automated acknowledgement. Zero-rated claims would receive full automated sanction after adjustment of pending dues and system risk evaluation. The Council described these as phases; the recommendations do not, by themselves, establish when each phase will be operational.

What could change in GST notices, penalties and appeals?

Show-cause notices and adjudication

The Council recommended comprehensive guidance for officers issuing demand notices and passing adjudication and appeal orders. It is intended to address quality and timeliness, evidence-based use of fraud, wilful-misstatement or suppression grounds, and natural justice, including personal hearings. It also recommended a combined tax-and-cess threshold of ₹10,000 for show-cause notices. Certain pending notices and appeals below that amount would be decided as if the threshold had applied when the notices were issued.

Reduced penalties and general penalty ceiling

For non-fraud cases, the proposed reduced penalty would be 5% if tax and interest are paid within 30 days after an adjudication order under section 73, or within 60 days after an adjudication order under section 74A. The Council also recommended removing the minimum ₹10,000 penalty. Separately, the maximum general penalty under section 125 would fall from ₹25,000 to ₹10,000. These are distinct proposals, and the reduced-penalty conditions should not be read as applying to fraud cases.

Appeal pre-deposit when only a penalty is disputed

Where an appeal order involves only a penalty and no tax demand, the proposed upper limit for the pre-deposit is ₹40 crore combined: ₹20 crore for CGST and ₹20 crore for SGST/UTGST. The Council separately recommended clarifying interest on returned appeal pre-deposits through a standalone section 115 provision and circular.

Arrest and prosecution proposals

The Council recommended withdrawing GST arrest powers by omitting section 69, raising the prosecution threshold from ₹1 crore to ₹5 crore, and narrowing or rationalizing specified prosecution offences and punishments. These are consequential enforcement proposals; the recommendations do not establish that the powers or thresholds have already changed.

Which export and other procedural proposals may matter?

Export-related treatment

Recommended changes include facilitating export-related treatment for services supplied to or through foreign offices or branches, and a circular on permissible receipts in foreign exchange or Indian rupees. The Council also proposed a default recipient-location place-of-supply rule for certain services where the recipient makes goods physically available. In specified cases, goods delivered to an SEZ or FTWZ for an overseas buyer, with payment received in convertible foreign exchange or permitted Indian rupees, could receive zero-rating treatment. These proposals may affect exporters’ refund and ITC recovery positions, but their precise conditions require final legal text.

E-way bills, electronic credit-ledger blocks and late fees

  • Limit e-way-bill interception more tightly and require authorization.
  • Provide a hearing process for objections to electronic credit-ledger blocks under rule 86A.
  • Waive late fees for delayed returns by taxpayers with preceding-year turnover up to ₹5 crore if the returns are filed by the end of the month in which they are due.

The Council’s recommendations describe the proposed process; they do not establish the final forms, scope of authorization or operation of these measures.

What should taxpayers do before relying on a proposed change?

  • For a refund claim, identify the credit type, whether the supply is zero-rated or under an inverted duty structure, and the date the credit was availed. Those details determine whether the proposed dates are relevant.
  • For return corrections, keep reconciling outward supplies and ITC under the rules currently in force. Do not rely on the proposed Invoice Management System or revised mechanism until the applicable instructions and portal functionality are confirmed.
  • For a dispute, distinguish a tax-demand appeal from a penalty-only appeal, and a non-fraud case from a fraud allegation. The proposed time limits and pre-deposit cap relate to specific situations, not every GST proceeding.
  • Before making a claim or changing a filing process, check the final statutory amendment, commencement notification, CBIC circular and GST portal notice that applies to that measure.

As background, the Government of India’s 2026 explainer reported around 60 lakh registered taxpayers in 2017 and approximately 1.70 crore as of September 2026, along with 3,053 crore cumulative invoice uploads and 833.82 crore e-way bills as of 30 September 2026. It also reported gross GST collections of approximately ₹12.46 lakh crore during April–September 2026, up 11.6% year on year. These figures describe the scale of the system, not a measured impact of the 57th Council’s proposals.
