India’s GST Council has recommended removing GST arrest powers, raising the prosecution threshold from ₹1 crore to ₹5 crore, and changing specified offences and penalties. The proposals point toward a less punitive and more predictable tax administration—but they are recommendations, not confirmed changes to current law. Businesses still need safeguards against coercive enforcement, clear procedures and accessible remedies.

What the GST Council recommended

At its 57th meeting on 8 October 2026, the GST Council recommended a package that reaches beyond criminal enforcement to include administration, refunds, penalties and appeals. The Council’s release and the government’s explanatory material describe these measures as recommendations or proposals, not as changes already in force. Read the Council’s 8 October release and the GST Council’s 9 October FAQ.

Arrest powers and prosecution

  • Arrest: The recommendation is to omit section 69 of the Central Goods and Services Tax (CGST) Act, 2017, thereby removing GST arrest powers.
  • Prosecution threshold: The proposed threshold would rise from ₹1 crore to ₹5 crore.
  • Offences and punishment: The package would omit or narrow specified offences and rationalise punishment under section 132. The FAQ also describes giving courts discretion to impose only a fine and removing the minimum six-month imprisonment.

Penalties, appeals and refunds

  • The proposed maximum general penalty would fall from ₹25,000 to ₹10,000.
  • For cases involving only a penalty and no tax demand, the proposed upper limit on pre-deposits would be ₹40 crore.
  • Refund proposals include system-based processing, a shorter acknowledgement time, deemed acknowledgement if no response is issued, and risk-based handling.

The recommendations also cover registration, returns, adjudication, notices, proceeding standards and trade facilitation. The official summaries describe intended changes; they do not establish how these measures will work in practice or what outcomes businesses will see.

Are the GST arrest changes in force?

The available official material does not establish that the October 2026 recommendations have been enacted or commenced. A Council recommendation is not, by itself, an amendment to the law. The 8 October release uses recommendation language, and the 9 October FAQ calls the arrest amendments proposed. Businesses should check for the relevant amending Act, notification and commencement date before treating any proposal as operative, and should not rely on the proposals as a substitute for advice about a current case.

Why protection from coercive enforcement still matters

Removing arrest powers and raising the prosecution threshold would change important parts of the announced enforcement framework. But protection also depends on how the law is applied: whether notices explain the alleged violation and evidence, whether proceedings follow consistent standards, and whether businesses can contest decisions without unreasonable delay or financial pressure.

The Council’s package addresses some of those broader concerns through proposed changes to notices, adjudication, penalties, appeals and refunds. Whether those provisions deliver clearer, more proportionate treatment will depend on their final legal form, implementation and observed results. The official material reviewed does not include independent business testimony or survey evidence establishing how prevalent coercive enforcement is, or whether businesses broadly support the package. The case for safeguards is therefore an important policy argument, not a documented measure of business-wide experience.

Scale is not proof of fairness

Government figures illustrate the reach of GST administration, but they do not measure whether enforcement is fair, accurate or coercive. The Press Information Bureau reported that registered taxpayers increased from around 60 lakh in 2017 to about 1.70 crore as of September 2026. As of 30 September 2026, it said the GST System had cumulatively processed 3,053 crore invoice uploads and 833.82 crore e-way bills, while gross GST collections reached about ₹12.46 lakh crore during April–September 2026, up 11.6% year on year. These are official government figures, not independent evaluations of the tax system. See the PIB’s 2026 account of GST administration.

In a statement published by the Prime Minister’s Office on 8 October 2026, Narendra Modi described the government’s focus as “Faster decisions. Lower compliance costs. Automated refunds. Trust-based administration.” That is the Prime Minister’s description of the intended direction, not evidence that each result has already been achieved. Read the Prime Minister’s Office statement.

How to assess whether the package protects businesses

Businesses and advisers can evaluate the reform package against five practical questions, separating announced design from implementation and results:

  1. Arrest authority: Has an amendment actually removed the relevant power, and when did it commence?
  2. Prosecution scope: Is the threshold ₹5 crore in operative law, and which offences remain prosecutable?
  3. Notice and proceeding standards: Do the final rules make notices and adjudication clearer and more consistent?
  4. Refund access: Are acknowledgements and risk-based processing delivering timely refunds with less manual intervention?
  5. Appeal access: Does the pre-deposit limit apply as proposed, and does it reduce the financial obstacle to challenging a penalty-only case?
