To appeal a GST penalty order in India, first record the date the order was communicated, then file FORM GST APL-01 before the applicable Section 107 deadline, submit the certified order and supporting papers under Rule 108, and preserve the final APL-02 acknowledgement. The ordinary statutory period stated in the cited Central Goods and Services Tax (CGST) Act text is three months from communication, with up to one additional month possible when sufficient cause is shown. Confirm the current CGST, SGST or UTGST provisions, notifications, extensions and portal instructions before relying on a live deadline.
1. Identify exactly what you are appealing
A GST penalty appeal begins with the decision or order that legally aggrieves you. Do not calculate time from the date printed on the order unless that is also the date it was communicated. Keep the complete order, its annexures and reliable proof of communication, such as a portal record, email, delivery record or other official service evidence.
- Ordinary adjudication appeal: an appeal under Section 107 against a decision or order of an adjudicating authority.
- Section 128A waiver rejection: an appeal against FORM GST SPL-07 when an application for waiver of interest or penalty has been rejected. This is a special subject-matter branch; it is not a second hearing on every issue in the original demand.
State or Union Territory GST rules may affect the authority, form workflow and calculation. The CGST references below are a framework for preparation, not a substitute for checking the law that governs the particular order.

2. Deadline checklist: communication date controls the calculation
Ordinary Section 107 period
The Section 107 text hosted by the Central Board of Indirect Taxes and Customs (CBIC) states that an aggrieved person has three months from communication of the decision or order to appeal to the prescribed Appellate Authority. The authority may allow up to one further month where sufficient cause prevented timely filing. Because the cited hosted Act page is not presented as a current consolidated edition, check amendments, notifications, court directions and order-specific extensions before treating any date as final.
#1 Best Overall
Build a written deadline record
- Write down the date and method by which the order was communicated.
- Check whether the matter is governed by CGST alone or also by the relevant SGST or UTGST law.
- Calculate the ordinary three-month period using the currently applicable counting rules.
- If filing will be late, prepare a specific explanation and evidence for sufficient cause; do not assume the extra month is automatic.
- Record portal cut-off times, holidays and any official extension separately from the statutory calculation.
A late appeal can fail before the merits are considered. Escalate immediately to a qualified GST professional when the communication date is uncertain, the ordinary period has expired, or an extension notification may apply.
3. Filing sequence: APL-01, certified papers and APL-02
FORM GST APL-01 is the first-appeal form. Rule 108 of the CGST Rules describes a sequence in which the appeal and documents are submitted, followed by the certified copy of the appealed decision or order and supporting documents. The rule’s filing consequence is critical: “For the provisions of this rule, the appeal shall be treated as filed only when the final acknowledgement, indicating the appeal number, is issued.”
- Prepare APL-01. Complete the verification, signature and grounds fields applicable to the case. Check that the order number, date, tax period, registration details and challenged amounts match the order.
- Submit through the currently applicable route. Use the GST portal or other route prescribed for the authority and current version of the form. Save the provisional acknowledgement and the submission receipt.
- Deliver the certified order and supporting documents. Follow the Rule 108 process and the applicable instructions for certification, format and delivery. The rule text describes a seven-day period for this submission sequence; verify how the current portal and authority apply it.
- Confirm final status. Obtain FORM GST APL-02 showing the appeal number. Keep it with the provisional acknowledgement and proof that the certified order and supporting papers were submitted.
- Reconcile the portal record. A successful upload or payment screen is not, by itself, proof that the appeal has reached final filing status. Confirm that the appeal number appears in the official record.
4. Document checklist
The following is a practical preparation list. Attachment requirements vary with the order, authority and current instructions, so include only material that is relevant and properly authenticated.
| Document or record | Why it matters |
|---|---|
| Complete appealed order and proof of communication | Identifies the decision under challenge and starts the deadline analysis. |
| FORM GST APL-01, verification and signature | Creates the appeal and states the relief and grounds requested. |
| Certified copy of the decision or order | Required in the Rule 108 submission sequence; retain proof of delivery. |
| Show-cause notice and annexures | Allows each penalty finding to be compared with the allegation actually notified. |
| Reply, written submissions and hearing record | Shows what was placed before the adjudicating authority and whether it was addressed. |
| Invoices, returns, ledgers and reconciliations | Tests the factual findings and the amount attributed to the alleged contravention. |
| Payment evidence and correspondence | Supports arguments about tax paid, voluntary correction, communications and disputed computation. |
| Chronology | Links notice, reply, hearing, order, communication and filing dates in one audit trail. |
| Admitted-versus-disputed calculation | Separates amounts accepted from amounts challenged for pre-deposit analysis. |
| Provisional and final acknowledgements | Proves submission and preserves the final appeal number issued in APL-02. |
For an SPL-07 matter, add the waiver application, SPL-07 rejection, payment records and documents relevant to eligibility under Section 128A.
5. Write grounds that track the order
There is no universal “penalty was too high” ground. Build the appeal from the actual findings and record. A useful ground has four parts:
- Finding: quote or accurately identify the paragraph, amount or conclusion being challenged.
- Contrary material: point to the notice, statutory provision, document, return, payment or testimony that contradicts or qualifies it.
- Error or prejudice: explain the legal, factual or procedural consequence of the mistake.
- Relief: state exactly what should happen, such as setting aside the penalty, recomputing it, remanding a defined issue, or granting another lawful remedy.
Issues to test against the record
- Does the penalty provision and factual basis in the order match the allegation and provision in the show-cause notice?
- Did the authority address material submissions, reconciliations and documents, or omit a response to a decisive point?
- Do the established facts satisfy every statutory condition for the particular penalty?
- Is the amount calculated using the correct period, turnover, tax, rate, cap or other statutory measure?
- Was the required opportunity of hearing provided, and is the hearing or adjournment history documented?
- Does the order state points for determination, the decision on those points and reasons for the result?
Section 107 permits an additional ground to be admitted under a statutory condition, but that limited safety valve is not a reason to file vague or incomplete grounds. Number each ground, attach the document that proves it and cross-reference the relevant page or paragraph.
6. Payment, pre-deposit and recovery: do not use a generic percentage
The Section 107(6) text cited by CBIC describes payment in full of admitted dues plus a prescribed percentage of the remaining disputed tax. It also states that recovery of the balance is stayed after the required payment. The cited hosted Act page does not establish the current consolidated percentage, any cap, amendments or how the rule applies to every penalty-only appeal.

1Scan for outdated or missing drivers - takes under a minute2Clear out junk files and repair common Windows errors3Fix the driver behind crashes, sound loss and screen glitchesBefore paying, classify the demand precisely:
- tax admitted by the appellant;
- tax disputed by the appellant;
- interest, penalty and other amounts shown separately in the order; and
- amounts already paid or credited under the governing law.
Verify the operative Section 107(6) text, current notifications, portal calculation and the authority’s treatment of a penalty-only demand. Do not publish or rely on a universal rupee figure or assume that a percentage of disputed tax automatically applies directly to the penalty. Keep challans, payment references and the calculation used for the filing.

7. Special branch: appeal from an SPL-07 waiver rejection
CBIC Circular No. 238/32/2024-GST explains that a rejection of an application for waiver of interest or penalty under Section 128A in FORM GST SPL-07 may be appealed under Section 107 within the applicable time.
What the appeal should address
The issue is whether the applicant qualifies for the waiver and whether the rejection correctly applied Section 128A and its conditions. It is not, according to the circular, an appeal on the merits of the original notice, statement or order. Frame grounds around waiver eligibility, required payments, dates, prescribed conditions and the reasons given in SPL-07.
Documents for this branch
- SPL-07 and proof of its communication;
- the original waiver application and acknowledgements;
- payment records relevant to waiver eligibility;
- the underlying order only to the extent needed to establish the waiver conditions; and
- the APL-01, certified-order material and APL-02 records required for the Section 107 filing.
The circular notes that pre-deposit treatment can depend on whether relevant tax dues already paid satisfy Section 107(6). Verify that issue for the actual demand rather than assuming that a waiver request removes every pre-deposit requirement.

8. Ordinary merits appeal versus SPL-07 appeal
| Question | Ordinary adjudication appeal | SPL-07 waiver-rejection appeal |
|---|---|---|
| Decision challenged | Adjudicating authority’s decision or order. | Rejection of a Section 128A waiver application in FORM GST SPL-07. |
| Main subject | Legal and factual correctness of the demand or penalty. | Applicability of the statutory waiver and correctness of the rejection. |
| Time basis | Communication date, ordinary period and any condonable period under current Section 107. | Communication of SPL-07 and the applicable Section 107 period. |
| Evidence emphasis | Notice, reply, hearing record, transaction evidence and calculation. | Waiver application, eligibility evidence, payments and SPL-07 reasons. |
| Filing proof | APL-01, Rule 108 document sequence and final APL-02. | The same Section 107 filing sequence, plus waiver-specific records. |
9. Hearing, decision and what to preserve
The Appellate Authority is to provide an opportunity of hearing and may confirm, modify or annul the order after any further inquiry it considers necessary. The disposal order is to state the points for determination, the decision and the reasons. Attend or respond through the permitted channel, bring a concise issue list and ensure that any additional written submission is acknowledged.
Rank #4
After disposal, preserve the appellate order, hearing notices, written submissions, acknowledgement of service and payment or recovery records. If the result is adverse, obtain advice promptly on the next statutory remedy and its deadline; do not assume that the first appeal automatically extends later limitation periods.

Fix: map every ground to the notice, order paragraph, statutory provision and requested relief.
Assuming a pre-deposit percentage
Fix: separate tax, interest and penalty; verify current law and portal calculation for the exact demand.
Turning an SPL-07 appeal into a challenge to the original demand
Fix: focus on Section 128A eligibility and the reasons for waiver rejection, while checking the circular’s treatment of payment and pre-deposit.
Uploading unreadable or unauthenticated records
Fix: use legible files, consistent names, page numbers and a document index; retain the original files and submission receipts.
11. A one-page readiness check
- Order and communication date are identified and evidenced.
- Correct Appellate Authority and current CGST plus SGST or UTGST provisions are confirmed.
- APL-01 is signed, verified and internally consistent with the order.
- Grounds are numbered and tied to evidence and precise relief.
- Certified order and supporting documents are ready for the Rule 108 process.
- Admitted and disputed components are separated; pre-deposit treatment is verified.
- Provisional acknowledgement, submission proof and final APL-02 are saved.
- For SPL-07, waiver application, eligibility evidence and payment records are included.
Use a qualified tax professional when limitation, classification of a penalty-only demand, certification, waiver eligibility or a large recovery exposure is uncertain. Professional representation is not automatically required, but a missed deadline or incorrect filing status can be difficult to repair.
