Should you export under LUT or pay IGST? For a registered Indian exporter making a zero-rated supply, both routes can lead to a refund, but they work differently. An export under a bond or Letter of Undertaking (LUT) does not require IGST to be paid upfront; the exporter instead claims a refund of eligible unutilized input tax credit (ITC). The alternative is to pay IGST on the export and claim a refund of that tax. LUT is usually easier on cash flow, while payment of IGST can suit a business that can finance the tax and prefers a refund based on the tax actually paid. Neither route is universally better. Your choice should follow your cash position, ITC balance, export type, payment timing, documentation and current refund eligibility.

What the two export routes actually do

Export under bond or LUT without payment of IGST

The no-payment route lets a registered person export without charging and paying IGST on the export transaction. Before exporting, the person furnishes a bond or Letter of Undertaking in FORM GST RFD-11 to the jurisdictional Commissioner, as described in Rule 96A of the CGST Rules. The exporter then seeks a refund of eligible unutilized ITC under the applicable refund rules.

This is not a tax exemption that removes compliance. The exporter still has to make the supply in the required manner, issue an invoice with the correct endorsement, maintain export evidence, satisfy the applicable goods or services conditions and monitor the deadlines in Rule 96A. Only eligible ITC enters the refund calculation; an entire electronic credit-ledger balance is not automatically refundable.

Export on payment of IGST

Under the payment route, the exporter pays IGST on the export and then claims a refund of the IGST paid, subject to the applicable rules and reporting requirements. The tax payment creates an immediate cash outflow. The refund base is different from the LUT route: it is the IGST paid on the export, not a refund calculated from eligible accumulated ITC.

Paying IGST does not guarantee a prompt refund. The claim still depends on correct export documentation, matching information, eligibility and the current refund process. The cited CBIC material explains the two statutory routes but does not establish that either route is always processed faster.

Quick comparison: LUT or payment of IGST?

Decision axis Export under LUT or bond Export on payment of IGST
Upfront cash No IGST payment on the export under this route. IGST must be funded before the exporter claims its refund.
Refund basis Eligible unutilized ITC, calculated under the applicable refund rules. IGST paid on the export, subject to the rules.
Working-capital effect Preserves cash that would otherwise be used to pay IGST, although credit may remain tied up until the ITC refund is granted. Creates a temporary tax outflow until the refund is received.
Core compliance document Bond or LUT in FORM GST RFD-11 furnished before export, plus the route-specific invoice endorsement. Route-specific invoice endorsement and evidence of IGST payment.
Timing exposure Rule 96A conditions apply to export of goods and receipt of service consideration. Payment and refund processing must be completed; the sources do not establish a universal time advantage.
Question to ask Can the business use LUT and manage the associated conditions while obtaining an ITC refund? Can the business finance IGST and would a refund of tax paid fit its cash planning?

How to choose the route for your business

1. Start with the cash-flow question

If paying IGST would consume money needed for payroll, inventory, freight, contractors or the next export cycle, LUT avoids that initial payment. This can matter particularly when invoices are large or exports are frequent. LUT does not make cash completely irrelevant: eligible ITC may still be locked in the credit ledger until the refund is sanctioned, and the exporter must meet the route’s conditions.

The payment route is more workable when the business has sufficient cash or a reliable short-term funding line and can tolerate the period between paying IGST and receiving the refund. Model the largest expected tax outflow, not just an average shipment, because one large export can create a temporary funding requirement.

2. Compare the ITC you can actually claim

LUT refunds are based on eligible unutilized ITC under the refund rules. Input tax credits may be restricted by the nature of purchases, documentary requirements, reversals or other statutory conditions. Do not treat the total credit balance as the expected refund. Review the credits connected with exported taxable goods or services and apply the prescribed refund calculation.

If the business has little eligible accumulated ITC, the LUT route may not generate a large refund even though it avoids IGST payment. In that situation, paying IGST can produce a refund claim based on the tax charged on the export, provided the export and refund conditions are met.

3. Identify whether you are exporting goods or services

Rule 96A uses different conditions for goods and services. For goods, the rule states a period of three months from the date of the export invoice when the goods have not been exported. For services, it states a period of one year from the invoice date when payment in convertible foreign exchange has not been received. These periods are followed by a further 15-day period to pay the tax and applicable interest unless an extension is allowed.

Service exporters should therefore map expected receipt dates, currency and customer payment terms before selecting LUT. A long payment cycle, disputed invoice or customer concentration can create a compliance exposure even when the service itself has already been delivered.

4. Consider how much administrative control you have

LUT requires a pre-export undertaking and ongoing tracking of export and payment conditions. The payment route requires accurate tax payment, export reporting and a refund claim for the tax paid. The route with fewer internal controls is not automatically the safer route; a missed condition or mismatched invoice can delay either type of refund.

5. Decide shipment by shipment only after checking current eligibility

The IGST Act provides the two routes for zero-rated supplies, but eligibility and procedure can be affected by amendments, notifications and the current portal process. A business with several export models should document which route applies to each model rather than assume that a decision made for goods also fits services, or that a prior-period practice remains valid.

Step-by-step: using the LUT route

  1. Confirm the transaction is an eligible zero-rated export. Check that the supplier is registered, the transaction qualifies as an export and the business can satisfy the applicable export and payment conditions. If the transaction has an unusual structure, obtain transaction-specific professional advice.
  2. Furnish the undertaking before export. Provide the required bond or LUT in FORM GST RFD-11 to the jurisdictional Commissioner before making the export without payment of IGST. Keep the accepted filing and supporting records with the export file.
  3. Use the no-payment invoice endorsement. The CBIC Tax Invoice Rules prescribe the wording: SUPPLY MEANT FOR EXPORT UNDER BOND OR LETTER OF UNDERTAKING WITHOUT PAYMENT OF IGST. Confirm the rest of the current invoice particulars under the applicable rule.
  4. Complete the export and preserve evidence. Retain the commercial invoice, transport and customs records where applicable, export documentation, contracts, proof of delivery or performance and payment records. The exact evidence set depends on the transaction and current rules.
  5. Track Rule 96A deadlines. For goods that have not been exported, the cited rule refers to three months from the export invoice, followed by 15 days to pay tax and interest unless an extension is allowed. For services where convertible-foreign-exchange payment has not been received, it refers to one year from the invoice, followed by 15 days to pay tax and interest unless extended.
  6. Calculate the ITC refund under the current formula. Use only eligible unutilized ITC and the prescribed refund calculation. Reconcile purchase invoices, credit notes, reversals, returns and export turnover before submitting the claim.
  7. File and monitor the refund claim. Keep the refund application, statement, supporting documents and acknowledgement together. Reconcile the claim with the electronic credit ledger and export records so that a query can be answered without changing the underlying figures.

Step-by-step: exporting after paying IGST

  1. Confirm that payment of IGST is appropriate. Verify the supply’s zero-rated status, the exporter’s registration and the ability to fund the tax until the refund is received.
  2. Issue the payment-route invoice. The prescribed export endorsement is SUPPLY MEANT FOR EXPORT ON PAYMENT OF IGST. Use the current invoice rule for other mandatory particulars.
  3. Calculate and pay the IGST correctly. Base the calculation on the taxable value and applicable rate for the export transaction. Retain the payment and return records that support the amount claimed for refund.
  4. Complete export reporting and reconciliation. Ensure invoice numbers, dates, values and export details reported in the relevant returns or customs systems match the refund claim. Small differences can create an enquiry or delay even when tax was paid.
  5. Claim the refund of IGST paid. Submit the claim through the applicable current process, supported by payment evidence and export documentation. The refund is of the tax paid on eligible exports; it is not a refund of unrelated ITC.
  6. Monitor the claim and answer discrepancies. Keep a transaction-level reconciliation of tax paid, export completion, return reporting and refund status. Do not assume that payment alone proves eligibility.

Refund mechanics: what you receive under each route

LUT refund

The refund is tied to eligible unutilized ITC attributable to exports without payment of IGST. CBIC’s refund rules provide a calculation for exported taxable goods or services under bond or LUT. The formula and supporting conditions matter: an exporter cannot simply request every credit accumulated during the period.

Before claiming, separate eligible export-related credit from credit requiring reversal, blocked credit or credit connected with supplies outside the refund calculation. Preserve the invoices and return entries that establish entitlement, because the refund authority may require evidence of the credit and export turnover used in the calculation.

IGST-paid refund

The payment route seeks a refund of IGST paid on the export. The claim therefore depends on the tax having been correctly charged and paid, the export being completed and the information matching across the exporter’s records and the relevant reporting systems.

This route can be attractive where the business has limited eligible ITC but can finance the tax. It can also be less attractive where the tax outflow would disrupt operations or where a refund delay would create borrowing costs.

Rule 96A conditions and what happens when a deadline is missed

Rule 96A is central to the LUT route because the undertaking is conditional. The cited rule states that, if goods covered by the export invoice are not exported within three months, the exporter has 15 days to pay the tax due and applicable interest unless an extension is allowed. For services, it states that if payment in convertible foreign exchange is not received within one year from the invoice, the same 15-day payment period follows unless extended.

These are statutory periods described in an older rules update. The indexed CBIC PDF is not a current consolidated edition, so check the latest rule text, amendments and any extension mechanism before relying on a deadline for a live transaction. CBIC Circular No. 37/11/2018-GST also addresses LUT and export-refund issues, including late-export handling; review the current circular position with a qualified adviser where a deadline has been missed.

If a deadline is approaching, identify the affected invoices, confirm whether export or payment evidence is available, check whether an extension is legally available and quantify tax and interest exposure. Do not wait until a refund query to discover that a service invoice has remained unpaid beyond the permitted period.

IGST paid SUPPLY MEANT FOR EXPORT ON PAYMENT OF IGST
Bond or LUT SUPPLY MEANT FOR EXPORT UNDER BOND OR LETTER OF UNDERTAKING WITHOUT PAYMENT OF IGST

Illustrative decisions for common business situations

Exporter with substantial eligible ITC and tight cash

LUT may be the practical starting point because it avoids the IGST outflow. The exporter should first verify that the accumulated credits are eligible under the refund rules and that it can monitor Rule 96A conditions. The benefit is cash preservation, not an automatic or immediate refund.

Service exporter with a long customer payment cycle

Map the one-year service-payment condition from each invoice and test whether customers normally pay in convertible foreign exchange within that period. If payment timing is uncertain, the business needs a documented escalation process and advice on the consequences of a missed condition before choosing LUT.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Exporter with little eligible ITC but reliable funding

Paying IGST can produce a refund based on the tax paid rather than a small ITC balance. The business must model the temporary cash requirement and verify that export data, tax payment and refund reporting will match.

New exporter still changing its invoicing process

Do not select a route solely because another exporter uses it. First establish who will furnish RFD-11, who approves invoice wording, who reconciles export data and who tracks goods or service-payment deadlines. A controlled process is more important than a theoretical preference for one refund base.

Common mistakes and how to correct them

Calling LUT “tax-free”

LUT removes the upfront IGST payment for the export; it does not remove export obligations, ITC eligibility rules or the consequences of failing the Rule 96A conditions. Describe it as export without payment of IGST, not as a tax-free transaction.

Assuming every ITC balance is refundable

The refund rules use eligible unutilized ITC and a prescribed calculation. Reconcile and classify credits before estimating the amount. A ledger balance is not a promise of cash refund.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Using the wrong invoice endorsement

Keep separate invoice templates for the two routes and check the exact CBIC wording. Correct an error through the permitted process and preserve the audit trail rather than silently changing a tax document.

Ignoring service-payment timing

For LUT service exports, track the invoice date, expected receipt date, currency and actual receipt. A customer’s late payment can create a tax-and-interest issue even when the service was delivered correctly.

Assuming IGST payment guarantees speed

The sources establish the refund route, not a universal processing-time advantage. Refund timing can depend on complete documentation, matching data, eligibility and the current administrative workflow.

Relying on an old rule summary

Rule 96A details in the cited CBIC PDF come from an older update, and CBIC FAQs may contain legacy workflow descriptions. Before a live filing, check the current consolidated rules, notifications, circulars and portal instructions or obtain advice from a GST practitioner or chartered accountant experienced with export refunds.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

A practical decision checklist

  • Is the supplier registered and is the supply genuinely zero-rated?
  • Is the transaction an export of goods or services, and which Rule 96A condition applies?
  • Can the business fund IGST until the refund is received without disrupting operations?
  • How much eligible unutilized ITC is available after applying the refund rules?
  • Can the business furnish FORM GST RFD-11 before exporting under LUT?
  • Are invoice templates configured with the exact endorsement for the selected route?
  • Who will reconcile invoice, return, customs, payment and refund data?
  • For services, what is the expected date and currency of customer payment?
  • What evidence will prove export completion and, where relevant, receipt of convertible foreign exchange?
  • Have current amendments and the latest consolidated Rule 96A text been checked?

Bottom line for the choice

Choose LUT when preserving cash is important, you can furnish FORM GST RFD-11 before export and you can satisfy the export or service-payment conditions while claiming only eligible ITC. Choose payment of IGST when the business can finance the tax, has a reason to prefer a refund of tax paid and can maintain exact payment and export reconciliations. Treat both as conditional refund mechanisms, not as guaranteed outcomes, and verify the current rules before applying either route to a live export.
