A supplier’s non-filing can put your GST input tax credit (ITC) at risk, but the result depends on exactly what the supplier failed to do. First determine whether the invoice was never reported, was reported in GSTR-1 or IFF but the corresponding GSTR-3B was not filed, or is affected by an amendment or credit note. Then reconcile the transaction, check the supplier’s filing status, preserve evidence, and apply Rule 37A only when its specific trigger and deadlines are met.

A tax invoice by itself does not guarantee credit. Section 16 of the CGST Act includes supplier furnishing and communication of invoice details and an actual-tax-payment condition, among other requirements. GSTR-2B helps with reconciliation, but the GST portal describes it as an information statement that does not decide every legal eligibility question.

Why a supplier’s return failure affects your ITC

Section 16 of the CGST Act sets the eligibility framework for claiming input tax credit. Its current wording includes the supplier’s duty to furnish invoice or debit-note details in the outward-supplies statement and communicate them to the recipient. The provision also addresses payment of the tax to the Government and contains other conditions that must be tested for the transaction and tax period. Read the applicable text at Section 16 of the CGST Act.

That means the recipient must evaluate more than possession of an invoice. A purchase may be genuine and properly recorded in the accounts, yet still require corrective action if the supplier has not furnished the relevant details or has not completed the corresponding return filing. The legal effect can also differ according to the financial year, the version of the Act and Rules in force, and whether the recipient is filing a return, responding to a notice, or challenging an order.

Identify which filing failure occurred

Do not treat every “supplier default” as the same event. The first practical question is whether the invoice exists in the supplier’s outward-supply data and whether the supplier filed the return that accounts for the tax.

Supplier position What you may see What it means for your review
Invoice not furnished in GSTR-1 or IFF The document is absent from the relevant recipient statement, or its particulars do not match. Check whether the supplier must amend or newly report the document. A tax invoice alone does not satisfy the reporting-related condition.
Invoice furnished, but corresponding GSTR-3B not filed The invoice may appear in the supplier data while the supplier’s return status shows a filing gap. This is the distinct situation addressed by Rule 37A, subject to its operative wording and deadlines.
GSTR-1 and GSTR-3B filed, but details do not reconcile Differences in GSTIN, invoice number, date, value, tax, place of supply, amendment or credit note. Resolve the data error and determine whether the corrected document enters a later statement or changes the credit calculation.
Document is pending or rejected in the Invoice Management System (IMS) The document is not flowing to the expected statement while that status remains. Use the IMS action available for the document and retain the reason for acceptance, rejection or pending treatment.

These categories require different evidence and different communications with the supplier. In particular, Rule 37A is not a general rule for every missing invoice or every mismatch.

What GSTR-2B can—and cannot—tell you

GSTR-2B is generated from supplier statements and specified other feeds. It is useful for finding missing documents, checking tax amounts and identifying amendments, but the GST portal’s guidance expressly warns that other legal scenarios may make credit unavailable. You must self-assess eligibility rather than treating the appearance of an invoice in GSTR-2B as conclusive. See the official GSTR-2B FAQ.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Conversely, an invoice absent from one statement is a warning that needs investigation, not by itself a final determination of every fact. Check whether the supplier filed late, used an amendment, reported the document under a different period, or issued a credit note. Download the relevant portal records and record the date on which each status was observed.

How IMS status changes the reconciliation

The Invoice Management System provides accept, reject and pending actions for covered documents. The published IMS FAQ states that taking no action is treated as deemed acceptance for GSTR-2B generation. A document left pending does not flow to GSTR-2B or GSTR-3B while it remains pending, and it cannot be kept pending beyond the applicable Section 16(4) timeline. These portal mechanics do not replace the statutory eligibility test; they determine how the document is represented in the statements you use for reconciliation. Keep a copy of the action history and the document version you relied on. The official guidance is in the IMS FAQ.

Recipient action plan

  1. Build the transaction file. Collect the original tax invoice or debit note, purchase order or contract, goods-receipt note or service-acceptance evidence, payment records (including the tax component), accounting-ledger entries, and any amendments or credit notes. The applicable documentary requirements are in the CGST Rules; use the version governing the transaction at CGST Rules.
  2. Reconcile every material field. Compare your books with the GSTIN, invoice number and date, taxable value, tax amount, tax period, place-of-supply details, amendment history and credit-note information shown on the portal. A typographical difference can be a correction issue; a missing supplier filing is a different risk.
  3. Check the supplier’s filing trail. Establish whether the supplier furnished the invoice in GSTR-1 or IFF and whether the corresponding GSTR-3B was filed. Save downloaded statements, filing-status screens and any later updates. Note the relevant financial year and return period, because the operative law and deadlines can change.
  4. Ask the supplier to cure the defect in writing. Send a dated request identifying the invoice and asking the supplier to furnish or amend the outward-supply details and file the corresponding GSTR-3B. Request confirmation of the filing reference or acknowledgement. Written follow-up demonstrates that you acted promptly and gives you a record if the supplier remains unresponsive.
  5. Test Rule 37A separately. Apply it only when the supplier furnished the invoice details in GSTR-1 or IFF but failed to file the corresponding GSTR-3B by the specified deadline. Confirm the notified rule text for the tax period before calculating a reversal or re-availment.
  6. Decide the return treatment with professional advice where needed. Do not claim, retain or re-avail credit merely because a document appears in GSTR-2B. Consider the invoice, receipt, payment, supplier reporting, tax-payment and all other Section 16 conditions. If the amount is material or a notice has been issued, have an Indian GST professional review the facts and the period-specific law.
  7. Continue monitoring. Recheck the supplier’s later statements and GSTR-3B status. When the supplier corrects the filing, download the updated record and link it to the original reconciliation and correspondence.

Rule 37A: the supplier-filed-but-GSTR-3B-missing case

Rule 37A addresses a defined sequence: the supplier furnishes invoice details in GSTR-1 or IFF, but does not file the corresponding GSTR-3B within the prescribed period. It requires the recipient to reverse the relevant ITC by the later prescribed date and allows re-availment after the supplier files that corresponding return. It is therefore different from a case in which the supplier never reported the invoice at all.

The GST Council’s published agenda material describes dates of 30 September following the relevant financial year for the supplier filing trigger and 30 November for the recipient’s reversal. Those dates must be checked against the notified Rule 37A text and amendments applicable to your tax period; the agenda note is not a substitute for the operative rule. Consult the GST Council Rule 37A agenda text together with the current CGST Rules.

How to document a Rule 37A calculation

  • Record the financial year, supplier GSTIN, invoice identifiers and tax amount.
  • Capture evidence that the invoice was furnished in GSTR-1 or IFF.
  • Capture the supplier’s GSTR-3B filing status and the date on which the prescribed deadline passed.
  • Calculate the reversal using the rule and version applicable to that period, not a generic calendar assumption.
  • Keep the reversal working paper, return reference and management approval with the transaction file.
  • When the supplier files the corresponding GSTR-3B, verify that event and document the re-availment in the return period permitted by the rule.

If the invoice was never furnished in GSTR-1 or IFF, Rule 37A’s supplier-filed-but-return-unfiled trigger is not established. You must instead pursue correction and assess the ordinary Section 16 conditions and any other applicable provisions.

Evidence that protects the recipient’s position

Maintain one indexed file per supplier or disputed period. Include:

  • the original invoice or debit note and all revised versions;
  • the purchase order, contract, delivery challan, goods-receipt note or service-completion evidence;
  • bank statements, payment vouchers and ledger entries showing the commercial payment, including the tax component;
  • the GSTR-2B period file, supplier statement extracts, IMS action history and downloaded filing-status records;
  • emails or letters requesting reporting, amendment and GSTR-3B filing, plus the supplier’s replies;
  • reconciliation worksheets showing GSTIN, invoice number, date, value, tax, period, place of supply and amendment checks;
  • copies of any reversal, re-availment calculation and return acknowledgement; and
  • the notice, order, response, hearing record and appeal documents if the department has already acted.

Preserve the files in a form that shows when each portal record was downloaded. Supplier records can change after a late filing or amendment, so an undated screenshot is weaker than a dated download linked to your reconciliation.

If the department issues a notice or demand

A notice changes the task from routine reconciliation to a procedural response. Before drafting, identify:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • the statutory provision cited and the exact tax periods;
  • the date and method of service;
  • the response deadline and any hearing date;
  • the invoice list, tax and interest amounts alleged; and
  • whether an order has already been passed and whether an appeal is pending or available.

Map each disputed invoice to evidence rather than replying with a general statement that the purchase was genuine. Explain whether the issue is missing GSTR-1 reporting, a GSTR-3B filing gap, an IMS status, a mismatch, or another Section 16 condition. Attach the supplier correspondence and portal records, and show any reversal already made under the applicable rule. Because appeal routes and limitation periods depend on the provision, order and service facts, the reviewed materials do not establish a single remedy for every notice; obtain case-specific advice before the deadline expires.

What older court guidance does—and does not—establish

A 2025 Karnataka High Court decision discussing Circular 183/15/2022-GST describes that circular’s mismatch guidance as case-specific to bona fide reporting errors for financial years 2017-18 and 2018-19. That material should not be presented as a blanket current defence to supplier non-filing or as a general right to retain credit despite Section 16 or Rule 37A. Courts decide within the statutory wording, tax period and facts before them. Read the judgment at Hindustan Construction Company judgment and have counsel assess whether its reasoning is relevant to your period.

Common mistakes to avoid

  • “The invoice is genuine, so credit is automatic.” Genuine supply evidence is important, but supplier reporting, tax payment and other statutory conditions still apply.
  • “GSTR-2B says eligible, so no further review is needed.” The portal itself says recipients must self-assess beyond the statement.
  • “Every supplier default falls under Rule 37A.” The rule’s trigger requires supplier furnishing in GSTR-1 or IFF and failure to file the corresponding GSTR-3B.
  • “Leave a disputed IMS document pending indefinitely.” Pending documents do not flow to the statements while pending and are subject to the relevant Section 16(4) timeline.
  • “An old mismatch circular settles a current dispute.” The cited circular guidance concerns specified historical years and bona fide reporting errors, not a universal current-period exemption.
  • “Wait for a notice before contacting the supplier.” Early written follow-up and dated portal monitoring create evidence and may allow correction before the dispute escalates.

A practical decision path

  1. If the invoice is absent because the supplier did not furnish it, obtain a correction or fresh reporting and reassess the applicable Section 16 conditions.
  2. If the invoice was furnished but the supplier did not file the corresponding GSTR-3B, calculate whether Rule 37A applies for that financial year and follow its reversal and re-availment mechanism.
  3. If both returns were filed but data differs, classify the exact mismatch, obtain an amendment where possible and retain proof of the correction.
  4. If an IMS action or GSTR-2B presentation is disputed, preserve the portal history and do not confuse statement treatment with legal eligibility.
  5. If a notice or order exists, work from its provision, period and deadline with qualified advice rather than relying on a generic internet explanation.
