The GST Council is the constitutional Centre–State body created by Article 279A of the Constitution. It makes recommendations to the Union and State Governments on the design of India’s goods and services tax, including coverage, exemptions, model laws, thresholds, rates and special provisions. A GST standing committee is different: it is a working body constituted under the Council’s administrative framework to examine a defined subject, coordinate implementation or prepare material for Council consideration.
The distinction matters because a committee may analyse a rate, draft rules or resolve an urgent implementation issue, but the committee does not acquire the Council’s constitutional identity or independently replace the recommendation process. Committee names, membership and remits can also change. The eight-committee structure recorded during the 2017 rollout is therefore historical evidence of assigned work, not a guarantee that every committee still operates under the same name or scope.
GST Council and standing committees: the difference at a glance
| Comparison point | GST Council | Standing or other GST committees |
|---|---|---|
| Legal position | Constitutional body established by Article 279A. | Administrative or working structures constituted under Council records; they are not, by that description, separate constitutional decision-makers. |
| Main job | Makes recommendations to the Union and States on specified GST matters. | Examines, coordinates, drafts, troubleshoots or supports work in an assigned subject area. |
| Typical subject matter | GST coverage, exemptions, model laws, levy principles, place of supply, thresholds, rates and special provisions. | Legal rules, information technology, taxpayer interface, fitment of rates, outreach, capacity building, settlement and guidance notes in the 2017 framework. |
| Decision authority | Acts through the constitutional meeting and voting procedure. | Authority depends on the mandate delegated or assigned to that committee. A committee’s recommendation or administrative decision is not automatically a Council recommendation. |
| Continuity | The constitutional basis remains in Article 279A unless amended. | Names, composition and remit may be modified. The current directory must be checked instead of assuming the 2017 structure is unchanged. |
In plain language, the Council is the principal forum for Centre–State GST policy recommendations. Committees are specialised working groups around that forum. They can prepare the technical, legal and administrative work needed for a Council decision, or handle authority expressly delegated to them, but they should not be described as bodies that independently legislate or permanently set GST rates.
What is the GST Council?
Constitutional foundation
Article 279A, inserted through the 101st Constitution Amendment Act, 2016, establishes the Goods and Services Tax Council. The provision describes a joint institution rather than a department of either the Union or a State. Its membership combines the Union and State levels: the Union Finance Minister chairs it; the Union Minister of State in charge of Revenue or Finance is a member; and ministers nominated by State Governments are members.

The constitutional text states: “The Goods and Services Tax Council shall make recommendations to the Union and the States on—” Article 279A(4) then identifies the matters on which those recommendations may be made. The wording is important. The Council’s constitutional function is to recommend; it is not itself a legislature passing a GST Act.
Matters within the Council’s remit
Article 279A gives the Council a broad design and coordination remit. Its listed subjects include:
- which Central, State and local taxes, cesses and surcharges may be subsumed into GST;
- which goods and services should be taxed, exempted or brought within particular treatment;
- model GST laws, including principles for levy;
- principles governing the place of supply of goods and services;
- the threshold below which goods or services may be exempt from GST;
- GST rates, including rate structures for goods and services;
- special rates for a specified period to raise resources during a natural calamity or disaster; and
- special provisions for specified States.
This list explains why questions about GST rates, exemptions, thresholds or place-of-supply design are normally associated with the Council. A committee may study one of those questions, but the constitutional recommendation role belongs to the Council.

How the GST Council makes a decision
Quorum
Article 279A(7) provides that one-half of the Council’s total membership constitutes a quorum. A meeting therefore cannot validly proceed as a Council decision-making meeting without at least half of the total membership represented, subject to the constitutional text and applicable procedure.
Weighted voting
The voting rule is not a simple headcount. Under Article 279A(9), a decision requires at least three-fourths of the weighted votes of members present and voting. The Union Government’s vote carries one-third of the total weighted vote. The votes of all State Governments together carry two-thirds.
| Procedural value | Constitutional rule | Provision |
|---|---|---|
| Quorum | At least one-half of total Council membership. | Article 279A(7) |
| Approval threshold | At least three-fourths of weighted votes of members present and voting. | Article 279A(9) |
| Union weight | One-third of the weighted vote. | Article 279A(9) |
| States’ combined weight | Two-thirds of the weighted vote. | Article 279A(9) |
These are constitutional procedural values, not performance statistics. They also show why a committee’s internal consensus cannot be equated with a Council decision: the committee does not use the Council’s Article 279A voting status simply by discussing the same subject.

What GST standing committees do
The term “standing committee” is used for a continuing subject-focused group, but its exact meaning depends on the Council record that created or modified it. The official record dated 29 May 2017 described the constitution of a GST Implementation Committee, standing committees and sectoral groups for the smooth rollout of GST. Minutes of the Council’s 14th meeting separately described eight proposed standing committees and allocated work to them.
The 2017 framework should be read as a dated rollout arrangement. It documents the responsibilities assigned at that stage; it does not prove that every committee name, membership or remit remains identical today.
Law and Rules Committee
The Law and Rules Committee’s recorded work included finalising GST rules, preparing non-tariff notifications, troubleshooting and simplifying business-process design, and examining trade representations on legal issues. This made it a technical and legal preparation forum. Its work could shape material placed before the Council or support implementation, but the record does not make the committee a constitutional body with independent power to enact GST law.
Information Technology Committee
The IT Committee monitored GST Network and Centre–State information-technology preparedness and the linkage of systems and networks. Its focus was operational readiness: whether the technology environment required for registration, compliance administration and inter-government coordination was prepared for rollout. The 2017 description assigns monitoring and coordination responsibilities, not a power to determine tax policy.
Single Interface Committee
The Single Interface Committee was assigned work concerning migration and verification of past credit, rules for a single taxpayer interface in coordination with the Law Committee, coordination of taxpayer assignment, and State-level administrative issues. These tasks addressed how taxpayers and administrations would interact across the new GST system.

The Fitment Committee dealt with tax-rate recommendations for commodities and services. Its recorded remit also covered interest rates prescribed under sections and rules and composition rates. “Fitment” therefore refers to matching goods, services and specified situations to an appropriate tax treatment for consideration. The committee’s role was to recommend or prepare material; it should not be described as independently imposing a binding GST rate.

Publicity and Outreach Committee
The 2017 list included a Publicity and Outreach Committee. Its title indicates responsibility for communicating GST information and supporting awareness during rollout. The cited meeting record lists the committee as part of the framework, but it does not establish a current detailed remit or continuing membership.
Capacity Building and Facilitation Committee
A Capacity Building and Facilitation Committee was also proposed. This category covered the preparation and facilitation work needed by officials and stakeholders as GST processes were introduced. The historical record identifies the committee and its broad place in the rollout structure; a current directory should be consulted for any later form or mandate.
Fund Settlement Committee
The Fund Settlement Committee was included in the eight-committee proposal. Its subject was settlement-related coordination between governments. The historical listing does not, by itself, establish the committee’s present composition, powers or continuing operation.
The Tool Desk

The Guidance Notes Committee completed the 2017 list. Its name points to explanatory material intended to support consistent understanding of GST procedures. As with the other historical entries, the 14th-meeting record is evidence of the rollout framework at that date, not a standing guarantee for every later year.
What the GST Implementation Committee does
The GST Implementation Committee, often abbreviated as GIC in the Secretariat’s description, has a different position from the Council. The GST Council Secretariat states that the Council delegated powers to the GIC to decide issues of an urgent and procedural nature in the interval between two Council meetings.
That delegation explains why implementation does not have to wait for a full Council meeting every time an urgent procedural question arises. It does not erase the distinction between delegated administration and constitutional recommendation. The GIC’s authority exists because the Council delegated it, and the description limits the delegation to urgent and procedural issues in the interregnum between meetings. A policy question requiring a Council recommendation should not be relabelled as a committee decision merely because the committee handles implementation work.

What the GST Council Secretariat does
The Secretariat is the administrative engine supporting the Council and its committees. Its described functions include:
Crashes, No Sound, or Screen Glitches?
Random freezes, missing sound and display glitches usually trace back to one bad driver. Find and replace yours safely.Free scan · under a minuteWindows Errors? Fix Them Before They Spread

- drawing up agenda notes;
- preparing minutes;
- following up implementation of Council decisions;
- processing representations concerning GST laws, rules and rates; and
- organising national coordination meetings.
This role is easy to confuse with policy authority. Preparing an agenda note or recording minutes does not mean the Secretariat has decided the GST issue. Likewise, following up a Council decision is administrative execution of an institutional decision, not a substitute for the Council’s recommendation procedure.
Who decides GST rates in India?
The constitutional answer is that the GST Council recommends rates to the Union and States under Article 279A. The Fitment Committee may examine commodities, services, interest rates or composition rates and prepare recommendations. The Council then considers matters within its constitutional remit under its quorum and weighted-voting rules.
A Council recommendation is not the same thing as a committee announcement. The legal effect for taxpayers comes through the applicable GST legislative and notification framework adopted by the competent authorities. For that reason, a reliable rate answer should be checked against the current law, notification or circular applicable to the relevant date, product, service, place of supply and taxpayer category. A committee’s historical recommendation cannot safely be treated as the current rate without that check.

- Issue identification: a rate, exemption, legal rule, technology problem or representation is identified by the administration, taxpayers or another stakeholder.
- Technical examination: the relevant committee or working group studies the subject. For example, a fitment question may go to the Fitment Committee, while a rule-design problem may go to the Law and Rules Committee.
- Inter-government coordination: Centre–State administrative or technology concerns may be coordinated through the appropriate committee, Secretariat process or national coordination meeting.
- Agenda preparation: the Secretariat organises the material and prepares agenda notes for Council consideration where a Council-level recommendation is required.
- Council consideration: the Council meets with the constitutional quorum and decides through the Article 279A weighted-voting rule when a decision is required.
- Implementation follow-up: the Secretariat follows up the Council’s decision. Urgent or procedural matters between meetings may fall within the authority delegated to the GST Implementation Committee.
- Legal and administrative effect: taxpayers rely on the resulting Act, rule, notification, circular or other applicable instrument, not merely on an internal committee discussion.
Some issues will not pass through every stage. The sequence is a way to keep constitutional recommendation, committee examination and administrative implementation in their proper places.

2017 committee framework versus current listings
The dated 2017 records are useful for understanding how GST rollout work was divided. They proposed eight standing committees and described specialised functions for law, IT, interface, fitment, outreach, capacity building, fund settlement and guidance notes. Those records should be labelled “2017 framework” whenever they are cited.
The GST Council’s current committee directory lists bodies including the Fitment Committee, Law Committee, GST Implementation Committee, Grievances Redressal Committee, State Coordination Committee, All India Coordination Committee and IT-GRC, along with other groups. The Law Committee page includes a modification entry dated 10 February 2025. This demonstrates that committee structures are maintained and updated over time.
A directory listing proves that a body is documented by the Council; it does not, by itself, establish the full current remit or membership of every listed committee. For a current legal or compliance question, use the latest committee record and the applicable GST Act, rule, notification or circular rather than copying a 2017 description without a date.
Common mistakes when describing the two institutions
- Calling a committee a constitutional body: Article 279A establishes the Council, not every committee mentioned in Council records.
- Saying a committee sets binding rates: the Fitment Committee’s recorded role is to recommend rates and related treatments; the constitutional recommendation role belongs to the Council.
- Presenting 2017 names as permanently current: committee names, composition and responsibilities can be modified, as shown by current directory records and the Law Committee’s 10 February 2025 modification entry.
- Confusing Secretariat work with policy decisions: agendas, minutes, representations and follow-up are administrative functions.
- Treating delegated implementation power as unlimited: the Secretariat describes the GIC delegation as covering urgent and procedural issues between Council meetings.
- Using a committee page as a substitute for current law: institutional descriptions do not replace the latest Act, rules, notifications and circulars applicable to a transaction.
Where to verify GST law and institutional information
For the constitutional foundation, consult Article 279A as reproduced in the 101st Constitution Amendment Act, 2016. For committee history, use the GST Council’s 29 May 2017 constitution record and the minutes of its 14th meeting, while preserving their dates in any explanation. For current committee names or modifications, use the GST Council’s committee directory and the relevant committee page.
For the rule that actually applies to a filing, invoice or transaction, consult the current Central Board of Indirect Taxes and Customs GST legal resources, including the applicable CGST Act, rules, notifications and circulars. A printed GST bare act or law reference book can be useful only if its edition incorporates the amendments and notifications relevant to the period being checked.
Key takeaway
The GST Council is the constitutional Centre–State forum that makes recommendations on the architecture and operation of GST. Standing committees are specialised support and examination bodies created or modified through the Council’s administrative framework. They can develop legal, technical, rate-fitment and implementation work, and the GST Implementation Committee has delegated authority for urgent and procedural matters between Council meetings. They do not automatically possess the Council’s constitutional status, voting rule or power to make binding GST law. Always date a committee description and verify the current legal instrument before relying on it.
