If a GST adjudicating authority has passed an order against you, the ordinary first appeal is filed in FORM GST APL-01 under section 107 of the Central Goods and Services Tax Act, 2017. The normal deadline is three months from the date the order is communicated, not necessarily the date printed on the order. You must pay the amount you admit as payable and a statutory pre-deposit calculated on the remaining disputed tax before filing.
This guide explains the first-appeal process, the documents and calculations it requires, what the APL-01 acknowledgement means, and the further appeal route to the Appellate Tribunal under section 112. State and Union Territory GST laws generally provide corresponding routes, but the applicable enactment, notifications, forum and filing instructions should be checked for the jurisdiction handling your order.
First, identify the order, forum and deadline
A GST appeal is not a general request to reconsider a tax position. It challenges a specific decision or order passed by an adjudicating authority. Before drafting anything, identify the order number, order date, issuing officer, legal provision under which it was made and the Appellate Authority to which the appeal must be addressed.

Section 107(1) gives an aggrieved person three months to appeal from the date the decision or order is communicated. The communication date may differ from the date shown on the order. Preserve the email, portal delivery record, acknowledgement, physical service record or other evidence that establishes when you received it. If several versions or communications exist, obtain advice on which event starts the period before relying on the latest date.

The one-month condonation window is not automatic
Under section 107(4), the Appellate Authority may admit a late appeal within a further period of up to one month if it is satisfied that sufficient cause prevented timely filing. This is a limited power to condone delay, not an extension that applies automatically. A delayed APL-01 should explain the cause, the dates involved and why the delay was beyond the appellant’s control, supported by records. Filing after the available condonation period creates a much more serious maintainability risk.
What to do when the communication date is uncertain
- Save every portal alert, email, SMS, courier envelope, acknowledgement and downloaded copy of the order.
- Ask the authorised representative or tax team to create a dated chronology showing service, internal review and payment events.
- Use the earliest defensible communication date for planning rather than assuming the most favourable date.
- Obtain case-specific Indian GST advice immediately if the ordinary period may have expired.
Calculate the amount that must be paid before filing
The pre-deposit calculation is separate from the merits of the appeal. Section 107(6) requires two payments before a first appeal can be filed:

- the full amount of tax, interest, fine, fee and penalty arising from the order that the appellant admits as payable; and
- 10% of the remaining amount of tax in dispute, subject to the maximum prescribed in section 107.
The 10% base is disputed tax. It is not automatically the total of every disputed line in a demand, such as interest, fine, fee and penalty. Read the demand table in the order, mark each component as admitted or disputed, account for payments already made, and reconcile the result with the electronic liability and cash ledgers. The applicable statutory text controls if the order’s presentation is unclear.
A practical calculation worksheet
| Calculation item | What to record |
|---|---|
| Tax admitted | The tax amount you accept as payable under the order |
| Other admitted amounts | Admitted interest, fine, fee or penalty arising from the order |
| Tax in dispute | Only the tax amount challenged in the appeal |
| First-appeal pre-deposit | 10% of disputed tax, checked against the statutory maximum |
| Payments already made | Date, challan or ledger reference and the component to which each payment relates |
| Balance before filing | Admitted amount plus the required disputed-tax pre-deposit, after crediting valid prior payments |
Keep the challan, payment reference, ledger extract and a signed calculation sheet with the appeal. A mismatch between the amount entered in APL-01 and the amount actually credited can delay processing or produce a notice.

Documents required for a first GST appeal
FORM GST APL-01 captures the core case information and the taxpayer’s arguments. The rules also require the certified copy of the appealed decision or order and relevant supporting documents to be submitted through the prescribed process. The following file structure helps you meet those requirements without treating every item as mandatory in every dispute.
Order and identity records
- Certified copy of the decision or order being appealed.
- Order number, order date and the name and designation of the issuing officer.
- Proof of the date on which the order was communicated.
- GSTIN or other identifier, legal name, trade name and registered address.
- Authority letter, power of attorney or other authorisation for the representative, where applicable.
Records that support the grounds
- Returns, invoices, debit or credit notes and ledgers for the disputed tax period.
- Reconciliations linking return figures, books and the demand calculation.
- Show-cause notice, relied-upon documents, replies, written submissions and hearing correspondence from the adjudication stage.
- Payment challans, electronic liability or cash ledger extracts and the pre-deposit calculation.
- Contracts, purchase orders, delivery records, certificates or classification evidence relevant to the specific finding.
- Documents proving limitation, exemption, export, place of supply, valuation or input-tax-credit entitlement when those issues form a ground.
Do not attach an unstructured data dump. Name each file, number the pages and make an index that maps every important document to a paragraph or ground in the appeal. Redact information that is irrelevant or legally protected only after checking the applicable filing rules.

Record the communication date, calculate the ordinary deadline and identify the correct Appellate Authority. Save the complete order and all annexures in an unaltered format.
- Separate admitted and disputed amounts. Prepare the section 107(6) calculation, make the required payments and retain proof. Do not use a percentage calculated on the entire demand unless the statutory tax-in-dispute calculation produces that result.
- Complete the case fields. APL-01 asks for the GSTIN or identifier, legal and trade names, address, appealed order number and date, issuing officer, communication date, authorised representative, brief issue, description or classification of goods or services, dispute period and amounts under dispute.
- Write the statement of facts. Set out the transaction, return or event in chronological order. Identify what was filed, what the officer decided, which amount was demanded and where the decision departs from the record. Keep factual assertions tied to an annexure.
- Number the grounds of appeal. Give each legal or factual error its own heading. Explain the challenged finding, the provision or evidence that applies, and the consequence for the demand. Do not bury several unrelated arguments in one paragraph.
- State the prayer. Specify the relief requested, such as setting aside or modifying the challenged demand, allowing a particular credit or classification, or granting another remedy that the authority has power to provide. The prayer should match the grounds and the amounts in dispute.
- Choose the hearing option. APL-01 asks whether a personal hearing is sought. Make the choice deliberately and explain any procedural issue that requires oral submissions in the written appeal.
- Sign and submit as prescribed. Complete the verification and signature in the manner required for the appellant or authorised representative. Upload the order, supporting documents and payment evidence in the format and size currently accepted.
- Track the provisional acknowledgement. Under the stated rules procedure, a provisional acknowledgement is issued immediately after submission. It is not the same as the final acknowledgement that assigns the appeal number.
- Provide the certified order and supporting documents within seven days. The CBIC appeal rules describe a seven-day follow-up submission under the prescribed procedure. Confirm the currently notified submission mode and keep proof of delivery or upload.
- Retain the final acknowledgement. The rules state that the appeal is treated as filed only when the final acknowledgement bearing the appeal number is issued. Save that acknowledgement, the appeal number, the submitted APL-01 and the final document set in more than one secure location.
How to draft grounds that can be decided
The form separates the statement of facts, grounds of appeal and prayer because each performs a different job. A strong ground lets the authority see the alleged error and the remedy without reconstructing the case from hundreds of pages.

Use a finding–reason–relief structure
- Finding: quote or accurately identify the paragraph, table or conclusion in the order that is challenged.
- Reason: explain the statutory interpretation, calculation error, evidentiary omission, jurisdictional defect or procedural failure that makes the finding wrong. Cite the relevant return, invoice, reply or annexure by page or reference.
- Relief: state the precise adjustment requested for that ground and how it changes the demand.
Keep law, facts and arithmetic consistent
- Use the same tax period, registration number, invoice identifiers and amounts throughout the form and annexures.
- Distinguish a challenge to tax from a challenge to interest, fine, fee or penalty; the pre-deposit calculation depends on that distinction.
- Where classification or exemption is disputed, explain the competing descriptions and identify the evidence for the proposed treatment.
- Where input tax credit is disputed, reconcile the claimed credit to invoices, returns, payment records and any matching or eligibility issue raised in the order.
- Do not add a new factual case that was never supported in the adjudication record without explaining why the material is relevant and permissible.
What happens after APL-01 is filed
Keep monitoring the portal, registered email and authorised representative’s correspondence for requests concerning document completeness, payment, authorisation or hearing. A provisional acknowledgement confirms receipt of the initial submission; the appeal’s filing status depends on the final acknowledgement and appeal number described above.
Prepare a hearing bundle that contains the filed form, indexed annexures, a one-page chronology, the disputed-demand calculation and a short list of the findings that remain contested. If a notice asks for clarification, answer each question directly and preserve the submission receipt. Do not assume that uploading a later document silently changes the grounds in the original appeal; identify any supplementary submission and its purpose.
The Appellate Authority will decide the appeal under the applicable GST law and procedure. The merits, limitation, evidence and relief depend on the individual order, so a general guide cannot predict the result or replace advice on a consequential dispute.
If the first appeal is unsuccessful: the Appellate Tribunal route
Section 112 provides a further appeal against an order under section 107 or section 108. The rules identify GST APL-05 as the Tribunal appeal form. This is a separate proceeding with its own deadline, payment calculation and filing arrangements.
| Issue | First appeal | Appellate Tribunal appeal |
|---|---|---|
| Primary law | Section 107 of the CGST Act | Section 112 of the CGST Act |
| Order challenged | Decision or order of the adjudicating authority | Order under section 107 or section 108 |
| Ordinary deadline | Three months from communication of the order | Three months from communication of the order being challenged |
| Late filing | Up to one additional month may be admitted for sufficient cause under section 107(4) | Apply the limitation and condonation provisions applicable to the Tribunal proceeding; verify the current notification and forum practice |
| Amount admitted | Pay the full admitted tax, interest, fine, fee and penalty arising from the order | Pay the full admitted amount required by section 112 |
| Disputed-tax pre-deposit | 10% of the remaining disputed tax, subject to the section 107 statutory maximum | Additional 20% of the remaining disputed tax, in addition to the amount paid under section 107(6) |
| Prescribed form | GST APL-01 | GST APL-05 |
| Recovery effect | Follow the section 107 payment and procedural rules | When the amount prescribed in section 112(8) is paid, recovery proceedings for the balance are deemed stayed until disposal of the appeal |
| Filing arrangements | Use the currently notified GST portal and Commissioner instructions | Verify the Tribunal’s current operational filing arrangement and applicable notifications before presenting the appeal |
Plan the Tribunal appeal before the first order arrives
At the first-appeal stage, preserve the complete record that may be needed later: the original order, APL-01, final acknowledgement, written submissions, hearing notes, appellate order and proof of every payment. If the result is adverse, calculate the section 112 amount from the Tribunal order and check the three-month period from its communication date. Do not assume that an older portal workflow or an announced Tribunal arrangement is still the live process for your jurisdiction.
Quick Recap
Common mistakes and how to prevent them
- Counting from the order date: build the deadline from documented communication unless the applicable authority confirms another rule.
- Treating condonation as an extension: file within the ordinary period whenever possible and explain any unavoidable delay with evidence.
- Applying 10% to the whole demand: isolate disputed tax from interest, fine, fee and penalty before calculating the first-appeal deposit.
- Ignoring admitted amounts: the admitted portion must be paid in full; a partial payment can leave the appeal defective.
- Uploading only the order: attach the records that prove each ground and submit the certified copy and follow-up documents in the prescribed time.
- Stopping at the provisional acknowledgement: retain and verify the final acknowledgement with the appeal number.
- Using generic grounds: connect every ground to a specific finding, record and requested remedy.
- Changing the case informally: identify supplementary evidence or submissions clearly instead of assuming an additional upload replaces the original appeal.
- Relying on stale portal instructions: confirm current forms, upload limits, signing requirements and Tribunal arrangements before submission.
Final filing checklist
- Communication date proved and deadline calculated.
- Correct Appellate Authority identified.
- Order and annexures preserved in certified and working copies.
- Admitted amounts separated from disputed tax and other demand components.

- Personal-hearing choice and verification completed.
- Supporting documents indexed and tied to individual grounds.
- Certified order and follow-up documents submitted through the currently prescribed process.
- Final acknowledgement and appeal number saved and circulated to the responsible tax team.
- If the result is adverse, Tribunal deadline, APL-05 requirements, additional pre-deposit and current filing arrangements reviewed promptly.
