Under the Central Goods and Services Tax (CGST) Act text published by CBIC, a first appeal requires payment of the admitted tax, interest, fine, fee and penalty in full, plus 10% of the remaining disputed tax. An appeal to the GST Appellate Tribunal requires the admitted amounts in full plus a further 20% of the remaining disputed tax; that 20% is additional to the first-appeal payment, not a replacement for it.

For an ordinary tax dispute, the disputed-tax deposits therefore total 30% across both stages. Paying the statutory amount triggers a deemed stay of recovery of the balance. Penalty-only cases require separate checking because a GST Council recommendation is not, by itself, an enacted and commenced amendment.

How to calculate the first-appeal pre-deposit

1. Separate admitted and disputed amounts

Start with the order against which the appeal is filed. Identify what is admitted and what remains disputed. The admitted portion is a full-payment requirement covering the listed components of the order: tax, interest, fine, fee and penalty. It is not replaced by the 10% calculation.

Then determine the remaining amount of tax in dispute. The 10% percentage is applied to that tax figure. Interest, fine, fee and penalty are not silently converted into the 10% tax base; classify each amount from the actual order and payment records.

2. Apply the 10% formula

For the ordinary first appeal, the calculation is:

First-appeal disputed-tax deposit = 10% × remaining tax in dispute

Add the admitted tax, interest, fine, fee and penalty that must be paid in full. The resulting payment is the section 107(6) requirement.

3. Worked illustration

Assume, solely to show the arithmetic, that the remaining disputed tax at the relevant calculation point is ₹10 lakh. The 10% disputed-tax deposit is ₹1 lakh. Any admitted tax, interest, fine, fee or penalty identified in the order must be added at its full admitted amount. This illustration does not decide whether a particular liability is admitted or disputed; that classification must come from the order and prior payment records.

Build a component schedule before paying

A useful schedule has separate columns for the amount demanded, amount admitted, amount disputed, amount already paid and amount still payable. Keep tax in its own row and list interest, fine, fee and penalty separately. This prevents a common error: taking a percentage of a combined figure that includes amounts on which the 10% statutory formula does not operate. Reconcile the schedule to the adjudication order, any rectification order and the electronic liability ledger.

How the Tribunal-stage pre-deposit works

The 20% is expressly additional

Section 112(8) requires a Tribunal appellant to pay the admitted amounts in full and “a sum equal to twenty per cent. of the remaining amount of tax in dispute, in addition to the amount paid under sub-section (6) of section 107.” The quoted language appears in the CBIC Act text.

Consequently, a Tribunal appeal does not reset the calculation to 20%. The section 107(6) payment remains part of the statutory history, and the Tribunal-stage payment is another 20% of the remaining disputed tax.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Worked illustration across both stages

Using the same ₹10 lakh remaining disputed-tax figure, the first appeal requires ₹1 lakh at 10%. The Tribunal appeal then requires an additional ₹2 lakh at 20%. The disputed-tax deposits paid across both stages are ₹3 lakh, or 30% of that ₹10 lakh figure, before adding any admitted amounts payable in full.

Illustration where admitted amounts also exist

Suppose an order records ₹10 lakh of disputed tax and, separately, ₹2 lakh of tax and ₹30,000 of interest that the taxpayer admits. The statutory arithmetic is not a flat 30% of ₹12.30 lakh. The first stage uses 10% of the ₹10 lakh disputed-tax figure, while the ₹2 lakh admitted tax and ₹30,000 admitted interest are paid in full. At the Tribunal stage, another 20% of the relevant disputed-tax figure is added, together with any admitted amounts still required. The figures are illustrative only; the order and payment history control the actual base.

Why the calculation base must be checked again

The relevant figure can depend on the amount actually disputed in the impugned order and on payments already made. Before filing, reconcile the demand notice or order, the appeal grounds, challans and the electronic liability ledger. Do not describe the result as a percentage of the “total demand” unless the total demand happens to equal the remaining disputed tax and the admitted components have been separately addressed.

What payment does to recovery

First appeal

Once the section 107(6) payment is made, section 107(7) provides that recovery proceedings for the balance are deemed to be stayed. The stay is tied to making the statutory payment; filing an appeal without satisfying the payment condition does not create the same statutory protection.

Tribunal appeal

Section 112(9) similarly provides a deemed stay for recovery of the balance after the Tribunal-stage requirement is met. The Tribunal provision expressly describes the stay as continuing until disposal of the appeal. The statutory language is available on the CBIC Act page.

What the stay does not decide

A deemed stay prevents recovery of the balance under the statutory conditions; it does not decide the merits of the tax dispute, waive the admitted portion, or eliminate the need to comply with filing and document requirements. Keep proof of each payment and acknowledgement with the appeal file.

Keep evidence of the triggering payment

Save challans, bank confirmation, the electronic credit or liability entry and the appeal submission reference. If recovery correspondence arrives after payment, these records help demonstrate when the statutory condition was met. They also allow the disputed-tax calculation to be reproduced if the matter moves from the Appellate Authority to the Tribunal.

Deadlines and discretionary extensions

First appeal: three months, with a possible one-month extension

Section 107(1) gives three months from communication of the relevant order for filing a first appeal. Under section 107(4), the Appellate Authority may allow a further one month if sufficient cause prevented timely filing. The extra month is discretionary, not an automatic grace period. The statutory deadline provisions are in the CGST Act text.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Tribunal appeal: three months, with a possible further three months

Section 112(1) provides an ordinary three-month period from communication of the order. Section 112(6) allows the Tribunal to admit an appeal within three months after expiry of the ordinary period when sufficient cause is shown. This is also a discretionary admission power, so an appellant should file within the original period whenever possible and document the reason for any delay.

Counting the period

Use the date on which the relevant order was communicated, not merely the date printed on the order. Preserve the communication record, portal download, email or other evidence used to calculate the deadline. If the communication date is uncertain, obtain professional advice before relying on a later date.

Do not confuse the two extension windows

The first appeal has a possible further one month, while the Tribunal has a possible further three months after the ordinary deadline. Neither provision creates a routine filing grace period. A delay application should explain the cause, cover the complete period of delay and be supported by documents that show why timely filing was not possible.

Electronic Tribunal filing: FORM GST APL-05 and acknowledgement

CBIC’s appeal rules page describes the electronic Tribunal process. Confirm the live portal workflow and any later amendment before filing, but the described sequence is:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  1. Prepare the Tribunal appeal in FORM GST APL-05 within the statutory period.
  2. Upload the certified copy of the impugned order, supporting documents and the prescribed fee through the electronic process.
  3. Submit the certified order and required supporting material within seven days where the rules call for post-submission document delivery or confirmation.
  4. Wait for the final acknowledgement in FORM GST APL-02.
  5. Treat the appeal as filed only when the final acknowledgement is issued, rather than assuming that an initial upload or draft number is sufficient.

The form and acknowledgement mechanics are described by CBIC’s CGST Appeal Rules page. Keep the filing reference, payment challans, uploaded files and APL-02 acknowledgement together; a missing certified order or incomplete acknowledgement can create an avoidable filing dispute.

Practical document pack

Prepare the impugned order and proof of communication, statement of facts, grounds of appeal, calculation schedule, proof of admitted payments, proof of the 10% payment and, for a Tribunal matter, proof of the additional 20% payment. Add the relied-on notices, replies, written submissions and relevant reconciliation documents in an indexed PDF or other format accepted by the portal. Check file-size and naming requirements immediately before upload because portal instructions can change.

Penalty-only orders: do not confuse a recommendation with current law

What the 55th GST Council release says

The GST Council’s 55th meeting press release, dated 21 December 2024, records recommendations for cases involving only a penalty demand and no tax demand. It describes reducing the first-appeal penalty-only pre-deposit from 25% to 10% and adding a 10% pre-deposit for a Tribunal appeal in such cases. The wording of the proposed Tribunal change refers to “payment of pre-deposit at 10% for filing appeals before Appellate Tribunal in cases involving only demand of penalty without involving the demand of tax.”

The recommendation is recorded in the 55th GST Council press release. A Council recommendation alone does not prove that Parliament enacted the amendment, that it has commenced, or that it applies to the appeal under consideration.

How to verify the operative rule

For a penalty-only order, check the amending Act, commencement notification and any applicable rules or circulars in force on the filing date. The CBIC Act page reviewed for the ordinary comparison displays the standard section 107 and section 112 formulas. Do not blend the proposed penalty-only percentages with the ordinary tax-dispute calculation, because the proposal is limited to orders involving penalty without a tax demand.

Special admission rule for small Tribunal disputes

Section 112(2) states that the Tribunal may, in its discretion, refuse to admit an appeal where the amount of tax, input tax credit, fine, fee or penalty involved does not exceed ₹50,000. This is an admission threshold, not an alternative pre-deposit formula and not an exemption that automatically removes the section 112(8) payment. Whether the Tribunal exercises that discretion depends on the statutory conditions and the facts of the case.

Interest where a refund becomes due

Section 115 addresses interest on qualifying amounts paid for admission of an appeal when a refund becomes due. The provision should be read with the order, refund determination and applicable conditions; it does not turn the pre-deposit into a general interest-bearing investment. Use the current statutory text of section 115 and obtain advice on the exact refund and interest computation for the case.

Common calculation and filing mistakes

Treating 20% as a replacement for 10%

The most consequential error is paying only 20% at the Tribunal stage and ignoring the earlier 10%. Section 112(8) says the 20% is “in addition to” the section 107(6) amount. Reconcile both payments before submitting the Tribunal appeal.

Applying the percentage to the entire demand

The percentage is calculated on the remaining tax in dispute. The admitted tax, interest, fine, fee and penalty are handled as a separate full-payment requirement. A demand containing several components therefore needs a component-by-component schedule.

Assuming an extension is automatic

The one-month first-appeal extension and the Tribunal’s further three-month admission window require sufficient cause and an exercise of statutory discretion. File on time rather than planning around the extension.

Confusing an upload with a filed appeal

For the Tribunal process described in the appeal rules, the final APL-02 acknowledgement is the filing event. Retain evidence that the acknowledgement was issued and verify that the certified order and documents were accepted.

Using the Council recommendation as if it were enacted law

Penalty-only treatment can change through legislation and commencement notifications. Quote the recommendation as a recommendation and verify the operative provision before calculating or advising on payment.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Failing to recalculate after an order changes

A rectification, partial payment, appellate direction or corrected ledger entry can alter the amount remaining in dispute. Recalculate from the operative order and current payment records rather than copying an earlier challan amount. Keep both versions of the schedule so the reason for any change is clear.

Pre-filing checklist

  • Record the date and method by which the order was communicated.
  • Classify each amount as admitted or disputed and identify tax separately from interest, fine, fee and penalty.
  • Calculate 10% of the remaining disputed tax for the first appeal.
  • For a Tribunal appeal, calculate an additional 20% and attach proof of the section 107(6) payment.
  • Confirm that admitted amounts have been paid in full where required.
  • Check the three-month deadline and prepare a sufficient-cause explanation if a discretionary extension is unavoidable.
  • For Tribunal filing, prepare the certified order, supporting documents, fee and FORM GST APL-05 submission.
  • Obtain and preserve FORM GST APL-02 as evidence that the appeal was filed.
  • If the order is penalty-only, verify the enacted and commenced rule rather than relying solely on the 21 December 2024 Council release.
  • Check the applicable State GST Act, state notifications and the live portal process for the jurisdiction involved.

Central and State GST qualification

This comparison is based on the CGST Act and CBIC materials. State GST provisions generally mirror the central framework, but state-specific instruments, notifications and procedural implementation can affect an actual filing. Confirm the relevant State GST Act, current amendments, commencement notifications and portal instructions before relying on these figures in a live dispute.

Frequently Asked Questions

How much pre-deposit is required for a GST first appeal?

For an ordinary tax dispute, pay the admitted tax, interest, fine, fee and penalty in full, plus 10% of the remaining amount of tax in dispute under section 107(6) of the CGST Act.

Is the 20% GST Tribunal deposit over and above the 10% first-appeal deposit?

Yes. Section 112(8) expressly requires an additional 20% of the remaining disputed tax in addition to the amount paid under section 107(6). The disputed-tax deposits therefore total 30% across both stages in a regular tax dispute.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Is the 20% calculated on the entire GST demand?

No. The percentage applies to the remaining tax in dispute. Admitted tax, interest, fine, fee and penalty are separate amounts that may have to be paid in full.

When does recovery become stayed?

After the statutory payment is made, recovery of the balance is deemed stayed. At the Tribunal stage, section 112(9) expressly continues that stay until the appeal is disposed of.

What is the filing deadline for a GST first appeal?

The ordinary period is three months from communication of the order. The Appellate Authority may allow a further one month for sufficient cause, but that extension is discretionary.

What is the filing deadline for a GST Tribunal appeal?

The ordinary period is three months from communication of the order. The Tribunal may admit an appeal within a further three months if sufficient cause for delay is shown; this is not an automatic grace period.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

What form is used for a Tribunal appeal?

CBIC’s appeal rules describe electronic filing in FORM GST APL-05, submission of the certified order and supporting documents, and issuance of the final FORM GST APL-02 acknowledgement. The appeal is treated as filed when the final acknowledgement is issued.

What pre-deposit applies to a penalty-only order?

The GST Council’s 21 December 2024 press release recommended a 10% first-appeal deposit and a 10% Tribunal deposit for penalty-only cases. Verify the enacted amendment, commencement notification and applicable rules before treating those recommendations as the operative law.

Can the Tribunal refuse a small-value appeal?

Section 112(2) gives the Tribunal discretion to refuse an appeal where the amount of tax, input tax credit, fine, fee or penalty involved does not exceed ₹50,000. This is an admission rule, not a substitute pre-deposit calculation.

The Bottom Line

For a normal GST tax dispute, pay admitted tax, interest, fine, fee and penalty in full, then deposit 10% of the remaining disputed tax for the first appeal. A Tribunal appeal adds another 20%, so the disputed-tax component is 30% cumulatively. Meet the three-month deadlines, obtain the required acknowledgement and verify any penalty-only amendment and State GST variations before filing.
