For a first appeal against a GST order that demands only a penalty and no tax, the statutory pre-deposit is 10% of the penalty. That is not the same calculation used when the order also demands tax. In an ordinary tax-demand appeal, the appellant generally pays the admitted amount plus 10% of the remaining disputed tax, subject to the applicable statutory limits and the facts of the order.
Before paying, classify the order by its operative demand, identify whether the appeal is under section 107 or section 112, check the communication date and current law, and make sure earlier payments are credited to the correct demand ID.
The key distinction: what does the order actually demand?
The phrase “penalty order” is not enough to determine the deposit. Read the demand created by the adjudicating order. The important question is whether the order demands penalty without involving any demand of tax, or whether it demands tax as well as interest and penalty.

| First appeal under section 107: penalty-only order | 10% of the penalty demanded | The order must demand penalty without involving a tax demand; this is the amended proviso to section 107(6). |
| First appeal under section 107: tax-demand order | The admitted amount in full, plus 10% of the remaining disputed tax | Separate the admitted liability from the disputed tax and check any statutory cap and the order’s exact figures. |
| Appeal before the Appellate Tribunal under section 112 | Depends on the current section 112(8) text, the underlying section 107 payment and applicable caps | Do not automatically reuse the first-appeal calculation; verify the consolidated law in force when filing. |
An order that lists a penalty but also creates a tax demand is not a penalty-only order for the amended proviso. Conversely, an order that imposes a penalty and does not demand tax must be tested against the specific statutory wording, not against an older portal explanation or an informal description.

Read the operative portion, not just the summary
Start with the final paragraphs, demand table and electronic liability entry. A show-cause notice may propose several components, while the adjudication order may confirm only a penalty. The reverse can also happen: a document headed “penalty proceedings” may confirm tax, interest and penalty. The pre-deposit follows the amount legally demanded by the impugned order, not the heading used by the officer or the portal.
Keep a copy of the complete order, annexures and demand reference. If the order is amended, rectified or partly withdrawn, use the version that is actually being appealed and record which figures remain enforceable.
Penalty-only first appeals: the 10% rule
Finance Act 2025 section 129 substituted the proviso to section 107(6) of the Central Goods and Services Tax Act. The operative sentence is:
“Provided that in case of any order demanding penalty without involving demand of any tax, no appeal shall be filed against such order unless a sum equal to ten per cent. of the said penalty has been paid by the appellant.”
For this category, the percentage is applied to the penalty amount in the impugned order. It is not applied to a notional tax amount, turnover, or the total of every figure shown in the order. Interest, late fee or other amounts should not be folded into the base unless the current statutory provision and the order show that they form part of the relevant penalty demand.
Illustrative calculation
If the order demands a penalty of ₹1,00,000 and no tax demand is involved, 10% of that penalty is ₹10,000. The example illustrates the base and arithmetic only; the actual amount can change if the order contains another demand, a payment already credited to the demand, a statutory limit, or a transitional issue.
If a qualifying order demands ₹4,50,000 as penalty and no tax, the same method produces a 10% figure of ₹45,000. Preserve the calculation sheet and the order page on which the penalty amount appears so the payment can be reconciled if the portal displays a different description.

When the 10% penalty base does not apply
- An order demanding ₹1,00,000 of tax and ₹20,000 of penalty is not penalty-only. The first-appeal calculation is based on the admitted amount and disputed tax, not 10% of ₹20,000.
- An order described in a notice or portal label as a “penalty case” must still be checked for a tax demand in the operative portion.
- An order predating the amendment requires a commencement and transitional-law check. The amendment wording alone does not resolve every dispute about an older order.
- If one part of the demand is admitted and another part is challenged, do not treat the entire order as penalty-only merely because the tax component is small. The existence of any tax demand changes the classification for the first-appeal calculation.
Tax-demand first appeals under section 107
The ordinary section 107(6) structure requires payment of the amount admitted from the impugned order, together with 10% of the remaining amount of tax in dispute. The GST Portal’s appeal guidance describes the 10% disputed-tax pre-deposit. This is a different base from the amended penalty-only proviso.
How to separate the amounts
- Read the order’s demand table and identify the tax, interest and penalty figures.
- Record the amount you admit as payable. That admitted amount is generally payable in full for the first appeal.
- Calculate the remaining tax that you dispute. Apply the 10% pre-deposit to that disputed-tax amount, not to the penalty or interest figure.
- Check the statutory ceiling, any amount already paid and the order-specific treatment of interest or other components before finalising the payment.
- Reconcile the calculation with the electronic liability register and the demand ID that will be selected in the appeal application.
Illustrative calculation
Suppose an order contains ₹30,000 of admitted tax and ₹2,00,000 of disputed tax. The illustrative first-appeal calculation is ₹30,000 plus 10% of ₹2,00,000, or ₹20,000, for a total of ₹50,000 before checking applicable caps, credits and the current statutory text. This example is not a substitute for the figures and classifications in the actual order.
For example, if ₹80,000 of tax is admitted and ₹3,50,000 remains disputed, the arithmetic base is ₹80,000 plus 10% of ₹3,50,000, or ₹35,000. A penalty shown separately does not add another 10% under the penalty-only proviso. Whether interest or other components must be paid depends on the order and the governing provision, so obtain a case-specific review where the demand table is complex.

Do not add 10% of the penalty merely because the order includes one. The amended penalty-only rule is triggered by an order demanding penalty without involving a demand of tax; it does not replace the ordinary calculation for a mixed tax-and-penalty demand.
Admitted liability versus disputed tax
Write the two categories separately in the working paper. An amount can be admitted for one tax period or issue and disputed for another. A broad statement that the entire order is “under protest” should not obscure the amount the appellant accepts. Keep invoices, returns, reconciliations and payment challans supporting the disputed-tax figure because the Appellate Authority may need to understand how the pre-deposit was derived.
First appeal versus Tribunal appeal
Section 107 concerns the appeal to the Appellate Authority. Section 112 concerns an appeal to the Appellate Tribunal, so the level of appeal must be identified before calculating anything.
The GST Council’s 55th meeting release of 21 December 2024 recommended a 10% pre-deposit for penalty-only first appeals instead of the earlier 25% proposal and recommended adding a 10% penalty-only provision for Tribunal appeals. The Finance Ministry’s Finance Bill 2025 explanatory memorandum described amendments to sections 107(6) and 112(8). A recommendation and an explanatory memorandum provide policy and legislative context; the enforceable first-appeal wording is the Finance Act amendment.
An older CBIC Act page describes the ordinary Tribunal tax-demand structure as an additional 20% of the remaining tax in dispute, in addition to the amount paid under section 107(6). That page also contains earlier penalty-only wording. It should not be used as the current source for the amended penalty-only first-appeal rule. Before filing a Tribunal appeal, check the current consolidated section 112 text, commencement provisions and applicable caps. The materials establishing the amended first-appeal sentence do not, by themselves, establish a definitive current Tribunal amount for every fact pattern.

A Tribunal appeal may require the amount paid for the first appeal plus an additional deposit calculated under section 112. A taxpayer who simply repeats the 10% penalty figure from the Appellate Authority stage could underpay or pay against the wrong component. Confirm whether the Tribunal provision has commenced for the relevant order, whether the first-appeal payment is credited, and whether the applicable ceiling has already been reached. Obtain the current consolidated text and preserve the calculation used when the appeal is filed.
Chronology and commencement cautions
Policy recommendation
On 21 December 2024, the GST Council recommended reducing the first-appeal pre-deposit for orders involving only penalty and no tax demand from 25% to 10%, and recommended a corresponding 10% penalty-only provision for Tribunal appeals.
Legislative amendment
The Finance Bill 2025 explanatory memorandum described the proposed changes. Finance Act 2025 section 129 contains the operative substitution of the section 107(6) proviso quoted above.
Commencement and older orders
A recommendation, an enacted amendment and the date on which an amendment commences are separate events. The official extracts available for this explanation establish the amended wording but do not establish a commencement-notification date. If the order or appeal falls near the amendment’s effective date, obtain the applicable notification and consider transitional case law before relying on the 10% penalty base.
Record three dates in the file: the date of the order, the date it was communicated and the date the appeal is submitted. They can affect limitation, the applicable version of section 107 or 112 and the evidence needed to show timely filing. Do not assume that a later payment date changes the law applicable to an earlier order.

How to file the first appeal and preserve the filing date
The GST Portal FAQ says a taxpayer or an unregistered person aggrieved by an adjudicating-authority decision or order may appeal to the Appellate Authority within three months from communication of the order. The normal form is FORM GST APL-01.
- Identify the communication date. Use the date on which the order was communicated for the three-month period stated in the portal guidance. Preserve the communication record, email, portal alert or other evidence of service.
- Classify the demand. Confirm whether the order demands only penalty or also demands tax. Record the section and appellate level.
- Compute the applicable deposit. Use 10% of the penalty for a qualifying penalty-only first appeal. For a tax-demand first appeal, calculate the admitted amount plus 10% of remaining disputed tax, then check caps and credits.
- Make or locate the payment. Use the payment details that correspond to the demand. A payment made during investigation through FORM GST DRC-03 may not automatically be linked to the demand ID.
- File FORM GST APL-01. Upload the order and supporting material requested by the portal and complete the payment and declaration fields. Check that the selected tax period, registration number and order reference match the impugned order.
- Supply a missing order copy promptly. If the order is not uploaded, the portal FAQ calls for a self-certified copy within seven days. If it is submitted late, the submission date is treated as the appeal filing date under that guidance.
- Keep the final acknowledgment. The appeal rules state that filing is treated as complete when the final acknowledgment with the appeal number is issued. A draft, payment reference or preliminary screen is not the same record.
Check the current portal instructions and applicable rules at the time of filing. Labels and workflows can change, while the legal classification of the order remains the central calculation issue.
Documents to retain
- The signed order, annexures and proof of communication.
- A calculation showing admitted liability, disputed tax or penalty and credits claimed.
- Challans, electronic cash or credit ledger entries and any DRC-03 or DRC-03A references.
- The submitted APL-01, uploaded attachments, payment confirmation and final acknowledgment with appeal number.
- Correspondence showing that a missing order copy was supplied within the seven-day period, where applicable.
DRC-03 payments and demand-ID linkage
GSTN has explained that a payment made through FORM GST DRC-03 during an investigation is not automatically linked to a particular demand ID. It may therefore appear in the system without being treated as paid against the demand used for the appeal calculation.
FORM GST DRC-03A is used to map the DRC-03 payment to the corresponding demand ID. Complete that mapping, where applicable, and verify that the electronic liability register reflects the credit before assuming the pre-deposit requirement has been met.
Practical verification list
- Note the DRC-03 reference number, date and amount.
- Identify the demand ID created by the adjudication order.
- Submit the DRC-03A linkage if the payment was not automatically attributed.
- Recheck the liability register and retain the acknowledgment or system evidence.
- Compare the credited amount with the calculation in the appeal form.
- If only part of a DRC-03 payment relates to the appealed order, document the allocation rather than claiming the full amount.
Common mistakes and how to correct them
Using 10% of penalty for a mixed demand
Problem: The appellant sees a penalty figure and pays 10% of it even though tax is also demanded.
Correction: Re-read the operative demand. If tax is demanded, use the admitted-amount and disputed-tax structure for the first appeal.
Treating the Council recommendation as the law
Problem: A recommendation for a 10% deposit is quoted as though it were the enforceable provision.

Relying on an old CBIC page for the amended penalty rule
Problem: An older statutory page contains earlier penalty-only language and is used without checking the amendment.
Correction: Check the Finance Act 2025 amendment and the current consolidated Act, particularly when the order date is close to commencement.

Decision checklist before paying
- Have you read the operative demand rather than relying on the order’s short title?
- Does the order demand penalty without involving any tax demand?
- Are you filing before the Appellate Authority or the Appellate Tribunal?
- What amount is admitted, and what amount of tax remains disputed?
- Which payments are already credited to the relevant demand ID?
- Do statutory caps or the current consolidated provisions alter the arithmetic?
- What date was the order communicated, and when does the three-month period end?
- If the order is not uploaded, can you provide the self-certified copy within seven days?
- Will you retain the final acknowledgment and appeal number?
- Have you checked whether the amendment and any commencement notification apply to this order?
What the rule means in practice
The amended first-appeal proviso is narrow but important: only an order demanding penalty without involving a tax demand uses the 10% penalty base. The presence of a penalty in a broader tax order does not move that order into the penalty-only category. Classification, appellate level, credited payments, commencement and portal acknowledgment must all be checked together before filing.
When the facts are straightforward, a one-page calculation and a demand-ID reconciliation can prevent a rejected or delayed filing. When the order combines several periods, contains rectification, or falls around the amendment’s effective date, obtain professional advice and verify the current statute rather than relying on a percentage copied from another case.
Frequently Asked Questions
How much pre-deposit is required for a penalty-only GST order?
For a qualifying first appeal under section 107, the amended proviso requires 10% of the penalty demanded by the order when no tax demand is involved. Confirm the order’s operative demand, commencement rules and any payment credit before filing.
Recommended Free Tools
Is the GST appeal deposit 10% of penalty or 10% of disputed tax?
It depends on the order. A penalty-only first-appeal order uses 10% of the penalty. An order that demands tax follows the ordinary structure: the admitted amount in full plus 10% of the remaining disputed tax, subject to applicable limits.
What if the order contains both tax and penalty?
It is not penalty-only. Do not calculate 10% solely on the penalty. Separate the admitted amount and disputed tax and apply the section 107 tax-demand calculation.
Does a DRC-03 payment automatically count toward the appeal pre-deposit?
Not necessarily. GSTN states that an investigation payment through DRC-03 may not be linked to the demand ID. Use DRC-03A where applicable and verify the credit in the electronic liability register.
How long do I have to file FORM GST APL-01?
The GST Portal FAQ states that an appeal may be filed within three months from communication of the adjudicating order. Preserve proof of communication and check the current rules for your circumstances.
What if the order is not uploaded on the portal?
The portal guidance calls for a self-certified copy within seven days. If it is submitted late, the submission date is treated as the appeal filing date under that guidance.
Is a payment receipt proof that the appeal has been filed?
No. The appeal rules treat filing as complete when the final acknowledgment carrying the appeal number is issued. Keep that acknowledgment with the payment and submitted APL-01.
Does the same 10% penalty rule automatically apply to a Tribunal appeal?
No. Section 112 applies at the Tribunal stage. Check the current consolidated section 112(8), commencement provisions, cumulative section 107 payments and applicable caps before calculating a Tribunal deposit.
What about an order issued before the Finance Act 2025 amendment?
Do not assume the amended 10% rule applies automatically. Check the commencement notification, the communication and filing dates, and any transitional case law relevant to the order.
