Yes. An H-1B worker may be able to pursue a green card without the usual employer-sponsored labor certification through EB-1A extraordinary ability or an EB-2 National Interest Waiver (NIW), if they meet the category’s demanding requirements. Schedule A is not a self-petition, and EB-5 is an investor route rather than a substitute based on employment history. Eligibility for a petition also does not mean an immigrant visa is immediately available.

Which green card routes may work if your employer will not pursue labor certification?

The standard employer-sponsored route for many EB-2 and EB-3 cases involves an employer obtaining labor certification from the U.S. Department of Labor (DOL) before filing Form I-140. If your employer cannot or will not do that, the options below differ in who files, what must be proved, and whether the route depends on your professional record, a designated occupation, or investment.

Route Who files or petitions? What is central to the route? Labor certification
EB-1A extraordinary ability The worker may self-petition. Evidence of extraordinary ability and standing at the top of the field. Not required.
EB-2 National Interest Waiver The worker may self-petition. First qualifying for underlying EB-2, then meeting the NIW standard for the proposed endeavor. May be waived if the NIW is granted.
Schedule A The employer files the labor-certification application. Working in a designated occupation or qualifying Schedule A group. Still part of the process, but submitted directly to USCIS rather than undergoing ordinary DOL review.
Ordinary employer-sponsored EB-2 or EB-3 The employer sponsors the case. Employer sponsorship and labor certification for many cases. Usually required for the cases discussed here.
EB-5 An investor route; it is not an employment-based self-petition based on professional achievements. Investment in a U.S. commercial enterprise and qualifying job creation or preservation. Not based on labor certification.

USCIS’s category-specific rules—not a person’s H-1B status by itself—determine whether one of these routes is available. There is no general “H-1B green card” category that replaces the requirements of the underlying preference category.

Can an H-1B worker self-petition for a green card?

EB-1A: extraordinary ability

EB-1A allows a person to petition on their own behalf without an employer sponsor or labor certification. USCIS describes the standard as expertise showing that the person is among the small percentage at the top of their field. That is a high evidentiary bar, not a benefit that follows automatically from seniority, a long career, or a successful H-1B job.

A major internationally recognized award is one example USCIS identifies. Other cases must be assessed under the applicable evidence rules; the relevant question is whether the record establishes extraordinary ability, not merely whether the applicant is accomplished or valued by an employer.

EB-2 National Interest Waiver

An NIW can waive the job-offer requirement and, as a result, the labor certification. The worker may file the petition without an employer sponsor, but must first qualify for the underlying EB-2 classification. USCIS’s January 15, 2025 policy alert emphasizes evaluating the proposed endeavor and, for an exceptional-ability case, the relationship between the claimed ability and that endeavor.

#1 Best Overall

Underlying EB-2 eligibility may rest on an advanced degree or exceptional ability. USCIS defines an advanced degree to include a degree above a bachelor’s degree or, in certain circumstances, a bachelor’s degree followed by at least five years of progressive post-baccalaureate experience in the specialty. A graduate degree, work in a popular industry, or a belief that one’s work benefits the country does not by itself establish NIW eligibility. The petition needs evidence addressing the applicable criteria and the waiver request.

Does Schedule A avoid PERM, and can the worker file it alone?

Schedule A is not a self-petition. It is a labor-certification process for specified groups: the employer submits the labor-certification application directly to USCIS instead of going through ordinary DOL review. In an April 10, 2024 alert, USCIS described this as submitting the application “directly to USCIS, bypassing DOL review.” It does not mean that any H-1B role qualifies or that labor certification disappears.

  • Group I: registered nurses and physical therapists.
  • Group II: people with exceptional ability in the sciences or arts, including a separate subset for performing arts.

If your occupation does not fit a designated group, Schedule A is not a general workaround for an employer that will not sponsor a case.

Is a different employer-sponsored EB-2 or EB-3 case still possible?

If your current employer will not pursue labor certification, the ordinary employer-sponsored route may not be workable through that employer. A different employer may be able to pursue a qualifying EB-2 or EB-3 case, subject to the applicable requirements. This is distinct from EB-1A or NIW, where the worker may petition without the ordinary employer-sponsored labor-certification process.

Is EB-5 a practical alternative to employer sponsorship?

EB-5 is based on investment in a U.S. commercial enterprise and a plan to create or preserve at least 10 permanent, full-time jobs for qualified U.S. workers. It is not a route based on the applicant’s H-1B work record or professional achievements.

The USCIS EB-5 page cited for this article listed minimum investments of $1.8 million generally and $900,000 in a targeted employment area. Its publication date was not stated, and investment thresholds and program rules can change; verify the current USCIS requirements before relying on those figures or filing.

How should you decide which option to investigate?

Start with the route’s legal basis and the evidence you can document. These categories are not interchangeable, and there is no sound way to rank them as “best” without knowing the person’s record, proposed work, occupation, finances, country of chargeability, and timing.

  • Consider EB-1A if your documented record may meet the very high extraordinary-ability standard.
  • Consider NIW if you can establish an underlying EB-2 qualification and support the waiver request with evidence about your proposed endeavor and its national-interest basis.
  • Check Schedule A only if your occupation or qualifications fit a designated group; the employer remains responsible for filing the labor-certification application.
  • Consider a new employer-sponsored case if another qualifying employer is willing and able to pursue the ordinary process.
  • Assess EB-5 separately if investment and the job-creation requirement are realistic; it is a capital-based route, not an achievement-based one.

USCIS’s Form I-140 instructions describe evidence examples and the documentation associated with an NIW request, but a generic checklist cannot establish an individual’s eligibility. A category-specific review of the record is more useful than relying on job title, degree alone, or anecdotal approval claims.

Does qualifying for a petition mean you can file for a green card now?

No. Petition eligibility and immigrant-visa availability are separate questions. The ability to proceed depends on the preference category, country of chargeability, the applicable monthly Visa Bulletin, and USCIS’s selection of the filing chart for adjustment applications. No October 2026 cutoff is asserted here. Check the current bulletin and USCIS filing-chart guidance when deciding whether an adjustment filing is possible; a petition approval alone does not establish that a visa number is available.

Can you change jobs while an I-140 or I-485 is pending?

Do not assume that filing or approval of an EB-1A or NIW petition gives unrestricted freedom to change employers or proposed work. USCIS describes portability for certain employment-based adjustment applicants with approved EB-1, EB-2, or EB-3 petitions when Form I-485 has been pending for at least 180 days and the new position is in the same or a similar occupational classification. USCIS says those portability provisions do not apply to adjustment applicants whose approved petition is based on extraordinary ability or an NIW. The effect of a proposed job change depends on the category and facts of the case.

How predictable is processing time?

USCIS says processing times vary with case volume, workload and staffing, response times, and policy or operational changes. A posted estimate is not a guarantee, and it does not answer when an immigrant visa will be available for a particular applicant.

What this means for an H-1B worker

If employer-sponsored labor certification is unavailable, EB-1A and NIW are the principal employment-based self-petition routes covered here, but each requires a distinct and demanding showing. Schedule A remains employer-filed and limited to designated groups; EB-5 depends on investment and job creation. Check petition eligibility and visa availability separately, and evaluate job changes under the rules for the specific case rather than assuming a petition creates portability.
