Giorgos Tsetis argues that senior AI leaders should face personal legal consequences when they knowingly release systems with serious, foreseeable risks. He is not calling for punishment whenever software fails. His proposed dividing line is culpable decision-making: ignoring safety warnings, cutting essential safeguards, concealing material problems, or shipping a system despite understanding the danger.
What Tsetis is proposing
In a Fortune commentary published October 17, 2026, Tsetis says responsibility should not end with the company that built or deployed an AI system. “Responsibility that stops at the corporate entity isn’t responsibility,” he writes.
The proposal is a principle rather than a finished bill. Tsetis leaves lawmakers and legal experts to determine whether liability should be civil, criminal, or both; which harms qualify; how compliance would be audited; and what exact duties would attach to a named executive.

The management incentive
Tsetis uses his experience at Nutrafol to explain the incentive. Because customers consumed his company’s products, he says he felt personally and legally responsible for their safety. That exposure encouraged him and his team to identify risks, escalate concerns, test safeguards, and accept delaying or stopping a launch when safety required it. He presents personal responsibility as both a safety mechanism and a foundation for consumer trust.

AI can affect infrastructure at scale
AI is being integrated into transportation, power systems, hospitals, classrooms, and other essential services. Tsetis argues that a failure in such a system could propagate across a city, a country, or a larger region rather than remain a defect in one consumer product. He also points to warnings from AI developers about possible loss of human control, which he treats as a reason for exceptional accountability.
When consequences would apply
Tsetis distinguishes unavoidable technical failure from a leader’s informed choice to accept serious risk. Under his argument, an executive would not automatically be punished because a model produced an incorrect answer or an unforeseen bug appeared. The relevant conduct would include:
- Releasing a system while knowing it presents serious risks.
- Ignoring credible internal safety warnings or suppressing escalation.
- Underfunding or weakening safety teams in ways that leave known risks unaddressed.
- Concealing significant problems from regulators, customers, or the public.
Those conditions would need precise legal definitions. Without a clear knowledge standard, executives could be exposed to punishment for ordinary engineering uncertainty; with an overly narrow standard, deliberate risk-taking could remain effectively consequence-free.

Why corporate fines may not be enough
State AI laws are evolving, federal safety requirements are under discussion, and major AI companies have signed a White House accord. Companies also use internal risk controls, independent audits, board-level safety oversight, and safety frameworks published by leading laboratories.
Tsetis’s criticism is that many of these measures are voluntary or leave enforcement at the corporate level. For a highly valued AI company, a fine can become another expense line. A personal duty aimed at the decision-maker would change the calculation by attaching consequences to the person who approved a release, rejected a warning, or withheld information.

The table separates mechanisms that already exist from Tsetis’s proposed change. It does not establish that any model prevents harm; the commentary supplies an argument, not a measured comparison or consensus finding.

Questions lawmakers would have to resolve
What level of knowledge is enough?
A statute could require proof that an executive actually knew about a serious risk, or it could use a recklessness or negligence standard. The higher the threshold, the more it protects ordinary experimentation; the lower the threshold, the easier it may be to address avoidable harm. Tsetis does not choose among these standards.
Which harms qualify?
Rules might cover physical injury, deaths, major infrastructure disruption, privacy or security damage, or another defined category. A workable system would need to distinguish a serious, foreseeable impact from routine model error.
Who audits the evidence?
Independent auditors could examine testing records, incident reports, access controls, and executive decisions. Regulators, civil courts, or prosecutors would still need reliable evidence about what the company knew, when it knew it, and who had authority to act.

What duty attaches to the executive?
Possible duties include maintaining adequate safety staffing, documenting risk acceptance, escalating unresolved warnings to the board, pausing a release when specified thresholds are met, and reporting material incidents. These obligations would have to be specific enough for executives to follow and courts to enforce.

- Report material incidents and known limitations accurately to regulators and affected users.
Documentation does not itself create legal immunity. It can, however, show whether leaders investigated a warning, funded safeguards, and made a deliberate, reviewable decision.

What the commentary establishes—and what it does not
Tsetis is identified as Nutrafol’s cofounder and an active AI investor. He says his investments include frontier-AI companies, AI infrastructure and compute, and an AI-enabled science and health platform, made through Great Things and his family office. His case therefore reflects an operator and investor’s policy judgment, not an independently measured estimate of AI risk.
The commentary provides no statistic, survey percentage, market figure, or quantified estimate showing how often AI harm results from executive misconduct. It also does not settle whether personal liability would improve safety or produce excessive caution. Those are questions for legislation, enforcement design, and evidence from actual cases.
Bottom line for readers
Tsetis’s central claim is narrow but consequential: inevitable system failure should not be treated like deliberate or reckless risk acceptance, yet executives who knowingly ignore serious warnings should not be shielded simply because a corporation signed the contract. Turning that principle into policy requires a defined knowledge threshold, covered harms, auditable duties, due process, and enforcement that can reach both the company and the responsible decision-maker.
