A newly announced federal lawsuit alleges that Coweta County, Georgia, deputies used Flock Safety’s automated license plate reader network to track Tyler Murkerson while his earlier civil-rights suit against the sheriff was pending. The alleged surveillance and retaliatory motive have not been established by a court; the available accounts describe the claims made by Murkerson and his lawyers, not a judicial finding.
What the lawsuit alleges
Hall & Lampros announced on October 9, 2026, that Murkerson had filed a class action against Flock Group, Inc. (doing business as Flock Safety), Coweta County, Sheriff Lenn Wood, and Coweta County sheriff’s deputies. The case is Murkerson v. Flock Group, Inc., et al., No. 3:26-cv-00223-LMM, in the U.S. District Court for the Northern District of Georgia, Newnan Division. The firm describes claims involving civil rights, privacy, and alleged misuse of automated license plate reader (ALPR) data. According to counsel’s description of the complaint, deputies used the Flock network to monitor Murkerson’s vehicle during the period his earlier lawsuit was pending. The complaint allegedly characterizes the monitoring as retaliation for that lawsuit and as unrelated to a specific investigation. Those are plaintiff-side allegations; the available reporting does not establish why any searches occurred or whether they were unlawful.

Counsel says the earlier case concerned an alleged use of force and arrest in a gas-station parking lot over a seatbelt allegation. The firm says the criminal charges were dismissed in June 2023 and the civil-rights case was resolved in 2026. The reported search count and the alleged surveillance period describe different things. A search is an intentional query; counsel separately alleges that Murkerson’s vehicle may have been placed on a hot list so that repeated alerts could be generated. The hot-list claim is expressly made “on information and belief,” not presented as a confirmed audit finding. The available information does not resolve the technical details of how any such alerts operated.

Counsel also says audit entries used the justifications “info” and “37,” and alleges the system accepted free-text reasons rather than requiring a case number or investigation identifier. These descriptions raise a question about what justification controls were in place and how specific they had to be; they do not, by themselves, establish what an officer searched for or why.
Alleged physical surveillance and impact
The law firm’s account says the complaint describes deputies appearing near Murkerson’s home, commute, and business, as well as roadblocks. Counsel further says Murkerson ended a business relationship with a neighboring police department because he felt unsafe. These are allegations about events and their effect on him, not independently verified findings in the available reporting.

What Flock has said about safeguards
In a company post dated August 13, 2026, Flock CEO Garrett Langley announced a set of ALPR data and misuse-control changes. Flock described a recommended default retention period of seven days, an Evidence Mode for retaining data connected to active investigations, required case codes and Audit Assistance/misuse detection for law-enforcement customers by the end of 2026, and a planned automatic lockout when activity meets criteria for abnormal behavior. The company said emergency searches could bypass case-code requirements but would be flagged for administrator review. These are company-announced policies and rollout commitments; the post does not establish which controls were active during the period alleged in Murkerson’s case. Flock’s post also says customers own and control their data and describes company security and access controls. Those statements are the vendor’s representations, not independent verification that misuse was impossible. Langley framed an alert as an investigative lead rather than proof: “An alert is a lead, not a conclusion, which should be confirmed by an officer.” That is the company’s stated view of how its product should be used.

The available accounts support reporting what the complaint is said to allege, but not a conclusion that retaliation occurred.
