There is no universal “GDPR-compliant cloud backup” stamp that makes a service suitable for every organization. A provider’s contract, security documentation and region controls are evidence to assess—not a guarantee that your particular data, configuration and backup practices comply. As the controller, you must choose a processor that offers sufficient guarantees and decide whether the processing and safeguards fit your purposes and risks.
What does GDPR compliance mean for cloud backups?
Cloud backup is part of personal-data processing, not a separate activity outside the GDPR. The controller determines the purposes and means of processing and remains responsible for assessing its use of the service. When a provider processes data on the controller’s behalf, Article 28(1) requires the controller to use only processors offering sufficient guarantees that appropriate technical and organisational measures will be implemented.
That assessment is contextual. Article 32 calls for security measures appropriate to the risk, taking account of factors such as the state of the art, implementation costs, and the nature, scope, context and purposes of the processing. It identifies possible measures including encryption or pseudonymisation, ongoing confidentiality, integrity, availability and resilience, timely restoration after an incident, and regular testing and evaluation.
Recommended Free Tools
A provider’s certification, GDPR statement, data-processing addendum (DPA) or region selector can inform your assessment. None, by itself, establishes that your configuration and processing comply. AWS, for example, says customers remain responsible for personal data they put in its services under its shared-responsibility model. AWS and Google Cloud publish service-specific backup and data-processing documentation; review the current terms for the actual service and contract rather than treating those documents as an endorsement or blanket assurance.

Does GDPR require cloud backups to stay in the EU?
The cited GDPR provisions do not establish a blanket rule that all personal data or backup copies must be stored in the EU. Chapter V sets conditions for transfers to third countries. Storage location is one part of the assessment, but it does not answer where all processing and access take place or which transfer mechanism applies.
Map more than the selected storage region
For each service, identify where primary backup copies and replicas are stored, where metadata is handled, where support personnel may access data, and where service operations or other transfers may occur. Record the relevant countries and the contractual or other transfer basis where required. A region choice is a control to assess, not a substitute for mapping the full data flow.
AWS documentation says customers select regions for customer data and also describes circumstances in which data may be transferred outside a selected region, including service needs, applicable law or other stated exceptions. Google Cloud’s Backup and DR data-processing and security terms discuss customer personal data and adequate-country concepts, but the terms alone do not establish every service’s behavior or guarantee a particular region outcome. Confirm the current documents and service-specific details with the provider.

Account for mixed datasets
Backup sets may combine personal and non-personal data. European Commission Your Europe guidance says mixed datasets generally remain subject to GDPR where the personal and non-personal data are inextricably linked. Do not assume a dataset falls outside GDPR merely because some of its contents are not personal data.
How long can cloud backups keep personal data?
GDPR does not give a universal backup-retention period. Article 5’s storage-limitation principle requires personal data to be kept in identifiable form no longer than necessary for the purposes for which it is processed, subject to the regulation’s stated exceptions. Set retention according to your actual purpose and applicable obligations, and document the reasoning; do not present a chosen number of days or months as “the GDPR period.”
Check how retention works in practice
- Define the purpose of each backup set and the period needed to meet it.
- Check how expiry, lifecycle rules and deletion requests apply to live copies, replicas and older recovery points.
- Ask what happens when a backup is immutable or otherwise cannot be changed immediately, and how the provider’s deletion process handles it.
- Make sure the retention design accounts for relevant legal obligations without keeping identifiable data indefinitely by default.
Retention and recovery needs can pull in different directions: keeping more recovery points may help restore data, while retaining personal data longer must still be justified. Resolve that trade-off in the design rather than assuming that a backup product’s default retention setting is appropriate.

Confirm the contract covers the service you will actually use
Do not rely on a general provider privacy page if your particular backup service, configuration or contract has different terms. Check whether the current DPA applies to the service, which processing instructions it covers, and which subprocessors are involved. Keep the documents and decisions that support your selection so the assessment can be revisited when the service or processing changes.
Assess security as a set of controls
Encryption is useful but is not a complete security assessment. Consider it alongside access restrictions, individual accounts, least privilege, MFA, logging, resilience and the ability to restore data. AWS Backup’s published guidance, for example, recommends controls including protecting account credentials, individual user accounts and least privilege, MFA, TLS and encryption solutions. These are AWS’s product recommendations, not proof that a customer’s implementation is appropriate or complete.

Key control matters to the practical security model. Find out what key-management options the service offers, who can use or administer the keys, and what happens to recovery if keys or credentials are unavailable. Then assess whether the arrangement fits the sensitivity of the data and the organization’s ability to operate it.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone. How should you configure and verify a cloud backup?
Choose settings from the processing purpose and risk assessment, not from a provider’s defaults alone. Keep a record of the decisions and test the recovery path that the organization will depend on.
- Define the data and purpose. Identify the personal data included, why it is backed up, who needs access, and how long identifiable copies are needed.
- Document the processing chain. Identify the controller, provider, subprocessors, applicable DPA and documented instructions. Map copies, replicas, metadata and possible support or service access.
- Assess safeguards and transfers. Review region behavior, transfer terms, encryption, key control, identities, least privilege, MFA and logging against the risks of this processing.
- Set retention and deletion behavior. Configure retention to match the defined purpose and obligations. Understand how expiry and deletion requests affect immutable or older backup copies.
- Test restoration. Exercise recovery procedures to determine whether the organization can restore availability and access in a timely manner, and evaluate the measures regularly.
- Plan for provider exit. Establish how data can be exported or restored elsewhere, in what format, and with what migration steps and costs.
- Reassess when things change. Review the assessment when data types, purposes, service terms, subprocessors, regions or configuration change.
Article 32(1)(c) describes, where appropriate, “the ability to restore the availability and access to personal data in a timely manner in the event of a physical or technical incident.” A provider’s recovery feature does not establish that your organization can meet that outcome: recovery depends on your configuration, procedures and ability to use the restored data. Regular testing and evaluation help establish whether the design works in practice.

How does cloud backup relate to breach response?
A backup can support recovery, but it does not replace incident assessment or notification duties. Under GDPR Article 33, the controller must notify the supervisory authority of a personal data breach without undue delay and, where feasible, within 72 hours of becoming aware of it, unless the breach is unlikely to result in a risk to the rights and freedoms of natural persons. That is a breach-notification deadline where the rule applies—not a required backup-retention period or a recovery-time target.
Include backup restoration and access to relevant records in incident planning, but assess a suspected breach under the applicable rules separately. The existence of a recoverable copy does not, on its own, determine whether notification is required.
What should you know about switching backup providers?
Portability is part of practical due diligence: determine before committing whether you can recover or export data in a usable format and understand the migration process and cost. European Commission Your Europe guidance describes cloud switching and provider duties to provide data in a common machine-readable format. It states that switching and moving data out will be free from January 2027; because that date is future as of October 2026, confirm the rule’s applicability and current status when planning a move.
