Short answer: a union is a worker organization designed to provide collective representation and, when workers organize successfully under the applicable labor law, bargain with an employer over a binding agreement. Employee advocacy group is a broad descriptive term for people who organize around workplace concerns. An advocacy group may educate workers, run campaigns, build solidarity, or support a union drive, but its name alone does not give it bargaining authority or make it the recognized representative of a studio’s employees.
The practical distinction depends on the group’s governing rules, who it represents, whether it is affiliated with a union, whether a labor authority or employer has recognized a bargaining unit, and which country’s law applies. In the game industry, a worker can encounter all of these structures at once.
The core distinction: representation versus advocacy
A union’s defining labor role is collective representation. The Communications Workers of America (CWA) describes a union as “a group of workers who organized together for representation and collective bargaining rights.” When workers successfully organize under the relevant legal process, the employer generally has a duty to bargain with their representative, and an approved collective agreement is binding on the parties. The exact recognition, election, bargaining and enforcement rules vary by jurisdiction.

It might be an informal workplace committee, a nonprofit campaign, a professional network, a cross-company movement, or a project that helps workers organize. It can influence working conditions without being the legal bargaining representative for anyone. Some groups later affiliate with or become part of a union; others remain independent. You must examine the organization’s actual structure rather than infer its powers from its name.

What a game-industry union does
Collective representation
A union speaks for a defined group of workers in dealings with an employer or employers. That group may be a certified or otherwise legally recognized bargaining unit at one studio, a group covered by a craft agreement, or—depending on the organization and local law—members spread across an industry. Representation can include grievances, disciplinary matters, health and safety concerns, pay discussions and enforcement of contract terms.
Collective bargaining
Bargaining is the process of negotiating employment terms as a group. Typical subjects include wages, scheduling, overtime, job security, remote-work rules, severance, credits, intellectual-property practices, harassment procedures and artificial-intelligence use. A negotiated agreement becomes enforceable according to the labor law and contract rules that apply. Union membership by itself does not guarantee that a worker is covered by a particular studio contract; coverage follows the agreement, bargaining-unit definition and applicable law.
Recognition and legal duties
In many systems, workers must demonstrate majority support, win a representation election, obtain voluntary recognition, or complete another statutory process before an employer is required to bargain. Some jurisdictions use different procedures, and some worker organizations operate without a formal certification. Therefore, “union” does not mean every organization has been certified in the same way, nor does it mean every union already has a collective bargaining agreement.

What an employee advocacy group can be
A descriptive label, not a legal status
“Employee advocacy group” describes purpose rather than legal capacity. A group using that label may campaign for pay transparency, oppose excessive crunch, publish workplace resources, provide mutual aid, organize petitions, or support workers facing retaliation. It may include employees from multiple studios, freelancers, students, unemployed workers and allies. Membership may be open to anyone who supports the cause, restricted to workers in a particular occupation, or limited by the group’s own rules.
Activities that do not create bargaining authority
Public statements, a petition, a social-media campaign, a meeting with management or a request for policy changes can produce real pressure without creating a collective bargaining relationship. Unless the group is the recognized representative under the relevant labor framework, management generally is not negotiating a binding contract with it merely because the group organized a campaign. The group may still have rights as individual workers or as an association; those rights must be assessed under local law and the group’s structure.

When advocacy becomes organizing
Advocacy often supplies the relationships and information needed for union organizing. Workers can begin with a committee that maps concerns, talks with colleagues and builds majority support. The committee may then affiliate with an established union or form one. That progression does not retroactively make every earlier advocacy activity a union action, and an independent advocacy group can continue to exist after a union is formed.
Union and advocacy group compared
| Question | Employee advocacy group | Union |
|---|---|---|
| Primary purpose | Education, solidarity, campaigns, mutual aid or organizing support around workplace concerns. | Collective representation and negotiation of employment terms, with enforcement of resulting rights where applicable. |
| Who may participate | Set by the group; it may include workers across studios, occupations, employment statuses or countries, plus allies. | Set by membership rules, occupational jurisdiction and any bargaining-unit or agreement limits. |
| Union affiliation | May be independent, informal, nonprofit or affiliated with a union. | May be an independent union or part of a larger labor federation or union structure. |
| Recognized bargaining unit | Not established by the label. A group may support one without representing it. | May represent a recognized bargaining unit, but recognition and the scope of coverage must be verified for the particular workplace. |
| Contract negotiation | Can ask management to change policy or support workers, but advocacy alone does not create authority to negotiate a binding collective agreement. | Can bargain where it is the authorized representative and the applicable law requires or permits bargaining. |
| Geographic and occupational scope | Whatever the group’s mission sets; often cross-company or cross-border. | Defined by the union’s rules, local law, occupational jurisdiction and specific agreements. |
| Legal framework | General association, employment, nonprofit, whistleblower, anti-retaliation and other laws may apply. | Labor-relations statutes, recognition procedures, collective agreements and contract-enforcement rules may apply. |
The categories can overlap. A union can run public advocacy campaigns, while an advocacy group can help workers form a union. The table describes the usual function of each form, not a universal legal test.
Game-industry examples and what they show
United Videogame Workers-CWA (UVW-CWA)
On March 20, 2025, CWA announced United Videogame Workers-CWA Local 9433 in partnership with the American Federation of Musicians. CWA describes it as a direct-join, industry-wide union for game workers in the United States and Canada. Its announced scope includes freelancers, indie developers, unemployed workers and people already organizing their workplaces, as well as workers employed at studios.
“Direct-join” is important: it describes an industry-wide membership route, not proof that every member belongs to a certified bargaining unit at a specific studio. A worker may join the organization and participate in industry organizing while still needing a separate workplace recognition process before a studio must bargain with a representative. CWA says the model is intended to let workers build power across the industry and address concerns that extend beyond one employer.
The mission statement quoted in CWA’s announcement says, “We are the ones that make the games, so we must be the ones that set the terms of how we work.” That is an organizing objective; it should not be read as a statement that all members already have identical contract rights.

CODE-CWA
CODE-CWA describes itself as a union movement of workers in technology, games and digital industries in the United States and Canada. It says workers organize across large and small companies, game studios, publishers, nonprofits and other workplaces, and campaign on working conditions and ethical use of labor. A movement can contain workplace campaigns at different stages: some may have recognized bargaining units and contracts, while others may still be building support. Check the status of the particular workplace rather than treating the movement’s broad mission as one contract.

CWA’s 2025 UVW-CWA announcement identifies Game Workers Unite as part of the grassroots mobilization that helped lead to UVW-CWA. This is an example of an advocacy or grassroots organization contributing to union development. It does not make every Game Workers Unite chapter, campaign or member the same legal entity as UVW-CWA, and it does not establish bargaining authority at a particular studio.
SAG-AFTRA and performance work
SAG-AFTRA’s August 13, 2024 guidance concerns members performing video-game work and the union agreements that cover those performers. It says Global Rule One requires members to work under a union contract, while specified interim or tiered-budget agreements can permit work under stated conditions. This is an occupationally distinct model from an all-industry organization open to a broad range of game workers. A performer agreement should not be assumed to cover programmers, artists, quality-assurance staff, writers or other roles, and a game-worker union should not be assumed to provide SAG-AFTRA performer protections.
Does a game studio union represent every game worker?
No. Representation follows the organization’s membership rules, occupational scope, geography and any bargaining-unit definition. UVW-CWA’s announced North American scope is unusually broad and expressly includes freelancers, indie developers, unemployed workers and people organizing a workplace, but that breadth does not place every game worker under one studio contract.

- Is the worker eligible to join the organization under its current rules?
- Has a bargaining unit been defined, recognized or certified at that employer?
- Does an existing collective agreement cover the worker’s job classification and location?
- Is the worker an employee, contractor, freelancer or performer subject to a different legal or contractual system?
Two people on the same game may therefore have different representation: a performer under a performer agreement, an employee in a recognized studio unit, a freelancer who belongs to an industry-wide union, and an unaffiliated worker supported by an advocacy campaign.
Can an employee advocacy group negotiate with management?
It can meet with management, present demands, request policy changes or negotiate a voluntary memorandum if management agrees. Those activities are not automatically collective bargaining in the legal sense. A binding collective agreement normally requires an authorized representative, a defined group and compliance with the labor process that applies in the jurisdiction.
Before assuming that a meeting creates union rights, look for the organization’s written authority, the employer’s recognition statement, the bargaining-unit description and the signed agreement. If those documents are absent, describe the activity as advocacy, consultation or a campaign—not as a ratified collective bargaining agreement.
How to identify what a named group can actually do
Use the following checklist before describing a group in a workplace article, internal memo or announcement.
- Read the governing documents. Look for bylaws, constitution, membership rules and a stated mission. Note whether the group calls itself a union, association, committee, network or campaign.
- Check membership eligibility. Record the occupations, employment statuses, countries and employers that can join. Distinguish members from supporters or petition signers.
- Verify affiliation. Determine whether the group is chartered by, partnered with or independent of a larger union. An affiliation can provide organizing resources without making every activity a certified bargaining relationship.
- Find the workplace status. For a specific studio, look for a recognition agreement, election result, certification, bargaining-unit description or other official labor record.
- Read the contract scope. If an agreement exists, check covered classifications, locations, employers, effective dates, exclusions and grievance procedures.
- Separate campaign claims from legal facts. A group’s statement about “building power” or “representing workers” may describe its mission. Confirm legal status through the applicable labor authority, agreement or employer recognition.
- Confirm the date. Membership terms, organizing totals, agreements and strike status can change. CWA’s UVW-CWA announcement is dated March 20, 2025, and SAG-AFTRA’s cited guidance is dated August 13, 2024; verify current details before relying on them.
Why jurisdiction and worker status matter
Labor law is not uniform across North America, and the examples above are primarily United States and Canada focused. Rules can differ on who is an employee, how a union is recognized, whether freelancers can bargain collectively, what subjects are mandatory, and how agreements are enforced. A process described by CWA may not apply unchanged in another country, state or province.

Worker status adds another layer. Employees may fall within a statutory bargaining system; independent contractors and freelancers may face different competition, employment and collective-action rules; performers may be governed by a craft union agreement; and unemployed or prospective workers may participate in an industry organization without having a current employer to bargain with. Do not infer legal rights from membership category alone.
What this means for workers
If you want help with a workplace problem
An advocacy group may be the fastest place to find education, peer support or contacts at other studios. A union may offer formal organizing assistance, representation and a route toward a collective agreement. Ask what confidentiality protections exist, whether the group has a retaliation-response process, and whether it can represent your specific occupation and location.
If you want a contract at your studio
Membership in an industry-wide organization can help build a committee and connect you with organizers, but a studio contract normally requires a workplace-specific organizing and recognition process. Clarify who will be in the proposed unit, how support is counted, what recognition route is available and what happens during bargaining.
If you are a freelancer or indie developer
Check whether the organization expressly admits your status and what benefits membership provides. An industry-wide union may give you collective voice and organizing resources without creating an employment relationship with a studio. Contract, tax, intellectual-property and payment questions remain governed by the agreements and laws that apply to your work.
What this means for studios and managers
Do not dismiss a group as “just advocacy” because it lacks the word union in its name, and do not treat every campaign as a certified bargaining unit. Identify the group’s stated purpose, the workers involved and any formal recognition. Management should obtain jurisdiction-specific labor advice before responding to organizing activity, changing policies, communicating with workers or negotiating with a representative.
Similarly, a union label does not answer every operational question. Determine whether the organization is seeking recognition, already represents a unit, or is offering industry-wide membership outside a studio bargaining relationship. The answer affects who must be consulted, what information can be requested and which agreement controls.
Understanding organizing scale without overstating it
CWA reported that CODE-CWA had helped more than 6,500 technology and video-game workers organize to join the union since 2020. That is CWA’s own reported total for the period; it is not presented as an independently audited count. It indicates organizing activity at scale, but it does not show that all of those workers share one employer, one bargaining unit or one collective agreement.

A practical decision guide
- You need education, solidarity or a public campaign: an advocacy group may be the appropriate starting point.
- You want formal representation in discipline or grievances: look for a union and verify that your workplace and role are covered.
- You want to organize colleagues at one studio: contact organizers, define the proposed unit and learn the recognition process for your jurisdiction.
- You work across studios or as a freelancer: examine an industry-wide union’s membership rules, services and limits; do not assume a studio contract follows automatically.
- You perform game characters or voice work: check performer-specific union agreements rather than relying on a general game-worker label.
Bottom line for the game industry
A union and an employee advocacy group are not interchangeable labels. The union question is: who is authorized to represent which workers, under what legal process, and for what agreement? The advocacy question is: what concerns does this group organize around, and what support or pressure can it provide? In practice, advocacy can be the path to union organizing, a union can conduct advocacy, and a worker can participate in both. Verify the organization’s documents, affiliation, bargaining-unit status, contract scope and jurisdiction before promising rights or describing a group as a studio’s representative.
