Short answer: selling misbranded food can attract a penalty of up to ₹3 lakh under section 52 of the Food Safety and Standards Act, 2006. A misleading advertisement or label is listed separately under section 53, with a penalty of up to ₹10 lakh. Food that is not of the nature, substance or quality demanded can attract up to ₹5 lakh, although the FSSAI manual notes a ₹25,000 ceiling for a petty food business operator under section 50.
Those figures are statutory maxima or stated limits, not automatic bills. The applicable section, the person’s role, the evidence, the enforcement route and any harm caused determine the outcome. Unsafe food can also lead to imprisonment, with the consequences increasing sharply when injury or death results.
The penalty map at a glance
The Food Safety and Standards Act, 2006 consolidates India’s food-safety rules and regulates the manufacture, storage, distribution, sale and import of food. FSSAI’s enforcement material groups common contraventions by the conduct involved and by the people who can be held responsible.

The table uses “up to” because the law sets an upper limit. It does not mean that every case receives that amount, and it does not determine which section an officer or court will apply.

What each food offence means in practical terms
Section 50: food not of the nature, substance or quality demanded
This provision addresses food that does not match what a purchaser reasonably demanded or what the product was represented to be in its basic nature, substance or quality. The maximum listed penalty is ₹5 lakh. FSSAI’s enforcement manual notes that, for a petty food business operator, the section 50 penalty must not exceed ₹25,000.
The petty-FBO ceiling is a limit for that category under this section; it is not a general ₹25,000 cap for every food-law violation or every small seller. The facts, the operator’s legal classification and the section selected still matter.
Section 51: sub-standard food
Sub-standard food is listed separately from food that fails to meet the demanded nature, substance or quality. Section 51 can apply to a manufacturer, seller, distributor, storage operator or importer, with a penalty of up to ₹5 lakh.

Section 52: misbranded food
Section 52 lists a penalty of up to ₹3 lakh for misbranded food. FSSAI’s listed liable categories include the manufacturer, seller, distributor, storage operator and importer.
Misbranding concerns how the product is identified or presented as food. Examples might include a package whose required information is inaccurate, incomplete or presented in a way that gives a false impression. Whether a particular package is misbranded depends on the applicable labelling requirements and the evidence collected in that case; a retailer should not assume that changing a sticker after inspection erases the original allegation.
Section 53: misleading advertisement or label
FSSAI’s penalty table separately lists a misleading advertisement or label under section 53, with a maximum penalty of ₹10 lakh. The listed liable person is the person who publishes or participates in publishing the communication.
This provision focuses on the misleading communication itself, including claims made to persuade a buyer. It can therefore involve an advertiser, a brand owner, an agency or another participant in publication, rather than only the person who physically sold the packet. A misbranded-food allegation under section 52 and a misleading advertisement or label allegation under section 53 are distinct legal questions. The same conduct may raise more than one issue after the facts and applicable provisions are assessed, but penalties do not automatically stack merely because two descriptions appear possible.

Section 54: extraneous matter
Section 54 carries a penalty of up to ₹1 lakh for food containing extraneous matter. The amount is a statutory maximum. The nature of the material, how it entered the food and the evidence connecting each business to the product can affect the proceeding.
Section 55: ignoring a Food Safety Officer’s direction
Failure to comply with a Food Safety Officer’s direction can attract a penalty of up to ₹2 lakh under section 55. This is separate from the underlying food-quality allegation. A business that disagrees with a direction should use the available legal response rather than simply ignore it; non-compliance can create an additional contravention.
Section 56: unhygienic or unsanitary processing or manufacture
Unhygienic or unsanitary processing or manufacture is listed under section 56, with a penalty of up to ₹1 lakh. The provision concerns the conditions or methods of processing and manufacture, not just the appearance of a finished label. Cleaning records, pest-control measures, personnel practices and the condition of equipment may become relevant evidence, although the final finding depends on the inspection and applicable requirements.

Section 57: possessing an adulterant
Section 57 distinguishes between adulterants that are not injurious to health and those that are injurious. The maximum is up to ₹2 lakh in the first category and up to ₹10 lakh in the second. Possession itself is the listed conduct; a business does not have to wait until the adulterant is sold before the issue can arise.

When unsafe food can mean prison as well as a fine
FSSAI’s enforcement manual separates monetary-only provisions, including sections 50–58, 61 and 63, from provisions that can combine a fine with imprisonment. Section 59 is the central unsafe-food provision in the supplied penalty summary, and the consequence escalates according to the harm caused.
| Result of the unsafe food | Imprisonment stated in the FSSAI summary | Fine stated in the summary |
|---|---|---|
| No injury | Up to six months | ₹1 lakh |
| Non-grievous injury | Up to one year | ₹3 lakh |
| Grievous injury | Up to six years | ₹5 lakh |
| Death | Not less than seven years | Not less than ₹10 lakh |
The first three rows describe maximum imprisonment periods in the summary, while the death category states minimum terms and a minimum fine. These are not administrative fixed charges. A prosecution, the evidence of causation and the level of harm all matter. The death provision is especially important because “not less than” sets a floor rather than a ceiling in the wording summarized by FSSAI.
Why the maximum fine is not an automatic fine
The figures in the penalty table answer “what is the highest stated monetary penalty for this offence?” They do not answer “what will every seller pay?” A decision-maker must first identify the applicable offence and then consider the person’s role, the product, the evidence and any resulting harm.
Different people can be connected to the same food in different ways. The manufacturer, seller, distributor, storage operator and importer are expressly listed for several provisions, while section 53 focuses on a person who publishes or participates in publishing a misleading communication. A retailer may therefore face a different allegation from the manufacturer, and an advertiser may face a different one from both.

The route also matters. Monetary provisions can proceed through adjudication, while offences that allow imprisonment can involve prosecution. The existence of a notice, an inspection finding or a laboratory result does not by itself establish the final penalty. A business should read the exact section cited and the role attributed to it before deciding how to respond.

These terms are close in ordinary speech but appear as separate entries in FSSAI’s penalty map.
- Misbranded food (section 52): asks whether the food, as offered and identified, meets the applicable branding and presentation requirements. The listed maximum is ₹3 lakh.
- Misleading advertisement or label (section 53): asks whether a published claim or label communication misleads consumers. The listed maximum is ₹10 lakh, directed at the person who publishes or participates in publishing it.
Consider two hypothetical cases. A packet carries an inaccurate mandatory declaration but no promotional health claim; the facts may be examined as a misbranding issue. A social-media campaign promises a result the product cannot support; the publication may raise the section 53 issue. If the packet and the campaign contain different problems, authorities may examine both, but there is no automatic rule that the two maximums are simply added together.
What to do if an officer raises a food-safety violation
These steps do not replace legal advice, but they help preserve options and reduce the chance of creating a second problem.
- Identify the exact allegation. Record the section number, product, batch or lot, premises and the conduct described. “Unsafe,” “misbranded” and “sub-standard” are not interchangeable labels.
- Pause distribution of the affected stock. Segregate the identified batch and prevent further sale while the notice or direction is being reviewed. Do not relabel, destroy or move stock in a way that could compromise traceability.
- Preserve records. Keep purchase invoices, supplier details, batch records, test reports, photographs, label artwork, advertisements and communications showing who approved or published each claim.
- Follow a written direction carefully. Section 55 creates a separate risk for failing to comply with a Food Safety Officer’s direction. If a direction appears unclear or impossible to meet, seek clarification or the appropriate legal remedy rather than ignoring it.
- Map responsibility. Separate what the business manufactured, stored, distributed, sold or published. This matters because the Act lists different liable roles for different provisions.
- Respond through the stated process. Meet the response date in the notice and attach relevant evidence. A response should address the cited section and facts instead of making a broad admission that could cover unrelated conduct.
- Get qualified advice where harm or prosecution is possible. If anyone was injured, if an adulterant is alleged to be injurious, or if section 59 is cited, obtain advice from a lawyer familiar with Indian food-safety proceedings promptly.
Preventive checks for sellers and food businesses
- Verify that every product’s label matches the formulation, batch records and applicable labelling requirements.
- Keep the final approved label and every advertisement version, including digital creatives, so the publisher and approval chain can be identified.
- Use supplier documentation and receiving checks to detect sub-standard ingredients or adulterants before storage or sale.
- Maintain sanitation, cleaning, pest-control and processing records that show routine controls rather than relying on a one-time cleanup.
- Keep batches traceable through storage, distribution and returns so an affected lot can be isolated quickly.
- Train staff not to make health, nutrition or performance claims that the product and its evidence cannot support.
- Review directions from Food Safety Officers centrally, assign an owner and document completion.
Which legal text should control your decision?
Use the Food Safety and Standards Act, 2006 and the current regulations and notifications that apply to the product and conduct. FSSAI says its regulations compendia are provided for ready reference and are not legal documents. Where a compendium conflicts with or overlaps an original notification or amendment, the original notification or amendment prevails.
That qualification matters because labelling and product standards can change. Before relying on a fine table or a compliance checklist, verify the current statutory text, the applicable notification and the enforcement contact for the relevant state or authority. A general web summary cannot determine whether a particular label, product or injury meets an offence definition.
Bottom line for a seller
A misbranding allegation under section 52 carries a listed maximum of ₹3 lakh; a misleading advertisement or label under section 53 carries up to ₹10 lakh; and food that is not of the demanded nature, substance or quality can carry up to ₹5 lakh, subject to the ₹25,000 petty-FBO ceiling noted for section 50. Unsafe food is the higher-risk category because section 59 can bring imprisonment and substantially greater consequences when injury or death results. Treat every figure as a limit, identify the exact offence and role, preserve evidence, comply with directions and respond through the proper adjudication or prosecution process.
