FOIA is usually the law to use for federal agency records, including information about government activity or another person. Generally, any person may submit a Freedom of Information Act request. The Privacy Act is narrower: it generally lets a U.S. citizen or lawful permanent resident obtain their own records from a covered agency system of records, subject to identity checks, exemptions, and agency rules.

If you are requesting records about yourself, ask the agency to process the request under both FOIA and the Privacy Act when applicable. The correct route depends on who the records concern, whether the agency keeps them in a Privacy Act system of records, and the agency’s published procedures.

FOIA and the Privacy Act at a glance

The two laws overlap, but they answer different questions. FOIA is primarily a public-access law for federal agency records. The Privacy Act regulates federal agencies’ handling of records about individuals and gives eligible people a right to inspect records about themselves when those records are maintained in a covered system of records.

Question FOIA Privacy Act
Who may request? Generally any person, including organizations and people who are not U.S. citizens or residents. Generally a U.S. citizen or lawful permanent resident requesting their own record.
What is covered? Federal agency records, subject to statutory exemptions and exclusions. The requester’s record in a covered system of records, subject to limitations and exemptions.
Records about another person? You may ask under FOIA, but privacy and other exemptions may protect the information. The requester has no access right under the Act to another person’s record.
Records about yourself? Available as a FOIA request, including records outside a Privacy Act system of records. Potentially available when the record is in a covered system and you satisfy identity and agency requirements.
How do the laws interact? For a first-party request, the agency may have to analyze both FOIA and Privacy Act rules. For a first-party record, withholding generally requires an applicable exemption under both laws.

These distinctions come from the U.S. Department of Justice’s guidance on the interface between FOIA and the Privacy Act, its Privacy Act access overview, and its FOIA overview.

What FOIA lets you request

FOIA provides a general route to ask a federal agency for agency records. The subject can be an agency’s policy, operations, decisions, contracts, communications, investigations, or other information held by that agency. The request is not limited to records about the requester. A person, company, organization, or non-U.S. person can generally submit one.

The law is about access to existing agency records, not a requirement that employees create a new report, answer questions, or conduct research for the requester. A useful request identifies the records sought clearly enough for the agency to search for them. The agency then applies FOIA’s exemptions and exclusions to the records it locates. A request for another person’s sensitive information can therefore be validly submitted but still produce a denial or redacted response because privacy interests are protected.

FOIA can also reach records about you that are not maintained in a Privacy Act system of records. That makes it the broader option when you do not know how an agency stores the material or when the records concern agency activity rather than an individual file.

What the Privacy Act lets you request

The Privacy Act’s individual access right is narrower. It generally applies when a U.S. citizen or lawful permanent resident seeks access to their own record in an agency system of records. The agency’s system must be one covered by the Act, and the agency’s regulations determine how an individual verifies identity and submits the request.

A system of records is important because the Privacy Act does not cover every document that happens to mention a person. The access right concerns a record maintained in a designated system and generally retrieved by the individual’s name or another identifying particular. Agencies publish system notices and rules describing those systems and their access procedures.

Some systems or records may be exempt under agency regulations. Even when a record is in a covered system, the agency must review applicable exemptions and any information about other people that appears in the file. The Privacy Act is therefore a targeted first-party access mechanism, not a universal right to every document containing your name.

Choose the law by what you are trying to learn

You want information about federal policy or agency action

Start with FOIA. Requests about how an agency made a decision, administered a program, spent funds, communicated internally, or carried out its mission fit FOIA’s public-access purpose. The Department of Justice describes that purpose in its FOIA overview.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

You want your own file

Check whether the agency maintains the file in a Privacy Act system of records. Follow the agency’s identity-certification instructions and consider expressly invoking both statutes. The combined approach allows the agency to treat a covered first-party record under the Privacy Act while also considering FOIA for records or portions outside that system.

You want records about another person

Use FOIA, not the Privacy Act. The Privacy Act does not give you an access right to another individual’s record. FOIA still permits the request, but the agency must weigh privacy protections and other exemptions. The result may be a partial release, redactions, or withholding. The DOJ explains third-party disclosures and privacy limits in its Privacy Act third-party disclosure overview.

You are unsure where the record is maintained

Identify the federal agency most likely to hold the material and read its FOIA procedures, Privacy Act regulations, and system-of-record notices. Describe the subject, people or offices involved, and relevant time period. A FOIA request can cover records beyond a Privacy Act system, so uncertainty about the storage system does not prevent you from making a well-scoped request.

How the laws overlap for your own records

For a first-party request, an agency may need to analyze the same record under both statutes. DOJ guidance says that an individual’s Privacy Act record can be withheld from that individual only when an exemption under both the Privacy Act and FOIA applies. The agency’s regulations and the specific record still control the analysis.

This statement appears in the U.S. Department of Justice Office of Information Policy’s guidance, issued September 15, 2022, titled The Interface Between the FOIA and Privacy Act. It does not mean every first-party request will be granted. It means that a withholding must be supported under both legal regimes when the record is the requester’s Privacy Act record.

A first-party file can also contain information about witnesses, family members, complainants, employees, or other third parties. DOJ notes that courts have differed on some questions involving third-party information embedded in a requester’s record. Agencies should evaluate those privacy interests separately rather than treating the entire file as automatically releasable.

Step-by-step: submit a FOIA request

  1. Identify the agency that holds the records. FOIA applies to federal agencies, but each agency publishes its own submission instructions. Start with the agency’s FOIA page and confirm the correct component or office.
  2. Define the records, not just the question. State the subject, names or offices involved, date range, event, program, and record types you seek. Explain distinctive terms or case numbers that will help a search. Avoid asking the agency to “tell you why” something happened without identifying records that would show the answer.
  3. Follow the agency’s published delivery method. Use the online portal, email address, mail address, or other method specified in the agency’s current FOIA procedures. DOJ’s guidance for agency FOIA regulations explains why requesters should follow agency-specific rules.
  4. State the scope and preferred form clearly. Separate essential records from optional categories so the agency can understand priorities. If you are seeking electronic records, say so, but do not assume a particular format is available.
  5. Keep the submission and correspondence. Save the request, attachments, confirmation, and any clarification messages. If the agency says the request is too broad or unclear, respond by narrowing the description rather than sending an unrelated new request.
  6. Evaluate the response record by record. An agency may release records in full, redact portions, or withhold records under FOIA exemptions. A request about another person’s personal information is especially likely to raise privacy protections.

Step-by-step: submit a Privacy Act access request

  1. Confirm that you are seeking your own records. The general access right is for a U.S. citizen or lawful permanent resident seeking a record about themselves. Requests for someone else’s record do not become Privacy Act access requests merely because you have a personal reason for asking.
  2. Find the relevant system of records. Review the agency’s Privacy Act system notices and access regulations. Look for the system that covers the program, case, personnel file, benefit, investigation, or other activity connected with your record.
  3. Follow identity-certification requirements exactly. Agencies may require a signed statement, a specific certification, notarization, or another method. Use the procedure published by the agency rather than assuming that a name and mailing address are sufficient. DOJ’s Privacy Act regulations page points to agency rules.
  4. Describe the records and the likely system. Include your full name, identifying details requested by the agency, the subject or case, offices involved, and the date range. If you know the system name, include it; if not, explain the activity that generated the records.
  5. Invoke both laws when appropriate. Say that you are requesting access under the Privacy Act and FOIA. This is especially useful when some responsive material may be in a Privacy Act system and other material may be outside it.
  6. Flag third-party information. Ask the agency to release segregable portions while recognizing that information identifying other people may be protected. This makes clear that you are seeking your records without assuming every line can be disclosed.

Suggested wording for a combined request

The following language is a starting point, not a substitute for the agency’s required form or identity certification:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
I request access under the Freedom of Information Act and, where applicable, the Privacy Act to records about me concerning [program, case, or activity] for [date range]. Please search the systems of records and other agency files reasonably likely to contain these records. I will provide the identity certification required by your regulations. If any portion is exempt, please release all reasonably segregable nonexempt material and identify the legal basis for each withholding.

Replace the bracketed descriptions with concrete facts. Do not include a template placeholder in the submitted request; provide the actual program, dates, and identifying information the agency needs.

Common mistakes and how to correct them

  • Choosing the Privacy Act for a public-interest question. The Privacy Act is aimed at an eligible person’s own record. Reframe a request about agency conduct, policy, or another person as FOIA.
  • Assuming FOIA guarantees another person’s file. FOIA is the access route, but privacy exemptions may prevent release. Ask for records the agency can lawfully disclose and accept that sensitive portions may be redacted.
  • Assuming every record mentioning you is a Privacy Act record. Check the system-of-record requirement. If the material is outside a covered system, FOIA may still be available.
  • Sending the request to the wrong agency or component. Read the agency’s published procedures and identify the office that maintains the activity or program. The relevant agency and record location determine whether a search can occur.
  • Leaving the description too general. “Everything about me” or “all communications” may not tell the agency what to search. Add dates, offices, subjects, case numbers, and distinctive terms.
  • Omitting identity certification. A first-party Privacy Act request can be delayed or rejected if it does not meet the agency’s identity rules. Use the exact certification procedure the agency publishes.
  • Ignoring mixed records. Your file may include information about other people. Request segregable portions and do not assume that a first-party request overrides every third party’s privacy interest.
  • Treating agency procedures as identical. Submission channels, regulations, system notices, and identity requirements differ by agency and can change. Check the current instructions before sending the request.

Examples: which route fits?

Your objective Best starting point What can limit access
Learn how a federal agency developed a policy FOIA FOIA exemptions, exclusions, or the agency not possessing the requested records.
Obtain your own file held in a named Privacy Act system Privacy Act plus FOIA Identity rules, system-specific exemptions, and any exemption that applies under both statutes.
Obtain your own emails or records that may not be in a Privacy Act system FOIA, with a Privacy Act request where applicable FOIA exemptions and uncertainty about which agency component holds the material.
Obtain a former colleague’s sensitive personnel information FOIA Personal-privacy exemptions and other restrictions may require redaction or withholding.
Ask an agency to explain a decision without identifying records Revise as a records request under FOIA FOIA does not require an agency to create an explanation or new record.

Agency rules, dates, and uncertainty matter

There is no single submission process that works for every federal agency. DOJ directs requesters to agency FOIA procedures and Privacy Act regulations, and those documents identify where and how requests must be sent. Use the current instructions for the agency that actually maintains the records.

The general comparison cannot predict whether a particular request will succeed. The outcome depends on the agency, the record system, the facts in the file, applicable exemptions, and whether other people’s information is intertwined with yours. A carefully targeted request improves the agency’s ability to search and make a record-by-record decision, but it does not eliminate statutory withholding grounds.

A practical decision checklist

  • Is the subject federal agency activity, policy, operations, or another person? Begin with FOIA.
  • Is the request for your own records, and are you generally eligible as a U.S. citizen or lawful permanent resident? Check the Privacy Act.
  • Does the agency maintain the material in a covered system of records? If yes, follow that system’s access and identity rules.
  • Could responsive records exist outside that system? Include FOIA so the search is not limited to Privacy Act records.
  • Are other people’s personal details likely to appear? Expect a separate privacy analysis and possible redactions.
  • Have you checked the agency’s current FOIA procedures, Privacy Act regulations, and submission address?
  • Have you described the records with enough detail for the agency to search without guessing?

The shortest answer to “which law lets you request federal records?” is: FOIA for federal agency records generally; the Privacy Act for an eligible person’s own records in a covered system; and both when your first-party request may involve both categories. The agency that holds the records and its published rules determine the practical next step.
