There is no single oil-and-gas regulator. The right office depends on three facts: where the activity occurs, what the activity is, and whether a pipeline or sale crosses a state line. Federal agencies handle federal minerals, offshore leasing, interstate transportation, pipeline safety and national environmental rules; state commissions and environmental agencies handle most production, intrastate facilities and retail utility matters.
A project can need several approvals at once. For example, an interstate gas pipeline may involve FERC for its certificate and rates, PHMSA for safety, EPA and a state environmental agency for environmental permits, and BLM if it crosses federal land.
The fastest way to identify the right agency
Start by answering the three questions below. Do not start with the agency name; start with the jurisdictional facts.

Identify federal onshore minerals, state or private minerals, tribal lands, or federal offshore acreage. Land ownership and mineral ownership are not always the same, so verify both.
- What is happening? Leasing, drilling, production, gathering, interstate transportation, storage, retail sale, emissions control, wastewater management and spill response are regulated in different lanes.
- Does anything cross a state line? Interstate transportation and interstate sales can shift economic jurisdiction to the Federal Energy Regulatory Commission (FERC). A facility that stays within one state is generally handled under that state’s framework, although federal safety and environmental laws may still apply.

Federal and state authority can overlap
Federal versus state regulation is not an either-or choice. A federal lease does not erase generally applicable state requirements for air, water, roads or emergency response. Conversely, a state permit does not replace a federal approval required by federal land, offshore, interstate-commerce, pipeline-safety or environmental law.
Think of each agency as occupying a lane. One agency may control the right to use minerals, another may issue an air permit, a third may authorize an interstate route, and a fourth may inspect the pipe for safety. The operator is responsible for satisfying all applicable lanes before construction or operation.
What each federal agency regulates
BLM: onshore federal minerals
The Bureau of Land Management manages the federal government’s onshore oil-and-gas program. Its responsibilities include leasing, exploration, operations and production, inspection and enforcement, and reclamation. The principal legal foundations identified for this program are the Mineral Leasing Act of 1920, the Mineral Leasing for Acquired Lands Act of 1947, and related federal statutes and regulations.
Do these 3 things before closing this tab:
1Repair Windows errors before they cause bigger problems2Scan for outdated or missing drivers - takes under a minute3Clear out junk files and repair common Windows errorsBLM’s own program description says it manages the federal onshore oil-and-gas program to facilitate safe and responsible development while providing a fair return for taxpayers. That authority follows the federal minerals, not simply the surface address. A well on privately owned surface can still require BLM involvement if the minerals are federally owned, and a federal lease can still require state environmental or operational permits.
BLM manages about 700 million acres, according to its current program overview. Federal minerals are important but do not represent the entire domestic market: BLM reports that federal production accounted for approximately 15% of domestically produced oil and 9% of domestically produced natural gas in fiscal year 2024. Those percentages are national FY2024 figures, not a prediction for a particular state or lease.
BOEM: leasing federal offshore acreage
The Bureau of Ocean Energy Management is the federal bureau identified for leases to explore federal offshore lands. If the question is whether a company can obtain an offshore federal tract for exploration, BOEM is the starting point. Leasing authority is distinct from day-to-day platform safety and environmental enforcement.

BSEE: offshore safety and environmental enforcement
The Bureau of Safety and Environmental Enforcement oversees offshore safety and environmental enforcement. BSEE’s role is therefore different from BOEM’s leasing role. An offshore project may deal with BOEM for the lease and BSEE for operational safety, inspections and environmental enforcement.
EPA: environmental rules, permits and enforcement
The Environmental Protection Agency provides the federal legal and regulatory framework for oil-and-gas extraction and refining, along with enforcement information and sector resources. Its subject areas include air emissions, wastewater, hazardous waste and cleanup.
EPA does not replace every state environmental office. Many federal environmental programs operate through state implementation plans, delegated permits or state enforcement partnerships. The correct first call may therefore be the state environmental agency, EPA, or both. Ask which program applies, who issues the permit in that state, and whether the site is on federal, state, private or tribal land.
FERC: interstate transportation, rates and siting
FERC is an independent agency that, in its official description, “regulates the interstate transmission of electricity, natural gas, and oil.” For this topic, its principal responsibilities are:
- Interstate transmission of natural gas.
- Natural-gas resale in interstate commerce.
- Interstate oil-pipeline transportation.
- Siting and abandonment of interstate natural-gas pipelines.
- Siting and abandonment of interstate natural-gas storage facilities.
- Review of liquefied natural gas terminal proposals and related environmental matters within FERC’s jurisdiction.
FERC’s economic authority is not the same as pipeline-safety authority. FERC can decide whether an interstate natural-gas pipeline receives the required federal authorization and can regulate covered rates, while PHMSA handles federal pipeline-safety rules. Environmental reviews and permits can involve EPA, state agencies and land-management agencies as well.
PHMSA: pipeline safety
The Pipeline and Hazardous Materials Safety Administration is the federal pipeline-safety agency in the multi-agency structure described by EPA. PHMSA’s lane covers safety oversight for gas and hazardous-liquid pipelines. State pipeline-safety partners may inspect or enforce requirements under agreements and state authority.

Do not send a safety complaint to FERC merely because a line is interstate. FERC’s economic and siting jurisdiction and PHMSA’s integrity and hazardous-materials safety jurisdiction are separate questions. A single incident can require contact with both, plus emergency responders and environmental agencies.
What state and local agencies usually handle
State oil-and-gas commissions and conservation departments
Most states assign well permitting, spacing, pooling, drilling rules, production reporting and field inspections to an oil-and-gas commission, conservation department or similarly named office. These agencies generally regulate production on state and private lands under state law. The name, powers and boundaries differ by state, so there is no universal “state oil-and-gas agency.”
For an intrastate well question, identify the state first, then locate the office responsible for permits and conservation rules in that state. A state production permit does not automatically cover air, water, waste, endangered-species, federal-land or pipeline requirements.
State environmental agencies
State environmental departments commonly issue or administer permits for air emissions, water discharges, wastewater, solid or hazardous waste, and spill response. Some programs are federally authorized and implemented by the state; others remain under direct federal administration. The agency that issues an air permit may therefore differ from the agency that regulates a well’s spacing or a pipeline’s safety.
State public utility commissions
State public utility commissions generally regulate retail natural-gas service and intrastate utility matters. FERC states that retail natural-gas rates are usually set by state commissions. If the problem is a household gas bill, a local distribution company’s service, or a proposed retail utility rate, the state commission is normally the correct first forum rather than FERC.
Local and other authorities
Local requirements can remain relevant even when a project is federally authorized. Roads, emergency coordination, land-use matters and locally administered permits may involve county, municipal or other authorities, subject to state-law limits. On tribal lands, tribal jurisdiction and federal requirements must be evaluated separately. The exact local role depends on the state, the facility and the governing land status.

How to route common oil-and-gas questions
“I want to lease or drill on federal onshore minerals.”
- Confirm that the minerals, not only the surface, are federally owned.
- Start with BLM for the federal lease and onshore operations program.
- Identify the state oil-and-gas and state environmental agencies whose permits still apply.
- Check whether the project needs separate approvals for access roads, water, emissions, waste, reclamation or a pipeline connection.
“I want to lease an offshore federal tract.”
- Start with BOEM for the federal offshore lease.
- Plan for BSEE involvement in offshore safety and environmental enforcement once operations begin.
- Identify additional environmental reviews and permits for the proposed activity.
“I need a permit for a well on state or private land.”
- Contact the state’s oil-and-gas commission or conservation department for the well, spacing, pooling and production rules.
- Contact the state’s environmental agency for air, water, waste and spill requirements.
- Determine whether federal minerals, federal funding, interstate commerce or another federal trigger adds a federal approval.
“Who approves an interstate natural-gas pipeline?”
- Start with FERC for the interstate certificate, route, rates and related abandonment or storage matters within its jurisdiction.
- Identify PHMSA and any state pipeline-safety partner for design, operation and integrity requirements.
- Map environmental permits and reviews involving EPA, state environmental agencies and, where applicable, BLM or other federal land managers.
- Check every affected landowner, state and local process; a FERC authorization does not make all other permits unnecessary.
“What about a pipeline that never leaves one state?”
A wholly intrastate pipeline is generally subject to state regulation for its transportation and utility functions. That does not remove federal pipeline-safety or environmental requirements. The commodity, facility type and connection to interstate commerce can change the analysis, so confirm the classification with the state regulator and PHMSA framework.
“Who regulates an interstate oil pipeline?”
FERC handles the economic regulation of interstate oil-pipeline transportation, including rates and terms within its jurisdiction. PHMSA handles pipeline safety. Environmental agencies and land managers address releases, permits and land impacts.
“My gas bill or local distribution service is wrong.”
Begin with the state public utility commission, which usually sets retail natural-gas rates and regulates local distribution utility matters. The utility’s complaint process may be an initial step, but the commission is the state forum for regulated retail disputes.
“There has been a spill or an emissions problem.”
Use the emergency reporting channel specified by the operator, state emergency system or local responders when there is an immediate threat. For regulatory follow-up, identify the medium and facility: EPA or the state environmental agency for air, water, waste or cleanup; BSEE for offshore safety and environmental enforcement; PHMSA for pipeline-safety concerns; and BLM when a federal onshore lease or reclamation obligation is involved. More than one report may be appropriate.

|---|---|---|---|---|
| BLM | Federal onshore minerals | Leasing, exploration, production and reclamation | Land and mineral management, inspection and enforcement | Lease, operating decision, inspection or reclamation requirement |
| BOEM | Federal offshore acreage | Exploration leasing | Offshore mineral leasing | Lease-related decision |
| BSEE | Federal offshore operations | Platform and operational safety, environmental enforcement | Safety and environmental enforcement | Inspection, compliance or enforcement action |
| EPA | Facilities and activities covered by federal environmental statutes | Emissions, wastewater, waste and cleanup | Environmental standards, permits and enforcement | Federal rule, permit, inspection or enforcement action |
| FERC | Interstate natural-gas and oil commerce | Transmission, rates, pipeline and storage siting, LNG review | Economic regulation and specified federal authorizations | Certificate, rate or tariff proceeding, or related environmental review |
| PHMSA | Gas and hazardous-liquid pipeline systems | Pipeline design, operation and integrity | Federal safety regulation | Safety standard, inspection or enforcement action |
| State oil-and-gas commission | State and private production, subject to state law | Wells, spacing, pooling and production | State conservation and operational regulation | Well permit, field rule, inspection or enforcement action |
| State environmental agency | State environmental programs and delegated federal programs | Air, water, waste and spills | Environmental permitting and enforcement | Permit, compliance order or cleanup action |
| State public utility commission | Retail and intrastate utility service | Retail gas rates and local distribution | Utility economic regulation | Rate, service or consumer complaint proceeding |
The appeal or docket forum follows the agency that issued the decision. FERC matters use FERC’s federal proceeding and docket system; BLM, BOEM, BSEE, EPA and PHMSA matters follow the applicable federal administrative process; state permits and utility decisions follow the state’s commission or environmental-agency procedures. Read the decision or permit for the filing deadline and reviewing body rather than assuming that one agency’s appeal route applies to another.

Common mistakes and how to avoid them
Assuming “federal land” answers every question
Land status identifies an important regulator, but it does not answer the environmental, safety or interstate-commerce questions. A federal lease can still require state permits, and a pipeline across federal land may need both land authorization and FERC or PHMSA involvement.

Treating FERC as the pipeline-safety agency
FERC’s interstate economic and siting role is different from PHMSA’s safety role. Route, certificate, rate and storage questions point toward FERC; integrity, hazardous-liquid and gas-safety questions point toward PHMSA and state safety partners.
Sending a retail complaint to a federal regulator
Retail gas rates and local distribution service are usually state public-utility matters. FERC’s interstate authority does not make it the normal forum for a household bill or local utility service dispute.
Looking for one national state regulator
States divide responsibility among oil-and-gas commissions, environmental departments, public utility commissions and sometimes other offices. Identify the state and the precise activity before choosing a contact.

Leases, well permits, air permits, water authorizations, waste approvals, pipeline certificates and safety compliance are different approvals. Build a permit matrix listing the issuing agency, activity, land status, interstate connection, deadline and enforcement contact.
A practical decision checklist
- Record the state, county or offshore area and whether the minerals are federal, state, private, tribal or offshore federal.
- Describe the activity in one phrase: lease, drill, produce, gather, transport, store, sell at retail, emit, discharge, manage waste or respond to a spill.
- Trace the commodity’s path and mark every state line crossed by a pipeline or sale.
- Separate economic authority from land, safety and environmental authority.
- List every likely agency and verify which one issues the specific permit or receives the complaint.
- Keep the permit, inspection notice or docket number; it determines the correct appeal or follow-up channel.
- For an emergency, contact emergency responders first, then make the required regulatory reports.
The bottom line
Choose the regulator by jurisdiction, activity and interstate reach. BLM is the key federal onshore-minerals agency; BOEM handles federal offshore leasing; BSEE handles offshore safety and environmental enforcement; EPA and state environmental agencies handle environmental requirements; FERC handles covered interstate transportation, rates and siting; PHMSA handles pipeline safety; and state oil-and-gas, environmental and public-utility agencies handle the state and retail lanes. Because those lanes overlap, the most reliable answer is often a coordinated list of agencies rather than a single name.
