Federal bankruptcy courts have not closed. A cybersecurity incident affecting contractor BAE Systems disrupted the nationwide Bankruptcy Noticing Center (BNC) beginning October 9, 2026, stopping or delaying BNC-produced notices and orders, including section 341 meeting notices. CM/ECF filing and electronic filing notices (NEFs) continue to operate, but parties may need alternate creditor-address queries and should seek local deadline relief if late notice causes prejudice.
What happened to the Bankruptcy Noticing Center
The Administrative Office of the U.S. Courts reported on October 15, 2026, that BAE Systems IT and the systems and websites supporting the BNC were impacted by a cybersecurity incident. BAE Systems is the contractor that services the BNC, which produces and transmits bankruptcy notices for every federal bankruptcy court.
The Eastern District of Texas reported that the disruption began October 9. It affected both electronic and paper processing and delivery nationwide. The judiciary has not published counts of delayed notices, cases, parties, or compromised records, so the operational scope is known but no numerical impact estimate is available.

BNC notice and order production is halted or delayed, including service of notices for section 341 meetings of creditors. The following public services were reported unavailable:

Because BNC handles the court’s centralized notice production, a case can continue moving in CM/ECF even while a mailed or BNC-generated notice has not been produced or delivered.
What still works in CM/ECF
Courts continue accepting filings, opening cases, and processing documents under ordinary procedures. Notices of Electronic Filing (NEFs), which CM/ECF generates when a document is filed, continue to be distributed normally. An NEF is separate from a BNC notice: receiving an email NEF does not mean that a delayed paper or electronic BNC notice has been sent.

How to obtain a temporary creditor mailing list
The Eastern District of Texas and the District of Hawaii described a CM/ECF workaround for users who cannot generate or print the usual List of Creditors, also called the mailing matrix. The labels can vary slightly by court, but the published sequence is:

- Select the Creditor link in the case menu.
- Leave the creditor-type field blank.
- Run the query to display creditor names and addresses.
- Save or print the resulting display in the format permitted by your court and case workflow.
This query is not a substitute for checking the complete service list. The court instructions warn that it may omit interested parties. Counsel should compare the output with the applicable Bankruptcy Rules, local rules, case orders, and the document being served, then add parties such as the debtor, trustee, U.S. Trustee, and U.S. Attorney when required. A query result that looks complete can still be inadequate if a particular motion requires service on a party not recorded as a creditor.

Hearings, 341 meetings, and deadlines
Scheduled hearings generally proceed unless the assigned court orders otherwise. The District of Hawaii said a person prejudiced by missing or late BNC notice may request relief under the court’s general order. The Eastern District of Texas entered General Orders 2026-1 and 2026-2 addressing extensions of time and related relief.
There was no estimated restoration date in the Southern District of New York notice dated October 13, and the District of Hawaii repeated on October 14 that it had no estimated restoration date. The national judiciary said BAE Systems was investigating and working to restore operations. Until a court announces restoration, treat BNC delivery as unreliable and monitor CM/ECF and the local court’s notices.

What to do if you are a debtor, creditor, or attorney
If you must file something
File through CM/ECF on the normal schedule unless a judge or local order gives different instructions. Keep the filing receipt and NEF, because those records establish what was filed and when even if a separate BNC notice is delayed.
If you are waiting for a 341 or other BNC notice
Check the case docket and contact the assigned bankruptcy court for case-specific instructions. Do not assume that the absence of a BNC message cancels a scheduled hearing. Verify the hearing status directly and request an adjustment if the missing notice prevents a meaningful opportunity to participate.

If you need to serve a pleading
Use the CM/ECF creditor query only as a starting point. Build the service list required for that pleading, document how addresses were verified, and follow any emergency procedures announced by the court.
If a deadline has passed or is about to pass
File the required motion or request for extension in the affected case and explain the connection between the BNC outage, the missing or late notice, and the prejudice suffered. Identify the applicable general order or local instruction, attach available docket evidence, and ask for the specific relief needed. Courts decide these requests individually; the outage does not automatically extend every deadline nationwide.
Are bankruptcy courts closed?
No. The reported disruption is to the BNC contractor systems and notice websites, not to the courts’ ability to accept filings or process documents. Court operations can still be affected for matters that depend on timely BNC service, so check the individual court’s orders rather than treating the outage as a blanket closure.

Use the affected court’s official announcements and the docket for each case. The national judiciary had not supplied a restoration date as of October 15, 2026. A website becoming reachable would not by itself prove that previously delayed notices were delivered; rely on a court’s instructions about catch-up notices, rescheduled hearings, or revised deadlines.
