FATCA and CRS are information-sharing systems, not substitutes for your U.S. tax filings. FATCA is a U.S. law that can require foreign financial institutions to report accounts connected with U.S. persons and can require certain taxpayers to file Form 8938. CRS is an OECD standard under which participating jurisdictions collect and exchange financial-account information annually. Separately, a U.S. person may need to file an FBAR with FinCEN, file Form 8938 with an income-tax return, file both, or file neither, depending on the facts for that tax year.

Your bank’s request for a FATCA or CRS self-certification does not determine whether you owe U.S. income tax, Form 8938, or FBAR reporting. Those questions must be tested separately.

FATCA and CRS at a glance

Feature FATCA CRS
Legal source U.S. Foreign Account Tax Compliance Act, enacted in 2010 OECD-developed Common Reporting Standard, approved by the OECD Council on July 15, 2014
Main purpose Identify and report certain financial accounts connected with U.S. taxpayers Enable participating jurisdictions to obtain financial-account information and exchange it automatically each year
Who performs the primary reporting work Foreign financial institutions, partner governments under some agreements, and certain U.S. taxpayers Financial institutions in participating jurisdictions, with domestic tax authorities exchanging the information
Where information goes To the IRS directly in some arrangements or through a partner government in Model 1 arrangements Between tax authorities under the participating jurisdictions’ activated exchange relationships
Individual U.S. forms associated with the system Form 8938 may be required when specified foreign financial asset thresholds are met There is no single CRS filing form for U.S. account holders
Does it replace FBAR? No No

The same account can be visible to a bank under one or both systems and still create separate U.S. filing questions. A bank’s compliance process is not a substitute for reviewing your income-tax return, Form 8938, and FBAR requirements.

What FATCA is and how it works

FATCA has an institution side and an individual side

FATCA is a U.S. statute aimed at offshore financial transparency. It has two related but distinct mechanisms:

  • Institution reporting: certain foreign financial institutions identify accounts associated with U.S. persons and report required information under FATCA rules.
  • Individual reporting: some taxpayers report specified foreign financial assets on IRS Form 8938 when the applicable thresholds and exceptions are met.

These mechanisms are connected, but they are not the same filing. A bank may collect your U.S. status and account information for its FATCA process even when you have no Form 8938 filing requirement. Conversely, a person can have a Form 8938 obligation that is not resolved by completing a bank self-certification.

How FATCA information reaches the IRS

The route depends on the agreement between the United States and the relevant jurisdiction. Under a Model 1 intergovernmental agreement, a financial institution generally reports to its local government, which then exchanges information with the IRS. Under a Model 2 arrangement, institutions report directly to the IRS in specified circumstances, with the local government’s role defined by the agreement.

FATCA also contains withholding rules for certain withholdable payments. Those rules are part of the financial-institution compliance regime; they do not turn a bank’s onboarding questionnaire into a personal U.S. tax return.

What a FATCA bank request usually means

A financial institution may ask whether you are a U.S. citizen, U.S. resident for tax purposes, or otherwise a U.S. person, and may request a taxpayer identification number or certification. The exact form and wording depend on the institution and local implementation. Answer accurately and keep a copy of what you submitted. If the request is unclear, ask whether it is being made under FATCA, CRS, local law, or more than one regime.

What CRS is and whether it applies to U.S. citizens

CRS is a multijurisdictional standard

The OECD’s Common Reporting Standard calls on participating jurisdictions to obtain information from their financial institutions and automatically exchange that information with other jurisdictions annually. It establishes common due-diligence procedures, identifies covered financial institutions and account types, and sets categories of taxpayers and information for exchange.

CRS is not a U.S. law and is not one worldwide return that a U.S. citizen files. A jurisdiction must implement the standard through its own law, and the relevant jurisdictions must have an activated exchange relationship for information to move between them. The country, account type, tax year, and domestic rules therefore matter.

Citizenship is not the CRS test

CRS onboarding generally focuses on tax residence under the local rules and the jurisdiction’s exchange network, rather than using U.S. citizenship alone as the deciding question. A U.S. citizen who lives in a CRS-participating country may be asked for a CRS tax-residency self-certification. A bank may also ask separate FATCA questions because U.S. citizenship or U.S. tax status is relevant to FATCA.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

That does not mean CRS determines whether you must file a U.S. return, Form 8938, or FBAR. Those obligations arise under U.S. law and must be analyzed independently. The OECD adopted amendments to the CRS in 2023, so technical definitions and coverage should be checked against current consolidated OECD materials and the relevant country’s current rules.

Your U.S. tax return is a separate question

Worldwide income generally remains reportable

The IRS states that U.S. citizens and resident aliens living or traveling outside the United States generally have filing and estimated-tax responsibilities similar to people living in the United States. Moving abroad does not, by itself, end those obligations. Interest, dividends, gains, compensation, and other income may still belong on the U.S. return under the rules for the particular tax year.

Whether a foreign account is reported by a bank under FATCA or CRS does not decide whether income from that account is taxable or reportable. Start by determining your U.S. tax status and whether a federal income-tax return is required. Then analyze the separate information-reporting forms.

FBAR: the FinCEN report for foreign financial accounts

General filing trigger

A U.S. person generally must file FinCEN Report 114, commonly called the FBAR, when they have a financial interest in, or signature authority or other authority over, foreign financial accounts whose combined value exceeded $10,000 at any time during the calendar year. The test is based on the aggregate value of covered accounts, not just the balance on December 31.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

“U.S. person” for FBAR purposes can include individuals and certain entities. Ownership, financial interest, signature authority, and special rules for jointly held accounts, trusts, estates, and entities can change the result. If your role is limited to signing authority, do not assume that the account is automatically outside the rules; review the applicable exceptions and instructions.

Where and how to file

File the FBAR electronically through FinCEN’s BSA e-filing system. It is not an attachment to your federal income-tax return and is not filed on Form 8938. Use the current FinCEN instructions for the filing deadline, extensions, account classification, and any exception that may apply.

Form 8938: the IRS report for specified foreign financial assets

What it covers

Form 8938 is attached to the federal income-tax return. It covers specified foreign financial assets, a category that can include foreign financial accounts and certain investment assets held outside a financial account. The form asks for information such as the asset, its value, and related income or identifying details required by the current instructions.

Thresholds depend on residence and filing status

Thresholds vary with filing status and whether you live in the United States or abroad. The IRS international tax FAQ gives these examples for an unmarried U.S. resident: more than $50,000 on the last day of the tax year or more than $75,000 at any time during the year. For married taxpayers filing jointly who are U.S. residents, the examples are more than $100,000 at year end or more than $150,000 at any time.

Those figures are examples, not universal thresholds. Taxpayers living abroad, married taxpayers using a different filing status, and other situations have different rules. The current Form 8938 instructions for the specific tax year control. Valuation, currency conversion, jointly owned property, and assets held through entities can also require careful analysis.

Form 8938 does not replace FBAR

The IRS expressly says that the Form 8938 requirement does not replace or otherwise affect the obligation to file an FBAR. One account can appear on both reports. Conversely, an asset that must be listed on Form 8938 but is not a foreign financial account may have no FBAR entry. Depending on your facts, you may need one form, both forms, or neither.

Form 8938 and FBAR compared

Question Form 8938 FBAR
Administered by Internal Revenue Service Financial Crimes Enforcement Network (FinCEN)
Filing channel Attached to the federal income-tax return FinCEN BSA e-filing system
General value trigger Thresholds vary by residence and filing status; IRS examples for unmarried U.S. residents are over $50,000 at year end or over $75,000 at any time More than $10,000 in aggregate foreign-account value at any time during the calendar year
Assets and accounts covered Specified foreign financial assets, including some assets held outside an account Foreign financial accounts in which the filer has a financial interest or signature or other authority
Can the same account be reported? Yes Yes
Does filing one satisfy the other? No No

Worked examples: when one form, both forms, or neither may apply

Example 1: Both reports may be required

An unmarried U.S. resident has one foreign savings account worth $60,000 at year end and never more than $70,000 during the year. The account exceeds the general $10,000 FBAR trigger and also exceeds the IRS FAQ’s example Form 8938 threshold for an unmarried U.S. resident. If no exception changes the analysis, the person may need to file both reports.

Example 2: FBAR may apply while Form 8938 does not under the resident example

An unmarried U.S. resident has a foreign account that reaches $20,000, with no other specified foreign assets. The account exceeds the general FBAR threshold but does not exceed the $50,000 year-end or $75,000 annual-maximum examples quoted for that resident filing situation. The person may therefore have an FBAR obligation without a Form 8938 obligation. The actual result still depends on the complete facts and current instructions.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Example 3: An asset outside an account may point to Form 8938

A taxpayer owns a specified foreign investment asset that is not itself a foreign financial account. That asset may be relevant to Form 8938 even though it is not an FBAR account. The forms use different definitions, so do not assume that an asset omitted from the FBAR belongs nowhere.

Example 4: A low balance does not end every question

An account never exceeds $10,000, but it earns interest that belongs on the U.S. return. The account may fall below the general FBAR threshold, while the interest still has to be considered for income-tax reporting. Account-reporting thresholds and income-tax rules answer different questions.

How to respond when a bank asks for FATCA or CRS information

  1. Read the request’s heading and definitions. Determine whether it asks for FATCA status, CRS tax residence, a local self-certification, or multiple certifications.
  2. Identify the status being requested. FATCA may focus on U.S.-person status; CRS generally asks for tax residence under the participating jurisdiction’s rules. Citizenship and tax residence are not interchangeable concepts.
  3. Provide complete and consistent information. Use the legal name, address, tax-identification numbers, and tax-residency details required by the form. Keep a copy and note the date submitted.
  4. Ask which local rule applies if the request is unclear. The CRS standard does not by itself tell you how every country implements due diligence or which exchange relationship is active for a particular year.
  5. Do not treat acceptance by the bank as a filing clearance. A completed certification does not decide whether you must file a U.S. return, Form 8938, or FBAR.
  6. Correct changes promptly. A move, new tax residence, change in citizenship or status, account closure, or inaccurate prior certification may require an updated self-certification under the institution’s rules.

A yearly checklist for U.S. taxpayers with overseas accounts

  1. Establish your U.S. tax status for the year. Confirm whether you are a U.S. citizen, resident alien, or another category and whether a federal income-tax return is required.
  2. List every relevant account and asset. Record the institution, country, account type, ownership, financial interest, signature or other authority, and whether an asset is held inside or outside a financial account.
  3. Capture peak values. Obtain statements and determine the highest value of each account during the calendar year. Keep the currency and conversion method used.
  4. Test the FBAR threshold separately. Add the maximum values of covered foreign accounts and compare the aggregate with the $10,000 trigger. Review exceptions and the current FinCEN instructions.
  5. Test Form 8938 separately. Classify each specified foreign financial asset, apply the residence and filing-status threshold for the tax year, and check whether an exception or duplicate-reporting rule applies.
  6. Prepare the correct filing channels. Attach Form 8938 to the federal return when required. Submit the FBAR electronically through FinCEN’s BSA e-filing system; do not attach it to the tax return.
  7. Retain support. Keep statements, ownership records, self-certifications, exchange-rate calculations, filed forms, and confirmation records for the period required by your tax adviser and the applicable rules.
  8. Recheck changes before filing. Review new accounts, closures, transfers, marriage or divorce, a move abroad or back to the United States, powers of attorney, signature authority, trusts, and entity interests.

Common mistakes and how to avoid them

  • “The bank reported it, so I do not have to.” Bank reporting and personal filings serve different systems. FATCA or CRS reporting by an institution does not replace your return, Form 8938, or FBAR analysis.
  • “I filed Form 8938, so the FBAR is covered.” The IRS specifically rejects this assumption. Check the FinCEN filing requirement independently.
  • “The account was under $10,000 at year end.” FBAR uses the combined maximum value at any time during the calendar year, not only the December 31 balance.
  • “CRS means every country exchanges everything with every other country.” Participation, domestic implementation, covered institutions, and activated exchange relationships determine what information is exchanged.
  • “A U.S. address means CRS does not matter.” A bank’s CRS analysis can involve tax residence and local rules. A U.S. person may still receive a CRS self-certification request from an institution in a participating jurisdiction.
  • “One threshold works for everyone.” Form 8938 thresholds change with residence and filing status, and forms and instructions are tax-year specific.
  • “Signature authority never counts.” FBAR rules can cover signature or other authority, subject to exceptions. Do not omit an account solely because you do not own the money.
  • “A foreign account is not taxable because the money was earned abroad.” U.S. citizens and resident aliens generally remain subject to U.S. filing rules on worldwide income while abroad. Income inclusion and information reporting are separate analyses.

Penalties and why accuracy matters

The IRS FATCA-reporting summary lists a $10,000 initial penalty for failing to file Form 8938, an additional penalty of up to $50,000 for continued failure after IRS notification, and a 40% penalty on an understatement of tax attributable to undisclosed assets. These figures describe the Form 8938 regime, not an automatic result for every late or incomplete filing. Applicability, reasonable cause, continued noncompliance, and the underlying tax facts are determined case by case.

The IRS says reasonable cause may prevent a Form 8938 penalty when the facts support it. Do not transfer the Form 8938 penalty figures to the FBAR; FBAR has a separate statutory and administrative regime. If a prior filing omitted an account, involved an entity or trust, or included signature authority, obtain advice before choosing a correction or late-filing path.

When professional advice is warranted

Many straightforward account situations can be organized from statements and current instructions, but individualized advice is valuable when the facts involve:

  • joint accounts, community-property issues, nominee ownership, or beneficial ownership;
  • trusts, estates, partnerships, corporations, or other entities;
  • signature authority without ownership;
  • an account opened, closed, transferred, or inherited during the year;
  • multiple countries, changing tax residence, or conflicting self-certifications;
  • late, incomplete, or previously inaccurate Form 8938 or FBAR filings; or
  • large balances, nonstandard investments, private funds, insurance products, or assets held outside an account.

If you engage a preparer or adviser, verify relevant U.S. tax credentials and experience with international information returns. Professional help is not automatically required, but a fact-specific review can prevent treating two different reporting systems as one.

Bottom line

FATCA is a U.S. law involving financial-institution reporting and, for some taxpayers, Form 8938. CRS is an OECD standard implemented by participating jurisdictions for annual automatic exchange of financial-account information. Neither system answers your personal filing question by itself. Determine your worldwide-income filing status, test Form 8938 using the current residence- and filing-status thresholds, test the separate $10,000 FBAR rule, and file through the correct IRS or FinCEN channel for the tax year involved.
