Smart glasses that can quietly capture video or audio should make recording obvious to everyone nearby, according to a 13 October 2026 statement from the European Data Protection Board (EDPB). The board recommends conspicuous signals—such as bright lights, sounds, voice cues, phone notifications or distinctive hardware—so people are not filmed without understanding what is happening.
What the EDPB announced
The EDPB adopted a statement alongside its expert report, The connected gaze. Video recording, surveillance and administering evidence in the age of smart glasses. It describes smart glasses as ordinary-looking eyewear that may contain cameras and microphones and connect to the internet.
Because the glasses can resemble conventional eyewear, a person nearby may not know whether the wearer is looking, photographing, recording video or capturing sound. The EDPB’s central recommendation is that recording must be apparent to bystanders, particularly in public spaces.

EDPB Chair Anu Talus said smart glasses should make recording obvious through measures that are reliable, difficult to miss and kept up to date. The board gives several possible approaches rather than prescribing one particular design.
#1 Best Overall
- Solid Black Privacy Protection: Keep your camera fully covered with these Brvlsoc vinyl webcam covers, designed in a sleek, solid black finish to discreetly protect your privacy across all your smart devices.
- Multiple Sizes for All Devices: Comes in various sizes to fit everything from laptops and tablets to smartphones, smart TVs, and gaming consoles—providing full compatibility and coverage versatility.
- Restickable & No Residue: These low-tack vinyl stickers are restickable, allowing multiple uses without leaving behind sticky residue or damaging your device surface.
- Ultra-Thin & Durable Design: The covers are thin, flexible, and water-resistant, ensuring your device closes easily while maintaining lasting adhesion for everyday protection.
- Safe & Non-Scratching: Made from smooth, soft vinyl that won’t scratch your screen or webcam lens, these reusable camera covers provide peace of mind without compromising functionality.
- Bright LED indicators: a light that is clearly visible from relevant viewing angles while recording is active.
- Audio signals: tones or other sounds that indicate when capture starts and continues.
- Voice-activation cues: an audible or otherwise perceptible signal when a voice command enables recording.
- Privacy-friendly smartphone notifications: linked-phone alerts that can inform people nearby without exposing unnecessary personal data.
- Distinctive designs: hardware that is recognisably recording-capable instead of indistinguishable from ordinary glasses.
The recommendation goes beyond simply installing an indicator. A warning that can be disabled, covered, hidden by tinted lenses or left inaccurate after a software change may not satisfy the EDPB’s expectation that signals remain reliable and hard to ignore.
Why smart-glass recording worries regulators
The EDPB identifies heightened risks in hospitals, schools and workplaces, where people may have limited ability to refuse recording or may be dealing with sensitive information. The same concern applies when footage is uploaded to social networks or when children use the devices or appear in their recordings.
Its report treats smart glasses as potential tools for interpersonal surveillance and evidence handling. A wearer may have capabilities that people around them cannot easily detect or challenge, creating a power imbalance. An earlier European Data Protection Supervisor technology report, published on 18 January 2019, also highlighted discreet video and audio capture, recording without bystanders’ knowledge and possible cloud sharing with third parties as core privacy problems.

When does GDPR apply?
GDPR responsibility depends on the purpose and setting, not just on the fact that glasses were used.
Public, professional and political use
Someone who shares recordings publicly on social media, or uses smart glasses for official, professional or political activities, will generally be treated as a data controller. That brings duties such as having a lawful basis, providing appropriate information, limiting collection, securing the material and handling people’s rights.
Personal and household activity
A purely personal activity—such as recording family or friends or using a private translation function—may fall within the GDPR household exemption. That exemption is not a blanket permission to record. Criminal, civil, labour and sector-specific rules can still restrict filming, audio capture or disclosure.

- ULTRA-THIN PROFILE FOR SEAMLESS DEVICE FIT: Engineered to be barely noticeable — slides smoothly over front-facing cameras on laptops, tablets, and smartphones without interfering with screen closure or case fit. Ideal for Mac Book, iPad, iPhone, and Windows devices.
- SMOOTH SLIDING MECHANISM FOR INSTANT PRIVACY: Features a precision-engineered slider that glides effortlessly to cover or uncover the lens — no sticking, no jamming. One-handed operation ensures quick access during video calls or meetings.
- STRONG ADHESIVE BACKING WITH NO RESIDUE: Uses premium 3 M-style adhesive that sticks firmly to glass or plastic surfaces but removes cleanly without leaving sticky marks or damaging device finishes. Safe for repeated repositioning.
- UNIVERSAL COMPATIBILITY ACROSS DEVICES: Designed to fit most front camera modules — works with laptops, tablets, smartphones, and even smart glasses. The oval shape accommodates various lens placements without blocking sensors or microphones.
- MATTE BLACK FINISH FOR DISCREET PROTECTION: Blends seamlessly with device bezels — won’t draw attention or clash with your setup. Perfect for professional environments, classrooms, or home offices where privacy matters.
Manufacturers and service providers
Manufacturers, app developers and connected service providers keep their own data-protection obligations. They cannot shift those duties to the wearer through terms of service. If a new feature creates additional processing, the provider must assess whether it is compatible with the original collection purpose and apply the required safeguards.

- Check the indicator: confirm exactly what light, sound or notification appears when video or audio capture starts, stops and remains active.
- Test visibility: view the glasses from the front, side and typical distance. A signal visible only to the wearer is not a meaningful bystander warning.
- Review controls: look for physical controls, clear recording status, permissions and ways to prevent accidental activation.
- Limit sensitive locations: avoid recording in hospitals, schools, workplaces and other places where people may reasonably expect heightened privacy unless there is a clear lawful basis and appropriate notice.
- Control storage and sharing: find out whether footage is stored on the glasses, phone or cloud, who can access it, how long it is retained and what happens when it is uploaded.
- Tell people: where recording is necessary, explain it plainly and stop if people object or the legal basis is uncertain.
How to compare privacy-friendly smart glasses
| Factor | Questions to ask |
|---|---|
| Recording visibility | Is the indicator conspicuous from multiple angles and during both photo and video capture? |
| Tamper resistance | Can the warning be disabled, covered or electronically bypassed without an obvious change in status? |
| Audio and phone cues | Are there audible or voice-activation signals, and can nearby people receive privacy-preserving notifications? |
| User controls | Is there a physical stop control, clear status display and protection against accidental activation? |
| Storage and sharing | Where is content stored, who receives it, how long is it kept and can automatic social sharing be restricted? |
| Sensitive-environment suitability | Does the design and policy support use around patients, pupils, employees and children? |
The EDPB does not endorse a particular brand or model. A product with a recording LED is not automatically privacy-safe: the indicator’s visibility, reliability, tamper resistance, software behavior and data practices all matter.

The EDPB statement is a regulatory recommendation, not a published numerical test showing how many glasses fail to warn people. Its materials provide qualitative guidance rather than a prevalence statistic or a universal technical brightness threshold. National authorities may apply additional rules. Luxembourg’s data-protection authority has issued separate guidance covering smart-glass operation, risks and obligations for manufacturers, suppliers and professional users, while the Dutch Data Protection Authority says secretly filming others with camera glasses in public is generally prohibited and is coordinating with European regulators.

Frequently Asked Questions
Do smart glasses already have to use a specific warning light under EU law?
The EDPB statement recommends clear, reliable and difficult-to-ignore warnings, but it does not set one universal light specification or endorse a particular model. It lists bright LEDs, audio signals, voice cues, privacy-friendly phone notifications and distinctive designs as examples.
Can I record family members with smart glasses without dealing with GDPR?
A genuinely personal or household activity may fall within the GDPR household exemption, but other criminal, civil, labour or sector-specific rules can still apply, especially if recording is shared or causes harm.

The Bottom Line
If smart glasses can record, people nearby should be able to tell immediately. Choose devices with conspicuous, tamper-resistant status signals, limit use in sensitive settings and assess GDPR and local-law responsibilities based on the purpose and audience of each recording.
