For most French traders, an EU/MiCA-compliant stablecoin used through an authorised EU crypto-asset service provider is the safer default. MiCA creates issuer and service-provider obligations, while the ACPR relays an EBA warning that stablecoins issued by firms without MiCA authorisation do not benefit from safeguards such as fund protection and redemption protection. Offshore tokens and platforms may offer liquidity or access, but they leave you with greater legal, counterparty and recovery risk. No stablecoin is a bank deposit, a government guarantee or protection against trading losses.
What “safer” means for a French trader
Safety is not the same as a token staying exactly at one euro or one dollar. A useful comparison covers eight separate questions:
- Is the issuer authorised for the token’s legal category?
- Can you enforce redemption, and on what terms?
- What assets back the token, and how transparent are those reserves?
- Is the exchange or wallet provider supervised for the service offered to French clients?
- Who holds custody of your assets, and how do complaints work?
- How liquid are the token and the trading pairs you need?
- What happens to your euro value when the token is linked to the US dollar?
- Can you realistically recover funds after a freeze, hack or insolvency?
MiCA reduces legal and conduct uncertainty on the first five questions when the relevant issuer and provider are authorised. It does not remove issuer-credit, reserve, blockchain, smart-contract, custody, liquidity or currency risks.
How MiCA classifies and regulates stablecoins
Electronic-money tokens (EMTs)
An EMT is a crypto-asset that purports to maintain a stable value by referencing one official currency. A euro-referenced token and a US-dollar-referenced token can therefore fall into the EMT framework. Issuers need the applicable authorisation and must meet MiCA disclosure, governance and redemption requirements.

Asset-referenced tokens (ARTs)
An ART refers to another value, a right, or a combination of assets, potentially including several currencies, commodities or crypto-assets. ART issuers also face authorisation, reserve and governance requirements under MiCA.
The classification is not a marketing label. Ask which legal entity issues the token, which category applies and whether that entity is authorised for the activity. A token can look “regulated” in advertising while the issuer, exchange or specific service available to a French resident is outside the relevant authorisation.
The French transition period
The AMF describes a transition for providers that operated before MiCA’s application. In France, pre-existing providers can use transitional arrangements through July 2026, subject to the applicable conditions. That date does not make every provider automatically authorised, nor does it turn every token into a compliant EMT or ART. Check the current register and the provider’s legal notices before depositing money.

Protection associated with an authorised route
The ACPR states that companies offering or admitting EMTs or ARTs must follow the new procedures. It also relays the EBA warning that stablecoins not issued by an enterprise authorised under MiCA “are not covered by safeguards, notably in terms of protection of funds and reimbursement.” In practical terms, an authorised route should give you clearer information, a defined redemption process, supervised conduct and a formal complaint path.
These are regulatory safeguards, not a deposit guarantee. If a reserve asset loses value, a blockchain fails, a custodian misappropriates assets or a market becomes illiquid, MiCA does not promise that you will be made whole.
What an offshore route may leave you without
“Offshore” is not one legal category. A provider incorporated outside the EU might be authorised in its home country, restricted from serving EU residents, or operating without meaningful supervision. The decisive question is whether the specific issuer and service are authorised for the French or EU activity involved.

If they are not, assume that EU fund-protection, redemption and complaint safeguards may not apply. A French user may face unfamiliar insolvency law, a foreign regulator, language and jurisdiction barriers, and a much harder process for serving notices or enforcing a judgment. A website being reachable from France does not establish authorisation to serve you.
How stablecoins can lose their peg
Reserve and redemption mechanics
Banque de France describes stablecoins such as Tether (USDT) and USD Coin (USDC) as private digital assets linked to reserves that can include currencies, public debt, private debt or bank deposits. The reserve is intended to anchor the token’s value, but reserve management does not always transparently guarantee that sufficient reference assets are available.
A token can trade below its target when holders rush to sell, market makers withdraw, redemption is delayed, or doubts arise about the reserve. A mass sell-off can force the issuer to liquidate reserve assets, transmit stress to traditional markets and create a temporary depeg. An attestation or reserve report improves visibility; it does not eliminate a run, valuation uncertainty or a mismatch between the token’s promise and the assets actually available.
Platform, custody and technology failures
- Exchange failure: an exchange can freeze withdrawals, become insolvent or suffer an internal control failure even when the token issuer remains solvent.
- Custody loss: a hosted wallet may be hacked, frozen by a court order or affected by a key-management error.
- Blockchain risk: congestion, a chain halt, bridge exploit or smart-contract bug can prevent timely transfers.
- Liquidity risk: a quoted price may exist while order-book depth is insufficient for your trade size.
- Fraud and money-laundering exposure: unsolicited offers, fake support accounts and platforms demanding extra “release” payments are common warning signs.
Dollar exposure for a euro-based trader
USDT and USDC target one US dollar, not one euro. Even if either token holds its dollar peg, its euro value changes with EUR/USD. A stronger euro can reduce the value of your holdings in euros; a weaker euro can increase it. A euro stablecoin avoids that particular currency conversion, but it still has issuer, reserve, custody and liquidity risks.
EU-regulated route versus offshore route
| Comparison point | EU/MiCA-facing issuer and authorised provider | Offshore issuer or provider without relevant EU authorisation |
|---|---|---|
| Issuer authorisation | Authorisation and MiCA disclosures apply to the relevant EMT or ART issuer. | Home-country status may not authorise French or EU activity; status can be unclear. |
| Enforceable redemption | MiCA-facing arrangements should state redemption rights, procedures, fees and limits. | Rights may depend on foreign law, contract wording or an issuer with no accessible EU presence. |
| Reserve transparency and quality | Required disclosures and governance improve information, but do not guarantee reserve value. | Reporting, asset quality, segregation and audit or attestation standards may be harder to verify. |
| Platform supervision | An authorised service provider is subject to applicable EU conduct and organisational rules. | Supervision may be weak, distant or irrelevant to a French customer. |
| Custody and complaints | Clearer custody arrangements and EU complaint and supervisory channels. | Foreign terms, inaccessible support or no practical escalation route are possible. |
| Liquidity and pairs | Liquidity depends on the specific venue; some offshore markets may have more pairs. | Deep liquidity can coexist with withdrawal, legal and counterparty risk. |
| EUR/USD exposure | Euro tokens reduce dollar conversion exposure; dollar tokens retain it. | The same currency risk applies, regardless of where the platform is incorporated. |
| Recovery after freeze, hack or insolvency | EU legal identity, records and complaint routes generally make recovery more practical, not certain. | Cross-border enforcement and asset recovery can be slow, expensive or impossible. |

AMF’s 2025 Markets and Risks Outlook reported that USDT’s share of stablecoin capitalisation fell from 70% in December 2024 to 60% in April 2025, while USDC’s share rose from 20% to 26%. Those are market-share measurements, not proof that either token is solvent, compliant for your account or safer in every situation.

For a French user, a US-dollar token issued and distributed through an EU-compliant arrangement can have stronger legal and complaint protections than an otherwise identical token obtained through an unauthorised offshore venue. Conversely, a compliant token on a poorly controlled platform can still expose you to custody and withdrawal risk. Compare the issuer and service, not just the ticker.
How to verify a platform before sending funds
- Identify the legal entity. Record the company name, registered address, regulator and the exact domain shown in its legal documents. Do not rely on a brand name or app-store listing.
- Identify the token. Confirm whether it is presented as an EMT, ART or another crypto-asset, which entity issues it, which blockchain networks are supported and whether French residents are eligible.
- Search official registers. Check the AMF and ESMA registers for the provider’s legal entity and the ACPR information for relevant authorisation. Match the exact service—exchange, custody, transfer or issuance—to the permission shown.
- Read redemption terms. Look for who can redeem, minimum amounts, settlement timing, fees, suspension triggers, identity checks and what happens during a stress event.
- Examine custody. Determine whether assets are segregated, who controls private keys, whether the provider can rehypothecate assets and how withdrawals are handled.
- Review reserves. Read the latest reserve disclosure and any independent attestation. Check the asset types, maturity, concentration and publication date; an attestation is not an insolvency guarantee.
- Test a small withdrawal. Before committing significant funds, verify that deposits, conversion and withdrawals work on the network and bank route you intend to use. Account for network fees and settlement delays.
- Save evidence. Keep confirmations, wallet addresses, transaction hashes, terms, support tickets and screenshots. These records can matter in a complaint or insolvency.
Warning signs that should stop a deposit
- Guaranteed yield, “risk-free” returns or pressure to act immediately.
- Copy-trading or social-media messages from unsolicited accounts.
- A platform that refuses to identify its legal entity or regulator.
- Withdrawal being made conditional on an extra tax, insurance payment or “unlock” fee.
- Conflicting token symbols, unexplained chain changes or support asking for your seed phrase.
- Reserve claims that provide no dated report, asset breakdown or redemption explanation.
DGCCRF’s consumer guidance is direct: “L’argent facile n’existe pas : soyez vigilant et n’investissez que dans des produits financiers dont vous comprenez le fonctionnement.”
Costs, liquidity and practical trade-offs
Authorised EU access may offer fewer trading pairs or higher visible fees than a large offshore market. That is a convenience and execution trade-off, not evidence that the offshore route is safer. Compare the total cost: spread, commission, network fee, deposit and withdrawal fee, conversion cost, and any minimum redemption amount.

Market context and what the figures do—and do not—show
Banque de France reported total crypto-asset capitalisation of €1.510 trillion in December 2023 and total stablecoin capitalisation of $110 billion in December 2023 in its 2024 publication. These figures describe market size at a date; they do not establish the solvency of an issuer or the safety of a particular platform.
The AMF’s 2025 market-share figures likewise show how usage changed between December 2024 and April 2025, not which token will maintain its peg during a future shock. Treat market share and liquidity as decision inputs, never as substitutes for authorisation, reserves and enforceable redemption.

A sensible operating policy for French traders
For trading collateral
Keep only the amount needed for active orders on an exchange. Move surplus to custody you control after checking network compatibility and recovery procedures. Separate operational balances from long-term holdings and keep a written record of which legal entity holds each asset.

For euro spending or savings
Do not treat a stablecoin as a bank deposit or emergency cash. Use a regulated bank account for obligations that require principal certainty. A stablecoin can depeg, become temporarily unredeemable or lose euro value through exchange-rate movements.
For an offshore venue you decide to use
First establish why the EU-authorised alternative cannot meet your liquidity or technical need. Limit exposure, avoid leaving idle balances, verify withdrawals with a small test and accept that recovery may depend on foreign proceedings. Never assume that being able to open an account means French consumer protections apply.
Frequently asked questions
Can I legally use an offshore stablecoin in France?
Access from France does not answer the authorisation question. The issuer and service must be assessed for the activity offered to French residents. If the relevant firm is not authorised under the applicable EU framework, EU safeguards may not apply and enforcement can be difficult.
What happens if my stablecoin depegs?
You may be able to sell on a market, redeem with the issuer or wait for the price to recover, depending on the token’s terms and the platform’s operation. None is guaranteed during a run. Check redemption conditions before buying and do not assume a one-dollar target prevents a loss in euros.

No. It is evidence about reserves at a particular time and under a particular scope. It does not guarantee that assets remain available, liquid and correctly valued during a mass redemption or that your platform will process withdrawals.

Is a regulated stablecoin covered by French deposit insurance?
No. A stablecoin is not automatically a bank deposit and does not receive deposit-insurance protection merely because its issuer or trading venue is authorised under MiCA.
Which official records should I check?
Use the AMF and ESMA registers for the provider’s legal entity and the ACPR information relevant to payment, electronic-money or crypto-asset authorisation. Confirm the exact service and client geography, then compare those entries with the legal name in your account agreement.
Why can a euro stablecoin still lose value?
Its target may be one euro, but reserve losses, delayed redemption, market illiquidity, custody failure or a smart-contract problem can push the market price below that target. Regulation reduces some risks; it does not make the token risk-free.
Frequently Asked Questions
Can I legally use an offshore stablecoin in France?
Access from France does not establish authorisation. Check whether the specific issuer and service are authorised for French clients; otherwise EU safeguards may not apply.
What happens if my stablecoin depegs?
Selling, redeeming or waiting may be possible depending on the token and platform, but none is guaranteed during a run. A dollar peg also does not fix its euro value.
Does a reserve attestation guarantee repayment?
No. It reports information at a defined time and scope but does not guarantee liquidity, correct valuation or successful withdrawals during stress.
Is a regulated stablecoin covered by French deposit insurance?
No. MiCA authorisation does not turn a stablecoin into a bank deposit or provide automatic deposit insurance.
Which official records should I check?
Search the AMF and ESMA registers and relevant ACPR information, matching the exact legal entity, service and French-client eligibility.
