The EU AI Act does not make every fintech AI system high-risk. The main questions are what each system is intended to do, whether that use falls into a regulated category such as creditworthiness assessment or credit scoring, and whether the institution acts as provider, deployer, or both. Requirements are phased: Article 50 transparency rules apply from 2 August 2026, while the main high-risk rules apply from 2 December 2027 for Annex III systems and 2 August 2028 for high-risk AI embedded in certain regulated products.

Does the EU AI Act apply to fintech?

Fintech is not a single risk category under the Act. A bank, lender, payments company, or other financial technology business should assess its AI systems individually by their intended purpose, function, and actual use. The same company may operate systems with different classifications and different responsibilities.

The Act has been in force since 1 August 2024, but its requirements start on different dates. Some obligations already apply; others are not due until 2027 or 2028. Use the amended dates in Regulation (EU) 2026/1744, which is in force, rather than dates copied from older summaries.

When do the EU AI Act rules start applying?

2 February 2025 AI literacy provisions and prohibited-practice rules began applying, subject to later amendments to specified prohibitions. Review staff AI literacy and screen relevant systems for prohibited practices.
2 August 2025 Governance provisions and obligations for general-purpose AI models began applying. Map relevant relationships when using third-party foundation or general-purpose models.
2 August 2026 Article 50 transparency requirements and enforcement for applicable provisions began. Review customer-facing AI interactions and workflows involving generated or manipulated content.
2 December 2026 A transition deadline applies to certain pre-existing systems for Article 50(2); specified new prohibitions also apply from this date. Check when a system was placed on the market and which exact transparency duty applies.
2 December 2027 High-risk rules apply to systems in Annex III. Prepare in-scope creditworthiness and credit-scoring systems for the applicable high-risk requirements.
2 August 2028 High-risk rules apply to AI systems embedded in products covered by Annex I. Assess this route only if the system falls within the regulated-product category.

The dates for high-risk systems reflect Regulation (EU) 2026/1744, published in the Official Journal on 24 July 2026. The consolidated AI Act text and the European Commission’s timeline are the appropriate references for the applicable dates; older explainers may show the original timetable.

Is AI credit scoring high-risk under the EU AI Act?

Creditworthiness and credit scoring

Annex III identifies certain AI systems used to evaluate the creditworthiness of natural persons or establish their credit score as high-risk. For a lender or consumer-finance provider, review the system’s real function and how its output affects an applicant—not just the label used internally for the product.

Fraud detection

The Annex III creditworthiness entry excludes AI systems used for detecting financial fraud. That exclusion is not a blanket exemption for a broader system that also scores applicants or determines access to credit. If one product performs both functions, assess each purpose and the system’s actual design and use.

Other fintech systems

Do not assume that a system is high-risk merely because it is used by a financial institution. Check the statutory categories and the system’s intended purpose. Separately review customer interaction and generated-content workflows for the Article 50 transparency requirements that apply from 2 August 2026.

What does the EU AI Act mean for banks and fintechs?

Identify whether the institution is a provider, deployer, or both

A financial institution that develops an AI system in-house may be both its provider and deployer. An institution using a system developed by another company will generally be a deployer. The European Banking Authority’s 20 November 2025 banking-sector analysis describes this distinction; the Act also provides for circumstances, including certain substantial modifications or changes of intended purpose, in which an operator may assume provider obligations.

Record the role for each system rather than assigning one label to the entire business. The distinction matters because provider and deployer duties are different, and the operating role can change with the system’s development or use.

Build controls around the system’s risk and role

For high-risk systems, the Commission’s overview of the Act identifies provider work across risk management, data quality, technical documentation and traceability, transparency, human oversight, accuracy, cybersecurity, robustness, conformity assessment, and quality management. Deployers must use systems in accordance with instructions, monitor them, and assign competent human oversight.

Human oversight should be meaningful, not just a named person on an organisation chart. Staff responsible for oversight need appropriate competence, training, authority, and support, and the institution should be able to document how oversight operates.

Make third-party arrangements work in practice

Using an external model or system does not remove the institution’s own duties. Establish which party supplies the information and assistance needed for the institution to meet its obligations. For high-risk systems, the Act specifies written cooperation arrangements between providers and relevant third-party suppliers. Supplier terms should address access to technical documentation and testing information, known limitations, incident handling, and cooperation where those are needed for compliance.

How should a fintech prepare?

  1. Inventory AI systems. Record each system’s owner, supplier, intended purpose, affected users, data inputs, decision impact, and deployment locations. Include internally developed tools and third-party systems.
  2. Classify each use case. Compare its intended purpose and actual operation with the statutory categories. Review creditworthiness and scoring, fraud detection, biometric applications, customer interaction, and generative AI transparency workflows as distinct questions.
  3. Map the operating role. Document whether the institution is provider, deployer, or both, and flag design changes, substantial modifications, or changes of purpose that could affect that assessment.
  4. Build the high-risk control plan. For systems likely to fall within a high-risk category, organise risk management, data governance, documentation and logging, human oversight, accuracy, robustness, cybersecurity, quality management, conformity assessment, and post-market monitoring.
  5. Assign dates at system level. Track the relevant application date and any transition rule for each system, including its market-placement date where that affects Article 50(2).
  6. Review contracts and support. Confirm that supplier arrangements provide the technical information, testing details, incident cooperation, and assistance the institution needs to discharge its responsibilities.
  7. Keep the assessment current. Track Commission guidance, standards, and national competent-authority arrangements. Treat draft guidance and illustrative examples as non-binding rather than as definitive classification decisions.

How to distinguish two similar fintech AI systems

When two tools appear similar, compare the elements that determine the legal assessment rather than relying on their product names.

  • Purpose and decision: Does the system assess creditworthiness, detect fraud, or perform another function? What decision can its output influence?
  • Applicable category: Does the use fall within a listed high-risk category, and does a specific exclusion apply to that use?
  • Role: Is the institution the provider, deployer, or both?
  • Impact and data: What data and affected-person or fundamental-rights risks are relevant?
  • Supply model: Is the system built internally or supplied by a third party, and can the institution obtain the information and assistance it needs?
  • Timing and controls: Which application date or transition rule applies, and what documentation, oversight, monitoring, and conformity steps follow?

Credit scoring and fraud detection illustrate why purpose matters: the Annex III creditworthiness entry includes certain creditworthiness and scoring uses but excludes systems used for detecting financial fraud. A product that combines functions still needs an assessment based on what it actually does.

What remains uncertain in classification?

The European Commission’s classification-guidance page describes its guidance as draft and non-binding. It reflects the Commission’s interpretation, and its practical examples are non-exhaustive and may be updated. Use the binding Act as the baseline and assess the particular system rather than treating an example as a guaranteed legal outcome. A specific institution’s duties also depend on the system facts and applicable sectoral law; this overview is not a legal determination for an individual system.
