No, Anbernic has not been confirmed banned in the United States. Reports dated October 12 and 13, 2026 say the Entertainment Software Association (ESA) recommended that the U.S. Trade Representative (USTR) consider Anbernic in its Notorious Markets process, citing handhelds bundled with microSD cards allegedly containing unauthorized game copies. That recommendation is not a USTR decision, and no U.S. sales ban has been verified.
What the ESA reportedly asked the USTR to consider
Retro Handhelds reported on October 12, 2026, that the ESA recommended Anbernic for consideration in connection with handhelds bundled with microSD cards. Android Authority reported on October 13 that the ESA had submitted suggestions through Regulations.gov and described the allegation as cards containing unauthorized copies of games published by ESA members.
That is an allegation attributed to the ESA, not a finding independently established here. The Regulations.gov filing link in Android Authority’s report returned a 403 error when accessed, so the submission itself could not be reviewed. The reports do not establish how many devices or cards are involved, which specific games are alleged to be present, or the full scope of the ESA’s submission.

No formal USTR listing, order to stop selling, or U.S. sales ban was verified as of October 13, 2026. A recommendation is a request for consideration; it does not automatically put a company on the final Notorious Markets list. Android Authority says USTR makes the ultimate determination, and Retro Handhelds notes that the agency could decline to adopt the recommendation.

The reports also do not establish what any future action would cover. It is not known whether possible consequences would concern particular product bundles, hardware, or sales channels. Any effect on U.S. sales remains conditional unless and until USTR takes an official action.
Is the concern the handheld or the preloaded card?
The reported concern centers on microSD cards bundled with handhelds that ESA says contain unauthorized game copies. The reporting does not establish that the handheld hardware itself is the subject of a final U.S. restriction. Nor does it confirm that a hardware-only configuration is available from a particular seller.

For a purchase decision, distinguish the device from what may be supplied on its storage card. If you are considering a retro handheld, check the seller’s exact listing, what is included, shipping availability for your location, and the warranty and return terms. A blank replacement microSD card can provide storage, but using a blank card does not make unauthorized game files lawful. Use content you are entitled to use and consult the relevant rights holder’s official guidance.
Do these 3 things before closing this tab:
1Clear out junk files and repair common Windows errors2Scan for outdated or missing drivers - takes under a minute3Repair Windows errors before they cause bigger problemsEmulators and ROMs are not the same thing
An emulator is software that imitates another system’s behavior; a ROM is a copy of game data. Those terms refer to different things, so the presence of emulator software does not, by itself, establish that a device contains unauthorized game copies.

Nintendo’s official Intellectual Property & Piracy FAQ describes unauthorized game files as ROMs and states Nintendo’s position that copying, downloading, or distributing pirate game copies is illegal. It says: “The uploading and downloading of pirate copies of Nintendo games is illegal.” The page also says some emulator software may circumvent security measures. That is Nintendo’s characterization, not a neutral legal ruling about every emulator, every game, or every jurisdiction, and it does not adjudicate the Anbernic allegation.

USTR must make any official determination about inclusion on the Notorious Markets list. The October 2026 reports establish that ESA reportedly made a recommendation; they do not establish that USTR accepted it or that a particular Anbernic product has been restricted. Until an official decision is announced, claims that Anbernic is banned or that all of its handhelds are affected go beyond what those reports support.
