The Entertainment Software Association (ESA) reportedly nominated Anbernic for consideration in the U.S. Trade Representative’s (USTR) 2026 Notorious Markets review, alleging that some retro handheld offerings are bundled with unauthorized game files. That is an industry association’s request—not a confirmed USTR designation, a court ruling, or an announced U.S. sales or import ban.
What the ESA reportedly asked USTR to consider
On October 13, 2026, Video Games Chronicle (VGC) reported that the ESA submitted recommendations for USTR’s 2026 Notorious Markets List and named Anbernic, a maker of retro handheld gaming devices. The allegation concerns devices offered or shipped with removable memory cards containing large libraries of games published by ESA members, rather than a verified finding about every Anbernic product or seller.
VGC reports that the ESA describes the alleged plug-and-play devices as video-game “superfakes.” The ESA’s submission, as quoted by VGC, says: “In the video game sector, illicit plug-and-play consoles and handheld devices are the functional equivalent of superfakes.” This is the association’s advocacy language, not a legal classification or USTR conclusion.

Here, “superfake” is an analogy for polished, consumer-ready handheld hardware and presentation whose appeal, the ESA alleges, is tied to an unauthorized game catalogue. The ESA also describes alleged products whose “commercial appeal rests solely on a concealed memory card or internal drive loaded with hundreds, thousands, or even tens of thousands of unauthorized copies of copyright-protected games.” That quantity is the ESA’s characterization, not an independently verified count or estimate of how commonly such bundles are sold.

It also does not establish a model-by-model allegation.

What USTR’s Notorious Markets List does—and does not do
USTR publishes the list annually to highlight online and physical markets reported to engage in or facilitate substantial trademark counterfeiting or copyright piracy. Its stated purpose is to raise awareness and help governments and market operators prioritize enforcement. In its March 3, 2026 release about the 2025 list, USTR says the list is not exhaustive and does not itself constitute findings of legal violations or the U.S. government’s broader assessment of a country’s intellectual-property climate.

The USTR release reviewed concerns the prior year’s list; it does not confirm a decision on the ESA’s reported 2026 recommendation. The sources reviewed do not establish the 2026 docket schedule or a decision date.

What a buyer or owner should take from the report
- Do not treat the report as a blanket finding about all Anbernic devices. The allegation reported by VGC concerns game libraries allegedly bundled with some offerings, not every model or configuration.

- Check what a specific listing includes. The reported concern is about unauthorized game files on removable media or internal storage. The reporting does not verify the contents of any individual listing.
