Employees should share in invention profits when the law that applies requires compensation, or when a fair employer policy rewards inventions that materially contribute to commercial value. There is no universal percentage or automatic right: ownership, eligibility, timing and calculation depend on the country, employment terms and the employer’s policy.

First establish who owns or controls the invention

Being named as an inventor does not, by itself, establish who owns an invention or whether the inventor is entitled to a share of commercial returns. Start with the law where the employee works, the employment agreement, any collective agreement and the employer’s invention policy. Then determine whether the invention arose from ordinary duties, a specifically assigned project or another work-related obligation.

The legal examples below illustrate different approaches; they are not a substitute for checking the rules that apply to a particular employee and invention.

Jurisdiction or example Ownership and compensation trigger How compensation is assessed Important limit
Germany The Employee Inventions Act covers employee inventions and technical improvement proposals in private and public service. A right to reasonable compensation arises when the employer claims a service invention. The statutory approach considers economic exploitability, the employee’s duties and position, and the employer’s contribution. The parties should agree within a reasonable time; if they do not, the employer fixes compensation through a reasoned statement in text form under the statute. This is not simply a flat percentage of profits. The statute and applicable guidelines govern the calculation.
United Kingdom Under section 39 of the Patents Act 1977, qualifying inventions made in the course of normal or specifically assigned duties, or under a special obligation to further the employer’s interests, belong to the employer as between employer and employee. Under sections 40 and 41, a court or comptroller may award compensation for a qualifying employer-owned patented invention if it is of outstanding benefit to the employer and an award is just. The award is intended to secure the employee a fair share of the benefit, considering all the circumstances. The statutory threshold is demanding. The rule does not give every employee inventor an automatic royalty.
United States The USPTO explains that a patent application may be filed by an assignee or by someone to whom the inventor is contractually obligated to assign the invention. The USPTO page cited for this point does not establish a general employee right to invention profits. Contract terms and other applicable law need review. This limited point does not support a broad claim that US inventors always—or never—share profits.
Freie Universität Berlin policy example The university’s published policy addresses commercial exploitation of inventions. The university says inventors receive 30 percent of gross commercial exploitation revenue. If there are multiple inventors, the amount is divided according to their proportional contribution. This is one university’s policy, not a legal rule, industry norm or recommended rate for other employers. The page’s publication year is not stated; it was accessed in 2026.

The UK legislation’s employee-invention provisions were current through 2026-10-06. The US point above is deliberately narrow: the USPTO material addresses assignment and patent applications, not a comprehensive US employee-compensation framework.

When a profit share is a sound policy choice

Even where a law does not require compensation, an employer can choose to reward inventions that contribute materially to commercial value. A transparent policy can recognize employee contributions, make expectations clearer and reduce disputes. Those are reasons to consider a policy, not evidence that profit sharing has a guaranteed effect on innovation, retention or productivity.

A fair policy should distinguish compensation required by law from any additional employer-created award. It should also make clear whether the employee receives a statutory payment, a contractual bonus, a share of commercialization returns or some combination of these.

Decide the trigger and calculation before value is realized

“Share profits” is not a complete formula. A policy should define the event that creates eligibility and the value against which a payment is calculated. These choices affect whether compensation is due when an invention is disclosed or patented, only when money is earned, and whether costs reduce the amount.

  • Trigger: State whether payment follows disclosure, patent filing, patent grant, licensing, sale or actual collection of commercial revenue. Separate a right to submit an invention for assessment from a right to receive money.
  • Calculation base: Specify gross receipts, net benefits after defined costs, a fixed award or another measure. Define which licensing payments, sale proceeds, deductions and related transactions count.
  • Timing: Explain when amounts are calculated and paid, how ongoing revenue is handled, and what happens if commercialization value changes or a deal is later reversed.
  • Co-inventors: Set out how contributions are recorded and how a shared award is divided. Inventorship and the allocation of an employer’s award are related but distinct questions; a policy should explain its method and how employees can contest it.
  • Administration: Identify who assesses the invention, what information employees receive, how calculations can be reviewed, and how disagreements or later adjustments are handled.

The legal and institutional examples show why there is no single formula: Germany uses a statutory reasonable-compensation framework; UK law offers a conditional fair-share remedy for a qualifying invention of outstanding benefit; and Freie Universität Berlin specifies a gross-revenue share in its own policy.

Questions to resolve for a specific invention

  1. Which rules apply? Confirm the employee’s work location and review applicable national law, the employment agreement, collective agreements and employer policy.
  2. Who owns or controls it? Compare the invention’s relationship to job duties or an assigned project with the applicable ownership rules and contract terms.
  3. What compensation route exists? Determine whether the employee may qualify under a statute, an agreement or an employer policy—and what event triggers that route.
  4. How is the amount determined? Check the stated calculation base, eligible revenue or benefits, treatment of costs, co-inventor allocation and payment timing.
  5. Can the calculation be checked? Find the reporting, review, dispute and adjustment procedures, including what happens if the invention later generates additional value.

For an individual claim, the result depends on the work location, contract, invention facts, patent status, collective agreements and employer policy. A lawyer familiar with the relevant jurisdiction can assess those details; a general comparison cannot determine an employee’s entitlement.
