Future-proof email marketing by treating opens as an imperfect signal, building measurement around clicks and outcomes, and managing authentication, consent, and unsubscribe operations as separate controls. Apple Mail Privacy Protection can trigger image downloads without a person reading a message, while Gmail delivery rules and marketing laws vary by provider and recipient market.
Are email open rates still accurate?
They are not reliable proof that a person read a message. Open tracking commonly depends on a remote image or tracking pixel being requested. Apple says Mail Privacy Protection downloads remote content in the background by default, independently of whether a recipient engages, and routes Mail activity through two relays to separate the recipient’s IP address from the remote content. As a result, a pixel request may be counted as an open without a human reading the email, and that request is not a dependable way to infer a recipient’s location or activity. Apple explains Mail Privacy Protection, and Apple Support describes its settings and behavior in Mail.
This does not mean every reported open is false or that every Apple Mail user has protection enabled. Apple’s documentation explains the feature, not how many recipients use it. Treat open rates as a qualified, directional signal, not as confirmation of attention or permission.

Use a measurement hierarchy
| Signal | What it can help answer | How to interpret it |
|---|---|---|
| Conversions and other business outcomes | Did the campaign produce the intended result? | Define the outcome and attribution window for your own reporting; do not treat a pixel event as a substitute. |
| Clicks and replies | Did a recipient take an observable action? | Use them as stronger engagement evidence than opens, while distinguishing a click from the downstream result it may or may not produce. |
| Delivery, complaints, and unsubscribes | Are messages reaching recipients, and are people objecting or opting out? | Keep these operational signals distinct from engagement and from proof of consent. |
| Opens | Is there a directional change in remote-content activity? | Label the metric as an estimate affected by privacy features and email-client behavior. |
Change automations that depend on opens
If an automation waits for an open or sends a follow-up because no open was recorded, provide another trigger: a click, an explicit preference, or an elapsed-time rule. Monitor what that alternative does rather than assuming an open means attention. For time-sensitive campaigns, make the decision rule explicit so a noisy open signal does not become the sole basis for a consequential message.

What are Gmail’s bulk-sender requirements?
Google defines a bulk sender as one that sends close to 5,000 or more messages to personal Gmail accounts within a 24-hour period. The threshold is based on delivery to personal Gmail accounts, and messages from subdomains count toward the same primary domain. Google says a sender that has met the threshold is permanently classified as a bulk sender. These are Gmail policy criteria, not a general legal definition of bulk email. Check Google’s periodically updated sender FAQ for the current details.
For senders in scope, Google identifies authentication, avoiding unwanted or unsolicited email, and easy unsubscribe as requirements. Its sender guidance recommends SPF and DKIM aligned at the organizational level and consistent From addresses by message category. These are provider-specific delivery requirements and recommendations; they do not determine whether a campaign has a valid legal basis. See Google’s email sender guidelines for current technical instructions.

Do I need consent to send marketing email in the UK?
Under the UK Privacy and Electronic Communications Regulations (PECR), the answer depends partly on whether the recipient is an individual or corporate subscriber and whether a valid exception applies. The Information Commissioner’s Office (ICO) says consent is generally required for marketing email to individual subscribers unless an applicable soft opt-in applies. PECR treats corporate subscribers differently. Do not assume that a public email address, a purchased list, or a general statement in a privacy policy automatically provides permission.
The ICO updated its electronic-mail guidance on 28 April 2026 to explain a charitable soft opt-in introduced by the Data (Use and Access) Act 2025. Whether that or another soft opt-in applies depends on the circumstances, including the subscriber class and how the address was collected. Consult the ICO’s current electronic-mail guidance and assess any additional data-protection obligations for your campaign.
What does CAN-SPAM require for US marketing email?
The US CAN-SPAM Act applies to commercial email, not only bulk campaigns, and has no general business-to-business exception. The Federal Trade Commission’s compliance guide calls for accurate sender and header information, non-deceptive subject lines, ad identification where required, a valid postal address, and a working opt-out. The opt-out mechanism must remain available for at least 30 days after sending, and opt-out requests must be honored within 10 business days.

Responsibility does not disappear when a business hires a company to send its messages: the FTC says the marketer remains responsible for compliance. Read the FTC’s CAN-SPAM compliance guide. These are US requirements; they do not settle permission rules for recipients elsewhere.

How to future-proof your email program
- Map your audience and permissions. Inventory recipients by market and subscriber type. For each record, retain the permission basis, collection context, date, and source, and keep suppression lists synchronized across the systems that send messages.
- Separate sender controls from audience controls. Document domain authentication and provider configuration alongside consent, transparency, and suppression processes. Authentication helps meet sender-policy expectations; it does not establish that a recipient agreed to marketing.
- Make unsubscribe dependable. Test the full path from the email’s unsubscribe control to suppression, including any applicable one-click unsubscribe mechanism for Gmail traffic. Confirm that removed recipients are not reintroduced by imports or connected systems.
- Build segments from meaningful signals. Prefer declared preferences and first-party actions, and make the promised message frequency clear. Do not treat an inferred open as proof of interest.
- Redesign reporting and triggers. Give clicks, conversions, replies, complaints, bounces, and unsubscribes clear definitions. Mark opens as qualified, and review dashboards and automations for decisions that depend on them.
- Assess vendors against your workflow. When choosing an email service provider, verify its authentication, consent and suppression workflows, unsubscribe handling, and reporting capabilities directly. Confirm product claims and commercial terms with the provider rather than assuming a platform’s features or legal compliance.
- Review tracking and notices for each market. Have qualified counsel assess privacy notices and tracking practices where you operate, particularly if pixels identify individuals or support cross-context profiling. The official guidance cited here does not establish one global rule for email pixels.
Keep privacy compliance and deliverability distinct
The controls overlap in day-to-day operations but solve different problems. Authentication and complaint or unsubscribe handling address sender policy and inbox placement. Permission records, transparency, and suppression address audience choices and legal obligations. An open pixel alone does not solve either problem, and a strong delivery setup does not prove that a campaign is lawful.
